Fair Work (General) Regulations 2024

Several core legal and administrative concepts are central to these regulations.

Declared employer for public employees (regulation 4)

• The regulations use a declaratory device to identify the person occupying a particular public service office as the employer for purposes of the Act. Regulation 4 states that "the person for the time being holding or acting in the position of Chief Executive of the Attorney‑General's Department is declared to be the employer of public employees" for the purposes of paragraph (a) of the definition of employer in section 4(1) of the Act. That operates as a fixed point of legal identification of employer status where the Act uses that definition.

Exclusion from the Act for domestic work (regulation 5)

• Regulation 5 implements the Act's power to exclude classes of employment. It excludes part‑time or casual employment performed in a private residence where the work is "wholly or mainly performed for a domestic purpose" and defines domestic purpose as work not performed for the purpose of the employer's trade or business. The test is functional: if the work serves a domestic purpose rather than the employer's trade or business, the worker is outside the Act.

Notice and procedural rules for enterprise bargaining (regulations 6, 7, Schedule 1)

• Associations that propose to enter an enterprise agreement on behalf of a group of employees must give written notice to each employee in the group and, if practicable, display a written notice at the workplace (regulation 6(2)). The regulation prescribes content requirements (regulation 6(3)), including plain language, the association's full name, contact details of an officer, identification of the employee group, statements explaining authorisation consequences for members, means for non‑members to authorise the association, and a required signature.
• Employers must also give notice before negotiations start (regulation 7(1)). Employer notice must propose a date and place for commencement, identify the employee group, may outline proposed negotiation procedures and matters, must be signed and may follow the Schedule 1 form. Employers must ensure notice is available in languages appropriate to significant numbers of the employees and must supply translations on reasonable request (regulation 7(2), (4) and 6(4)-(5)).
• Schedule 1 supplies a template employer notice that includes a required statement that the proposed commencement date cannot be less than 14 days from the date notice is given, and a reminder that employees have a right to representation in negotiations.

Signing and representation rules for enterprise agreements (regulation 8)

• Regulation 8 translates the Act's signing rules into concrete options: employers must have the agreement signed by the employer or an authorised person; employees can sign by individual approving members of the group, by an authorised officer of an authorised association, or by a person authorised by the employees. When an agreement contains an exclusivity provision under section 77(1)(d) of the Act, it must also be signed by the authorised officer of the association given the exclusive right to represent employees.

Unfair dismissal exclusions (regulation 9)

• Regulation 9 lists classes excluded from Chapter 3 Part 6 (unfair dismissal): employees serving a period of probation or qualifying period provided the period's duration is determined in advance and is reasonable; casual employees except where they have been engaged regularly and systematically for at least 6 months and have or would have had a reasonable expectation of continuing employment; and employees whose employment is governed by an award, agreement or contract that makes specific unfair dismissal arrangements that as a whole provide protection at least equivalent to Chapter 3 Part 6.

Awards relating to disabled workers (regulation 10 and Schedule 2)

• Regulation 10 declares a list of bodies and organisations to be recognised organisations for the purposes of section 113 of the Act (Schedule 2 gives names and principal locations). It also prescribes that an award under section 90 may not regulate the wages or salary of a person to whom section 113 applies, and clarifies that "wages or salary" for that purpose excludes rates or shift premiums, overtime and allowances.

Continuous service (regulation 11)

• Regulation 11 identifies events or matters to be disregarded when ascertaining continuous service, pursuant to Schedule 8 section 1(3) of the Act. The list includes employer actions intended to avoid obligations, authorised leave, illness or accident (subject to notification/substantiation conditions), absences for reasonable cause (subject to notification rules), absences due to collective industrial action (but not where SAET determines the absence breaks continuity), and other absences unless the employer gives written notice within specified timeframes that the absence breaks continuity. The regulation prescribes the method and timing for employer notice and confirms that such a notice may be withdrawn.

Continuity of industrial arrangements and national instruments (regulation 12)

• Regulation 12 adapts federal industrial instruments that continue in operation under the Act by converting references to Commonwealth acts and federal institutions into references to the South Australian Act and SAET. It also excludes a specific award (Municipal Officers (SA) Award 1998) from the operation of a specified clause of the transitional schedule.

These concepts are operational rules that allocate duties and define exclusions. They are expressed as subordinate instruments made "pursuant to" the named Act provisions, so their legal effect flows from those parent Act powers.

The regulations affect distinct categories of persons and organisations, and they allocate responsibilities between employers, employee associations, employees and certain public office‑holders.

