What it does
This instrument is a federal Ministerial declaration made under subsection 12(1) of the Marine Safety (Domestic Commercial Vessel) National Law Act 2012 (the Act). It (a) formally declares that specified State and Territory statutes correspond to the national Marine Safety (Domestic Commercial Vessel) National Law for the purposes of subsection 12(1) of the Act, (b) repeals the prior Declaration titled Marine Safety (Domestic Commercial Vessel) National Law (Meaning of Corresponding State-Territory law) Declaration 2023 in full, and (c) comes into force on 1 March 2024. The instrument identifies the Minister who made it (Catherine King) and the date it was made (13 February 2024) (see sections 1, 2 and the heading information).
Mechanically, the operative provisions are short and concentrated. Section 4 defines the shorthand term Act to mean the Marine Safety (Domestic Commercial Vessel) National Law Act 2012. Section 6 performs the core legal work: it states that, for the purposes of subsection 12(1) of the Act, each law named in the included table is declared to correspond to the Act. The table lists the State and Territory Acts that are declared to correspond (New South Wales, Victoria, South Australia, Tasmania, Northern Territory, Queensland and Western Australia, with the precise statutory titles set out for each jurisdiction). Schedule 1 contains a single item repealing the 2023 Declaration instrument in its entirety.
The instrument does not itself amend the substantive regulatory provisions of the national Act or the State and Territory Acts it names. Rather, it is a formal declaration under the national Act that certain local application Acts correspond for the purposes of subsection 12(1). Section 5 makes a general point about schedules: any instrument specified in a Schedule is amended or repealed as set out in the Schedule, and any other item in a Schedule has effect according to its terms. The Schedule in this instrument effects the full repeal of the prior 2023 declaration.
