Greenhouse and Energy Minimum Standards (Incandescent Lamps for General Lighting Services) Determination 2024

The Determination is structured around a small set of core regulatory concepts: product classes, GEMS level requirements (energy performance), GEMS labelling requirements, testing regimes, families of models and transitional/registration effects. Each is defined and operationalised in the text.

Product classes: Section 13 defines two distinct classes by rated voltage and permitted cap types, linking cap definitions to IEC 60061‑1 and shape/outline standards where relevant. Product class 1 covers lamps with rated voltage >140 V, listing caps including common mains caps such as E26/E27 and various bayonet and GU10/GZ10 types. Product class 2 covers low‑voltage lamps rated ≥11 V and ≤13 V with a small set of capsule/pin caps (for example G4, GU5.3). The instrument narrowly confines its scope to these classes and delegates other exclusions to Schedule 2 (see section 14 and Schedule 2).

GEMS level requirements: Section 16 prescribes the initial efficacy requirement for each class using explicit mathematical formulas that depend on the mean measured initial luminous flux, L (lumens). For product class 1 the requirement is efficacy ≥ 1/(0.24/√L + 0.0103) (see section 16(1)); for product class 2 the requirement is efficacy ≥ 2.8 ln(L) − 4.0 (section 16(2)). Those formulas operationalise the concept of a minimum energy performance threshold tied to the lamp’s luminous flux.

Testing and labelling: Sections 17 and 20 require that testing for both energy‑efficiency and labelling be conducted in accordance with section 2 of AS/NZS 4934.1:2014. Test reports must show conformity to AS 4934.2:2021 and include the Appendix A information from that standard (section 17(2)). Section 19 mandates specific labelling declarations and precise numerical relationships to measured values: luminous flux rated value may not exceed mean measured initial value × 1.1 (rounded to nearest 10 lumens); power must lie between mean×0.9 (rounded to nearest watt) and mean×1.1; median lamp life marked value must not exceed measured median × 1.1 (rounded to nearest 100 hours). These are binding packaging requirements (section 19).

Families and registration: Section 8 defines when two or more models may be treated as a family of models for registration purposes under section 28 of the Act. Requirements include same brand, same product class, reliance on the same test report, and congruent physical and performance characteristics (section 8(2)). A family may contain no more than eight models (section 8(4)). Schedule 1 identifies models whose registrations are affected by this Determination (section 11 and Schedule 1).

Other technical limits: Section 23 sets additional performance parameters: lumen maintenance factor must be at least 80% when measured at 75% of rated median lamp life (section 23(1)); minimum median lamp life is 2000 hours (section 23(2)); product class 2 must also meet maximum wattage requirements in clause 2.6 of AS 4934.2:2021 (section 23(3)). Sample sizes for these tests are specified (section 24(3)).

Exclusions and evidence requests: Schedule 2 excludes aeronautical lamps and aeronautical ground lights that meet specified aviation/delivery standards, and it permits the GEMS Regulator to request evidence of compliance for those exclusions (Schedule 2 notes). Other exclusions (high temperature, infrared heat lamps and low power decorative lamps) are defined precisely, including chromaticity/CCT boundaries for infrared heat lamps (Schedule 2).

Transitional arrangements: The Determination contains a limited grandfathering period for product classes 1 and 2 (five years) (section 10) and provides that labelling conformity may be recognised if a replacement Determination contains transitional labelling provisions (section 21). It also sets out that registrations listed in Schedule 1 are affected by the instrument (section 11), with a statutory note that affected registrations will cease to be in force (section 11 Note 2 referencing section 48 of the Act).

Standards by reference and copyright: Section 6 lists the external standards relied upon and makes those references effective as at the date the instrument was made (section 6(2)). The instrument includes a copyright and licensing statement that the Determination (excluding certain third‑party standards material) is licensed under CC BY‑NC‑SA 4.0, while the AS/IEC/CIE standards themselves remain subject to third‑party rights and purchase requirements.