Employers

• All employers within the scope of the Fair Work Act 1994 are affected where the regulations elaborate an Act obligation. In practical terms employers must: provide the notices required before bargaining (regulation 7); ensure those notices meet the content and language requirements (regulation 7(2)-(4) and Schedule 1); sign enterprise agreements themselves or ensure a duly authorised signatory does so (regulation 8(1)(a)); provide employees with reasonable access to applicable awards as required by Schedule 1 note; and manage continuity of service notifications in accordance with regulation 11(5)-(6).
• For public sector arrangements, the person holding or acting as Chief Executive of the Attorney‑General's Department is declared to be the employer of public employees for the Act's definition (regulation 4). That has direct effect for bargaining, notice and employer‑liability questions where the Act uses that definition of employer.

Associations (employee organisations)

• Associations that intend to enter enterprise agreements on behalf of employees must give the prescribed notice (regulation 6(1)-(3)). They must take reasonable steps to give written notice to each employee in the proposed group and, where practicable, display a notice at the workplace (regulation 6(2)). Notices must be in plain language, identify the association, contain contact details, describe the group, explain authorisation rules and provide means for non‑members to give authorisation (regulation 6(3)). Notices must be signed by or on behalf of the association (regulation 6(3)(g)). Associations must also act on translation requests and ensure workplace displays are in appropriate languages (regulation 6(4)-(5)).

Employees

• Employees who are the subject of proposed bargaining must receive the notices required by regulation 6 or 7. The regulations create specific consequences that affect employees directly: for example, regulation 6(3)(e)(ii) treats any employee within the group who is a member of the association as having given authorisation to the association unless the employee withdraws that authorisation by written notice. Employees who are not association members must be informed of how to give authorisation to the association (regulation 6(3)(f)).
• Certain classes of employees are specifically affected by exclusions: probationary/qualifying period employees are excluded from unfair dismissal protections if the period is determined in advance and is reasonable (regulation 9(a)); most casual employees are excluded except where they meet the regular and systematic engagement test and have a reasonable expectation of continuing employment (regulation 9(b)); and employees whose conditions are governed by instruments that provide equivalent unfair dismissal protection are excluded from Chapter 3 Part 6 for unfair dismissal (regulation 9(c)).

Persons engaged in disability‑related employment

• The organisations listed in Schedule 2 are declared to be recognised organisations for section 113 of the Act (regulation 10(1)). Where section 113 applies to a person, the regulation constrains award regulation of wages or salary for that person (regulation 10(2)-(3)). This affects employers and employees in the disability services sector covered by the listed organisations.

Tribunal/Regulator interactions

• SAET is referenced as the tribunal that, for example, can determine that an employer is exempt from the employer notice requirement under section 76(1) of the Act (regulation 7 note), and may determine that an absence from work is to be taken as breaking continuity of service for notice and compensation purposes (regulation 11(4)). That situates SAET as the decision point for specific exemptions or continuity determinations referenced in the regulations.

Other affected parties

• The repeal of the 2009 Regulations (Schedule 3) affects any person who relied on those instruments; from commencement the 2024 instrument supplants the 2009 framework. The mapping of federal references in regulation 12 affects the legal reading of federal instruments that continue to operate as awards or enterprise agreements within the South Australian system, so parties subject to such instruments are affected by the substitution rules.

In short, the regulations allocate procedural duties primarily to employers and associations in the enterprise bargaining context, set definitional fixes for public sector employer status, narrow the Act's reach for certain domestic or casual employment, and create specified administrative outcomes for disability‑sector awards and continuous service reckoning. Who pays and who decides will vary: employers typically bear the costs of notices, translations and recordkeeping; employees decide whether to withdraw authorisations or authorise an association; and SAET retains decision authority for some discretionary determinations cited in the regulations.

The regulations impose specific duties and confer certain statutory effects that alter behaviour by creating formal obligations, prescriptive content requirements and procedural timeframes.

Notifications by associations (regulation 6)

• Duty: An association that proposes to enter an enterprise agreement on behalf of a group of employees must give notice of that proposal in accordance with regulation 6 (regulation 6(1)). The association must take reasonable steps to ensure written notice is given to each employee in the group and, if practicable, displayed at the workplace (regulation 6(2)).
• Content duty: Notices must be in plain language; state the full name of the association; provide an officer's name and phone number; identify the employee group with sufficient particularity; state that a majority authorisation enables the association to bind all members and that association members will be taken to have authorised the association unless they withdraw in writing (regulation 6(3)(a)-(e)); and provide means for non‑members to give authorisation (regulation 6(3)(f)). Notices must be signed by or on behalf of the association (regulation 6(3)(g)).
• Language/access duties: Associations should, so far as reasonably practicable, display notices in languages appropriate for a significant number of employees (regulation 6(4)), and must take reasonable steps to supply a requested translation (regulation 6(5)).
• Rights/effects for employees: A membership status effect is created in regulation 6(3)(e)(ii): a member of the association will be taken to have given authorisation unless they withdraw in writing. That is a default rule that converts membership into presumed authorisation unless there is an express written withdrawal.

