Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) (Modifications of the Repatriation Private Patient Principles) Instrument 2017

The instrument is compact and technical; its main concepts are subsidiarily about definition alignment, transitional continuation, and repeal of a previous instrument. The central legal mechanisms are substitution of definitional text and omission of certain paragraphs of the existing Principles. The instrument identifies a small set of concepts that determine how the Repatriation Private Patient Principles operate in the context of the 2006 Act.

Key concepts and where they appear in the instrument:

• “Act”: The instrument substitutes the definition of “Act” in paragraph 1.2 of the Principles so that it now means the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006 (Schedule 1, item 2). That substitution makes the Principles’ operation explicitly tied to the 2006 Act wherever the term “Act” appears in the Principles.
• “Commission”: The definition is replaced so “Commission has the meaning given by section 5A of the Veterans’ Entitlements Act 1986” (Schedule 1, item 3). This anchors the administrative decision-maker to the Commission as defined in another Act (the Veterans’ Entitlements Act 1986).
• “Entitled person”: The term “entitled person” in the Principles is redefined to mean “an eligible person within the meaning of the Act” (Schedule 1, item 5). This redirects any prior “entitled person” test in the Principles to the eligibility rules of the 2006 Act.
• “Private patient”: The instrument substitutes the definition so that “private patient has a meaning affected by subsection 17(8) of the Act” (Schedule 1, item 8). This signals that the specific legal scope of who counts as a private patient under the Principles is to be read in light of that subsection of the 2006 Act.
• “Treatment Principles”: The definition now refers to the Treatment Principles as modified by the 2013 Instrument (Schedule 1, item 9). This maintains a linkage between private patient principles and the Treatment Principles as previously modified for the same cohort.
• “Former Repatriation Hospital”: The definition is tied to institutions formerly operated by the Commission under paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986 (Schedule 1, item 6).
• Omission of “dependent of a Vietnam veteran” and “Vietnam veteran”: The instrument deletes those definitional entries (Schedule 1, items 4 and 11), removing them from the Principles’ text entirely.
• Transitional provision (1.1B): If a thing was started under the earlier 2006 instrument and not finished by 1 July 2017, it may be finished under these modified Principles on or after that day as if started under these Principles (Schedule 1, item 1.1B). This is an express continuity mechanism.
• Repeal: The 2006 Modified Repatriation Private Patient Principles instrument is repealed in full by Schedule 2.

Mechanically, the instrument does not set new substantive policy rules in the sense of altering benefit levels or clinical pathways. Instead, it re-attaches the Principles’ textual machinery to the definitions and eligibility structures of the 2006 Act and to certain parts of the Veterans’ Entitlements Act 1986 and the Treatment Principles as modified in 2013. The immediate legal effect is to change which statutory definitions and cross-references govern the operation of the Repatriation Private Patient Principles for the cohort concerned.

Because the instrument repeatedly substitutes definitions rather than drafting new operational rules, the concrete scope of entitlements and administrative discretion under the Principles now depends on the content of the 2006 Act (particularly s 17 and s 17(8)) and on the cross-referenced provisions of the Veterans’ Entitlements Act 1986 and the Treatment Principles as modified in 2013. The instrument therefore functions as a harmonising device, not as an independent entitlement-creating instrument.

The instrument affects a narrow set of stakeholders through changes in definitions and textual alignment of the Repatriation Private Patient Principles with the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006 and other statutes. The parties materially affected, as identified by the instrument itself and the text it amends, are:

• Entitled persons/eligible persons under the 2006 Act: The substituted definition of “entitled person” expressly makes that term mean “an eligible person within the meaning of the Act” (Schedule 1, item 5). Therefore, the cohort that benefits from or is subject to the Principles will be determined by the eligibility constructs of the Act rather than by any prior definition in the Principles. Practitioners assessing eligibility for private patient treatment under the Principles must therefore consult the Act’s eligibility definitions and conditions.
• Private patients as defined by s 17(8) of the Act: The instrument states that “private patient has a meaning affected by subsection 17(8) of the Act” (Schedule 1, item 8). Anyone whose status as a private patient is relevant to treatment planning, billing, or benefit access will be affected to the extent that s 17(8) alters the ordinary meaning used previously in the Principles.
• The Repatriation Commission: The Commission is the decision-making body for the instrument; the instrument is made by the Commission under section 17 of the 2006 Act (cl 3). The Commission’s statutory identity is given by reference to s 5A of the Veterans’ Entitlements Act 1986 by the substituted definition (Schedule 1, item 3). The Commission will therefore remain the administrative authority implementing the modified Principles.
• Hospitals and health providers, including former Repatriation Hospitals and “veteran partnering private hospitals”: Providers that deliver private patient treatment under the Principles will need to adopt the new textual references. The definition of “former Repatriation Hospital” ties that phrase to institutions formerly operated by the Commission under paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986 (Schedule 1, item 6). The definition of “veteran partnering private hospital” is changed by substituting the phrase “the Veterans’ Entitlements Act 1986” for “the Act” (Schedule 1, item 10), so that the term is to be read against the Veterans’ Entitlements Act rather than the 2006 Act where the phrase appears in the Principles.
• Administrative staff, claims officers and legal advisors within the Department of Veterans’ Affairs and Commission: They must interpret and apply the Principles with the new definitions and transitional rule in mind, and adjust internal procedures and documentation to reflect the deletions and substitutions.
• Persons or matters started under the 2006 instrument: The transitional provision (1.1B) specifically permits unfinished matters started under the Veterans’ Affairs (Modified Repatriation Private Patient Principles , Australian Participants in British Nuclear Tests) Instrument 2006 to be completed under the new Principles (Schedule 1, item 1.1B). This affects any pending applications, approvals, or administrative processes that were begun under the old instrument but not finalised by 1 July 2017.

The instrument does not explicitly create new recipient classes beyond those within the meaning of the Act and s 17(8). It also removes the definitions “Vietnam veteran” and “dependent of a Vietnam veteran” from paragraph 1.2 (Schedule 1, items 4 and 11), which removes any direct textual reference to those categories within the Principles themselves. The net effect is a reallocation of interpretative attention: eligibility and status are to be resolved primarily by reference to the 2006 Act and the specified cross-references to other legislation.

Who pays: The instrument itself does not set payment obligations, but because it links “entitled person” and “private patient” status to the Act and s 17(8), the financial responsibility for private patient treatment under the Principles will fall according to the eligibility and cost rules in the Act and in any other statutory instruments cross‑referenced by the Principles. The Commission, as the body administering the Principles, remains the decision-maker on whether an individual qualifies and therefore whether the Commission bears costs for private patient treatment under the modified Principles.

The instrument modifies the textual scaffolding of the Repatriation Private Patient Principles but does not itself set out procedural duties, application rights or appeal mechanisms beyond the inserted transitional provision. Nonetheless, the instrument creates or changes several duties and rights indirectly by redefining terms and altering cross-references. The operative duties and rights that arise from the instrument’s changes are those inherent in the Principles as they operate with the new definitions.

Principal duties and rights, as derived from the modified text:

• Right to be treated under the Principles if eligible under the Act: By substituting “entitled person means an eligible person within the meaning of the Act” (Schedule 1, item 5), the instrument makes the right to be treated as an “entitled person” under the Principles contingent on satisfying the Act’s eligibility tests. The legal right to private patient treatment under the Principles therefore depends on satisfying the Act’s criteria, which are now the operative reference for the term “entitled person.”
• Right (or status) as private patient governed by s 17(8): With “private patient has a meaning affected by subsection 17(8) of the Act” (Schedule 1, item 8), the instrument attaches the substantive meaning of “private patient” used in the Principles to the content of s 17(8). Any duties and rights that flow from being a private patient under the Principles must therefore be determined by reading that subsection alongside the Principles.
• Administrative duty to interpret and apply the Principles in line with the Act and the Veterans’ Entitlements Act 1986: The substituted definitions of “Act” and “Commission” and the alteration to the “veteran partnering private hospital” reference require administrators to interpret the Principles with those external statutory instruments in mind (Schedule 1, items 2, 3 and 10). This creates an operational duty on decision-makers and staff to be familiar with, and to apply, the relevant sections of the 2006 Act and the Veterans’ Entitlements Act 1986 when making decisions under the Principles.
• Continuity right for matters started under the prior instrument: The transitional provision (1.1B) creates a legal entitlement for unfinished matters begun under the 2006 instrument to be completed under the new Principles as if they had been started under these Principles (Schedule 1, item 1.1B). That provision imposes a duty on administrators to allow such continuations.
• Rights and duties of hospitals and providers depend on redefined cross‑references: By tying “former Repatriation Hospital” to paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986 and by referring “Treatment Principles” to the 2013 modification, the instrument makes providers’ rights and obligations under the Principles depend on those external instruments (Schedule 1, items 6 and 9). For example, hospital eligibility to be treated as a former Repatriation Hospital will be determined by the VEA paragraph referenced.
• Deletion of certain rights or references: The removal of the definitions “Vietnam veteran” and “dependent of a Vietnam veteran” (Schedule 1, items 4 and 11) removes any direct definitional reference to those categories in the Principles; duties or rights that previously relied upon those specific definitions within paragraph 1.2 of the Principles will need to be located elsewhere or determined under the Act.

