What this does

This Determination "approves" two Victorian Government support schemes run by the Transport Accident Commission (TAC):

Attendant Care Service – pays allowances for long-term and temporary personal care to people injured in transport accidents
Post Acute Support – provides similar post-hospital care support

Who it affects

Victorians who receive these TAC care payments and also claim or receive Commonwealth social security benefits (such as the Age Pension, Disability Support Pension, or JobSeeker Payment).

Why it matters

Once a state scheme is approved under section 35A of the Social Security Act 1991, the payments people receive from it are generally exempt from Centrelink’s income and assets tests. This means injured people can get their Victorian care allowances without having their Commonwealth pension or benefit reduced or cancelled.

In short: it stops people from being financially penalised for receiving injury-related care support from the Victorian TAC.

3. Personal care support schemes

The schemes for the provision of personal care support known as Attendant Care Service and Post Acute Support (being the schemes of that name established by the Victorian Transport Commission under the Transport Accident Act 1986 (Vic) under which an allowance for long term and temporary care is paid to certain injured persons) are approved schemes for the purposes of the Social Security Act 1991.
