#### 102 Application for inquiry into ballot irregularity (s 108(1)) (1) An application to the FWC under subsection 108(1) of the Act for an inquiry must be: (a) in the form set out in the Procedural Rules; and (b) made by: (i) a member of the constituent part of the organisation whose members were eligible to vote in the ballot; or (ii) a person acting on behalf of a member mentioned in subparagraph (i); or (iii) the Electoral Commissioner; and (c) lodged with the FWC together with any document that the Procedural Rules require to be lodged with the application. (2) For this Division, an inquiry is taken to have been instituted when an application mentioned in subregulation (1) is lodged.
