Fair Trading (Motor Vehicle Repair Industry) Act 2010

The Act centrally relies on a set of interlocking concepts: false or misleading representation, motor vehicle repair work, trade or commerce, and regulatory exemptions. Each of these concepts is explicitly defined or cross-referenced in the text.

False or misleading representation

• The core criminal concept is framed as a prohibition on certain classes of false or misleading representations made “in trade or commerce” and “in connection with the supply or possible supply of goods or services in relation to motor vehicle repair work or in connection with the promotion by any means” of such supply or use (s 49(1)). The subsection then lists categories of representation that are unlawful if false or misleading: representations about standards, quality, value, grade, composition, style or model, history or previous use, whether goods are new, the existence of an agreement to acquire goods or services, sponsorships or approvals, performance characteristics and accessories, price, availability of repair facilities or spare parts, origin (subject to the ACL exception), need for goods or services, conditions/warranties/guarantees/rights/remedies, and that services will be performed with necessary equipment, materials and skill having regard to vehicle age and make (s 49(1)(a)-(l). The breadth of the enumerated list implicates promotional material, quotes, invoices, statements of capability, and advice.

Motor vehicle repair work

• The dictionary supplies the operative scope for what kinds of work fall within the statute. “Motor vehicle repair work” expressly includes a wide range of activities performed on motor vehicles, parts or systems: examining or assessing condition or performance improvement, diagnosing and detecting faults, overhauling, dismantling and assembling, servicing and maintenance, replacing and adjusting objects for performance improvement, painting and treatment, modifying, altering, installing or fitting work (dictionary, motor vehicle repair work(a)(i)(A)-(H)). It also expressly includes giving advice on any of those activities (dictionary, motor vehicle repair work(a)(ii)). The dictionary permits further expansion or contraction by regulation: it includes any other work prescribed by regulation to be motor vehicle repair work and excludes any work prescribed by regulation not to be motor vehicle repair work (dictionary, motor vehicle repair work(a)(iii), (b)).

Trade or commerce and cross-referenced terms

• The Act defers to the Australian Consumer Law (ACT) for definitional clarity: “goods”, “price”, “services”, “supply” and “trade or commerce” all carry the meaning given in the Australian Consumer Law (ACT), s 49(4). This creates a direct conceptual connection to the broader consumer protection statutory architecture.

Regulation and exemptions

• The Act gives the Executive regulation-making powers (s 57), and expressly permits regulations to exempt a person from all or any provisions of the Act (s 53). That mechanism allows the Executive to alter who is captured or to provide carve-outs without primary-legislation amendment.

Interaction with investigation and criminal responsibility principles

• Section 5 places offences under the general criminal law framework in the Criminal Code, ch 2, so standard criminal law concepts such as conduct, intention, recklessness and strict liability will be applied to offences under this Act, and procedural matters will follow the Code (s 5 and notes). The Act also signals that investigative powers relevant to enforcement exist under the Fair Trading (Australian Consumer Law) Act 1992, div 5.2 (note to Part 7).

Penalty mechanics

• The Act sets the maximum criminal penalty at 200 penalty units for contravening s 49(1) (s 49(3)). The republication front-matter records the penalty unit values at the republication date: $160 for an individual and $810 for a corporation (Legislation Act, s 133, noted in the republication cover). Because the Act ties monetary maximums to penalty units, the actual dollar exposure will change if the Legislation Act is amended or the penalty unit value is re-indexed.

Scope exclusions and who is not taken to be carrying on business

• Section 7 qualifies who is not taken to be carrying on business as a motor vehicle repairer for the purposes of the Act. The exclusions are narrow but definitive: performing work in the course of employment by another person, being a member of a partnership that carries on the business, and publishing advertisements on behalf of another person about the other person’s business or services (s 7(a)-(c)). Those provisions affect the statutory question of who is treated as a business operator under the Act, but they do not remove those persons from the reach of s 49 if they make representations “in trade or commerce”.

Collectively, the main concepts create a targeted prohibition: representations made in trade or commerce that relate to the supply or promotion of goods or services connected to the activities listed in “motor vehicle repair work” are proscribed in specific categories. The Act relies on other statutes for conceptual definitions and investigatory infrastructure, and it preserves executive discretion to alter coverage through regulations and exemptions.

This Act imposes criminal liability for false or misleading representations on “a person” who acts in trade or commerce in connection with motor vehicle repair work or the promotion of supply or use of related goods or services (s 49(1)). The affected parties fall into several identifiable groups with different exposure and roles.

Businesses providing motor vehicle repair services and related goods

• Businesses that supply repair services, parts, maintenance, modifications, painting and allied services as defined in the dictionary are the primary audience. Any entity marketing or offering to supply those goods or services in trade or commerce is within the statutory net to the extent it makes any of the representations listed in s 49(1)(a)-(l). Because “motor vehicle repair work” includes advice, entities that provide advisory services or quotations for repairs are included (dictionary, motor vehicle repair work(a)(ii)).