Manufacturers and suppliers of incandescent lamps for general lighting services: The Determination directly affects manufacturers, importers and distributors that supply incandescent lamps in product class 1 (mains voltage >140 V, listed caps) and product class 2 (11-13 V, listed caps). Those actors must ensure products meet the efficacy formulas in section 16, pass the required tests in AS/NZS 4934.1:2014 (section 17), and have the specified packaging labelling (section 19). Affected actors also bear the cost of testing (sample size minimums: efficacy 10, lumen maintenance 10, median lamp life 20, see sections 17(4) and 24(3)), preparation of test reports meeting AS 4934.2:2021 Appendix A (section 17(2)), and potential re‑labelling and re‑registration work.

Retailers and suppliers: Retailers that import, distribute or sell covered incandescent lamps will be required to ensure that packaging meets labelling requirements (section 19). Where a product registration is affected by this Determination (Schedule 1), retailers and suppliers may need to review inventory and registration status because affected registrations cease as set out in section 11 and its notes.

Small manufacturers, private labellers and re‑branders: The Determination ties families of models to a single brand and imposes a limit of eight models per family (section 8). Small brands or re‑labellers relying on family registrations must ensure the grouping rules are met (section 8(2)) and that the single test report covers the lowest‑efficacy model when relying on one report for multiple models (note under section 8). This raises compliance choices for brands that previously registered larger ranges under a single registration.

Owners of excluded lamps and specialised purchasers: The Determination explicitly excludes aeronautical lamps and aeronautical ground lights that meet aviation airworthiness standards (Schedule 2, paragraph 1) and other special classes such as high temperature, infrared heat and low power decorative lamps (Schedule 2, paragraph 2). Operators that purchase or supply lamps for aviation, defence‑related aerodrome lighting, ovens, heat lamps or decorative low‑power lamps should treat these exclusions as safe harbours, provided they can document the qualifying attributes. The GEMS Regulator may request evidence of compliance with the exclusion criteria (Schedule 2 notes), so purchasers and suppliers must be ready to produce certificates or test reports.

Test laboratories and certification bodies: The Determination makes extensive use of specific Australian/New Zealand and international standards as the basis for testing (section 6 and sections 17, 20 and 24). Accredited test laboratories that can produce reports in conformity with AS/NZS 4934.1:2014 and AS 4934.2:2021 will be key service providers. The instrument’s sample sizes and ageing protocols (for example, 100 ±1 h initial ageing in section 17(3)) define testing workflows and capacity needs.

Consumers and procurement officers: The measure will affect the range and labelling of incandescent lamps available in the market. Packaging must state luminous flux, power and median life in specified ways (section 19). Procurement officers and specifiers must be aware that some products are excluded (Schedule 2), and that product claims must be supported by test reports (section 17(2)).

GEMS Regulator and enforcement agencies: The Determination creates duties that the Regulator is expected to administer, including registration effects (section 11), family registrations (section 8) and requests for evidence for excluded products (Schedule 2 notes). Operationally, the Regulator will decide whether supplied test reports and labelling meet the prescribed standards and may act under the powers of the Act referenced throughout (see sections 3, 8 and Schedule 2 notes).

Other government agencies: Aviation and defence regulators are implicated where aviation standards and DASA instruments are relied on to exclude particular lamps from the Determination (Schedule 2, paragraph 1). Procurement rules for government buyers may need to reference the Determination when specifying allowed lamp types.

Who pays: The immediate direct costs fall on lamp manufacturers, importers and suppliers, who must fund testing to the specified standards, prepare compliant labelling and manage registrations. Indirectly, consumers may experience price and availability effects if manufacturers withdraw non‑compliant incandescent models or reformulate product offerings.

Duties to meet GEMS level (energy) requirements: For each covered model, the manufacturer/importer must ensure the lamp meets the initial efficacy requirement applicable to its product class, as set out in section 16. Compliance requires calculation of mean measured initial luminous flux (L) from tests conducted per AS/NZS 4934.1:2014 (section 17(1)) and verifying efficacy meets the formula in section 16(1) (product class 1) or section 16(2) (product class 2).