Notifications by employers (regulation 7 and Schedule 1)

• Duty: Employers must give notice that negotiations are about to begin, pursuant to section 76(1) of the Act (regulation 7(1)). Employers must take reasonable steps to ensure the notice is given to each employee in the proposed group and displayed at the workplace in languages appropriate to a significant number of employees (regulation 7(2)).
• Content duty: Employer notices must be in plain language; include a statement that the employer proposes to begin negotiations and propose a date and place for commencement; identify the employee group with sufficient particularity; may outline proposed negotiation procedures and matters; must be signed; and may adopt the Schedule 1 form (regulation 7(3)(a)-(g); Schedule 1).
• Temporal duty: The Schedule 1 note states that under section 76(1) of the Act the proposed commencement date cannot be less than 14 days from the date the notice is given to employees. Employers must inform employees of their right to representation and provide reasonable access to applicable awards (Schedule 1).

Signing requirements for enterprise agreements (regulation 8)

• Duty: Agreements must be signed for validity. On the employers' side the agreement must be signed by the employer or a person duly authorised to sign (regulation 8(1)(a)). On the employees' side the agreement must be signed either by the employees who approve it, an authorised officer of an association authorised under section 75(2), or a person duly authorised by the employees who approve the agreement (regulation 8(1)(b)(i)-(iii)).
• Additional duty: If the agreement contains a provision authorised under section 77(1)(d) (which gives an association the right to represent industrial interests to the exclusion of another), the agreement must also be signed by an authorised officer of the association that has been given that right (regulation 8(2)).

Unfair dismissal exclusions (regulation 9)

• Declaratory duty: Regulation 9 declares classes of employees excluded from Chapter 3 Part 6 (unfair dismissal) pursuant to section 105A(2) of the Act. The regulation sets the conditions and factual tests that determine whether an employee falls within excluded categories.
• For probation/qualifying period employees the period must be determined in advance and be reasonable having regard to the nature and circumstances of the employment (regulation 9(a)(i)-(ii)).
• For casual employees the exclusion does not apply where the casual has been engaged on a regular and systematic basis during a sequence of periods of employment for at least 6 months and has, or would have had, a reasonable expectation of continuing employment (regulation 9(b)(i)-(ii)).
• For employees governed by instruments that make specific arrangements concerning unfair dismissal, the exclusion applies where those arrangements taken as a whole provide protection at least equivalent to the protection in Chapter 3 Part 6 (regulation 9(c)).

Continuous service rules and notification obligations (regulation 11)

• Guidance duty: Regulation 11 prescribes events to be disregarded in calculating continuity of service, including employer actions intended to avoid obligations, authorised leave, illness or accident (with employee notification/substantiation conditions), absence for reasonable cause (with notification conditions), and collective industrial action (subject to SAET determination) (regulation 11(1)(a)-(f)).
• Employee notification duties: For illness/accident (regulation 11(2)) and reasonable cause (regulation 11(3)), where contractual or award terms require notification and substantiation the employee must comply; in other cases the employee must inform the employer within 24 hours after commencement of the absence, or within a longer reasonable period, providing details of absence, whether due to illness/accident and likely duration (regulation 11(2)(b)(i)-(iii); 11(3)(b)(i)-(iii)).
• Employer notice right: For other absences an employer may give written notice within the absence period, or within 14 days after its end, that the absence shall break continuity of service, subject to delivery methods and the right of the employer to withdraw such a notice (regulation 11(5)-(7)).

Awards relating to disabled workers (regulation 10)

• Declaration: Schedule 2 bodies are declared recognised organisations for section 113 purposes (regulation 10(1)).
• Constraint: An award under section 90 cannot regulate wages or salary payable to a person to whom section 113 applies (regulation 10(2)). Wages or salary for that purpose specifically exclude shift premiums, overtime and allowances (regulation 10(3)(a)-(c)).

Rights to language access and representation

• Both employers and associations have a duty to take reasonable steps to supply notices in alternative languages on reasonable request and to display notices in languages appropriate to significant employee cohorts (regulations 6(4)-(5), 7(2) and 7(4)). Employees have the right to representation in bargaining (Schedule 1, clause 4).

These duties create concrete compliance obligations. The regulations do not themselves set separate penalty tariffs. Instead they implement obligations pursuant to specified Act provisions; therefore enforcement, validation of agreements and the consequences for non‑compliance are to be determined under the parent Act and by the relevant tribunal referenced in the Act and regulations.

