Superannuation (Productivity Benefit) (Qualified Employees and Alternative Arrangements) Declaration No. 2

The instrument introduces and uses a small set of defined and operational concepts that determine eligibility, the decision point, and payment mechanics.

• Declared member: shorthand used in the instrument for a member of the class of qualified employees declared in clause 5. Clause 3 explicitly defines “declared member” as a member of the class declared in clause 5 (cl 3). Clause 4 sets out who falls into that class: officers of the Defence Force serving on a continuous full-time basis and entitled to receive performance-based pay in that capacity (cl 4). The instrument thus makes eligibility contingent on both employment status (officer, continuous full-time) and an entitlement to a specific kind of pay.

• Performance-based pay: defined in clause 3 as “a payment of that name payable on or after 3 June 1994 under a decision of the Defence Force Remuneration Tribunal under section 58H of the Defence Act 1903” (cl 3). The definition ties the concept expressly to a tribunal-made decision and a particular statutory head of power in the Defence Act (s 58H), and fixes the earliest relevant date for such payments at 3 June 1994.

• Qualified employees / declared class exclusions: clause 4 designates the class of qualified employees; clause 5 declares that that class is “a class of employees who are neither fund employees nor interim arrangement employees” for the purposes of subsection 4A(1) of the Act (cl 5). Those excluded labels are used but not defined in this Declaration, implying their definitions and consequences sit in the Act.

• Election and notices: clauses 7-10 set up an opt-in mechanism. A declared member has the right to elect to have performance-based pay taken into account in their superannuation arrangements (cl 7). Elections are expressed to apply to particular payments only (cl 9). Notices must be in writing, signed, and given to the designated employer according to precise timing rules (cl 10).

• Designated employer, approved fund, nominated fund: the Declaration repeatedly uses the terms “designated employer”, “approved fund” and “nominated fund” (cl 8, cl 12-13). The instrument requires designated employers to pay 20 percent of the performance-based pay to either an approved fund specified by the member or the nominated fund in relation to the member (cl 12(2), cl 13(2)(b)). Those terms are operational but not defined within the text of this Declaration; definitions and criteria for “approved fund”, “nominated fund” and “designated employer” are therefore matters that must be located in the Act or associated instruments.

• Temporal distinction: the Declaration differentiates between performance-based pay relating to service before 1 July 1994 and service after 30 June 1994, producing distinct procedural and cashflow rules (cl 9, cl 12-13). The instrument has retrospective effect to 3 June 1994 by virtue of its commencement provision (cl 2 and definition of performance-based pay).

• Payment proportions and sequencing: the core arithmetic rule is a 5 percent member contribution combined with a 20 percent employer payment of the total amount of the performance-based pay, with the sequencing differing depending on the service date: member-paid within three months for pre-1 July 1994 payments (cl 12(2)) versus employer deduction at source for later payments (cl 13(2)(a)).

These concepts interact to determine who may elect, how to effect the election, which payment(s) are captured, who remits the contributions and to which fund those employer payments are to be made. The Declaration therefore functions as a narrow, procedure- and cashflow-focused instrument layered on top of the Act’s broader architecture.

The Declaration identifies a narrowly defined set of affected parties and, by implication, leaves the rest to the Act and other instruments. The directly affected parties in the text are:

• Declared members: the principal beneficiaries and decision-makers under the Declaration. A declared member is a person who fits the class described in clause 4 , an officer of the Defence Force serving on a continuous full-time basis who is entitled to performance-based pay in that capacity (cl 4). Those persons gain a statutory right to elect to include specified performance-based pay in superannuation arrangements (cl 7), and they bear certain obligations if they opt in (for pre-1 July 1994 payments they must make a 5 percent payment within three months, cl 12(2)).

• Designated employer: the body that receives notices, effects deductions, and must make employer payments to funds (cl 10(2), cl 12(2), cl 13(2)). The Declaration repeatedly requires the designated employer to act on member elections and either to receive a member’s 5 percent payment (pre-1 July 1994) or to deduct 5 percent by lump sum and pay 20 percent to an approved or nominated fund for post-30 June 1994 payments (cl 12(2), cl 13(2)). The instrument uses the term without defining it, so its precise identity, statutory responsibilities and relationship with the Act are matters external to this Declaration.

• Approved funds and nominated funds: these are the recipients of the employer’s 20 percent payment. The member may specify an “approved fund” in their notice (cl 8(1), cl 12(2)(a), cl 13(2)(b)(i)). If the member does not specify an approved fund, the employer must pay the 20 percent to the “nominated fund in relation to the member” (cl 12(2)(b), cl 13(2)(b)(ii)). The Declaration assumes the existence and legal meaning of those terms but does not define them: their regulatory criteria and tax/superannuation consequences are set out, if at all, in the Act or other superannuation law.

