What it does
This instrument, titled the Southern and Eastern Scalefish and Shark Fishery (Total Allowable Catch for Quota Species) Determination 2026, sets fishery-level total allowable catches (TACs) for specified quota species for the 2026-27 fishing year. The instrument is made by the Australian Fisheries Management Authority (AFMA) and is dated 11 March 2026 (the instrument pageheadings identify AFMA and list the Chair and Commissioners). It comes into force the day after registration on the Federal Register of Legislation (s 2) and ceases on 1 May 2027 (s 3). The legal authority for the instrument is expressed as subsection 11(1) of the Management Plan for the purpose of paragraph 17(6)(aa) of the Act (s 4). The Management Plan referred to is the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003; the Act is the Fisheries Management Act 1991 (s 5(1)).
Mechanically, the instrument does two things. First, section 6 applies to the 2026-27 fishing year and determines a single TAC for each species listed in the table in that section for the whole fishery, together with the basis on which catch for each species must be prepared or measured (Column 3). The species list in section 6 includes, for example, blue grenadier (14 650 tonnes, whole weight), pink ling (1 539 tonnes, whole weight), gummy shark (1 595 tonnes, trunked weight), and others (s 6(1)-(2) and the table). Second, section 7 applies to the same 2026-27 year and determines TACs for certain species in specified part or parts (zones) of the fishery, again with preparation/measurement bases (s 7(1)-(2) and the table). For example, orange roughy is allocated tonnages by zone (orange roughy eastern zone 1 163 tonnes, whole weight), and gemfish and deepwater shark eastern and western zones have separate TACs in that section.
Preparation or measurement conventions are specified alongside each TAC (Column 3 in s 6 table; Column 4 in s 7 table). Those conventions include whole weight, trunked weight, and a specific entry for elephant fish where the preparation is "Trunked, belly flaps removed" (s 6 table). The instrument therefore does not merely set numeric limits, it also prescribes the form in which catch is to be prepared for the purpose of accounting against those limits.