The regulations do not create standalone penalty provisions or new enforcement bodies. Instead they identify procedural duties and exemptions that operate pursuant to particular sections of the Fair Work Act 1994. Consequences for non‑compliance therefore derive from the Act and the decision‑making powers of the tribunal and regulators operating under the Act. Key enforcement features and practical consequences that follow from the regulations are:

No express penalty provisions in the regulations

• The text of the regulations contains no penalty or infringement scheme, and does not prescribe fines, offences or administrative penalties. Each regulation is formulated as a subordinate rule made "pursuant to" a specified Act provision, so legal consequences for failure to act as required depend on the parent Act and its enforcement scheme.

Connection to the Act and SAET determinations

• The regulations repeatedly reference specific Act provisions and the State Administrative and Employment Tribunal (SAET) where the Act anticipates tribunal decision‑making. For example, the employer notice requirement is made pursuant to section 76(1) of the Act and the regulation's note states that "under section 76(1) of the Act notice is not required if the agreement is negotiated to settle an industrial dispute, or SAET determines that there is good reason in the circumstances of the case to exempt the employer from this requirement" (regulation 7 note). Regulation 11(4) also gives SAET the role of determining whether an absence is to be taken as breaking continuity of service for the purposes of notice of termination or compensation instead of notice. These cross‑references locate enforcement and discretionary exemption decisions with SAET in the circumstances the Act describes.

How non‑compliance may be material

• While the regulations themselves do not specify penalties, non‑compliance with a regulation implementing an Act provision is likely to affect the legal operation of the Act. For example:
  • Failure to give the prescribed notice or to meet the content requirements for association or employer notices may affect whether bargaining and subsequent agreement formation complies with the Act's formal requirements, which in turn can affect the validity of an enterprise agreement under the Act. The regulations make notice obligations explicit by setting content and delivery standards (regulations 6 and 7).
  • Incorrect signing of an enterprise agreement may affect the capacity to register or enforce the agreement under the Act, because regulation 8 specifies who must sign pursuant to section 77(1)(g) of the Act.
  • Failure to make required translations or to provide access to awards as required in Schedule 1 may have procedural consequences when the validity of bargaining processes is considered.
  • An employer that issues a continuity‑breaking notice outside the regulatory time limits or by improper method risks having that notice ignored, with the effect that an absence may be disregarded or not and so may alter notice or compensation calculations under the Act.

Tribunal remedies and Act based enforcement

• The Act, not the regulations, establishes the enforcement and remedial framework for issues such as invalid enterprise agreements, unfair dismissals, and disputes about continuity of service. The regulations route particular factual and procedural issues into that framework by prescribing how notices, signatures and continuity rules operate. Any sanction, remedy or declaration for non‑compliance will therefore be a function of the Act and the tribunal or court processes the Act empowers.

Practical implication for compliance risk

• The lack of express monetary penalties in the regulations does not remove compliance risk. Procedural non‑compliance can materially affect legal rights and liabilities under the Act, including the enforceability and registration of agreements and the applicability of unfair dismissal protections. Parties should assume that the tribunal (SAET) or other bodies referenced in the Act will adjudicate disputes resulting from non‑compliance and that the statutory consequences under the Act will apply.

In sum, enforcement of duties imposed by the regulations is mediated by the Act and tribunal processes rather than by new sanctions in the regulations. The regulations operate as prescriptive rules that inform whether parties have complied with the statutory conditions that trigger particular legal outcomes under the Act.

The regulations are explicitly designed to operate in close relation to several provisions and schedules of the Fair Work Act 1994 and to align federal industrial instruments with the South Australian system where the transitional national industrial relations arrangements apply.

Direct references to the Fair Work Act 1994

• Every substantive regulation is made pursuant to a provision of the Act. The instrument repeatedly identifies the parent Act provision that authorises the regulation. Examples include:
  • Regulation 6 is enacted "pursuant to section 75(2)(b) of the Act" and governs association notice requirements for enterprise agreements.
  • Regulation 7 is enacted "pursuant to section 76(1) of the Act" and sets employer notice obligations before negotiations begin.
  • Regulation 8 is enacted "pursuant to section 77(1)(g) of the Act", determining signing requirements for enterprise agreements.
  • Regulation 9 is enacted "pursuant to section 105A(2) of the Act", declaring classes excluded from unfair dismissal protections.
  • Regulation 10 is enacted "pursuant to section 113(1)(c) of the Act" and "pursuant to section 113(3) of the Act", concerning recognised organisations and award limits.
  • Regulation 11 is enacted pursuant to Schedule 8 section 1(3) of the Act, concerning continuous service.
  • Regulation 12 is enacted pursuant to Schedule 2 clause 2(1)(b) and Schedule 2A clause 3(1)(e) of the Act, adapting federal instruments and references.