Advertisers, marketing agencies and publishers

• The statutory prohibition extends to representations made “in connection with” promotion “by any means” (s 49(1)). That language captures advertising and promotional activity, and thus affects third-party advertisers, digital marketers, online listing services, distributors of promotional material, and publishers releasing advertisements on behalf of repair businesses. However, s 7(c) says a person does not carry on business as a motor vehicle repairer only because the person “publishes, on behalf of another person, an advertisement” about that other person’s business or services. That exclusion narrows the Act’s “carrying on business” construct, but does not automatically immunise advertisers from s 49 where they engage in representations “in trade or commerce” themselves.

Employees and contractors

• Section 7(a) provides that performing motor vehicle repair work in the course of employment by another person does not alone make a person be taken as carrying on business as a motor vehicle repairer. The practical effect is that individual employees working under an employer’s direction will not, by operation of this section alone, be treated as the business for certain licensing or registration constructs formerly in the Act (now omitted). Nevertheless, s 49 applies to “a person” who makes false or misleading representations in trade or commerce. That could capture employees or contractors who themselves, in trade or commerce, make promotional or sales representations that are false or misleading, depending on the circumstances.

Partnership members

• Section 7(b) excludes a member of a partnership from being taken, solely by reason of membership, to carry on business as a motor vehicle repairer. This interacts with corporate and partnership structures: the statutory exclusion changes how “carrying on business” is attributed for the Act’s purposes, but the conduct-based offence in s 49 targets representations by persons, irrespective of status, when made in trade or commerce.

Consumers

• Consumers who purchase repair services, spare parts or related goods are the diffuse group whose protection the prohibition is designed to provide. The Act’s definitions link to the Australian Consumer Law (ACT) for the definition of “consumer” and for related concepts (see s 49(4) and dictionary notes), although the Act itself focuses on prohibiting certain representations, rather than setting out consumer remedies in this text.

Suppliers of spare parts and facilities

• Representations about availability of spare parts and repair facilities are specifically captured in s 49(1)(h). Suppliers and wholesalers of parts, as well as workshops advertising facilities or claiming access to parts, are therefore within scope for that aspect of the prohibition.

Regulators and the Executive

• The Commissioner for Fair Trading is referenced in the dictionary as “commissioner” and investigative avenues are noted by cross-reference to the Fair Trading (Australian Consumer Law) Act 1992, div 5.2. The Executive, through regulation-making powers (s 57), may make regulations affecting who is subject to the Act, and s 53 allows regulations to exempt persons from all or any provisions. This creates an administrative audience for the Act and places decision-making authority over exemptions and technical scope with the Executive branch.

Other legal actors and cross-jurisdictional considerations

• Because the definitions for “motor vehicle” and key consumer law concepts are drawn from other statutes, actors in adjacent regulated activities such as motor vehicle sales (Sale of Motor Vehicles Act 1977), consumer law compliance, advertising compliance and franchising may be affected when their conduct overlaps with repair work or repair-related promotions.

Who pays and who decides

• Criminal liability exposes the person who makes the representation to prosecution and, if convicted, to a penalty up to 200 penalty units (s 49(3)). The Executive makes regulations and may grant exemptions (ss 57 and 53). The commissioner and fair trading investigatory mechanisms are the likely prosecutorial and administrative actors, with investigations occurring under the Fair Trading (Australian Consumer Law) Act 1992 framework (note to Part 7).

In summary, the Act applies to businesses and persons who make specified representations in trade or commerce regarding the supply or promotion of goods and services connected to the comprehensive list of activities defined as motor vehicle repair work. Several narrow status-based exclusions (employees, partners, publishers acting for another) alter how the Act characterises “carrying on business”, but do not remove the broad reach of the representations offence where a person’s promotional or supply conduct falls within s 49.

The Act creates mandatory duties on persons who make representations in the motor vehicle repair context and preserves certain rights through procedural and definitional cross-references. The statutory duties are focused, discrete and criminal in nature.

Primary duties

• Do not make false or misleading representations in trade or commerce in connection with the supply or possible supply of goods or services related to motor vehicle repair work, or in relation to promotion by any means of the supply or use of goods or services relating to motor vehicle repair work (s 49(1)). The Act enumerates multiple specific categories of representations that must not be false or misleading:

  • Representations about standard, quality, value, grade, composition, style or model, and history or previous use (s 49(1)(a));
  • Representations about the standard, quality, value or grade of services (s 49(1)(b));
  • Representations that goods are new (s 49(1)(c));
  • Representations that a particular person has agreed to acquire goods or services (s 49(1)(d));
  • Representations that goods or services possess sponsorships, approvals, performance characteristics, accessories, uses or benefits they do not have (s 49(1)(e));
  • Representations that the person has sponsorship, approval or affiliation they do not possess (s 49(1)(f));
  • False or misleading representations as to price (s 49(1)(g));
  • Representations about the availability of repair facilities or spare parts (s 49(1)(h));
  • Country of origin representations, unless made in compliance with ACL part 5-3 (s 49(1)(i) and (2));
  • Representations about the need for any goods or services (s 49(1)(j));
  • Representations about the existence, exclusion or effect of any condition, warranty, guarantee, right or remedy (s 49(1)(k));
  • Representations that services have been or will be performed with the equipment, materials and skill necessary to carry out the work satisfactorily, having regard to the age and make of the vehicle, part or system (s 49(1)(l)).

