What it does
This instrument, the Telecommunications (Section of the Telecommunications Industry - Portability Service Suppliers) Determination 2025, formally identifies a class of market participants as a section of the telecommunications industry for the purposes of Part 6 of the Telecommunications Act 1997. It does four mechanical things.
First, it declares its name and commencement: the determination takes effect at the start of the day after it is registered on the Federal Register of Legislation (see ss 1 and 2). Second, it states the legal basis for the instrument, namely that it is made under subsection 110(3) of the Telecommunications Act 1997 (see s 3). Third, it repeals the earlier 2015 determination that served the same purpose (see s 4). Fourth, it defines the scope of the designated section. The instrument sets out the test for capture: persons who are carrying on a telecommunications activity as defined in section 109 of the Act, and who are providing "portability services", fall within the section of the telecommunications industry identified as "Portability Service Suppliers" (see s 7(2) and s 8).
The determination supplies a working definition of "number portability", and a three-part definition of "portability services" that expressly includes port administration services, ported number register database maintenance or provision, and the provision of network information services or intelligent network database services for call routing (see s 5). It also directs readers to the Telecommunications Numbering Plan 2025 for detailed rules on number portability (s 5 note).
This instrument does not itself prescribe operational requirements, fees, civil or criminal penalties, or procedural obligations. Its operative effect is classificatory: it places named activities and actors within the statutory concept of a section of industry under Part 6 of the Act. The Act, and instruments and rules made under it, will determine what regulatory consequences follow from that classification. The determination clarifies that references to other instruments are to their versions in force from time to time (see s 6), and it adopts the meanings of core terms from the Act where indicated (see s 5 note).