Translating federal instruments and references to Commonwealth laws and bodies

• Regulation 12 contains textual modification rules for federal industrial instruments that continue to operate as awards or enterprise agreements under the Act. It prescribes that references to the Workplace Relations Act 1996 or the Fair Work Act 2009 (Commonwealth) will be read as references to the Fair Work Act 1994 (South Australia), and that references to the Australian Industrial Relations Commission or Fair Work Australia will be read as references to SAET (regulation 12(1)(a)-(b); 12(2)(b)(i)-(ii)). That is an inter‑instrument mapping rule that aligns terminology where federal instruments remain part of the South Australian regulatory fabric under the transitional schedules of the Act.

Exclusion of a specific award from a transitional clause

• Regulation 12(2)(a) expressly excludes the Municipal Officers (SA) Award 1998 from the operation of clause 3(1) of Schedule 2A. That is a bespoke interaction with that particular federal instrument as it applies in South Australia.

Interaction with tribunal discretion and determinations

• The regulations expressly signal the role of SAET in making key determinations under the Act. For instance, the employer notice requirement in regulation 7 is subject to SAET's power to exempt an employer from that requirement under the Act. Regulation 11(4) provides that SAET may determine an absence is to be taken as breaking continuity of service for the purposes of notice or compensation. Those references integrate tribunal decision‑making into the operation of the regulations.

Overlap with awards and enterprise agreements

• Regulation 10(2) modifies the operation of awards relative to section 113 of the Act by preventing an award under section 90 from regulating the wages or salary of a person to whom section 113 applies. This creates a direct intersection between the regulations and award content, and it reframes the scope of award regulation for persons covered by section 113.

Repeal of prior subordinate legislation

• Schedule 3 repeals the Fair Work (General) Regulations 2009. That repeal is an express statutory interaction in the sense that prior subordinate rules are removed and replaced by the 2024 instrument.

Practical outcomes of these interactions

• The regulations are not free‑standing; they are interpretive and procedural adjuncts to the Act. They are designed to ensure consistency between the Act's framework and the practical mechanics of bargaining, continuity determinations and award application. Parties dealing with overlapping Commonwealth instruments, awards or former subordinate rules should note the textual mapping in regulation 12 and the repeal in Schedule 3, and align their documentation, contract wording and notices accordingly.

In summary, the instrument operates as a subordinate implementation layer for the Fair Work Act 1994 and includes explicit conversion rules so that certain federal instrument references operate coherently within the South Australian regulatory context. Tribunal discretion under the Act remains the avenue for exemptions and determinations referenced by the regulations.

The instrument contains a concise legislative history within its text. Key points:

Commencement and gazettal

• The regulations commenced on the day on which they were made, as provided by regulation 2. The legislative history records the principal regulations as 2024 No 85, gazetted 22 August 2024, with commencement noted as 22.8.2024 (Legislative history and Principal regulations entries).

Repeal of the 2009 regulations

• Schedule 3 expressly repeals the Fair Work (General) Regulations 2009. That repeal is a direct substitution: from commencement the 2009 subordinate instrument is removed and replaced by the 2024 regulations.

No further amendments recorded within the text

• The instrument's internal legislative history lists the principal regulation making particulars and commencement but contains no subsequent amendment entries or historical versions beyond the repeal of the 2009 Regulations. The text therefore records a single principal statutory event: the making and commencement of the 2024 regulations and the repeal of the 2009 instrument.

Chronological effect

• Mechanically, the 2024 regulations took effect from the date shown in the Gazette. Any transitional or saving provisions that might have been in the 2009 regulations are not reproduced in the 2024 instrument, so users must treat the 2024 regulation text as the operative subordinate law from the date of commencement.

Implications for compliance history

• Because Schedule 3 repeals the prior regulations, compliance obligations, templates and processes previously governed by the 2009 instrument are superseded. Parties should update policies, templates and compliance checklists to reflect the new text, including the new notice templates and the specifics of signing and continuity rules.

Absence of amendment entries

• The instrument contains no recorded subsequent amendments, variations or delegated instruments within its own text. Any later amendments would need to be tracked in the published legislation index and Gazette beyond the content provided in this instrument. The legislative history here is therefore a single‑step history: 2009 instrument repealed; 2024 instrument made and commenced 22 August 2024.

For practical compliance and archival purposes legal teams and compliance officers should treat the 2024 regulations as the current subordinate law text replacing the 2009 Regulations and ensure internal procedures are aligned with the 2024 wording and the specific commencement date noted.

The regulations themselves do not record any litigation. The instrument contains references to SAET decision‑making but does not cite any cases, tribunal decisions or judicial interpretations.