Observations within the instrument’s text about duties and rights:

• The instrument does not add enforcement or penalty provisions; it operates by amending definitions and references. Therefore, any penalties, appeal rights, or procedural safeguards remain those in the underlying Principles and the Act, as those instruments provide. The instrument does not itself alter dispute-resolution processes.
• The substituted linkage to the Act and to s 17(8) centralises the assessment of entitlement and private patient status in the substantive words of the Act; administrators must therefore exercise duties of statutory interpretation to determine rights under the Principles.
• The Commission’s identity being defined by reference to s 5A of the Veterans’ Entitlements Act 1986 clarifies which corporate entity or office holds administrative responsibility for implementing and enforcing the modified Principles (Schedule 1, item 3). That definition focuses operational duty in compliance and decision-making on the Commission as defined in that Act.

In short, the instrument’s key duties and rights are largely derivative: rights to treatment and obligations on administrators now flow from how the substituted definitions cause the Principles to read against the Act, s 17(8), the Veterans’ Entitlements Act 1986 and the Treatment Principles as modified in 2013. The transitional provision creates a clear right to complete previously started matters under the new text.

The instrument itself does not create or modify penalties, fines or criminal offences. It is a modification instrument that substitutes and omits definitions and adds a transitional provision to the Repatriation Private Patient Principles. Consequently, it delegates enforcement and penalty matters to the underlying legislative and regulatory instruments that govern the Principles and the Act.

What the instrument does state about enforcement architecture:

• Authority: The instrument is made under section 17 of the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006 (cl 3). Any enforcement powers, penalty regimes or decision-review processes that apply to the Commission’s administration of the Principles remain located in the Act and in the Repatriation Private Patient Principles themselves. The instrument does not amend those enforcement or sanction provisions directly; it changes the interpretative context through definition substitution.
• Commission as decision-maker: The instrument replaces the definition of “Commission” so it “has the meaning given by section 5A of the Veterans’ Entitlements Act 1986” (Schedule 1, item 3). That substitution identifies the corporate/administrative entity that will exercise enforcement or compliance functions under the Principles, subject to whatever powers are provided by the Act and by the Principles as modified.
• Transitional treatment: The inserted transitional provision (1.1B) requires administrators to allow unfinished matters started under the 2006 instrument to be completed under the new Principles as if they had been started under them (Schedule 1, item 1.1B). This is an implementation instruction that affects how administrators apply enforcement or procedural deadlines, but it is not a penalty. It has an operational enforcement implication because it prescribes how pending matters are to be treated for regulatory or administrative finalisation.
• Repeal of prior instrument: Schedule 2 repeals the Veterans’ Affairs (Modified Repatriation Private Patient Principles ‑ Australian Participants in British Nuclear Tests) Instrument 2006 in its entirety (Schedule 2). The repeal removes any legal force of the earlier instrument; compliance or enforcement under that earlier text is superseded from the instrument’s commencement date (1 July 2017). Consequently, any penalty or enforcement provisions that depended on the 2006 instrument are displaced by the new modified Principles and the Act going forward.

