Family Assistance Legislation Amendment (More Help for Families—One-off Payments) Act 2004

This Act introduces a group of defined legal concepts and numerical rules; understanding them is the key to operational compliance and legal effect.

• Entitled individual, entitled recipient and qualified person. The Family Assistance Act creates the term one‑off payment to families and ties entitlement to whether prescribed determinations were in force on 11 May 2004 (s 86). The Social Security Act creates separate qualifications for carers: one‑off payment to carers (carer payment related) and one‑off payment to carers (carer allowance related) (ss 247, 992N). The statute uses precise labels (entitled individual, recipient, qualified person) to reference the person to be paid.
• Eligible child and eligible care receiver. For families the eligible child concept is defined at s 87 and depends on which of s 86(2), (3) or (4) applies. For carers the eligible care receiver concept is defined in s 992O and links to qualifying instalments of carer allowance; special aggregation applies where subsection 953(2) had applied (treating two disabled children as a single eligible care receiver).
• Applicable section 16 rate / applicable section 17 rate. Family entitlements reference particular daily rates of family tax benefit determined under the Family Assistance Administration Act (s 86(2) and (4)). Those rates are the baseline used to identify eligible children and, to the extent prior percentage allocations reduced those rates, to reduce the one‑off payment proportionately (s 88(3)-(5)).
• Quantum rules. Core amounts are statutory: $600 per eligible child for family payments (s 88(2)); $1000 for a qualified person paid carer payment related (s 248); $600 per eligible care receiver for qualified persons paid carer allowance related (s 992P(2)), subject to proportional reductions where prior determinations allocated shares or percentages (s 88(3)-(5); s 992P(3)). Family payments are worked out by adding together the amounts for each eligible child (s 88(1)); carer allowance related payments are added per eligible care receiver (s 992P(1)).
• Percentage and share reductions. The family payment provisions expressly tie reductions to earlier percentage determinations under subsection 59(1), section 28 and section 29 that were taken into account when the applicable section 16 or 17 rate was worked out (s 88(3)-(5)). The carer allowance related payment uses a share determined under subsection 981(1) to reduce the $600 per care receiver (s 992P(3)).
• Administrative, non‑claim, and payment procedure rules. The Act expressly states a claim is not required for these payments (note to 65F and s 12AA). The Secretary must pay entitled individuals / qualified persons in a single lump sum on the earliest practicable date and in whatever manner the Secretary considers appropriate (65F; 47B).
• Tax and means‑test interactions. The Act amends the Income Tax Assessment Acts to exempt the prescribed payments from income tax (e.g. s 52‑150 additions and s 52‑10 additions) and amends the Social Security Act s 8(8) to treat such payments as specified exceptions in that context (inserted paras (jaa) and (jab)). It also adjusts definitions of separate net income (ITA 1936 s 159J(6)) to exclude these payments or payments under the administrative scheme.
• Debt and recovery rules. The Act creates specific debt rules in relation to the one‑off family payments (71I) and the one‑off carer payments (1223ABA). Those provisions make the payment, or part of it, a debt if, after payment, a relevant determination is changed, revoked, set aside or superseded and the change was made for the reason that the recipient or an associated other person knowingly made a false or misleading statement or provided false information, and had the change occurred by 11 May 2004 (or over the 2002-03 income year for certain s 86(4) cases) the payment would not have been made or would have been reduced (71I(3)-(4); 1223ABA(4)-(5)). For carer payments the Act also directs that, apart from section 1224AA, other general debt provisions in the Part do not apply to these payments (1223ABA(6)).
• Ministerial delegated scheme. If the statutory Parts do not produce appropriate results for circumstances occurring in the 2003-04 financial year, the Minister may, by legislative instrument, create or vary a scheme to make payments and deal with administrative matters, but the scheme cannot provide payments after 30 June 2007 and the payments must be made from the Consolidated Revenue Fund (Schedule 3(1)-(6)).

These concepts are tightly linked to particular dates (primarily 11 May 2004 and the 2002-03 income year) and specific earlier determinations. The Act therefore operates largely as a corrective distribution anchored to the administrative state on a historical date, with defined numerical reductions where prior percentage/share apportionments existed.

The Act affects several discrete groups differently: family claimants who had particular family tax benefit Part A rates on 11 May 2004, recipients of youth allowance who received instalments for dependent under‑18s on that date and certain carers who received carer payment or carer allowance instalments that included that date.