Key points drawn from the text:

• SAET is identified as the tribunal that may make particular determinations under the parent Act and as the entity to which federal institutional references are mapped (for example, regulation 12 maps references to the Australian Industrial Relations Commission or Fair Work Australia to SAET). Regulation 7 includes a note that under section 76(1) of the Act SAET may determine there is "good reason" to exempt an employer from giving notice when negotiating an agreement. Regulation 11(4) empowers SAET to determine whether an absence from work is to be taken as breaking continuity of service for notice and compensation purposes. Those provisions allocate decision authority to SAET for specific discretion points under the Act.
• The instrument contains no examples of SAET decisions, no reported appeals, and no judicial authorities are mentioned or incorporated.

Practical consequence for practitioners

• Because the regulations refer to SAET determinations as part of their operation, tribunal practice and case law governing SAET's exercise of the powers referred to will materially affect how the regulations operate in contested situations. Practitioners should therefore monitor SAET decisions dealing with exemptions from notice requirements, continuity of service determinations, and disputes about bargaining notice compliance. That monitoring is not possible from this instrument alone because it contains no decisions. The absence of litigation entries in the instrument simply means any litigation history must be sought from tribunal and court databases rather than from the regulatory text.

Limitations of the instrument as a source of dispute precedent

• The regulations provide procedural rules and declaratory content but do not purport to set out interpretive guidance resolved by case law. Where the Act or these regulations raise contested legal questions, such as what constitutes a "reasonable" probation period for exclusion under regulation 9(a), what amounts to a "reasonable expectation" of continuing employment for casuals under regulation 9(b), or whether a notice meets the content adequacy set out in regulations 6 and 7,those matters are likely to be adjudicated under the Act and by SAET. The instrument itself does not supply litigation precedent or interpretive guidance beyond the textual prescriptions.

In sum, the regulations refer disputes and discretionary questions to the tribunal framework established by the Act, but the regulations contain no litigation history or cited decisions. Legal research into tribunal decisions remains necessary to understand how SAET will apply the discretions the regulations envisage.

The regulations contain several provisions that may produce unintended practical consequences, evidentiary issues or operational traps if not carefully followed. The following are precise, source‑grounded points to watch for.

Authorisation by association members treated as default (regulation 6(3)(e)(ii))

• A notable automaticity is that any employee within the identified group who is a member of the association "will be taken to have given an authorisation for the purposes of the Act unless the employee, by written notice to the association, withdraws the authorisation" (regulation 6(3)(e)(ii)). The default presumption converts membership into authorisation unless there is an express written withdrawal. Associations and employers should ensure clear recordkeeping of any withdrawal notices because the absence of such a notice will be treated as continuing authorisation.

Precision required in identifying the group (regulations 6(3)(d), 7(3)(c), Schedule 1)

• Notices must "identify the group of employees who would or might be bound by the proposed enterprise agreement with enough particularity to enable an employee to determine whether or not they are or might be in the group" (regulations 6(3)(d), 7(3)(c)). Vague or overly broad descriptions risk challenge. The Schedule 1 template emphasises that the description used should be sufficiently precise. Practitioners should take care to craft class descriptions that can be operationally and evidentially verified.

Language obligations and translation requests (regulations 6(4)-(5), 7(2), 7(4))

• Both associations and employers must take reasonable steps to display notices in languages appropriate for significant employee cohorts and must supply translations on reasonable request. Failure to meet these duties could be argued to undermine the adequacy of notice. The regulations do not define "reasonable steps" or "reasonable request", so matters of cost, availability and timeliness will likely be contested in practice.

Employer notice timeframes and Schedule 1 14‑day rule (Schedule 1 note)

• The Schedule 1 note states that under section 76(1) the proposed date for commencement of negotiations cannot be less than 14 days from the date the notice is given to employees. Practitioners must track the notice date and proposed commencement date carefully; inadvertently proposing an earlier commencement may render the notice non‑compliant with the Act's timing requirement.

Authorisation mechanics for non‑members (regulation 6(3)(f))

• Associations must provide details of the means by which a non‑member employee may give authorisation. Failure to provide a clear, accessible mechanism could be challenged as diminishing the ability of non‑members to choose representation. The regulation does not prescribe the exact form of the mechanism, so there is a risk that inadequate procedures will be contested.

Signing formalities and exclusivity provisions (regulation 8(2))

• If an enterprise agreement contains a provision authorised under section 77(1)(d) of the Act (i.e., giving an association the exclusive right to represent employees to the exclusion of another), the agreement "must also be signed by an authorised officer of the association of employees that has been given the right to represent the industrial interests of the employees to the exclusion of another association of employees" (regulation 8(2)). Neglecting to obtain that signature risks procedural non‑compliance and could affect the enforceability or registration of the agreement.