• The duty to avoid false or misleading representations extends to promotion “by any means” and to offers of possible supply, which captures pre-contractual communications and advertising, not only completed transactions (s 49(1)).

Procedural and definitional rights and applications

• The Act gives effect to criminal responsibility principles under the Criminal Code through s 5. This means that usual criminal law elements and defences, including matters of intention, recklessness and strict liability, are applied in prosecutions under the Act as governed by the Criminal Code, ch 2 (s 5, note).

• For certain definitional questions (goods, price, services, supply, trade or commerce) the Act relies on the Australian Consumer Law (ACT) definitions (s 49(4)), which affords consistency with broader consumer protection frameworks. The Act also cross-references the Sale of Motor Vehicles Act 1977 for the definition of motor vehicle (dictionary).

Rights to relief and investigation framework

• The Act does not itself set out civil remedies or administrative reviews in the republished text. It, however, sits within the broader Fair Trading legislation environment: a note to Part 7 directs readers to the Fair Trading (Australian Consumer Law) Act 1992, div 5.2 for investigations by the commissioner, indicating the investigative and enforcement processes fall to existing fair trading machinery.

Exemptions and regulatory discretion

• The Executive can make regulations and the regulations may exempt a person from all or any provisions of this Act (ss 57 and 53). That is a substantive right in administrative form; it gives the Executive operational discretion to relieve specified persons from duties under the Act, subject to the normal requirements for regulations (they must be notified and presented to the Legislative Assembly under the Legislation Act, note to s 57).

Interaction of duties with status-based exclusions

• Section 7 provides that certain status alone does not make a person be taken to carry on business as a motor vehicle repairer. Specifically, employment status, partnership membership and acting as a publisher of advertisements for another do not, by themselves, constitute carrying on business as a motor vehicle repairer for the purposes of the Act (s 7(a)-(c)). This affects entitlement to regulatory treatment tied to carrying on business, although it does not itself create a defence to the s 49 offence where a person personally makes a false or misleading representation in trade or commerce.

Penalties and consequences

• Contravention of the duty in s 49(1) is a criminal offence with a maximum penalty of 200 penalty units (s 49(3)). The currency of penalty units is determined under the Legislation Act and is recorded in the republication front-matter. The application of the Criminal Code to offences under this Act means that criminal process, burdens of proof and general defences are those set out in the Criminal Code (s 5 and note).

Rights preserved by omission of licensing architecture

• The republished Act shows the omission of a number of licensing and occupational discipline provisions formerly in Parts 3 to 6 (see amendment history). That omission means the Act, as republished, does not impose a licensing regime for motor vehicle repairers within its text. Persons will therefore not be subject to licensing duties from this Act itself; however, that absence does not affect duties under other statutes or under the Australian Consumer Law.

In sum, the key duties imposed are specific prohibitions against particular classes of false or misleading representations connected to motor vehicle repair work. Rights arise mainly in the form of procedural application of Criminal Code standards, definitional cross-references to the ACL, and the Executive’s power to grant regulatory exemptions.

The Act frames contravention of its principal offence as a criminal matter, establishes the maximum penalty, and situates enforcement within the broader fair trading investigatory framework.

Maximum penalty and penalty unit mechanics

• Section 49(3) establishes that a person who contravenes s 49(1) commits an offence, with a maximum penalty of 200 penalty units. The republication front-matter notes the value of a penalty unit as at the republication date under the Legislation Act, s 133: $160 for an individual and $810 for a corporation. That means, at the date of republication, conviction could attract a maximum pecuniary penalty of $32,000 for an individual (200 × $160) and $162,000 for a corporation (200 × $810), but those figures change if the penalty unit value is amended thereafter. The Act’s linkage to the Legislation Act for penalty unit valuation makes the dollar exposure dynamic.

Application of the Criminal Code

• Section 5 directs that the Criminal Code, ch 2 applies to all offences against this Act. The Code sets out the general principles of criminal responsibility, including burdens of proof and general defences, and defines common terms used in offences (such as conduct, intention, recklessness and strict liability). Enforcement therefore follows standard criminal prosecution procedures and evidentiary tests under the Code, not a bespoke or administrative sanction regime in this Act.

Investigatory apparatus and prosecutorial pathways

• The Act itself does not contain detailed investigatory powers; instead, it directs readers to the Fair Trading (Australian Consumer Law) Act 1992, div 5.2 for investigations by the commissioner (note to Part 7). That means day-to-day investigations into alleged contraventions will typically be conducted by the commissioner for fair trading under the powers in that separate Act. The commissioner’s investigation could lead to administrative action, referral for prosecution, or other enforcement steps depending on the facts and statutory powers referenced in the Fair Trading (Australian Consumer Law) Act.