• Families and children. An individual is entitled to the family one‑off payment if one of three alternative conditions applies (s 86(1)-(4)). Those include: (a) claimants for whom a determination under subsection 16(2) of the Family Assistance Administration Act was in force on 11 May 2004 and whose applicable section 16 daily family tax benefit rate included a Part A rate greater than nil (s 86(2)); (b) recipients who were paid one or more youth allowance instalments in respect of a period that included 11 May 2004 where the instalment was in respect of another individual under 18 who was not independent and the instalment was paid to the recipient on behalf of that other individual in accordance with the Social Security (Administration) Act 1999 (s 86(3)); and (c) individuals for whom a determination under section 17 of the Family Assistance Administration Act was in force on 11 May 2004 and that determination determined a daily family tax benefit rate for all or part of the 2002-03 income year that included a Part A rate greater than nil (s 86(4)). Eligible children for whom payments are made are those FTB children taken into account in the relevant determinations or the youth allowance recipients described (s 87).
• Carers. Two classes are affected. First, persons who were paid an instalment of carer payment that included 11 May 2004 qualify for the carer payment related one‑off payment (s 247). Second, persons who were paid an instalment of carer allowance in respect of a period including 11 May 2004, where the reason the instalment covered that date was not only because of clause 16 or 17 of Schedule 2 to the Social Security (Administration) Act 1999, qualify for carer allowance related payments (s 992N). The carer payment related payment is $1000 per qualified person regardless of the number of care recipients (s 248). The carer allowance related payment is worked out per eligible care receiver (s 992P).
• Persons receiving youth allowance as payment nominees. The family provisions explicitly reach youth allowance instalments paid to another person on behalf of an under‑18 who was not independent where the instalment covered 11 May 2004 and was paid under the Social Security (Administration) Act s 45(1) or as a payment nominee under Part 3A (s 86(3)). Those payment nominees can therefore be entitled individuals for the family payment.
• Government agencies and administrators. The Secretary of the relevant administering agency must pay the entitlements in a single lump sum on the earliest reasonably practicable date and in such manner as the Secretary considers appropriate (65F; 47B). The Minister can establish an administrative scheme by legislative instrument when statutory Parts do not produce appropriate results for qualifying circumstances in the 2003-04 financial year (Schedule 3(1)-(4)).
• Tax authorities and recipients. The Act amends tax law to exclude these payments from various taxable income definitions and specifically exempts payments under the statutory Parts and under any administrative scheme determined under Schedule 3 from income tax (ITA amendments; see s 52‑150 insertion and s 52‑10 insertion). It also amends Social Security Act definitions to exclude these payments from other assessments (insertion of paras (jaa) and (jab) after s 8(8)(j)).
• Persons who subsequently have prior determinations changed. Where, after payment, a relevant determination is changed, revoked, set aside or superseded and the change was made because the recipient (or an associated person) knowingly made a false or misleading statement, the payment or part of it becomes a debt due to the Commonwealth (71I(3)-(4); 1223ABA(4)-(5)). For carer payments the Act limits the other debt provisions’ application so that, apart from section 1224AA, the usual debt provisions do not apply (1223ABA(6)).

The Act explicitly contemplates overlapping qualifications. For example, s 87 uses language such as “whether or not subsection 86(3) also applies” when identifying eligible children under s 86(2), which indicates a person may be within multiple entitlement categories simultaneously. The carer provisions carry a note that a person may be qualified for both carer payment related and carer allowance related payments, again signalling possible multiple payments to the same person when the statutory conditions are met (s 247 note; s 992N note). The Secretary’s discretion over timing and manner of payment (65F, 47B) means administrative processes will determine the operational order and mechanism for paying these overlapping entitlements.

The Act sets concrete duties for officials and defines rights to payment and rights to tax and means‑test treatment. It also creates limited rights for the Commonwealth to recover payments in specified circumstances.

Duties on administrators and the Minister

• The Secretary must pay any individual who is entitled to a one‑off payment to families in a single lump sum on the earliest date the Secretary considers reasonably practicable and in such manner as the Secretary considers appropriate (65F). The equivalent duty for carer payments is in section 47B of the Social Security (Administration) Act: the Secretary must pay entitled individuals entitled to carer allowance related or carer payment related payments in a single lump sum on the earliest practicable date and in such manner as the Secretary considers appropriate (47B).
• The Minister is empowered to determine, by legislative instrument, an administrative scheme to make payments where Parts 5 of the Family Assistance Act and Parts 2.5A and 2.19A of the Social Security Act do not produce appropriate results for circumstances occurring in the 2003-04 financial year. The Minister may vary or revoke that scheme (Schedule 3(1)-(2)). The scheme cannot provide for payments after 30 June 2007 and payments under it are to be made out of the Consolidated Revenue Fund (Schedule 3(3), (6)).

Entitlement rights and calculations

• Individuals who meet the statutory conditions gain a right to a one‑off payment. Family entitlement depends on the state of determinations in force on 11 May 2004 (s 86). Eligible children are those FTB children taken into account in determining the relevant rates, or the youth allowance recipients described in s 86(3) (s 87).
• The amount of the family payment is $600 per eligible child unless reduction rules apply because the applicable section 16 or 17 rate took account of percentage determinations under subsection 59(1) (s 88(3)), section 28 (s 88(4)), or section 29 (s 88(5)). Where such percentage determinations applied, the payment is that percentage of $600 or that percentage of the reduced amount where multiple percentage mechanisms apply (s 88(3)-(5)).
• A person qualified for the carer payment related entitlement receives $1000 regardless of the number of people cared for (s 248). A person qualified for the carer allowance related entitlement receives $600 per eligible care receiver, reduced proportionally if the qualifying instalment was paid at a rate that took account of a share determination under subsection 981(1) (s 992P(2)-(3)). Payments are worked out by adding amounts for each eligible child or eligible care receiver (s 88(1); s 992P(1)).

