What it does
This instrument, titled the Southern and Eastern Scalefish and Shark Fishery (Total Allowable Catch for Quota Species) Determination 2025, fixes aggregate catch limits for specified quota species in the Southern and Eastern Scalefish and Shark Fishery for the 2025-26 fishing year. The authority for the instrument is recorded at section 4: it is made by the Australian Fisheries Management Authority (AFMA) under subsection 11(1) of the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 (the Management Plan), for the purpose of paragraph 17(6)(aa) of the Fisheries Management Act 1991 (the Act). The instrument is dated 12 March 2025 (cover page) and is to commence on the day after registration on the Federal Register of Legislation (s 2). It ceases on 1 May 2026 (s 3).
Mechanically, the instrument performs two distinct determinations for the 2025-26 fishing year. Section 6 determines total allowable catch (TAC) for species across the whole fishery, listing 23 species with a TAC in tonnes and specifying the basis of weight or preparation to be used (s 6(1)-(2); whole-fishery table). Section 7 determines TACs for certain species within parts of the area of the fishery (zones), listing 11 items that allocate catch limits by zone and state the preparation basis for weighing (s 7(1)-(2); parts-of-area table). The instrument therefore sets aggregate quantity limits expressed in tonnes, and it specifies the preparation basis (for example, whole weight, trunked weight, or trunked with belly flaps removed) that must be used as the basis for those tonnes (s 6(2) table; s 7(2) table).
The instrument does not itself define the administrative processes for allocating the aggregate TAC among licence or quota holders, nor does it include enforcement provisions, penalties or reporting procedures. Its legal effect as a determination is founded on the Management Plan and the Act (s 4), and it operates for a bounded period covering the 2025-26 fishing year (s 6(1); s 7(1)).
