#### 15 Secretary must decide effective claim (1) If an effective claim that a person is eligible for an advance is made to the Secretary, the Secretary must decide whether the person is eligible for the advance. (2) If it is decided that a person is eligible for an advance, the Secretary must decide the amount of the advance in accordance with Part 3. > Note 1: Subsection (2) applies whether the decision that a person is eligible for an advance is made under subsection (1) or on review under Part 6. > Note 2: Division 1 of Part 6 contains provisions relevant to making and notifying decisions on eligibility for an advance and the amount of an advance.