What is not in the instrument and the practical effect:

• No new offence provisions: The instrument contains no new offences, pecuniary penalties or criminal sanctions. Any sanctions remain those provided in the Act or in the Repatriation Private Patient Principles as standing rules. The instrument relocates interpretive authority for certain terms to the Act (for example, “entitled person” and “private patient”) and to the Veterans’ Entitlements Act 1986; therefore, the legal thresholds for triggering sanctions or compliance obligations may change only insofar as the new definitions alter who is subject to pre-existing enforcement provisions.
• Implementation burden for enforcement: Because the instrument changes definitions and references, enforcement and compliance staff must update compliance checklists, internal guidance, notices and templates to reflect that “entitled person” is now an eligible person under the Act, and that “private patient” is affected by s 17(8) of the Act. This is administrative friction rather than a penalty change, but it is relevant to how enforcement will be administered.
• No express review or appeal changes: The instrument does not change appeal rights or review mechanisms in the Principles or the Act. If appeal or review rights are needed, they must be located in the Act or the Principles themselves.

In practical terms, penalties and enforcement continue to operate under the pre-existing legal architecture; this instrument’s effect is to alter who falls within that architecture and how officials identify those persons, by substituting and omitting definitions and cross-references. Any change in the incidence of enforcement or penalties therefore flows from those definitional changes rather than from new sanctioning provisions in this instrument.

This instrument expressly cross-references and aligns the Repatriation Private Patient Principles to several other legal instruments. Its interactions are limited to definitional and interpretive references; it does not itself change substantive provisions of other Acts. The instrument creates linkages with:

• The Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006: The instrument is made under section 17 of that Act (cl 3) and redefines “Act” in the Principles to mean that Act (Schedule 1, item 2). It also refers directly to subsection 17(8) of that Act in relation to the meaning of “private patient” (Schedule 1, item 8). These changes mean that the Principles, as modified, must be read with the 2006 Act’s eligibility criteria and any special definitions or rules set out in s 17 and s 17(8).
• The Veterans’ Entitlements Act 1986: The instrument substitutes the definition of “Commission” in the Principles to the meaning given by section 5A of the Veterans’ Entitlements Act 1986 (Schedule 1, item 3). It also redefines “former Repatriation Hospital” by reference to paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986 (Schedule 1, item 6). In addition, the definition of “veteran partnering private hospital” is amended by replacing the phrase “the Act” with “the Veterans’ Entitlements Act 1986” (Schedule 1, item 10). These substitutions require administrators to draw on the Veterans’ Entitlements Act 1986 when applying certain provider-related definitions and when identifying which Commission entity administers the Principles.
• Treatment Principles (as modified): The instrument defines “Treatment Principles” to mean the Treatment Principles as modified by the Treatment Principles modification instrument made in 2013 (Schedule 1, item 9). This maintains a direct textual relationship between the private patient rules and the Treatment Principles framework as previously adjusted for the cohort in question.
• Prior instruments: The instrument repeals the Veterans’ Affairs (Modified Repatriation Private Patient Principles ‑ Australian Participants in British Nuclear Tests) Instrument 2006 in full (Schedule 2). The repeal extinguishes the legal effect of that earlier instrument from the commencement date. The new instrument provides transitional continuity for matters started under the 2006 instrument (Schedule 1, item 1.1B).

Practical consequences of these interactions:

• Centralisation of eligibility assessment in the Act: Because “entitled person” is defined by reference to the Act and “private patient” is specifically linked to s 17(8), eligibility and category determinations must now be read against the Act’s text. That makes the Act the primary source for determining who falls within the Principles after modification.
• Provider definitions reference VEA: The use of the Veterans’ Entitlements Act 1986 for provider-related definitions means that providers, particularly former Repatriation Hospitals and veteran partnering private hospitals, must be identified using the rules of the VEA. This shifts certain provider classification duties out of the 2006 Act to the VEA for interpretative purposes.
• No change to substantive obligations outside definitions: The instrument does not change substantive obligations in the VEA or the 2006 Act; it aligns definitional meanings so that the Principles operate coherently within the 2006 Act’s treatment regime and existing veterans’ legislation. Any substantive obligations, administrative powers, penalties or appeal mechanisms remain in the other instruments and are triggered according to the newly substituted terminology.

In short, the instrument acts as a harmonising text, requiring decision-makers to consult the 2006 Act, subsection 17(8), the Veterans’ Entitlements Act 1986 and the 2013 modifications to the Treatment Principles when applying the Repatriation Private Patient Principles in the context of treatment for Australian participants in British nuclear tests and the British Commonwealth Occupation Force.

