What it does
This instrument, signed by Carolyn W Cameron as the Minister’s delegate, performs two discrete legal actions under federal statute. First, it revokes, by specific listing, a set of recovery plans previously adopted under the Environment Protection and Biodiversity Conservation Act 1999 (the EPBC Act). The revocation is exercised “pursuant to subsection 33(3) of the Acts Interpretation Act 1901” and affects eight recovery plans originally adopted on various earlier dates (ranging from 1999 to 2003). Those revoked plans are listed by title, authoring State agency and original adoption date in the instrument (see the itemised list under paragraph (a)). Second, the instrument adopts a new set of recovery plans as Commonwealth recovery plans under subsection 269A(7) of the EPBC Act. The plans adopted are State-made recovery plans prepared by Queensland, Victoria and Western Australia (or agencies of those States), and the instrument lists them by listed threatened species or ecological community, with full bibliographic identification of the plan (author, year, agency).
The instrument sets the temporal mechanics for legal effect. It states that the newly adopted recovery plans “will come into force on the day after this instrument is registered on the Federal Register of Legislative Instruments” (FRLI). It also specifies that the revocations in paragraph (a) “will take effect on the day after this instrument is registered on the Federal Register of Legislative Instruments.” The instrument is dated “first March 2010” (the printed form shows blanks filled with “first” and “March 2010”) and contains the delegate’s signature block.
Statutory authorities invoked in the instrument are explicit: revocation is taken under s 33(3) of the Acts Interpretation Act 1901; adoption is taken under subsection 269A(7) of the EPBC Act 1999. The instrument thus operates as a statutory instrument that changes which documents are the Commonwealth’s recovery plans for the named listed threatened species and ecological communities by revoking earlier adopted plans and adopting alternative state-prepared plans. The text does not incorporate the recovery plan content into the instrument; it adopts the listed plans by reference and identifies their authors and publication details.