Regulatory exemptions and their enforcement implications

• Sections 53 and 57 give the Executive the ability to make regulations and to exempt persons from “all or any of the provisions of this Act.” From an enforcement standpoint, this grants the Executive room to limit application of the Act to particular persons or circumstances by subordinate legislation. An exemption by regulation would remove the statutory basis for prosecuting the exempted person under this Act, although other statutory or common law causes of action might remain.

Scope of conduct that can be prosecuted

• The offence’s reach is wide: it applies to representations made “in trade or commerce” in connection with the supply or possible supply of goods or services relating to motor vehicle repair work or in connection with promotion “by any means” (s 49(1)). Prosecutions therefore can be brought in respect of promotional materials, advertising, pre-contractual statements, quotations, warranties and other communications that constitute representations within the enumerated categories. The breadth of covered representations includes factual claims (for example, origin, newness, availability of parts) and evaluative claims (for example about the quality or standard of services).

Potential criminal-law defences and evidentiary issues

• Because the Criminal Code governs offences under this Act, common criminal-law issues will arise in enforcement. Prosecutors must prove beyond reasonable doubt the elements of the offence, including that the representation was false or misleading and was made in the required commercial context. Mens rea questions, such as whether the person intended the representation to be false or acted recklessly, will be resolved under Criminal Code principles. The Act does not itself create strict liability presumptions; resolution of mental element issues will depend on the Criminal Code and statutory interpretation.

Practical enforcement consequences

• A conviction will expose the offender to the statutory penalty, which may be a substantial monetary amount given the corporate penalty unit value. The Act does not in its republished form set out ancillary sanctions such as injunctive relief, cancellations of licences or disciplinary orders within this text; those mechanisms were part of earlier versions that included licensing and occupational discipline provisions but have been largely omitted by amendments (see amendment history). Enforcement therefore will operate principally as criminal prosecution under s 49, supported by investigatory steps under the Fair Trading (Australian Consumer Law) Act 1992.

Notification and regulation parliamentary oversight

• The note to s 57 states that regulations must be notified and presented to the Legislative Assembly under the Legislation Act, providing parliamentary visibility and a disallowance process for subordinate legislation that creates exemptions or governs procedural details. This procedural oversight operates alongside prosecutorial discretion.

In short, s 49 creates a criminal offence enforced through criminal prosecution and investigation under existing fair trading mechanisms, with a significant monetary ceiling expressed in penalty units and the Criminal Code governing legal standards and defences. The Executive’s power to exempt persons by regulation and the requirement that regulations be tabled in the Legislative Assembly affect the practical enforcement boundary.

The Act is compact and intentionally cross-referential. It integrates with the broader statutory framework in several direct ways, which shape interpretation, investigatory practice and operational effect.

Australian Consumer Law (ACT)

• Section 49(4) explicitly imports definitions of “goods”, “price”, “services”, “supply” and “trade or commerce” from the Australian Consumer Law (ACT). Section 49(2) creates a specific carve-out for country of origin representations, stating a person does not contravene s 49(1)(i) if the person complies with the Australian Consumer Law (ACT), part 5-3 (Country of origin representations). That cross-reference aligns the Act’s treatment of origin claims with the ACL’s substantive and evidentiary regime and imposes on defendants and businesses the same compliance standards used in ACL enforcement and civil remedies contexts.

Fair Trading (Australian Consumer Law) Act 1992

• The note to Part 7 refers readers to the Fair Trading (Australian Consumer Law) Act 1992, div 5.2 for investigations by the commissioner. That means the commissioner’s investigation powers, information-gathering powers, directions and enforceable undertakings (if present in the Fair Trading Act) framed elsewhere will be the primary administrative route for inquiry into alleged contraventions. The Act therefore relies on the processes and sanctions available under the Fair Trading Act for practical enforcement activity and evidence collection.

Criminal Code

• Section 5 makes the Criminal Code, ch 2 applicable to offences under this Act, so the Criminal Code’s definitions of fault, general principles of criminal responsibility, burden of proof rules and defences will be used in prosecutions. This cross-reference shapes mens rea analysis and evidentiary standards in enforcement proceedings.

Sale of Motor Vehicles Act 1977

• The dictionary signposts the definition of “motor vehicle” to the Sale of Motor Vehicles Act 1977. That means that whether a particular object or item falls within the statutory ambit of “motor vehicle” depends on the definition contained in that Act. This interaction is important because the dictionary’s definition of “motor vehicle repair work” applies to work performed on a motor vehicle, motor vehicle part or motor vehicle system, so the scope of “motor vehicle” affects the reach of the s 49 prohibition.

Legislation Act 2001

• The Act uses the Legislation Act for several technical matters. The dictionary references the Legislation Act for terms such as “penalty unit” and “person”, and the republication front-matter relies on the Legislation Act, s 133 to state current penalty unit values. The note to s 3 and to notes also cite Legislation Act provisions that establish the legal status of notes and dictionary definitions. Regulations made under s 57 must be notified and presented to the Legislative Assembly under the Legislation Act, as noted to s 57.

