What it does
This instrument, signed 10 September 2012 by Debra Jayne Callister‑Carter as delegate of the Minister for Sustainability, Environment, Water, Population and Communities, revokes two previously adopted State recovery plans for the southern corroboree frog and adopts a set of State-prepared recovery plans as Commonwealth recovery plans under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). The instrument is made pursuant to subsection 33(3) of the Acts Interpretation Act 1901 and subsection 269A(7) of the EPBC Act, which the instrument cites as the statutory bases for revocation and adoption. The instrument expressly lists the recovery plans being adopted, identifies the authoring State agencies and the bibliographic references for each plan, and specifies that the adopted recovery plans will "come into force on the day after this instrument is registered on the Federal Register of Legislative Instruments."
Specifically, the instrument revokes the Commonwealth adoption of the following earlier New South Wales plans: NSW National Parks and Wildlife Service (2001) Recovery Plan for the Southern Corroboree Frog (Pseudophryne corroboree) and a similarly titled plan prepared by NSW NPWS (November 2000). It then adopts as Commonwealth recovery plans the following State-made documents:
- New South Wales plans (3): National Recovery Plan for Booroolong Frog (Litoria booroolongensis) (NSW Office of Environment and Heritage, 2012); National Recovery Plan for the Southern Corroboree Frog (Pseudophryne corroboree) and the Northern Corroboree Frog (Pseudophryne pengilleyi) (NSW OEH, 2012); National Recovery Plan for Small Purple-pea (Swainsona recta) (NSW OEH, 2012).
- South Australian plan (1): National Recovery Plan for the Plains Mouse Pseudomys australis (Moseby, K., Department of Environment, Water and Natural Resources, South Australia, 2012).