The instrument itself records a brief amendment and repeal history, which is entirely self-contained and concerns replacement of a 2006 instrument and the specific substitution and omission of particular paragraphs and definitions in the Repatriation Private Patient Principles.

Key chronological items in the instrument:

• 2006 instrument: The Veterans’ Affairs (Modified Repatriation Private Patient Principles ‑ Australian Participants in British Nuclear Tests) Instrument 2006 was previously in force and is expressly repealed in full by Schedule 2 to the 2017 instrument (Schedule 2, item 1). The repeal removes the prior instrument’s text from the legal framework as of the 2017 instrument’s commencement.
• 2013 Treatment Principles modification: The instrument refers to the Treatment Principles as modified by a 2013 instrument (Schedule 1, item 9). This indicates that the Repatriation Private Patient Principles are to be read in conjunction with those 2013 modifications but the 2017 instrument does not itself amend the 2013 instrument. It simply reasserts the earlier linkage.
• 2017 instrument timeline: The instrument is dated 8 June 2017 on the seal page; it was approved by the Minister on 23 June 2017 and commences on 1 July 2017 (cl 2(1) and Schedule 1, item 1.1A). The instrument’s commencement table records that “The whole of this instrument” commences on 1 July 2017 (cl 2).
• Substantive amendments to the Principles effected by the instrument: Schedule 1 of the 2017 instrument lists the specific substitutions and omissions that constitute the amendment history for the Principles: replacement/insertions for paragraphs 1.1 and 1.1A (new name and commencement statements), insertion of 1.1B (transitional provision), redefinitions in paragraph 1.2 for Act, Commission, entitled person, former Repatriation Hospital, Principles, private patient, Treatment Principles and veteran partnering private hospital, and omission of the “dependent of a Vietnam veteran” and “Vietnam veteran” definitions as well as omission of paragraph 3.6 (Schedule 1, items 1-12).
• Note about the commencement table: The instrument includes a note that the commencement table relates only to the provisions of this instrument as originally made and will not be amended to deal with later amendments (cl 2(2)). This is a drafting note about how the instrument is displayed in register versions and is not substantive.

No other amendments or historical iterations are recorded within this instrument. There are no later amending instruments included in the text provided. The instrument therefore represents a discrete 2017 update: it repeals the 2006 modified instrument and replaces or omits identified paragraphs and definitions in the Principles, with commencement fixed at 1 July 2017 and transitional protection for unfinished matters started under the 2006 instrument (Schedule 1, item 1.1B; Schedule 2).

The instrument as provided contains no litigation history. It does not cite or refer to any court decisions, tribunal determinations, or judicial interpretation of the provisions it substitutes or omits. There are no references to precedent, no case names, and no indications of judicial review or litigation arising from this instrument in the text provided.

Where litigation might later arise, the instrument itself directs interpretation of key terms to other statutory provisions (for example, subsection 17(8) of the Act and s 5A of the Veterans’ Entitlements Act 1986). Any litigation concerning the interpretation or application of the modified Principles would therefore require interpretation of the 2006 Act, s 17(8) in particular, and the referenced provisions of the Veterans’ Entitlements Act 1986 and the Treatment Principles as modified in 2013. However, such litigation is not described or narrated in this instrument.

For compliance officers, litigators and advisers: the instrument’s redefinitions increase the probability that any contested decisions under the Principles will raise statutory interpretation questions about the 2006 Act and the VEA provisions referenced. The instrument itself contains no judicial gloss or annotated decisions to guide that interpretation.

Because the instrument repeals the 2006 instrument, any existing litigation that relied on the 2006 instrument would be affected by the transitional clause (1.1B) where “a thing was started under the [2006] Instrument before 1 July 2017” and not finished by that date; such matters “may be finished under these Principles on or after that day as if it had been started under these Principles” (Schedule 1, item 1.1B). That transitional provision creates a statutory basis for administratively continuing matters and might in future be invoked in litigation over continuity of rights or procedural fairness, but this instrument records no such cases.

In short, this instrument contains no litigation history within its text; any case law relevant to the new definitions will be found in decisions interpreting the Act, s 17(8), the Veterans’ Entitlements Act 1986 and the Treatment Principles, none of which are set out or interpreted here.

