What it does
This instrument, titled the Telecommunications (Interception and Access) (Emergency Service Facilities,New South Wales) Instrument 2020, performs a narrow, technical function. Section 1 records the name of the instrument. Section 4 supplies a specification, "For subsection 6(2D) of the Act, each force or service operating premises and the geographical region in which the premises are located are specified in the following table." The operative content is the table in s 4, which lists eight forces or services and the geographic regions (towns, suburbs or other locality descriptors) that correspond to each listed premises.
Mechanically, the instrument does not itself create a new entitlement or new offence in express terms. It does one thing: it identifies, by naming the force or service and the corresponding geographical region for premises, the emergency service facilities that are "specified" for the purposes identified in subsection 6(2D) of the Act. The instrument therefore functions as a statutory schedule or specification used by the Act. The text shows the instrument is confined to New South Wales and enumerates specific localities for each listed agency: New South Wales Police Force (Item 1), Fire and Rescue NSW (Item 2), New South Wales Rural Fire Service (Item 3), Ambulance Service of NSW (Item 4), Telstra Corporation Limited (Item 5), NSW State Emergency Service (Item 6), Airservices Australia - Aviation Rescue and Fire Fighting Service (Item 7), and Royal Flying Doctor Service (Item 8). The table lists the localities that are the geographical region of the premises associated with each item.
Because the instrument expressly operates "for subsection 6(2D) of the Act", the legal effect that follows from being so "specified" depends on the operative text and effects of that subsection of the Act. The instrument is therefore a specification instrument rather than a freestanding substantive law change. Any legal consequences for service operators, telecommunications carriers, or third parties will flow from how subsection 6(2D) applies to the specified premises and regions under the Act.