Regulations under this Act and administrative discretion

• Section 57 empowers the Executive to make regulations, and s 53 permits regulations to exempt a person from “all or any of the provisions of this Act”. This creates an interaction with subordinate law that can materially alter who is bound by the Act’s provisions. Regulations are subject to parliamentary oversight under the Legislation Act, but the power itself creates an administrative route to change the Act’s practical coverage without primary legislation. That may intersect with other regulatory schemes that affect the repair industry, such as licensing regimes in other jurisdictions or industry codes applied under other statutes.

Other consumer protection or trade practices laws

• Because the Act imports definitions from the Australian Consumer Law and sits in the fair trading statutory cluster, conduct that breaches s 49 may also give rise to obligations or liabilities under the ACL itself or under other trade practices or misleading or deceptive conduct provisions. The Act does not displace other civil or administrative remedies that arise under the ACL or in other laws.

Omissions of licensing and discipline provisions and their effects

• The amendment history shows that many licensing, registration, disciplinary and administrative provisions were omitted by amendment (see entries such as A2016-46 amdt 2.4 and subsequent items). This materially affects the Act’s interaction with other laws by removing a standalone licensing overlay that previously may have interacted with occupational or business regulation in the ACT. As a consequence, industry oversight for motor vehicle repairers in the ACT will rely more heavily on general consumer law, criminal offences for false representations under this Act, and any other sectoral regulation rather than on licensing under this Act.

Notification and parliamentary oversight of subordinate legislation

• Regulations under s 57 must be notified and presented to the Legislative Assembly under the Legislation Act, creating a procedural interaction that subjects regulations (including exemptions under s 53) to parliamentary processes and potential disallowance.

In practice, an operator’s legal obligations will often be determined by cross-referencing this Act against the ACL, the Fair Trading (Australian Consumer Law) Act 1992 for investigative processes, the Sale of Motor Vehicles Act for the definition of motor vehicle, and any applicable regulations made under s 57. Because the Act is narrow and heavily cross-referential, compliance and enforcement matters will commonly be resolved within that network of statutes.

The Act has been amended several times since its initiation in 2010. The republication includes an amendment history table in the endnotes that documents removal and amendment of many substantive provisions. The amendment history is relevant to understanding the present form of the Act and the relics of earlier regulatory design.

Key chronological milestones and amendments

• Original notification and commencement: Fair Trading (Motor Vehicle Repair Industry) Act 2010 A2010-16 was notified LR 7 April 2010. Sections 1 and 2 commenced 7 April 2010 and the remainder commenced 7 October 2010 (legislation history endnote entries).

• 2010 Australian Consumer Law amendments: The Act was amended by the Fair Trading (Australian Consumer Law) Amendment Act 2010 A2010-54, which inserted and amended certain definitions and the offences provisions early in the Act’s life. The amendment history records changes to sections including the dictionary and s 49 through A2010-54 (amendment history).

• Removal of the licensing architecture: A substantial set of omissions occurred with the Traders (Licensing) Act 2016 A2016-46 and related amendment packages. The amendment history records that s 6 (carrying on business as motor vehicle repairer), and large parts of Part 3 (Licences) and Part 4 (Occupational discipline), as well as Part 5 (Licence register) and Part 6 (Advisory committee), were omitted by A2016-46 amdt 2.4 and consequent amendments (see entries “om A2016-46 amdt 2.4” at multiple points). Specific provisions omitted include s 8 (Person carrying on business as motor vehicle repairer to be licensed), s 9 (Eligibility for licence), s 11 (Application for motor vehicle repair licence), s 12 (Decision on application), s 13 (Licence conditions), and many others. The amendment history makes clear that the Act’s prior licensing and discipline mechanisms were largely removed in 2016.

• Subsequent red tape reduction and statute law amendments: Between 2011 and 2017, the Act was subject to Statute Law Amendment Act 2011 A2011-3, Justice and Community Safety Legislation Amendment Act 2011 (No 3) A2011-49, Justice and Community Safety Legislation (Red Tape Reduction No 1,Licence Periods) Amendment Act 2013 A2013-28, Red Tape Reduction Legislation Amendment Act 2014 A2014-47, Spent Convictions (Historical Homosexual Convictions Extinguishment) Amendment Act 2015 A2015-45, and other measures. These amendments touched on various technical details, including the dictionary and administrative procedures.

• 2016-2017 technical changes: The Red Tape Reduction Legislation Amendment Act 2016 A2016-18 and Statute Law Amendment Act 2017 A2017-4 made more technical amendments. Some changes adjusted replacement licence provisions and penalty or administrative details (amendment history).

• 2025 amendments: Justice and Community Safety Legislation Amendment Act 2025 (No 2) A2025-3 and Better Regulation Legislation Amendment Act 2025 A2025-13 are recorded in the legislation history. A2025-3 amdt 1.8 and amdt 1.9 affected Part 7 (offences) and s 49 respectively. A2025-13 (pt 9, s 23) also made amendments to s 49 and removed or altered advisory committee provisions. The Better Regulation amendment included a commencement on 26 November 2025 for pt 9, indicating relatively recent statutory change (legislation history entries).

Consequences of the amendment history

• The amendment history documents a deliberate statutory evolution away from a sector-specific licensing scheme towards a lighter-touch, offences-focused framework that relies on ACL cross-reference and fair trading investigative machinery. The widespread “omitted” entries in the amendment history make clear that many licensing, regulation and disciplinary powers that used to be in this Act no longer appear in the republished text.

• The repeal and omission pattern suggests a policy trajectory oriented to deregulation or consolidation of licensing into other legislative instruments, though the republished Act itself does not state policy rationales beyond the amendments. The history also shows continued legislative housekeeping and alignment with the Australian Consumer Law and broader fair trading statutory architecture.

Practical reading of the amendment history

• When advising clients, practitioners must treat earlier versions of the Act with care. The amendment history indicates that transitional provisions existed (for example Pt 10 with expiries), and some transitional provisions have expired (amendment history notes “exp 7 October 2011” for various transitional items). The endnotes to the republication include detailed edition and republication dates to help locate the historical text pre-amendment, which is necessary if reviewing past compliance or disciplinary history that arose under earlier versions.

• The amendment history entries show precise amending instruments, dates of notification, and commencement dates for different parts. Because many provisions referenced in older commentary or guidance may no longer be in force, practitioners must check the point-in-time version of the Act relevant to the factual circumstances they are advising on.

In short, the Act’s amendment history is essential for understanding present-day coverage: numerous licensing and regulatory provisions were removed mainly by A2016-46 and later instruments, and s 49 has been updated over time by specific amending Acts, including in 2010 and 2025. The amendment history provides the route to identify what remains operative and how the statutory design has shifted.

The republished text of the Fair Trading (Motor Vehicle Repair Industry) Act 2010 as provided here does not include reported case law, judicial interpretation or a litigation history section. The Act itself names no cases. The endnotes and amendment history record legislative changes, but do not catalogue judicial determinations.

Practical implications for litigation research

• Because the Act is an offences-focused statute that cross-references the Criminal Code and the Australian Consumer Law (ACT), litigation and prosecutorial outcomes that will bear on interpretation may arise under those broader statutes. For example, interpretation of “false or misleading” representations and of definitional terms such as “trade or commerce”, “goods”, and “services” may be informed by decisions under the Australian Consumer Law and trade practices jurisprudence, although specific case law that applies the ACT s 49 may be sparse or absent in the republication text.

• Investigations under the Fair Trading (Australian Consumer Law) Act 1992, div 5.2 are likely to generate administrative records and possibly court proceedings if the commissioner pursues prosecution or refers matters to the Director of Public Prosecutions. The note to Part 7 indicates that enforcement activity will commonly flow through those mechanisms.

• The absence of an in-text litigation history requires practitioners to search case law databases and tribunal decisions (for example ACAT and ACT courts) for decisions that reference the Act, s 49 specifically, or which apply the ACL and Criminal Code principles to motor vehicle repair industry disputes. The republished Act and endnotes do not provide that search result.

Points to consider when researching litigation history

• Check for decisions that interpret the phrase “in connection with the supply or possible supply” and “promotion by any means” in s 49(1), as these phrases determine the offence’s temporal and causal reach. Similar phrases in the ACL and trade practices law have been litigated and that jurisprudence may inform interpretation.

• Investigate whether the commissioner has exercised investigatory or enforcement powers under the Fair Trading (Australian Consumer Law) Act 1992 in matters that cite s 49, and whether prosecutions were laid. Administrative decisions, enforceable undertakings and prosecutorial outcomes may indicate enforcement priorities.

• Search both criminal and civil databases. Offending conduct may give rise to both criminal prosecutions under this Act and civil enforcement under the ACL and other consumer protection laws, so litigation history relevant to this sector is likely to be spread across jurisdictions and statutory regimes.

Because the Act does not itself present a litigation digest, practitioners must undertake external legal research to assemble a litigation history relevant to s 49 and its application to motor vehicle repair industry conduct.

The Act’s brevity and cross-referential structure create several practical pitfalls for businesses, advisers and enforcement officials. The following are concrete points to watch for, grounded in the Act’s text.

Broad temporal and causal reach of the offence

• The offence applies to representations made “in connection with the supply or possible supply of goods or services” and “in connection with the promotion by any means” of such goods or services (s 49(1)). That wording means liability can arise at the advertising and pre-contractual stages, not only after a contract is formed. Practitioners should note that speculative offers, promotional claims, and online listings may attract the same scrutiny as invoices or post-sale statements.

Wide substantive categories of prohibited representations

• Section 49(1) lists many distinct classes of representation. Some are factual (for example origin, newness, availability of parts), while others are evaluative (quality, standard). The statute makes no distinction between claims made negligently and claims made intentionally; both could attract criminal enforcement subject to the Criminal Code mens rea rules. The inclusion of “need for any goods or services” (s 49(1)(j)) is notable: asserting that a particular replacement part or repair is necessary when it is not may be an offence.