Testing and test‑report duties: The Determination requires tests to be conducted in accordance with section 2 of AS/NZS 4934.1:2014 in order to determine compliance with energy and labelling requirements (sections 17(1), 20). Test reports must demonstrate conformance to AS 4934.2:2021 and include Appendix A information (section 17(2)). Specified ageing durations apply: initial ageing is 100 ±1 hours unless the manufacturer specifies a lesser duration, and lamps failing before 100 h must be replaced and not included in means (section 17(3)). For lumen maintenance tests, lamps failing prior to 75% of rated median lamp life must not be included in the mean (section 24(2)). Minimum sample sizes are mandated (section 17(4) and section 24(3)).

Labelling duties: Manufacturers and suppliers must include on packaging the light output in lumens, with the rated value not exceeding mean measured initial value × 1.1 and rounded to nearest 10 lumens; the power in watts, rated value between mean×0.9 and mean×1.1 with rounding to nearest watt; and the median lamp life marker not exceeding median measured value × 1.1 rounded to nearest 100 hours (section 19). The duty is to ensure packaging statements are within those numerical bounds.

Family registration duties and limits: To register a family under section 28 of the Act, the models must meet the family criteria in section 8(2), including same brand, same product class, reliance on the same test report, and identical attributes that affect performance (dimensions, wattage, median life, lumen maintenance). Registration holders must observe the family maximum of eight models (section 8(4)). When using a single test report for family members with differing efficacies, the report must show results for the lowest‑efficacy model to confirm compliance for all members (note to section 8).

Transitional and registration obligations: Section 10 establishes a five‑year limited grandfathering period for product classes 1 and 2. Section 11 notifies that particular model registrations listed in Schedule 1 are affected and that affected registrations against the 2016 Determination cease to be in force (see section 11 and its notes). Registration holders must therefore track the status of their registrations and act to re‑register models where needed under this Determination or rely on grandfathering rules within the five‑year window.

Documentation and evidentiary duties for exclusions: Suppliers of excluded aeronautical or aerodrome lamps must be prepared to produce evidence that the lamps meet the specified aviation airworthiness standards or DASA requirements, because the GEMS Regulator may request evidence (Schedule 2 notes). The duty is to be able to demonstrate that the lamp qualifies for the exclusion.

Rights and administrative hooks: While the Determination imposes duties, it also creates administrative arrangements beneficial to regulated parties: families of models allow single test reports to cover multiple models where properly justified (section 8). The Determination permits transitional labelling conformity in the event of future replacement determinations (section 21), giving potential continuity if the Regulator designs compatible transitional arrangements.

Scope‑limitation rights: Suppliers have the right to supply products not covered by the instrument, for example low power decorative lamps under the definitions in Schedule 2, or fully compliant aeronautical lamps (Schedule 2(1)), subject to evidentiary duties if the Regulator asks for proof. The Determination’s precise definitions of excluded types create legal clarity on what remains outside the instrument.

Regulator discretion: The Determination authorises the GEMS Regulator to request evidence for excluded products and to administer registration effects (Schedule 2 notes; section 11). Those are administrative rights the Regulator has under the GEMS Act framework as invoked by this instrument (see section 3).

Limits on reliance: The Determination does not itself alter penalties or enforcement powers found in the Act; those remain in the Act (the Determination cites sections of the Act but does not set out offence provisions). Parties must therefore consult the Act for sanctioning mechanisms (see section 3 noting the Act as the enabling statute).

The Determination does not itself create named criminal offences or monetary penalty provisions within its text; it is made under the powers of the Greenhouse and Energy Minimum Standards Act 2012 (see section 3) and therefore operates within the enforcement architecture of that Act. The Determination prescribes substantive technical requirements and administrative processes , compliance with those technical and labelling requirements will be enforced by reference to the powers and penalties provided in the Act and associated regulations, not by provisions within this Determination.