Rights affecting tax and means testing

• The Act amends the Income Tax Assessment Acts to exempt payments under the statutory Parts and also payments under any administrative scheme made under Schedule 3 from income tax (e.g. s 52‑150 insertion; s 52‑10 insertion; ITA 1936 s 159J(6) adjustments). Those amendments in the text state explicitly that payments under the scheme determined under Schedule 3 are exempt from income tax (see the added subsection at the end of s 52‑150 and subsection 52‑10(1D)-(1E)). The Social Security Act is amended to add the payments to a list of specified exceptions (inserted paras (jaa) and (jab) after s 8(8)(j)), which affects treatment within that statute’s means and income tests.
• The Act makes clear a claim is not required for the payments (note after 65F; s 12AA). That is an administrative right: eligible individuals will be paid without filing a claim, subject to the Secretary’s practical implementation.

Debt and recovery rights of the Commonwealth

• The Act gives the Commonwealth a right to recover the whole payment or a part of it as a debt where, after payment, a relevant determination is changed, revoked, set aside or superseded and that decision was made because the recipient or an associated other person knowingly made a false or misleading statement or provided false information (71I(3)-(4); 1223ABA(4)-(5)). The relevant determinations are the determinations that formed the basis for payment (71I(2); 1223ABA(2)-(3)).
• For carers, the statute narrows the general debt provisions so that, apart from section 1224AA, the other provisions under which debts arise in that Part do not apply to payments of one‑off payments to carers (1223ABA(6)). This creates an explicit recovery regime for these particular payments.

Discretion and administrative choice

• The Secretary’s powers under 65F and 47B are framed as subjective administrative choices: pay on the earliest date the Secretary considers reasonably practicable and in such manner as the Secretary considers appropriate. Those provisions confer practical discretion over scheduling and method of payment.
• The Minister’s power to create a Schedule 3 administrative scheme is also discretionary; the Minister may, by legislative instrument, determine a scheme where the statutory Parts do not produce appropriate results (Schedule 3(1)-(2)). The scheme can be varied or revoked by legislative instrument.

Collectively, the Act shifts duties to the administration to identify entitled persons from historic determinations, to pay them in lump sum form, and to manage a narrow recovery regime. It creates rights to non‑taxable, lump sum payments with quantification rules determined by the interaction of current statutory amounts and historical percentage/share determinations.

This Act does not add new criminal penalties. Its enforcement architecture is administrative, consisting principally of (1) payment obligations on officials, (2) defined debt recovery triggers, and (3) limited exclusions and tax exemptions that affect downstream administrative processing.

Debt recovery triggers and mechanics

• Family payments. Section 71I creates an administrative enforcement mechanism: if, after a family one‑off payment is made, a relevant determination is changed, revoked, set aside or superseded and the change was made because the recipient (or, where relevant, another individual involved in the underlying determination) knowingly made a false or misleading statement or knowingly provided false information, and had the change occurred on or before 11 May 2004 (or, for s 86(4) cases, had the change occurred on or before the relevant part of the 2002-03 income year), the amount of the relevant payment (or the amount by which it would have been reduced) is a debt due to the Commonwealth (71I(3)-(4)). Subsection 71I(2) identifies which determinations are “relevant determinations” for these purposes.
• Carer payments. Section 1223ABA sets out an analogous debt recovery regime for one‑off payments to carers. If a relevant determination that led to the qualifying instalment is changed, revoked, set aside or superseded and the change was made because the recipient knowingly made a false or misleading statement or provided false information, and had the change occurred on or before 11 May 2004 the payment would not have been made (or would have been reduced), the amount is a debt due to the Commonwealth (1223ABA(4)-(5)). Section 1223ABA(6) also provides that, apart from section 1224AA, the other provisions of that Part under which debts generally arise do not apply to these carer payments. This narrows the universe of enforcement pathways for carer one‑off payments to the specifically enacted routes.
• The text does not impose civil penalties tied to provision of false or misleading information that are separate to the debt creation mechanism. The debt arises when the later determination changes for the reason that the person knowingly provided false information. The Act therefore couples recovery to a post‑payment administrative re‑assessment of the earlier determinations.

