What it does
This legislative instrument, made on 24 May 2018 by the Assistant Secretary as delegate of the Minister for the Environment and Energy, amends the List of Exempt Native Specimens established under section 303DB of the Environment Protection and Biodiversity Conservation Act 1999 (Cth) (EPBC Act). The amendment operates by deleting two existing entries from that list and inserting two replacement entries with different conditions and expiry dates. The two fisheries affected are the Western Australian Pilbara Fish Trawl Managed Fishery and the Western Australian West Coast Rock Lobster Managed Fishery.
Mechanically, Schedule 1 removes the previous entries for both fisheries. The old Pilbara entry referred to the “Pilbara Fish Trawl Interim Managed Fishery” and included a notation that specimens were listed only until 30 May 2018, with a condition that the specimen was taken lawfully. The old West Coast Rock Lobster entry referenced the fishery as defined in the West Coast Rock Lobster Managed Fishery Management Plan 2012 under the Fish Resources Management Act 1994 (WA), and required both lawful taking and that the specimens were covered by a declaration of an approved wildlife trade operation under section 303FN of the EPBC Act. Schedule 2 inserts new entries for both fisheries, each with updated descriptions, exclusions, and expiry dates.
The new Pilbara entry now refers to the “Pilbara Fish Trawl Interim Managed Fishery as defined in the management regime in force under the Fish Resources Management Act 1994 (WA) and Fish Resources Management Regulations 1995 (WA)”. Its expiry is extended slightly to 24 August 2018 , a mere three months. The new West Coast Rock Lobster entry refers to the fishery by the same name but now defines it solely by reference to the State management regime (the Act and Regulations, not the specific Management Plan), and its expiry is extended to 30 May 2025 , approximately seven years. Critically, the new rock lobster notation no longer requires an approved wildlife trade operation declaration under section 303FN; the only conditions are lawful taking and that the specimens are included in the list until May 2025. Both new entries also now expressly exclude specimens that belong to eligible listed threatened species as defined under section 303BC of the EPBC Act, or taxa listed under section 303CA (Australia’s CITES List). This exclusion was either absent or differently worded in the old entries.