Country of origin technical compliance

• Section 49(2) provides that a person does not contravene s 49(1)(i) if they comply with the Australian Consumer Law (ACT), part 5-3 (Country of origin representations). This is a narrow statutory safety valve, but it imposes a compliance requirement with the ACL regime; businesses cannot rely on a blanket exception for origin claims. Practitioners must align origin statements with ACL standards (labels, substantiation, evidentiary basis).

Subjective standard in equipment, materials and skill representation

• Section 49(1)(l) prohibits making a representation that services “have been or are to be performed with the equipment, materials and skill necessary to carry out the work satisfactorily, having regard to the age and make of the vehicle, part or system” when that representation is false or misleading. The reference to “having regard to the age and make” introduces a contextual test that requires factual assessment of competence and resources relative to the vehicle’s condition. That opens questions about how to demonstrate adequacy of equipment or skill; record-keeping and demonstrable qualifications will be important.

Status-based exclusions do not equate to immunity

• Section 7 establishes that employees, partnership members and third-party publishers acting on behalf of a business are not, by that fact alone, taken to carry on business as a motor vehicle repairer. That status-based exclusion affects the characterisation of “carrying on business” but does not automatically immunise those persons from s 49 liability if they themselves make representations in trade or commerce. For example, an employee making a false promotional claim on social media could still be the person who “makes” the representation for s 49 purposes.

Regulatory exemptions can create uneven obligations

• Section 53 allows regulations to exempt “a person from all or any of the provisions of this Act.” Practically, this means the Executive can provide selective exemptions. The availability of exemptions makes it important to monitor subordinate legislation closely; compliance obligations can be altered by regulation without amendment to the principal Act. Practitioners must check current regulations to understand whether their clients are exempt.

Reliance on other statutes for definitions

• The Act imports key definitions from the Australian Consumer Law and a definition of “motor vehicle” from the Sale of Motor Vehicles Act 1977 (dictionary; s 49(4)). This creates the need for cross-statutory compliance analysis. For instance, whether something is a “motor vehicle” under the Sale Act affects whether the conduct falls within the repair-work definition, and whether conduct is “in trade or commerce” will be judged by ACL jurisprudence.

Absence of licensing machinery in the current text

• Much of the licensing and occupational discipline content has been omitted by amendment (see amendment history). Where earlier versions of the Act contained licence conditions and administrative enforcement measures, those tools are not present in the republished text. That means regulatory oversight for repairers in the ACT, insofar as this Act is concerned, is concentrated in the representations offence and in ACL/fair trading enforcement mechanisms rather than a statutory licensing regime within this Act.

Evidence and mens rea considerations under the Criminal Code

• Because the Criminal Code applies (s 5), prosecutions will have to satisfy criminal proof requirements. That may create evidentiary challenges for prosecutors seeking to prove the falsity of representations or the requisite mental element. Conversely, businesses and advisers should be aware that criminal exposure exists and prepare to show contemporaneous records, substantiation and reasonable grounds for claims as part of a defence strategy.

Potential overlap with other liability regimes

• Conduct that violates s 49 could also trigger civil or administrative liabilities under the ACL, separate regulatory contraventions, contractual claims or consumer compensation obligations. Parties should not assume prosecution under s 49 is the sole legal consequence.

In short, the Act’s broad wording, interaction with the ACL, the subjective factors embedded in some prohibitions, the regulatory exemption power and the omission of licensing mechanisms make precision in advertising, record-keeping and compliance procedures crucial for businesses operating in the motor vehicle repair sector.

This section sets out practical, source-grounded steps a repair workshop, parts supplier, advertiser or adviser should take to reduce risk of contravening s 49, together with the statutory bases for each step.

1. Audit all representations relating to motor vehicle repair services and parts

• Why: s 49(1) covers representations about quality, standard, price, origin, availability, sponsorship, need, warranties and the capability to perform repairs with necessary equipment and skill.
• What to do: compile all advertising materials, website copy, social media posts, quotes, estimate forms, invoices, signage and dealer listings. Map each statement to the s 49 categories and identify any claims that are factual (for example “new part”, “Australian-made”) or evaluative (for example “best”, “guaranteed to last”).
• Evidence: retain the contemporaneous materials and version histories. If a representation is comparative or evaluative, ensure supporting evidence exists (test results, supplier documentation, manufacturer statements).

2. Ensure country of origin claims comply with the ACL

• Why: s 49(2) carves out liability for origin claims if the person complies with the Australian Consumer Law (ACT), part 5-3.
• What to do: verify the provenance of parts and components, obtain supplier declarations or traceable supply chain documentation, and apply ACL-part 5-3 labelling and substantiation requirements where necessary. Apply statutory criteria for claims such as “Made in Australia”.
• Evidence: keep supplier invoices, bills of lading, certificates of origin and test reports that substantiate origin claims.

3. Be precise about newness and replaced parts

• Why: s 49(1)(c) prohibits falsely representing goods as new; s 49(1)(h) and (l) touch on availability of spare parts and adequacy of equipment and skill.
• What to do: label refurbished or reconditioned parts as such, avoid statements that could be read as “new” if not; document the source and status of replaced parts; maintain stock records for spare parts availability claims; where a repair requires specialist tools or parts, accurately describe lead times and availability.
• Evidence: maintain parts ledger, supplier communications and customer authorisations for non-original or reconditioned parts.