Administrative discretion and practical enforcement

• The Secretary is required to pay the lump sums “on the date that the Secretary considers to be the earliest date on which it is reasonably practicable for the payment to be made” and “in such manner as the Secretary considers appropriate” (65F; 47B). Those provisions give administrators discretion over timing, which will affect how and when enforcement mechanisms (for example, checks prior to payment) operate in practice. There is no further statutory guidance on whether the Secretary must undertake additional verification before paying.
• The Minister has power to make an administrative scheme by legislative instrument dealing with circumstances where the statutory Parts do not produce appropriate results (Schedule 3(1)-(4)). That scheme can itself set administrative conditions for payment and potentially provide enforcement mechanics or procedural rules for entitlement and recovery within the constraints set by Schedule 3 (not after 30 June 2007 and out of the Consolidated Revenue Fund).

Absence of new criminal or pecuniary penalties in the Act text

• The statutory text supplied does not create new criminal offences or administrative pecuniary penalties expressly linked to the one‑off payments beyond the debts regime. The punitive mechanism is recovery as a Commonwealth debt where a later administrative determination finds knowing misrepresentation caused the original decision to be incorrect.

Interaction with other enforcement regimes

• The Act amends several definitions and cross‑references in both the Family Assistance and Social Security Administration Acts, and in the Income Tax Acts. Those amendments integrate the new payments into existing administrative architectures (for example, by inserting one‑off payment to families into lists of benefits and by amending definitions of relevant benefits and debts). Those amendments will direct existing enforcement machinery to recognise these payments in relevant statutory contexts (see the various insertions and substitutions across the Schedules). For example, the additions to the Income Tax Assessment Acts make clear that payments under the Schedule 3 administrative scheme are exempt from income tax (s 52‑150(2); s 52‑10(1D)-(1E)), which affects how tax administration treats recovered sums and recipients’ tax positions.

Operational enforcement consequences

• The debt provisions create an evidentiary link between the Commonwealth’s later determination changing for the reason of knowing false information and the existence of the debt. That link will require agencies to document the factual basis for any later determination and the knowledge element if recovery is to be pursued. The Act does not provide a simplified penalty schedule or automatic garnishee; recovery will proceed under the Commonwealth’s standard debt recovery procedures as applied to the debts created by these provisions, except where the Act explicitly restricts other debt provisions (1223ABA(6)).

In short, enforcement under the Act is administrative, not criminal. The Commonwealth’s recovery right is conditional upon later administrative determinations that find knowing falsehood. The Secretary and the Minister have discretionary roles that affect how payment and, indirectly, enforcement are carried out.

The Act is crafted as an overlay on pre‑existing family assistance, social security and taxation frameworks. It both depends on and modifies other statutory machinery; implementers must follow the cross‑referenced provisions closely.

Dependence on prior determinations and on Social Security (Administration) Act machinery

• Family entitlements under s 86 hinge on the state of determinations made under subsection 16(2) of the Family Assistance Administration Act and determinations under section 17 of that Act in respect of the 2002-03 income year (s 86(2), (4)). The Act therefore depends on the Family Assistance Administration Act’s existing processes for producing daily family tax benefit rates, and on the existence and content of those historical determinations.
• Section 86(3) imports the Social Security (Administration) Act 1999’s payment nominee and payment mechanisms. It requires that the relevant youth allowance instalment was paid to the recipient on behalf of the other individual in accordance with subsection 45(1) of the Social Security (Administration) Act or as payment nominee under Part 3A. Implementers will need to cross‑check the application of those payment nomination provisions when identifying entitled recipients.
• For carer allowance related payments, the qualification excludes instalments that covered 11 May 2004 only because of clauses 16 or 17 of Schedule 2 to the Social Security (Administration) Act 1999 (s 992N(1)(b)). Thus, the Act interacts with the application of those Schedule 2 rules to determine whether an instalment is a qualifying instalment.

Tax treatment and definitions

• The Act amends the Income Tax Assessment Acts to exclude the specified payments from the relevant taxable categories and to exempt payments made under the new statutory Parts and under a Schedule 3 administrative scheme from income tax (e.g. s 52‑150 additions; s 52‑10 additions; s 159J(6) adjustments). That interaction means recipients do not include the specified payments in separate net income calculations or in taxable income where the Act specifies the exemption.
• The amendments to the Social Security Act 1991 (inserting paras (jaa) and (jab) after s 8(8)(j)) affect how those payments are treated within the social security income assessment and means testing processes. Those insertions list “a payment of family assistance, or of one‑off payment to families, under the Family Assistance Act” and “a payment under the scheme determined under Schedule 3” as specified items. The text therefore integrates the new payments into existing income and means assessment machinery under the Social Security Act.

Debt recovery and administrative parts

• The Act modifies provisions governing debts and recovery by adding references to the new debt provisions (e.g. after s 71H insertion of s 71I in the Family Assistance Administration Act, and insertion of 1223ABA into the Social Security Act) and by amending cross‑references (for example by adding “one‑off payment to families” into lists at ss 66 and 74 of the Family Assistance Administration Act and adding references to one‑off payments into definitions such as “relevant benefit” at s 219TA). These changes ensure that when administrators use the existing debt recovery apparatus they account for the special rules created by this Act.
• There is an express limitation in the carers’ debt provision that “apart from section 1224AA, the other provisions of this Part under which debts arise do not apply in relation to payments of one‑off payment to carers” (1223ABA(6)). That narrows interaction with general debt recovery provisions in the Social Security Act and creates a specific enforcement channel.