The instrument contains several mechanisms that enable regulator‑led enforcement activity. It identifies models whose registrations are affected (section 11 and Schedule 1), which triggers the statutory effect that the earlier registration ceases to be in force (section 11 note referencing section 48 of the Act). The Determination allows the GEMS Regulator to request evidence in relation to excluded aeronautical and aerodrome lamps (Schedule 2 notes), which is an administrative enforcement lever: the Regulator can require producers to demonstrate eligibility for an exclusion.

Operational compliance checks will rely heavily on test reports prepared under AS/NZS 4934.1:2014 and AS 4934.2:2021 (sections 17 and 20). The Determination specifies precise testing regimes, sample sizes and ageing instructions (for example, initial ageing of 100 ±1 hours in section 17(3); minimum sample sizes in sections 17(4) and 24(3)). Those prescriptions give enforcement agencies concrete, objective benchmarks against which to assess conformity. Non‑compliance with labelling duties (section 19) or failure to produce required test documentation on request will leave a regulated party exposed to corrective action under the Act.

Because the Determination references the Act for legal authority, the enforcement powers, penalty scales, injunctions or orders will be those contained in the Act and subordinate instruments. The Determination’s own textual notes make clear that revocation and replacement of previous determinations have immediate registration effects (section 5 note referencing subsection 35(2) of the Act), which can be enforced administratively. For affected registrations (Schedule 1), the statutory note indicates the registration against the 2016 Determination will cease to be in force , a compliance consequence that can be policed by the Regulator (section 11 and its notes).

The instrument contemplates the GEMS Regulator exercising discretion in assessing exclusion claims and registration status. That discretion creates implementation risk for suppliers who rely on an exclusion without robust documentary proof; the Regulator’s request for evidence could trigger remedial enforcement if proof is absent (Schedule 2 notes).

The Determination also embeds standards by reference (section 6 and section 6(2)). Because laboratories must use the specified standards for testing, enforcement will depend on the availability and integrity of accredited testing facilities and on the content of those standards. The Determination does not itself address enforcement timetables, audit protocols or compliance cost recovery; those procedural elements remain within the regulatory apparatus of the GEMS Regulator and the enabling Act.

The Determination is made under and therefore operates within the framework of the Greenhouse and Energy Minimum Standards Act 2012 (section 3). It references multiple specific provisions of the Act by functional role: the Determination implements product coverage under subsection 23(1) and (2) (see section 12), sets GEMS level requirements under paragraph 24(1)(a) and labelling requirements under paragraph 24(1)(b) (sections 15 and 18 refer to those Act provisions), and uses section 28 (families of models) and section 29 (product category) of the Act to define registration and category matters (section 8 and section 9). Transitional and revocation mechanics reference section 35 (section 5) and sections 36 and 48 are cited in the notes about registration effects (section 11 notes). Practically, any enforcement or dispute will be resolved against the Act’s provisions and processes.

Aviation and defence safety laws intersect at the margins via Schedule 2 exclusions. Lamps designed for aircraft operation are excluded provided they satisfy the Civil Aviation Safety Regulations airworthiness standards or the Airworthiness Design Requirements Manual (Schedule 2(1)). Aeronautical ground lights are excluded if they meet Part 139 (Aerodromes) Manual of Standards or DASR 139 (Schedule 2(1)-(2)). Those references mean that compliance with aviation safety law may be used to avoid coverage under the GEMS Determination, and that the GEMS Regulator may need to consult aviation regulators or be satisfied with evidence of compliance with those other instruments.

Intellectual property and standards procurement laws: Section 6 incorporates Australian/New Zealand Standards, IEC and CIE standards by reference, but notes that the complete texts are available for purchase from Standards Australia Ltd or the relevant standards bodies. The Determination also states its own licensing under CC BY‑NC‑SA 4.0 for the content that is not subject to third‑party rights. Practically, regulated parties must buy or access third‑party standards to understand the precise test methods, and their access will be limited by the copyright and licensing terms of those standards providers.