Documentation of probation/qualifying periods (regulation 9(a))

• To rely on the unfair dismissal exclusion for probationary employees, an employer must ensure that the period or its maximum duration "is determined in advance" and "is reasonable having regard to the nature and circumstances of the employment" (regulation 9(a)(i)-(ii)). Employers should document the determination in advance and the basis for its reasonableness to withstand scrutiny.

Evidence required for casual exclusion exceptions (regulation 9(b))

• Casual employees are excluded from unfair dismissal protections except where they have been engaged on "a regular and systematic basis for a sequence of periods of employment during a period of at least 6 months" and have or would have had a reasonable expectation of continuing employment (regulation 9(b)(i)-(ii)). Employers and employees must be able to produce documentary or other evidence of work patterns and expectations. The regulations do not prescribe the form of evidence, so evidentiary disputes are foreseeable.

Continuous service notification timing and delivery (regulation 11(5)-(6))

• Employers may serve written notice to an employee within the absence or within 14 days after the end of the absence that the absence breaks continuity of service. The notice must be delivered personally or posted to the employee's last known address (regulation 11(6)). The regulation allows withdrawal of such a notice, but failure to comply with the delivery or timing requirements could leave an absence treated as continuous unintentionally.

Exclusion of wages regulation under section 113 and the narrow "wages or salary" definition (regulation 10(2)-(3))

• Regulation 10(2) provides that an award under section 90 cannot regulate wages or salary payable to a person to whom section 113 applies. However regulation 10(3) clarifies that wages or salary do not include rates or shift premiums, overtime or allowances. That narrower definition may produce counterintuitive outcomes where awards still regulate other pay components even though base wages are excluded. Employers should audit award coverage carefully in relation to disabled workers covered by section 113 and the Schedule 2 organisations.

Municipal Officers (SA) Award 1998 exclusion (regulation 12(2)(a))

• Regulation 12(2)(a) excludes the Municipal Officers (SA) Award 1998 from the operation of clause 3(1) of Schedule 2A. Practitioners dealing with that award should be alert to bespoke transitional treatment that may affect continuity or interpretive outcomes.

Recordkeeping and evidentiary burdens

• Many of the regulations create duties that will be proven by documentary evidence: notice copies, translations provided, signatures on agreements, authorisation withdrawals, dates of notice, delivery records of continuity notices, and documentation of probation periods. Failure to maintain clear records will complicate defence or prosecution of disputes arising under the Act where the regulations apply.

Collective action and continuity

• Regulation 11(1)(e) provides that absences due to concerted or collective industrial action are disregarded unless SAET determines otherwise (regulation 11(4) permits SAET to determine that such an absence breaks continuity). Parties should be aware that industrial action may have continuity consequences depending on tribunal findings.

These are practical "gotchas" drawn directly from the regulations. They indicate where routine HR or bargaining processes will need precise handling and where documentation and procedural care will materially alter legal outcomes under the Act.

Compliance with these regulations requires operational changes, careful documentation and delegation of responsibilities across employers, associations and HR teams. Below is a practical, section‑by‑section checklist and process guidance tied to the regulation text.

1. Declared employer for public employees (regulation 4)

• Action: For matters where the Act requires identification of the employer under paragraph (a) of the definition in section 4(1), treat the person holding or acting in the role of Chief Executive of the Attorney‑General's Department as the employer. Update delegation, correspondence and signatures on enterprise bargaining documentation accordingly.
• Document: A register of who occupies the Chief Executive role at relevant times and evidence of authorisation to act in employer capacity.

2. Excluded domestic employment (regulation 5)

• Action: Review contracts and job descriptions for part‑time or casual residential work and classify roles where the work is "wholly or mainly performed for a domestic purpose". If classified as excluded, mark them out of the Act's coverage.
• Document: Role assessment checklists documenting whether work is performed for the employer's trade or business or for domestic purposes.

3. Association notice obligations (regulation 6)

• Action: Associations proposing to negotiate must give written notices to each employee in the proposed group and display notices at the workplace if practicable.
• Content checklist for association notice (regulation 6(3)):
  • Plain language text.
  • Full association name.
  • Name and phone number of an officer for inquiries.
  • Precise description of the employee group.
  • Statement that majority authorisation can bind the group and that association members are taken to have authorised the association unless they withdraw in writing.
  • Instructions for how non‑members can give authorisation.
  • Signed by or on behalf of the association.
• Language obligations: Ensure workplace displays are in appropriate languages for significant employee groups and be ready to supply requested translations reasonably promptly.
• Document: Retain copies of notices, delivery records, signatures, translations provided, and any written withdrawal of authorisation from members.