Delegated law and administrative scheme

• The Minister’s power in Schedule 3 to determine a scheme by legislative instrument brings the Administrative Decisions (Judicial Review) Act 1977 and other administrative law regimes into play in practice, since the Ministerial instrument will be subordinate legislation. The scheme can set terms about circumstances, amount, procedural steps and administrative matters, but is constrained to circumstances in the 2003-04 financial year and cannot enable payments after 30 June 2007 (Schedule 3(2)-(3)). Payments under such a scheme are to be made from the Consolidated Revenue Fund (Schedule 3(6)), bringing in appropriation and public finance law considerations.
• The administrative scheme is expressly permissive where Parts do not “produce appropriate results” (Schedule 3(2)(a)). That wording creates an interaction between statutory entitlements and delegated rule‑making to fix cases that fall outside the statutory parameters.

Practical consequences for administrators

• Identifying entitled persons requires pulling together archival determinations under the Family Assistance Administration Act and the Social Security (Administration) Act (s 86 references). Administrators must ensure the determinations used were in force on 11 May 2004 and correctly identify the Part A components of family tax benefit daily rates and any percentage determinations that were taken into account when those rates were worked out (s 88(3)-(5)).
• For tax and social security purposes, the Act’s text instructs how to classify these payments through targeted amendments to the Income Tax Assessment Acts and the Social Security Act. Practically, taxation and social security agencies need to update their systems and guidance to reflect these exemptions and exclusions.

Overall, the Act operates by grafting a small, historically‑anchored set of payments onto the existing family assistance, social security and tax frameworks and by creating a limited delegated power to capture edge cases via a Ministerial legislative instrument limited in time.

The text supplied is itself an amending instrument and records the amendments it makes to multiple Acts. The Act’s Schedule structure sets out the changes. The main amendments and their locations are as follows.

Schedule 1 , One‑off payments to families (main amendments)

• A New Tax System (Family Assistance) Act 1999: Inserts the definition one‑off payment to families into subsection 3(1) and adds a new Part 5 containing sections 86-88 establishing entitlement, eligible children and amount for the one‑off payment to families (items 1-2 of Schedule 1, Part 1).
• A New Tax System (Family Assistance) (Administration) Act 1999: Inserts Division 4A (One‑off payment to families) into Part 3 and adds section 65F requiring payment by the Secretary, amends various cross‑references to include the new payment (items 3-13), and inserts a new debt provision 71I (Debts arising in respect of one‑off payment to families).
• Income Tax Assessment Act 1936: Amends subsection 159J(6) to add one‑off payment to families into the list of excluded items for separate net income and to add an explicit exclusion for payments under the Schedule 3 administrative scheme (item 14 and 15).
• Income Tax Assessment Act 1997: Amends section 11‑15 and section 52‑150 to add one‑off payment to families as an exempt item and to specify that payments to families under the administrative scheme determined under Schedule 3 are exempt from income tax (items 16-18).
• Social Security Act 1991: Inserts new exceptions into paragraph 8(8) for family assistance or one‑off payment to families and for payments under the Schedule 3 scheme (item 19).

Schedule 2 , One‑off payments to carers (main amendments)

• Social Security Act 1991: Inserts Part 2.5A (one‑off payment to people eligible for carer payment) comprising ss 247-248 and Part 2.19A (one‑off payment to people eligible for carer allowance) comprising ss 992N-992P; inserts debt provision 1223ABA and amends the Social Security (Administration) Act to add a non‑claim rule (12AA) and s 47B requiring payment by the Secretary (Schedule 2, Part 1).
• Social Security (Administration) Act 1999: Inserts s 12AA (no claim required) and s 47B (payment by Secretary) and amends definitions (items 4-6).
• Income Tax Assessment Act 1936: Amends subsection 159J(6) to include the carer one‑off payments in separate net income exclusions and specifies payment under Schedule 3 are excluded (items 7-8).
• Income Tax Assessment Act 1997: Inserts one‑off payment to carers items in section 11‑15 and amends s 52‑10 to make carer one‑off payments exempt from income tax, and notes that payments under the Schedule 3 scheme are also exempt (items 9-11).

Schedule 3 , Administrative scheme for one‑off payments to families and carers

• Inserts an item permitting the Minister, by legislative instrument, to determine a scheme to make one‑off payments to families and carers in circumstances where Parts 5 (Family Assistance Act) and Parts 2.5A and 2.19A (Social Security Act) do not produce appropriate results, limited to circumstances occurring in the 2003-04 financial year and prohibiting payments after 30 June 2007; allows the scheme to deal with amounts, eligibility, administrative processes and requires payments under the scheme to be appropriated from the Consolidated Revenue Fund (Schedule 3(1)-(6)). The Schedule also re‑states the Secretary payment provision (65F) and the family debt provision (71I) as inserted into the Family Assistance Administration Act.