4. Avoid asserting necessity of repairs without medical-style diagnosis

• Why: s 49(1)(j) prohibits making false or misleading representations about the need for goods or services.
• What to do: ensure diagnostic procedures and inspection reports document the factual basis for recommending a repair or replacement. Provide quotes and written advice explaining defects, risk, and alternatives.
• Evidence: keep inspection checklists, diagnostic logs, photographs showing wear/damage and dated reports signed by the customer.

5. Substantiate claims of sponsorship, approval or affiliation

• Why: s 49(1)(e)-(f) prohibit claims of sponsorships or affiliations the person does not have.
• What to do: only use logos, endorsements or brand-affiliation statements where written permission or a valid licence exists. Avoid implying manufacturer certification or warranties unless formally granted.
• Evidence: retain written licences, approval letters, and brand-use agreements.

6. Make price statements carefully

• Why: s 49(1)(g) covers false or misleading representations about price.
• What to do: ensure advertised prices include clearly stated conditions (for example, “parts and labour”, “subject to inspection”), state expiry dates for offers, and avoid hidden fees. Where a price estimate is conditional, label it clearly as an estimate and explain what conditions may change the price.
• Evidence: keep price lists, terms and conditions, and records of customer communications about price adjustments.

7. Demonstrate equipment, materials and skill are appropriate

• Why: s 49(1)(l) requires that representations about performance be accurate “having regard to the age and make of the vehicle.”
• What to do: maintain records of staff qualifications, technical certifications, equipment inventories and service manuals. Be cautious about blanket claims that all work will be performed to a high standard if some jobs require specialist tooling or parts not routinely available.
• Evidence: staff CVs, trade certificates, training records, equipment calibration logs, and supplier support documents.

8. Train front-line staff and contractors

• Why: promotional statements may be made by staff or third-party publishers; although s 7 provides some status exclusions, representations made in trade or commerce can attract liability.
• What to do: implement training on permissible advertising language, price quoting procedures, and documentation of customer authorisations. Provide scripts and templates for quotes and social-media posts, and review third-party listing content before publication.
• Evidence: training logs, signed staff policies, and documented approval processes for external publishers.

9. Maintain written customer agreements and informed-consent processes

• Why: s 49(1)(d) prohibits falsely representing that a particular person has agreed to acquire goods or services.
• What to do: obtain signed estimates or written authorisations before carrying out additional work beyond the agreed scope. Where additional work is necessary, communicate in writing and seek express customer consent.
• Evidence: signed work authorisations, variation forms, and records of telephone authorisations recorded and time-stamped.

10. Monitor regulations for exemptions and changes

• Why: s 53 allows regulations to exempt persons and s 57 allows the Executive to make regulations that may materially change coverage.
• What to do: subscribe to ACT legislation updates and regulatory notices to detect new exemptions or regulatory requirements. If an exemption or regulatory change is sought, consider stakeholder engagement with the regulator.
• Evidence: print and securely store the relevant regulation texts and registration notices as they take effect.

11. Prepare a response plan for investigations or prosecutions

• Why: enforcement is criminal, the Criminal Code applies and the commissioner may investigate under the Fair Trading (Australian Consumer Law) Act 1992.
• What to do: retain all contemporaneous records relating to the matter under investigation, stop any potentially offending communications, engage legal counsel experienced in criminal and consumer law, and cooperate with lawful investigatory demands subject to legal advice.
• Evidence: create an internal incident log, preserve electronic records, and document steps taken to remediate any misrepresentation.

12. Consider insurance, indemnities and dispute handling

• Why: civil claims under the ACL or contractual disputes may arise alongside criminal exposure.
• What to do: review professional indemnity and business insurance policies for coverage of representations-related exposures, and establish a formal customer-complaint handling and remediation process.
• Evidence: insurance policies, claims correspondence, and documented complaint-resolution steps.

13. Use conservative language where substantiation is incomplete

• Why: evaluative claims without evidence can be treated as misleading.
• What to do: qualify statements appropriately, use words like “may” or “typically”, and avoid definitive superlatives unless supported by data. Ensure any disclaimers are not contradictory or misleading in effect.

14. Document technical decisions where work is advisory

• Why: the dictionary includes “giving advice” within motor vehicle repair work, so advisory statements are within s 49.
• What to do: keep written advisory memos with the basis of the advice, including tests, measurements, and technical references.

These compliance steps flow directly from the Act’s text. They focus on avoiding the specific categories of prohibited representation (s 49(1)), complying with the ACL for country of origin claims (s 49(2)), maintaining records and substantiation for claims that implicate skill, equipment, parts availability and price, and monitoring regulations and investigatory processes referenced elsewhere in the statute. Implementation attention should be given to record retention, staff training, supplier evidence, and legal preparedness for investigatory processes under the Fair Trading (Australian Consumer Law) Act 1992.