Product safety and consumer law overlap: The Determination’s labelling duties (section 19) and test report requirements create obligations that supplement other consumer protection obligations under separate statutes (for example, Australian Consumer Law), although the Determination does not explicitly reference consumer law. Manufacturers and suppliers must therefore ensure they meet both the GEMS technical and labelling requirements and unrelated obligations under consumer guarantees and product safety regimes.

Regulatory coherence and statutory hierarchy: The Determination revokes the 2016 Determination (section 5 and Schedule 3). It permits continuity via transitional labelling recognition if a replacement Determination includes compatible transitional provisions (section 21). This shows the Determination is intended to sit within an evolving suite of GEMS determinative instruments under the Act, with future instruments able to create transitional arrangements affecting compliance.

Administrative law and judicial review: Because the GEMS Regulator will exercise discretion (for example, in requesting evidence for exclusions or deciding registration effects), regulated parties retain the usual administrative law rights to seek review of unlawful administrative decisions under relevant judicial review principles. However, the Determination does not itself set out appeal rights or procedures; those procedures are contained in the Act or general administrative law.

This Determination explicitly revokes and replaces the earlier Greenhouse and Energy Minimum Standards (Incandescent Lamps for General Lighting Services) Determination 2016 (section 5 and Schedule 3). Schedule 3 operates to repeal the entire 2016 instrument (Schedule 3, item 1). The Determination’s commencement clause (section 2) sets the effective date relative to registration: the whole instrument commences the day after the end of the 12‑month period from registration, meaning there is a statutory lead time between registration and legal effect for this instrument.

References to standards are fixed to their versions "as in force or existing on the day this instrument is made" (section 6(2)). That makes the Determination’s test methods and references current as of the making date; later editions of those standards are not automatically incorporated. This means an amendment to a referenced AS, IEC or CIE text would not take effect for the purposes of this Determination unless the Determination itself is amended or replaced, or the instrument otherwise adopts a different incorporation approach.

The Determination contains specific transition provisions: limited grandfathering is provided for product classes 1 and 2, ending at the end of five years from commencement (section 10). Section 21 contemplates that if this Determination is revoked and replaced, a replacement Determination may include transitional labelling provisions that, if complied with, will be taken to satisfy the revoked labelling requirements. That creates a mechanism for future instruments to soften immediate disruption.

There is no further amendment history contained within the text provided. The instrument’s own metadata (copyright notice) and the list of standards used show the point‑in‑time legal references. Any subsequent legislative or administrative amendments would be recorded by publishing an amending instrument or new Determination and would be shown in the Commonwealth’s legislation registers. Practitioners should therefore monitor the GEMS Regulator registers and the legislation.gov.au record for any later variations or successor determinations.

For practical planning, the Determination’s reliance on external standards and the five‑year grandfathering window create a deterministic timetable for industry action: manufacturers have the stated lead time before commencement and up to five years for grandfathered stocks, after which models must meet the new rules (sections 2 and 10). Schedule 1 identifies current registrations affected by the instrument and those particular registrations will cease to be in force as described in section 11 and its notes, which is an immediate administrative effect once the instrument commences and the replacement mechanism operates.

The Determination text contains no citations to cases, dispute outcomes or judicial interpretations. It does not record any litigation that has tested its provisions. The instrument relies on the Greenhouse and Energy Minimum Standards Act 2012 for legal authority (section 3) and uses established Australian/New Zealand and international standards for technical testing (section 6). Any legal disputes concerning interpretation, enforcement, registration decisions, or the validity of the Determination would therefore be litigated under the Act and general administrative law principles and would be recorded in external case law, but that material is not present in the Determination itself.