Form of amendments and cross‑references

• Across the Schedules the Act amends cross‑references and definitions to fold the one‑off payments into existing statutory vocabularies, for example by inserting references to one‑off payment to families into lists at subsections 66(1), 70, 74(a), and by adding the payments to definitions of relevant benefit (219TA) and family assistance payment (93A(6)) where required.

Timing and commencement

• The Act’s commencement is stated as the date of Royal Assent (s 2). Short title is Family Assistance Legislation Amendment (More Help for Families,One‑off Payments) Act 2004 (s 1).

Taken together, the amendment history in the text is self‑contained: it inserts new Parts and provisions into three principal Acts (Family Assistance Act, Social Security Act and Social Security (Administration) Act), and makes consequential amendments to the Income Tax Assessment Acts and various administrative cross‑references. It also creates a delegated power in Schedule 3 to fill gaps and a time‑limited window for any instrument made under that power.

The supplied legislative text contains no judicial decisions, references to litigation, or schedules of disputes. It records the statutory amendments and the administrative scheme power but does not record any cases, appeals or judicial interpretations affecting the provisions. Therefore, the Act’s litigation history within this source is nil.

That absence does not mean the provisions are immune from judicial review or dispute. The Act creates elements that are commonly subject to administrative law challenge or dispute in practice:

• Discretionary payment timing and manner (65F; 47B). The Secretary’s subjective discretion as to “the earliest date on which it is reasonably practicable for the payment to be made” and “in such manner as the Secretary considers appropriate” could be subject to administrative law review if an aggrieved person alleges an unlawful exercise of power or denial of procedural fairness in specific decisions about timing or method of payment.
• Ministerial delegated legislative instruments (Schedule 3). A scheme made under Schedule 3 would be subordinate legislation and thus potentially reviewable on standard public law grounds if a litigant considered the instrument exceeded power or did not comply with statutory constraints (for example, by purporting to provide payments after 30 June 2007 or dealing with circumstances outside the 2003-04 year).
• Debt creation based on later determinations. Sections 71I and 1223ABA make the payment or part of it a debt where a later determination shows the recipient or an associated person knowingly provided false or misleading information. That factual and mental element (knowledge of falsity) will typically be contested and could lead to merits review of the underlying administrative determination and judicial review of the legality of the agency’s decision‑making process.
• Classification and tax exemption disputes. The Act amends the income tax statutes to exempt these payments, but disputes could arise over whether particular payments are captured by the statutory characterisation or by the administrative scheme under Schedule 3. That could involve tax administration procedures and potential review.

Because no cases are cited in the legislative text, readers seeking precedent or authoritative judicial interpretation must look at subsequent case law and administrative decisions outside this instrument. The Act as supplied sets legal standards and administrative routes that litigants could later challenge, but the text does not itself record the outcome of any such proceedings.

The Act contains several technical features and interaction points that create traps for practitioners and administrators. The following are concrete operational and legal “gotchas” derived from the text, with references to the relevant provisions.

Historic-determination anchoring (s 86)

• The family entitlement is anchored to the existence and content of determinations that were in force on 11 May 2004 (s 86(2)-(4)). Practitioners must locate and correctly interpret those historical determinations (subsection 16(2) and section 17 Family Assistance Administration Act determinations, and Part A components of family tax benefit daily rates). If an administrator uses the wrong version or misidentifies the applicable determination, entitlement calculations and later recovery actions may be legally vulnerable.

Overlap of entitlements and additive calculation (s 87; s 88(1))

• The Act explicitly contemplates overlap. Section 87 notes that where s 86(2) applies “whether or not subsection 86(3) also applies” each FTB child taken into account is an eligible child. The family payment is calculated by adding amounts for each eligible child (s 88(1)). The carer provisions also note a person may be qualified for both carer payment related and carer allowance related payments (s 247 note; s 992N note). There is no express statutory prohibition on receiving multiple payments where conditions are met. That can produce larger aggregate payments than some administrators might assume; do not offset without statutory authority.

Percentage and share reductions (s 88(3)-(5); s 992P(3))

• The default $600 per eligible child (s 88(2)) is subject to reduction where the applicable section 16 or 17 rate was worked out taking account of a subsection 59(1) percentage, a section 28 percentage, or a section 29 percentage (s 88(3)-(5)). The Act specifies the order and interaction: section 88(4)(b) makes the section 28 percentage apply to the amount worked out under subsection 88(3) where both apply. For carers, s 992P(3) reduces the $600 per care receiver by a share determined under subsection 981(1). Practitioners must trace through these prior percentage and share determinations to apply the reductions correctly.

Carer payment related flat $1000 regardless of number of care recipients (s 248)

• By contrast to carer allowance related payments, the carer payment related payment is a flat $1000 regardless of the number of people the qualified person cares for (s 248). Failure to distinguish the two carer regimes will produce mispayments.

