What it does
This legislative instrument, the Biosecurity (Consequential Amendments and Transitional Provisions) (Extension of First Points of Entry Determinations) Instrument 2021, extends specified transition periods that relate to designated landing places (airports) and ports. The instrument is made under the statutory power described in s 3: "This instrument is made under subitem 1(4) of Schedule 3 to the Biosecurity (Consequential Amendments and Transitional Provisions) Act 2015." Mechanically, the instrument performs three discrete tasks.
First, s 5 extends the transition period for two landing places listed in its table, by specifying an "end day" for the transition period for each landing place. The landing places and end days are:
- Kingsford Smith Airport, Sydney , transition period extended until the end of 30 November 2022 (s 5 table, item 1);
- Norfolk Island Airport , transition period extended until the end of 15 March 2023 (s 5 table, item 2).
Second, s 6 extends the transition period for five ports listed in its table, again by specifying an "end day" for each port. The ports and end days are:
- Port of Ball Bay, Norfolk Island , until the end of 15 March 2022 (s 6 table, item 1);
- Port of Cascade Bay, Norfolk Island , until the end of 15 March 2022 (s 6 table, item 2);
- Port of Christmas Island , until the end of 15 March 2022 (s 6 table, item 3);
- Port of Cocos (Keeling) Islands , until the end of 15 December 2022 (s 6 table, item 4);
- Port of Sydney Bay (Kingston), Norfolk Island , until the end of 15 March 2022 (s 6 table, item 5).
Third, s 7 contains a savings provision. It states that, despite the repeal of two earlier instruments by Schedule 1 to this instrument (the Biosecurity (Consequential Amendments and Transitional Provisions) (Extension of First Points of Entry Determinations) Instrument 2019 and the (No. 2) 2019 Instrument), those earlier instruments "continue to apply" for a specified set of locations "as if that repeal had not happened." The locations saved by s 7 are:
