This Act refers specified workplace relations matters from the State to the Commonwealth by making parts of the Commonwealth Fair Work Act (and permitted express amendments) operate in the State (secs 3–5, sch.2). It affects employers and employees (including some public and local government roles only as the State’s referral law allows), excludes a set of subjects (eg superannuation, workers’ compensation, OH&S) and gives the Governor power to end references by proclamation with set timing and reporting rules (secs 6–9).

What it does

This Act refers specified workplace-relations matters from the State to the Commonwealth for the purposes of the Commonwealth Fair Work Act 2009 (Cwlth), limits which subjects are referred, and sets rules about the timing and termination of those references. Its operative mechanics are principally: (a) declaring fundamental workplace relations principles that the Commonwealth Fair Work Act should embody (section 4); (b) making three categories of references to the Commonwealth Parliament , an initial reference to include scheduled provisions in the Commonwealth Fair Work Act, an amendment reference permitting express Commonwealth amendments to the Fair Work Act on the listed subject matters, and a transition reference covering the move from prior federal and State regimes to the Fair Work framework (section 5(1)); and (c) providing mechanics for terminating those references by gubernatorial proclamation, with timing constraints (sections 7 and 9).

The Act limits the extent of the State’s reference by excluding particular subject matter from the reference (the definition of excluded subject matter in section 3), and by excluding certain classes of persons and entities from being covered by the references (section 6). The scheduled text (schedule 2) is incorporated as the “initial referred provisions” to be included in the Commonwealth Fair Work Act “in the terms, or substantially in the terms” set out in the schedule (section 5(1)(a)). The Act also contains transitional and interpretative provisions that ensure references affect federal instruments and definitions (for example, section 12 and the schedule 2 Division provisions such as sections 30M-30S).

Practically, the State transfers to federal lawmaking the power for specified workplace matters. Once the matters are included in or expressly amend the Commonwealth Fair Work Act, the federal provisions apply in the State to the extent the Commonwealth has legislative power under those references (section 5(2) and schedule 2, section 30S). The Governor may terminate references by proclamation (section 7), and those proclamations are subordinate legislation (section 10). The effect of termination on laws made prior to termination is preserved (section 8).
