What it does
This instrument sets out how Commonwealth payments for the supply of trastuzumab are calculated and claimed where the supplier is an approved private hospital authority, an approved pharmacist, an approved medical practitioner, an approved public hospital, or an approved public hospital authority. It does not reproduce the full pricing arrangements for highly specialised drugs; instead it links payments for trastuzumab to existing arrangements for highly specialised drugs and supplies discrete mechanical rules for public hospital authority payments and the claims process.
Key mechanical effects in the text are:
-
Approved private hospital authorities, approved pharmacists and approved medical practitioners who supply trastuzumab “in accordance with these arrangements” are entitled to be paid by the Commonwealth as if paragraphs 20 to 23 of the highly specialised drugs arrangements set out in No. PB 54 of 2009 applied to trastuzumab (s 18). The instrument therefore imports, by reference, those paragraphs for private suppliers.
-
For approved public hospitals, the Commonwealth is liable to pay the State or Territory government in which the hospital is located an amount equal to 99.2% of the “dispensed price” for the supply of the drug (s 19). The dispensed price for that purpose is to be ascertained in accordance with paragraphs 33 to 35 of the highly specialised drugs arrangements set out in No. PB 125 of 2009, applied to trastuzumab (s 20). The instrument therefore imports those paragraphs for the purpose of determining the dispensed price for public hospitals.
-
For approved public hospital authorities (distinct from the State or Territory entitlement in s 19), the Commonwealth is to pay amounts calculated against ex-manufacturer pack prices and a fixed mark-up of 11.1% where the supplied quantity equals a manufacturer’s pack (s 21-22). Rules are provided for broken packs (pro rata by unit) (s 23), mixed quantities that exceed a pack (s 24), and rounding to the nearest cent (s 25).