4. Employer notice obligations and Schedule 1 template (regulation 7, Schedule 1)

• Action: Employers must serve a notice before negotiations begin. The notice should follow the Schedule 1 template where practical and must propose date and place of negotiations.
• Timing: Ensure the proposed commencement date is not less than 14 days from the date the notice is given to employees (Schedule 1 note).
• Content checklist (regulation 7(3)):
  • Plain language.
  • Statement of proposed start date and place.
  • Precise description of the employee group.
  • Optional: outline proposed negotiation procedure, timeframes and consultative arrangements.
  • Optional: outline matters proposed to be subject to negotiations.
  • Signed by the employer or authorised signatory.
  • Include the employees' right to representation and details on how to access applicable awards.
• Language obligations: Display notices in appropriate languages and supply translations on reasonable request.
• Joint employer notices: If multiple employers are involved, consider a joint notice (regulation 7(5)).
• Document: Keep a record of notice delivery to each employee, workplace display photos or copies, and any translation requests and fulfilment.

5. Signing enterprise agreements (regulation 8)

• Action: Ensure an enterprise agreement is signed by:
  • The employer or an authorised person; and
  • Either: the approving employees comprising the group; an authorised officer of an authorised association; or a person duly authorised by those employees.
• If the agreement includes a s77(1)(d) exclusivity provision, obtain the authorised officer signature of the association given exclusive representation (regulation 8(2)).
• Document: Maintain a signature page with date, identity of signatories and copies of any authority documents for authorised signatories.

6. Unfair dismissal exclusions (regulation 9)

• Probation/qualifying periods:
  • Action: If relying on the exclusion, ensure the period is determined in advance and document the basis for its reasonableness in relation to the role.
  • Document: Written probation terms in the contract and evidence supporting the chosen duration.
• Casual employees:
  • Action: Where casuals may assert continuous engagement or reasonable expectation of continuing employment after six months, keep clear records of engagement patterns, hours worked and communications about ongoing work.
  • Document: Rosters, offer letters, engagement correspondence and payroll records showing sequences of periods.
• Employees under alternative instruments:
  • Action: Assess whether the award, agreement or contract contains specific unfair dismissal arrangements that as a whole provide protection at least equivalent to the Act. Document that equivalence assessment.
  • Document: Comparative analysis notes and the instrument text evidencing the protections.

7. Continuous service rules (regulation 11)

• Employee notifications:
  • Action: Communicate to employees their obligations to notify and substantiate absences in case of illness/accident or absence for reasonable cause. Where an award or agreement prescribes notification/substantiation, ensure employees know and follow that process.
  • Timing: Absent award terms, employees should be instructed to inform the employer within 24 hours of commencement of the absence or within a reasonable longer period, and to state the reason and likely duration.
• Employer continuity notices:
  • Action: Where an employer considers an "other absence" breaks continuity, serve a written notice either during the absence or within 14 days after its end, delivered personally or posted to the employee's last known address (regulation 11(6)).
  • Right to withdraw: Be prepared to withdraw the notice if circumstances change (regulation 11(7)).
• Document: Absence logs, notification records, medical certificates or substantiation documents, and copies of any continuity notices served and withdrawn.

8. Awards and disability sector declarations (regulation 10 and Schedule 2)

• Action: Identify workers to whom section 113 applies and ensure awards do not purport to regulate wages or salary for such persons, noting that wages or salary for this purpose excludes shift premiums, overtime and allowances (regulation 10(2)-(3)).
• Document: Cross‑reference lists of employees, award clauses, and records showing how pay components are characterised.

9. Continuity with federal instruments (regulation 12)

• Action: For any federal award or enterprise agreement that operates within the South Australian system, read references to Commonwealth Acts and institutions as references to the Fair Work Act 1994 and SAET as specified by regulation 12. Account for the exception for the Municipal Officers (SA) Award 1998.
• Document: Annotated instrument copies showing the textual substitutions required by regulation 12 for local interpretation.

10. Recordkeeping and audit

• Always retain:
  • Copies of notices sent to employees, proof of delivery, and photographs of workplace displays.
  • Translation requests and the translations supplied.
  • Signed enterprise agreements and written authorities for signatories.
  • Records of employee authorisations and any written withdrawals of authorisation.
  • Records of absences, notifications, medical substantiation and continuity notices.
  • Evidence of the employer's determination of probation periods and supporting rationale.
• Establish an internal compliance checklist mapping each regulatory obligation to an owner, timeline and stored evidence location.

11. Training and process governance

• Train HR and industrial relations staff on the precise wording requirements (for example, the specific authorisation presumption for association members and the 14‑day notice timing).
• Assign escalation paths for translation requests and ensure providers are on retainer or can be procured quickly.
• Where SAET determinations may be relevant (exemptions from notice, continuity decisions), maintain a connection with external counsel experienced in SAET practice.

By converting the regulations' text into concrete procedures, responsible officers can reduce the risk of procedural non‑compliance that would have legal consequences through the Act and tribunal processes.
