What it does
This legislative instrument exempts ASC AWD Shipbuilder Pty Ltd (ASC AWD) and a defined class of overseas technical specialists from specified requirements in the Work Health and Safety Regulations 2011 (WHS Regulations) that relate to general construction induction training (CIT) and evidence of that training. Mechanically, the instrument disapplies obligations in regulation 316 and subregulations 317(1) and (2) insofar as they would require ASC AWD to ensure that the technical specialists complete CIT and hold a construction induction training card (CITC) or a general construction induction training certification (GCITC) issued within 60 days before carrying out construction work (see para 4(a)(i)-(iii)). It also disapplies the obligation in subregulation 326(1) that would require workers carrying out construction work to keep available for inspection a CITC or a GCITC held pending a CITC decision (see para 4(b)(i)-(ii)).
The exemption applies only in relation to a precisely described activity and class of persons: technical specialists recruited from overseas by ASC AWD who carry out construction work involving technical support for installation, set-to-work, integration and testing of platform and combat system hardware equipment fitted to Air Warfare Destroyer ships under construction at ASC AWD’s shipyard at Osborne, South Australia (para 3). The exemption is explicitly limited to the CIT obligation and the forms of evidence that are the CITC and GCITC (para 5; para 6).
The exemption is conditional. ASC AWD must deliver an alternative ASC safety induction training that meets specified trainer qualifications, subject matter, language-assistance and assessment standards (para 7(1)-(2)). ASC AWD must retain course content documents and records showing successful completion for each technical specialist until completion of the Air Warfare Destroyer Program (para 7(3)-(4)). ASC AWD may only issue site security passes to technical specialists after satisfactory completion of the ASC safety induction training (para 7(5)). The instrument replaces a prior 2014 exemption, commences the day after registration, and expires on 30 September 2020 or upon completion of the Air Warfare Destroyer Program, whichever is earlier, unless amended or cancelled under regulation 697 of the WHS Regulations (paras 8-10). The instrument is described as a legislative instrument under the Legislative Instruments Act 2003 (note after name).