No claim required, but administrative identification still needed (note to 65F; s 12AA)

• The Act states a claim is not required for the family one‑off payment (note to 65F) and explicitly provides a no‑claim rule for carer payments (s 12AA). That does not remove the administrative requirement to identify entitled individuals using the historic determinations and instalments. Officials must still have processes to identify and notify recipients and to retain documentary records demonstrating the basis for payment to defend against future recovery action.

Debt recovery requires knowledge of falsity and timing test (71I(3)-(4); 1223ABA(4)-(5))

• The Commonwealth’s right to recover the whole or part of a payment as a debt is conditional on a later relevant determination changing for the reason that the recipient (or an associated other person) knowingly made a false or misleading statement, and that had the change occurred by the specified historical date the payment would not have been made or would have been reduced (71I(3)-(4); 1223ABA(4)-(5)). That imposes a high evidentiary threshold for recovery: agencies must establish the knowledge element and satisfy the temporal test. Also, for carers the Act restricts other debt provisions from applying (1223ABA(6)). Administrators cannot rely on ordinary debt provisions without checking the specific rules.

Ministerial scheme time window and scope (Schedule 3)

• The Minister’s delegated scheme may only address circumstances occurring in the financial year starting 1 July 2003 (Schedule 3(2)(b)) and must not provide for payments after 30 June 2007 (Schedule 3(3)). Any instrument purporting to operate beyond those temporal limits would exceed power. The scheme is also limited to cases where the statutory Parts “do not produce appropriate results” (Schedule 3(2)(a)), a potentially contestable threshold.

Classification and tax exemption caveats (ITA amendments)

• While the Act inserts explicit tax exemptions for payments made under the statutory Parts and under the Schedule 3 scheme (s 52‑150(2); s 52‑10(1D)-(1E)), practitioners must ensure the payment is in fact made under the specified statutory provision or under a valid Schedule 3 instrument to benefit from the tax exemption. The income tax amendments also adjust separate net income definitions (ITA 1936 s 159J(6)), so tax advisors must match the payment classification in tax filings to the statutory basis of the payment.

Youth allowance instalment complexity (s 86(3))

• Section 86(3) applies to recipients who have been paid youth allowance instalments in respect of periods including 11 May 2004 where the instalment was in respect of another individual who on 11 May 2004 was under 18 and not independent, and where the instalment was paid to the recipient under s 45(1) SSAA or as a payment nominee under Part 3A SSAA. This requires careful cross‑checking of youth allowance payment records and the legal basis for the instalment payment (payment nominee, s 45(1), Part 3A) before concluding entitlement.

Aggregation rule for two disabled children (s 992O(2))

• For carer allowance related payments, if subsection 953(2) had applied in relation to a qualifying instalment, the two disabled children to whom the instalment relates are to be treated as a single eligible care receiver (s 992O(2)). This aggregation reduces the amount payable relative to treating each child separately. Administrators must check whether s 953(2) applied to any qualifying instalments.

Document retention and evidence needs for recovery

• Because recovery depends on showing that later determinations were changed for reasons of knowing false information, agencies should retain the determinations, the evidence considered at the time, and files relating to any subsequent decision that changes those determinations. The statutory debt creation is factual and temporally sensitive; poor record keeping will undermine legitimate recovery attempts.

In summary, the principal gotchas are the historical anchoring to 11 May 2004 and the 2002-03 income year, the presence of percentage/share reductions, the possibility of multiple overlapping entitlements, the limited debt recovery channels that require proof of knowing falsehood, and the delegated scheme’s tight temporal limits. Each of these issues demands careful documentary tracing and precise application of the statutory cross‑references.

Practical compliance for administrators, practitioners and advisers requires mapped processes that translate the statutory triggers, calculation rules and recovery conditions into operational steps. The following is a checklist and recommended control points grounded in the Act’s provisions.

1. Identify the universe of potentially entitled persons

• Families: Locate determinations under subsection 16(2) of the Family Assistance Administration Act that were in force on 11 May 2004 in respect of claimants, and determinations under section 17 that determined daily rates for all or part of the 2002-03 income year (s 86(2), (4)). Extract the applicable section 16 or section 17 rate and confirm whether the Part A rate component was greater than nil. Record the FTB children taken into account for those determinations (s 87).
• Youth allowance-related nominees: Identify recipients who were paid youth allowance instalments for periods that included 11 May 2004 in respect of another individual under 18 who was not independent, where the instalment was paid under s 45(1) SSAA or as a payment nominee under Part 3A (s 86(3)). Map those youth allowance instalments to the relevant under‑18 individuals.
• Carers: Identify persons who were paid carer payment instalments that included 11 May 2004 (s 247) and carer allowance instalments satisfying the qualifying instalment test (s 992N(1)). For carer allowance instalments, check that the instalment covering 11 May 2004 was not solely because of clauses 16 or 17 of Schedule 2 SSAA (s 992N(1)(b)).

2. Compute amounts precisely

• Families: For each eligible child apply the default $600 (s 88(2)). If the applicable section 16 or 17 rate took account of a subsection 59(1) percentage, reduce the $600 by that percentage (s 88(3)). If a section 28 percentage applied to the FTB children, apply that percentage to $600 unless subsection (3) also applied, in which case apply the section 28 percentage to the amount computed under subsection (3) (s 88(4)). If a section 29 percentage applied in relation to section 17 rate, apply the analogous rule (s 88(5)). Add together the amounts for each eligible child (s 88(1)).
• Carers: For carer payment related payments, remit $1000 per qualified person (s 248). For carer allowance related payments, remit $600 per eligible care receiver unless the qualifying instalment took account of a share under subsection 981(1), in which case remit that share of $600 per care receiver (s 992P(2)-(3)). Where subsection 953(2) applied, treat two disabled children as a single eligible care receiver (s 992O(2)).

3. Payment mechanics and timing

• The Secretary must make each payment in a single lump sum “on the date that the Secretary considers to be the earliest date on which it is reasonably practicable for the payment to be made” and “in such manner as the Secretary considers appropriate” (65F; 47B). Establish internal protocols to determine what constitutes “reasonably practicable” (for example, data verification steps, banking details confirmation, identity checks), but document the decision rationale to defend against any judicial review or complaint about delay or method.
• Because the Act provides that a claim is not required (note to 65F; s 12AA), set up a system to proactively identify and pay entitled persons, and to notify them of payment and the basis for it. Maintain communication procedures for recipients to query payments.

4. Record keeping and evidence

• Retain the historic determinations, records of the calculations that produced the family tax benefit daily rates, and all evidence used to determine applicable percentages or shares (subsections 59(1), s 28, s 29, subsection 981(1)). Retain youth allowance and carer instalment payment records showing coverage of 11 May 2004 and the legal bases for payment (payment nominee records, s 45(1), Part 3A, Schedule 2 clauses).
• Preserve a contemporaneous audit trail for every payment showing how the entitlement was established and the calculations performed. This is essential because debt recovery requires demonstrating that a later relevant determination was changed for the reason that the recipient knowingly provided false information (71I(3)-(4); 1223ABA(4)-(5)).

5. Debt recovery procedures

• If a later relevant determination is changed, revoked, set aside or superseded and the change is made for the reason that the recipient knowingly made a false or misleading statement, follow the specific debt provisions: determine whether the whole amount or the amount by which the payment would have been reduced is a debt (71I(3)-(4); 1223ABA(4)-(5)). Ensure legal and evidentiary processes are followed to establish the knowledge element before issuing a debt notice.
• For carer payments, note the statutory limitation that apart from s 1224AA other general debt provisions do not apply (1223ABA(6)); confirm which recovery pathways are available and ensure actions stay within the statutory framework.

6. Tax and social security interaction

• Ensure recipients are advised that the payments are exempt from income tax where made under the statutory Parts or the Schedule 3 administrative scheme (ITA 1997 s 52‑150 and s 52‑10 insertions; ITA 1936 s 159J(6) amendments; see Schedule 1 and Schedule 2 amendments). Update payroll and tax reporting systems to reflect the statutory exemptions.
• Update social security assessment processes to treat these payments as specified exceptions under the Social Security Act (inserted paras (jaa) and (jab) after s 8(8)(j)). Coordinate with tax and social security compliance teams to ensure consistent treatment.

7. Administrative scheme contingency

• If a given case falls outside the statutory Parts but relates to circumstances in the 2003-04 financial year, consider whether a Schedule 3 administrative instrument could be used. Any scheme made must be by legislative instrument, be confined to FY 2003-04 circumstances, and must not allow payments after 30 June 2007 (Schedule 3(1)-(4)). Payment authority must be from the Consolidated Revenue Fund (Schedule 3(6)). Drafting of any instrument should record the justification that the statutory Parts do not produce appropriate results for the specific circumstances.

8. Communications and dispute handling

• Provide recipients with clear statements of the basis for payment, the calculation used, and the circumstances under which recovery will be sought. Because recovery requires a finding of knowing falsehood, set out how recipients can respond if a later administrative decision proposes to change a relevant determination.
• Maintain a clear appeal and internal review pathway for disputes about entitlement, calculation, or later determinations that may trigger recovery.

9. Systems testing and training

• Update IT systems to identify eligible records by cross‑referencing determinations and instalment dates (11 May 2004) and to apply percentage/ share reductions where applicable. Train staff on the precise statutory definitions, the historical anchoring of entitlements, the evidence required for recovery, and the boundaries of the Minister’s delegated scheme.

By following these steps and documenting every stage with reference to the statutory provision relied upon (for example s 86, s 87, s 88, s 247, s 248, s 992N-992P, 65F, 47B, 71I, 1223ABA, Schedule 3), administrators and advisers will align operational practice with the Act’s requirements while preserving the necessary evidence trail should recovery or review proceedings arise.