Because the Determination introduces precise technical and administrative rules (for example, the mathematical efficacy thresholds in section 16, the sample sizes and ageing rules in sections 17 and 24, and labelling tolerances in section 19), future litigation, if any, is likely to focus on factual and technical questions: whether a test report complies with AS/NZS 4934.1:2014 and AS 4934.2:2021, whether labelling values are within the prescribed rounding and tolerance margins, whether a product qualifies for an exclusion in Schedule 2, and whether the GEMS Regulator correctly applied administrative criteria such as affected registrations and family registrations under section 8.

The Determination’s own notes make clear that the GEMS Regulator may request evidence of compliance for excluded products (Schedule 2 notes). Challenges to regulator decisions on such requests or to registration effects under section 11 would be decided under the Act and through the courts or tribunal processes, but any such litigation history would be external to this instrument and not recorded here.

Practitioners should expect initial disputes, if they occur, to arise around technical test interpretation, the scope of exclusions (for example, precise CCT/chromaticity boundaries for infrared heat lamps) and family registration rules (for example, whether models share sufficient common characteristics to be treated as one family), because these are the areas where factual determinations and regulatory discretion intersect.

Rounding and numerical tolerances: Labelling tolerances in section 19 use multiplicative bounds and discrete rounding rules that can interact awkwardly. For luminous flux the rated value must be no more than mean measured initial value × 1.1 and rounded to the nearest 10 lumens; for power the rated value must lie between mean×0.9 and mean×1.1 with rounding to the nearest watt; median lamp life must not exceed measured median × 1.1 and is rounded to the nearest 100 hours (section 19). If a manufacturer rounds a measured lumen value to the nearest 10 lumens and the rounded figure ends up above the 1.1 multiple, the packaging would be non‑compliant even if the raw measured figure was within tolerance. The detail of rounding can therefore cause paperwork non‑conformances that are avoidable but require careful numeric control.

Sample size and failed lamp handling: The Determination prescribes that the minimum sample size for initial efficacy and most measures is 10 (section 17(4)), but for median lamp life the minimum sample size is 20 (section 24(3)(b)). The initial ageing requirement is 100 ±1 hours unless the manufacturer specifies a lesser duration (section 17(3)), and lamps that fail prior to 100 hours must be replaced and not included in the mean. Similarly, for lumen maintenance factor testing, lamps failing prior to 75% of rated median lamp life must not be included in the mean (section 24(2)). Laboratories and manufacturers must plan for replacement samples and appropriate statistical treatment; failing to follow these replacement rules will invalidate test results.

Family registration traps: A family may include no more than eight models (section 8(4)). The family rules require same brand, same product class, reliance on the same test report, and identical attributes that may affect performance (section 8(2)(b)-(d)). Practically, a manufacturer that attempts to register a family with models that differ in size, geometric form factor or wattage may be non‑compliant. The instrument allows a single report for family members with different efficacies only if the report shows results for the model with the lowest efficacy so that the initial efficacy requirement is met for all family members (note under section 8). Misusing family registrations or under‑testing higher‑risk members is a compliance hazard.

Interplay between commencement and grandfathering: The Determination commences the day after the end of the 12‑month period beginning on the day this instrument is registered (section 2). The limited grandfathering period for product classes 1 and 2 ends at the end of the five‑year period that begins on the day this instrument comes into force (section 10). Parties must carefully track registration and sale dates: models listed in Schedule 1 are “affected” and their prior registrations will cease as described in section 11 and its notes; this affects whether inventory may be sold and under what registration. Failure to align sales, re‑registration, or transitional labelling claims with these dates could lead to enforcement action.

Dependence on purchased standards: All testing and many definitions are by reference to AS/NZS 4934.1:2014 and AS 4934.2:2021 (sections 6, 17, 20, 24). Those standards are third‑party material typically available only by purchase, and the Determination explicitly excludes those texts from the CC licence (copyright statement). If a supplier relies on summaries or incomplete knowledge of the standards, the test methods, sample handling and reporting requirements in the standards may not be properly followed, and test reports could be rejected by the Regulator.