The instrument is short and technical, but several details can create practical risks or sources of confusion if they are overlooked. The following are concrete implementation and interpretation pitfalls that the text itself creates or highlights, without asserting external facts beyond the instrument.

1. “Private patient” depends on subsection 17(8) of the Act (Schedule 1, item 8)

   • The instrument does not define “private patient” directly; it says the term “has a meaning affected by subsection 17(8) of the Act.” That wording shifts the definition to the 2006 Act and to a specific subsection. Practitioners must consult subsection 17(8) to know who is or is not a private patient under the modified Principles. Failure to do so will lead to misclassification and incorrect application of the Principles.

2. “Entitled person” is now “an eligible person within the meaning of the Act” (Schedule 1, item 5)

   • Any existing templates, forms, or internal policies that refer to “entitled person” under the prior Principles must be updated to reflect that entitlement is now measured by the Act’s eligibility rules. Those eligibility rules may be narrower, broader or differently structured than the prior Principles’ tests; the instrument does not state which. Assess eligibility against the Act.

3. Commission defined by reference to s 5A of the Veterans’ Entitlements Act 1986 (Schedule 1, item 3)

   • Administrative responsibility is explicitly tied to the Commission as defined in the VEA. Staff must ensure they are interacting with the correct statutory corporate entity, and that delegations, letters of authority and decision records correctly identify the Commission in accordance with s 5A VEA.

4. Deletion of “Vietnam veteran” and “dependent of a Vietnam veteran” definitions (Schedule 1, items 4 and 11)

   • Those deletions remove the explicit textual presence of those categories in paragraph 1.2 of the Principles. If any policies, adjudications or advice relied on those specific definitions within the Principles, parties must confirm whether the Act supplies equivalent references or whether alternative definitional sources are now operative.

5. “Veteran partnering private hospital” now refers to the Veterans’ Entitlements Act 1986 (Schedule 1, item 10)

   • The substitution replaces “the Act” with “the Veterans’ Entitlements Act 1986.” That may change which set of criteria or statutory provisions govern the classification of a “veteran partnering private hospital.” Review provider agreements and accreditation criteria to confirm which statutory test applies.

6. Omission of paragraph 3.6 (Schedule 1, item 12)

   • The instrument omits paragraph 3.6 without reproducing or replacing its content. If paragraph 3.6 previously contained operative rights, duties, or exceptions, those will no longer appear in the Principles. Users must check the pre-existing text of the Principles to locate what 3.6 contained and whether its omission creates gaps requiring administrative rules or policy statements.

7. Transitional clause permissive rather than mandatory (1.1B)

   • The transitional provision states that an unfinished “thing” started under the 2006 instrument “may be finished under these Principles” as if started under them (Schedule 1, item 1.1B). The use of “may” is permissive; administrators should treat this as giving discretion to complete matters under the new Principles but should document the basis for choosing the new or old procedural approach, especially where procedural fairness or vested expectations are relevant.

8. Repeal of the 2006 instrument (Schedule 2)

   • The wholesale repeal means any policies or administrative practice relying on the old instrument must be updated. There is no transitional saving other than 1.1B for unfinished “things.” Confirm that no ongoing administrative processes implicitly relied on the prior definitions that the 2017 instrument removes.

9. Cross-references to the Treatment Principles as modified in 2013 (Schedule 1, item 9)

   • The instrument points to the Treatment Principles as modified in 2013. Practitioners must ensure they use the modified 2013 text, not an earlier version. Failure to use the correct version of the Treatment Principles can lead to mismatches in rights and clinical pathways.

10. Lack of explicit changes to enforcement, appeals, or costs

    • The instrument itself leaves enforcement and costs to the underlying instruments. If stakeholders expect changes to cost allocation or appeal rights, those expectations will not be met by this instrument alone; confirm any such rules in the Act or the Principles that are now to be read in light of the new definitions.

In short, the primary gotchas are interpretative: the instrument relocates key definitional determinations to the 2006 Act and to specified provisions of other legislation and prior modification instruments. Implementers and advisers must consult those primary texts and rework forms, templates and internal guidance to reflect the new cross-references and omissions.