Exclusion evidence burden: Schedule 2 excludes certain aeronautical and aerodrome lamps and others, but the notes say the GEMS Regulator may request evidence that such lamps comply with the approval requirements (Schedule 2 notes). Suppliers who assume exclusion without holding documentary proof face the risk of regulatory challenge if they cannot produce certificates, airworthiness approvals or test reports.

Colour/chromaticity technicality for infrared heat lamps: The exclusion for infrared heat lamps uses a Correlated Colour Temperature threshold (<2500 K) or chromaticity coordinate mathematical inequalities (Schedule 2, paragraph 2). These are technical criteria tied to the CIE colour space; mis‑measuring or mis‑stating CCT or chromaticity coordinates could result in a product being treated as covered rather than excluded. Suppliers should ensure proper spectral or chromaticity testing before relying on the exclusion.

Product class definitions and cap types: Product classes are tied to specific cap types as described in IEC 60061‑1 (section 13). Caps not listed are not in scope for the material classes; vendors of unusual cap types should not assume coverage. Misclassifying a product as class 1 or class 2 when it does not meet the cap or voltage criteria can produce non‑compliance.

Minimum median lamp life and lumen maintenance interplay: The Determination mandates a minimum median lamp life of 2000 hours (section 23(2)) and a lumen maintenance factor of at least 80% at 75% of rated median life (section 23(1)). Products that barely meet median life but fail lumen maintenance, or vice versa, may be non‑compliant even if individual metrics look acceptable in isolation.

Schedule 1 registration effects: The instrument lists specific registration numbers and models in Schedule 1 that are “affected” (section 11 and Schedule 1). Registration holders must understand that an affected registration ceases to be in force as set out in the Act and the Determination’s notes. Confusion over whether a model’s registration is affected or not is a practical compliance risk for suppliers.

Immediate compliance checklist

• Determine product class: Confirm rated voltage and cap type to decide whether a lamp falls in product class 1 (>140 V with listed caps) or product class 2 (11-13 V with listed pin/caps) per section 13. If the lamp falls outside these attributes, confirm whether it is excluded under Schedule 2.

• Review Schedule 1: Check whether your model appears in Schedule 1 (section 11). If listed, its registration is affected and prior registration effects apply. Confirm registration status under the Act and whether re‑registration or other steps are needed.

• Engage an accredited laboratory: Tests required by sections 17, 20 and 24 must be conducted in accordance with section 2 of AS/NZS 4934.1:2014. Arrange tests with a laboratory that can produce a report demonstrating conformance to AS 4934.2:2021 and that can include Appendix A information (section 17(2)).

Testing protocol practicalities

• Sample sizes and ageing: For efficacy and most measures use minimum sample size 10 (section 17(4)); for median lamp life use minimum sample size 20 (section 24(3)(b)). Perform initial ageing of 100 ±1 hours unless the manufacturer specifies a lesser duration; any lamps that fail prior to 100 hours must be replaced and not included in the mean (section 17(3)). For lumen maintenance, measure at 75% of rated median lamp life and exclude lamps that failed prior to 75% from the mean (section 24(2)).

• Calculation of L and efficacy: Use the mean measured initial luminous flux L from test results and apply the mathematical efficacy formulas in section 16 to confirm initial efficacy compliance. For class 1 use the reciprocal formula in section 16(1); for class 2 use the logarithmic formula in section 16(2). Ensure the laboratory’s calculations and rounding align exactly with the Determination’s definitions.

Labelling and packaging steps

• Lumens: Mark light output such that the rated lumen value is no more than mean measured initial value × 1.1, rounded to the nearest 10 lumens (section 19(a)). Confirm that rounding after multiplying does not push the stated figure above the 1.1 multiple.

• Watts: Mark power such that the rated value is no less than mean×0.9 and no more than mean×1.1, rounded to the nearest watt (section 19(b)). Coordinate internal technical sheets so that catalogue power and measured power are consistent.

• Median lamp life: Mark median life not more than median measured value × 1.1 rounded to the nearest 100 hours (section 19(c)). If median measured life is near a rounding boundary, consider conservative rounding to avoid overshoot.