Compliance with the changes introduced by this instrument requires administrative and interpretative steps. Because the instrument functions by changing definitions and references, compliance is largely about correctly identifying affected cohorts, updating documentation and ensuring that decisions are made using the newly authoritative texts. The following is a practical checklist, tied to specific instrument provisions, for administrators, providers, legal advisers and claims officers.

1. Confirm commencement and transitional coverage (cl 2 and Schedule 1, item 1.1A-1.1B)

   • Note the commencement date is 1 July 2017 (cl 2(1) and Schedule 1, item 1.1A).
   • Identify any matters, applications or processes started under the Veterans’ Affairs (Modified Repatriation Private Patient Principles ‑ Australian Participants in British Nuclear Tests) Instrument 2006 that were not finalised by 1 July 2017. For each such matter, determine whether it should be finished under the modified Principles and record the basis for exercising the permissive provision in 1.1B (Schedule 1, item 1.1B). Use administrative records to label these matters and to document decision rationale.

2. Re-map eligibility assessments to the Act (Schedule 1, items 2 and 5)

   • Replace any internal condition checks for “entitled person” in forms and decision tools with the eligibility criteria of the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006. Update operational guidance and training materials so staff know that “entitled person” must be determined by reference to the Act.

3. Re-define private patient status against s 17(8) of the Act (Schedule 1, item 8)

   • Obtain and review subsection 17(8) of the Act to determine how it affects the meaning of “private patient.” Update billing procedures, clinical admission forms, and provider agreements to reflect the correct private patient classification. Ensure that financial responsibility and cost-recovery processes align with determinations under s 17(8).

4. Update Commission references and delegation instruments (Schedule 1, item 3)

   • Because “Commission” is defined by reference to s 5A of the Veterans’ Entitlements Act 1986, ensure that organisational charts, signatures, delegation instruments, and correspondence identify the Commission in accordance with that statutory provision. Verify that delegated powers and authorised officers are documented consistently with the Commission’s statutory definition.

5. Reclassify provider definitions (Schedule 1, items 6 and 10)

   • Update the criteria for identifying “former Repatriation Hospital” and “veteran partnering private hospital” to reflect the Veterans’ Entitlements Act 1986 references. Revise provider lists, contracting terms, and accreditation checks where these classifications determine eligibility to treat entitled persons or the terms of engagement.

6. Remove or replace references to deleted definitions (Schedule 1, items 4 and 11)

   • Remove references to “Vietnam veteran” and “dependent of a Vietnam veteran” from local operating procedures that relied on paragraph 1.2 of the Principles. If classification of those persons remains necessary for other purposes, determine alternative statutory sources for those definitions (for example, check the Act or the VEA) and update guidance accordingly.

7. Reconcile Treatment Principles linkage (Schedule 1, item 9)

   • Confirm which version of the Treatment Principles (the version as modified by the 2013 instrument) applies. Ensure clinical pathways, payment schedules and provider agreements reference the correct version.

8. Remove reliance on the 2006 instrument (Schedule 2)

   • Following repeal of the 2006 instrument, withdraw or archive any documents that relied on that instrument and replace them with versions aligned to the 2017 modifications. Where internal systems track instrument citations, update them to reflect the repeal.

9. Record keeping and audit trail

   • For any matter continued under 1.1B, maintain a clear audit trail showing that the matter was started under the 2006 instrument, was unfinished by 1 July 2017, and was completed under the modified Principles. Document why completion under the new Principles was chosen if discretion was exercised.

10. Train staff and communicate with providers and claimants

    • Convey to hospitals, providers and claimants that definitions have changed and that eligibility and private patient status are now governed by the Act and s 17(8). Provide guidance notes and worked examples where possible to reduce errors in admission, billing and claims processing.

11. Legal review

    • Because the instrument ties interpretative questions to the Act, conduct a targeted legal review of relevant sections of the Australian Participants in British Nuclear Tests and British Commonwealth Occupation Force (Treatment) Act 2006 and of s 5A and paragraph 89(1)(a) of the Veterans’ Entitlements Act 1986 to ensure consistent application. Update internal legal memoranda to reflect the substituted definitions.

12. Check for downstream impacts

    • Review related policies that reference the old definitions or that use terminology changed by this instrument (for example, notices of entitlement, cost-recovery procedures, provider agreements and clinical admission protocols).