• Recordkeeping: Maintain complete test reports that include the Appendix A information from AS 4934.2:2021 as required by section 17(2). Keep records demonstrating the sample sizes used and the replacement of failed lamps where applicable (sections 17(3), 24(2)).

Registration and family management

• Family registrations: If you intend to use a family registration, confirm the models meet the family criteria in section 8(2) (same product class, same brand, same test report, same size/form factor/wattage/median life/lumen maintenance). Do not exceed eight models per family (section 8(4)). If family members differ in efficacy, ensure the single test report covers the lowest‑efficacy member (note under section 8).

• Registrations affected by instrument: For those on Schedule 1, plan for the administrative effect that the prior registration ceases to be in force when this Determination operates (section 11 and notes). Liaise with the GEMS Regulator early to understand whether re‑registration or other procedural steps are required.

Excluded products and evidentiary readiness

• Exclusions: If your product claims to be excluded (aeronautical lamps, aeronautical ground lights, high temperature, infrared heat lamps or low power decorative lamps under Schedule 2), assemble documentary evidence that demonstrates the applicable attributes or approvals (aviation airworthiness approvals, DASA compliance, temperature test reports, spectral measurements showing CCT < 2500 K or chromaticity coordinates within the exclusion zone).

• Readiness to produce evidence: The GEMS Regulator may request evidence of compliance for excluded products (Schedule 2 notes). Maintain certifications, test reports and approvals to satisfy a Regulator request.

Standards and access

• Acquire the referenced standards: AS/NZS 4934.1:2014 and AS 4934.2:2021, IEC 60061‑1 and other referenced documents are incorporated by reference (section 6). Purchase or obtain access to the complete standards to ensure testing and reporting follow the precise methods and reporting formats required.

Operational controls and internal audit

• Numeric checks and rounding controls: Implement internal calculators or software that apply the Determination’s multiplicative tolerances and rounding conventions exactly as set out in section 19. Document calculations and rounding choices in test reports and technical dossiers.

• Procurement and supply chain: Ensure suppliers of lamps and components know these requirements and that contract terms require correct testing and labelling. For imported lamps, check that overseas test reports are produced against the same AS/NZS/IEC methods (section 6(2) references the versions as at the making date), and verify equivalence.

• Product withdrawal and corrective action: If a lab or internal audit finds non‑compliance, implement a documented corrective action plan: remove non‑conforming stock from sale, re‑test if appropriate, and re‑label packaging where tolerated under transitional rules. Communicate with legal counsel and the GEMS Regulator if remedial steps may be required.

Engage with the Regulator and monitor developments

• Communicate proactively: Where the classification or family membership is marginal, or where exclusions are in play, consider early engagement with the GEMS Regulator to seek clarity or agree evidence steps.

• Monitor legal and standards changes: The Determination uses the versions of the referenced standards current at the date the instrument was made (section 6(2)). Future standard updates will not automatically apply; monitor both the GEMS Regulator and Standards Australia for any changes or new Determinations.

Practical risk mitigation

• Allow testing lead times and replacement samples: Budget for additional units in test runs to cover lamps that fail before required ageing thresholds and must be replaced (sections 17(3), 24(2)). Use accredited labs experienced with AS/NZS 4934 series to reduce risk of incorrect methodology.

• Conservative labelling: When in doubt, use rated values that sit comfortably within the allowed multiplicative margins after rounding. Conservative marking reduces the risk that rounding pushes values outside the permitted band.

• Documented chain of compliance: Keep full records of tests, calculation worksheets, certificates, family registration justifications and any correspondence with the Regulator. Those records will be needed if the regulator requests evidence or if there is an enforcement challenge.

Following these steps aligns product development, testing, labelling, registration and supply chain processes to the Determination’s technical and administrative requirements (Parts 2-5 and Schedules 1-3) and positions suppliers to demonstrate compliance to the GEMS Regulator when asked.