• Defence Force Remuneration Tribunal: indirectly implicated as the decision-making body whose decision generates the defined “performance-based pay” by operation of clause 3 (cl 3 referencing s 58H of the Defence Act 1903). The Tribunal’s determination is the lawful source of the payment type that this Declaration addresses.

• Administrative actors: payroll officers in the designated employer, superannuation fund administrators, and record-keepers. They must process written notices, validate timing, withhold or receive member payments, effect employer contributions to funds, and maintain contemporaneous documentation (cl 10-13). The instrument creates administrative obligations rather than broad regulatory duties.

• Persons explicitly excluded: the class of qualified employees declared by clause 5 is stated to be “neither fund employees nor interim arrangement employees” (cl 5). As those labels are exclusions from certain categories within the Act, persons falling within the labels “fund employees” or “interim arrangement employees” will not be caught as “declared members” under this Declaration.

By construction the affected population is concentrated (full-time Defence Force officers entitled to performance-based pay), the decision-maker capacity sits with the declared member (right to elect and to specify an approved fund, cl 7-8), and financial obligations rest with both the member (5 percent payment in some cases, cl 12(2)) and the designated employer (20 percent payment and deduction duties, cl 12-13). The Declaration shapes the administrative behaviour of employers and funds rather than creating a broad regulatory burden on unrelated actors.

The Declaration establishes discrete rights for declared members and compels specific actions for designated employers, with procedural duties that both sides must respect.

Rights of declared members

• Right to elect inclusion of performance-based pay: A declared member may elect to have performance-based pay taken into account in his or her superannuation arrangements under the Act (cl 7(1)). The instrument frames the election as permissive , the member chooses to opt in.

• Right to nominate a fund: If the member elects, they may also elect to have employer payments paid by the designated employer to an approved fund specified in the member’s notice (cl 8(1)(a)-(b)). The member’s choice between a specified approved fund and accepting payment into the nominated fund is preserved.

• Right to limit scope of election: An election applies only to particular payments. If the notice is expressed to apply to a pre-1 July 1994 payment, it applies only to that payment; otherwise it applies only to the first performance-based pay payment received after the notice takes effect (cl 9). That constrains the temporal scope of the member’s election.

Duties of declared members

• Form and timing of notice: A notice of election must be in writing and signed, and must be given to the designated employer according to strict timelines: for pre-1 July 1994 service-related payments, not later than three months after receiving the payment; for other cases, before receiving the payment (cl 10(1)-(2)). Notices take effect when given to the designated employer in accordance with those timing rules (cl 10(3)).

• Payment obligation for pre-1 July 1994 payments: If the election relates to performance-based pay for service before 1 July 1994, the declared member must pay 5 percent of the total amount of the performance-based pay to the designated employer within three months after receipt to trigger the employer payment obligation (cl 12(2)).

Duties of the designated employer

• Receipt and processing of notices: The designated employer must accept notices and recognise their effective date according to the timing rules (cl 10). The notice must be given to the designated employer, not to a fund (cl 10(2)).

• Employer payment obligation if member meets conditions (pre-1 July 1994): If the member pays the 5 percent within three months for pre-1 July 1994 payments, the designated employer must pay 20 percent of the total amount of the performance-based pay to the specified approved fund or, if no fund is specified, the nominated fund (cl 12(2)).

• Employer deduction and payment obligation (post-30 June 1994): For performance-based pay relating to service after 30 June 1994, the designated employer must deduct 5 percent of the total amount by a lump-sum deduction from the performance-based pay payment to the member; and must pay 20 percent of the total amount of the performance-based pay to the specified approved fund or the nominated fund (cl 13(2)(a)-(b)). The use of “must” in these clauses creates mandatory employer duties.

Other operational duties

• Fund routing: Employers must route employer contributions either to the fund the member specified under clause 8, or, if none is specified, to the nominated fund for the member (cl 8(1), cl 12(2)(a)-(b), cl 13(2)(b)(i)-(ii)).

• Scope restriction: Employers must respect the scope restrictions imposed by clause 9: an election applies only to the particular payment(s) specified (cl 9).

Negative right (non-inclusion by default)

• If the declared member does not make an election, the member’s performance-based pay is not taken into account for the purposes of the Act (cl 11). This establishes a default negative right: absence of election results in non-treatment under the Act.

Procedural certainty and compliance obligations are central. The text prescribes formality (writing and signature), specific timing cut-offs, a clear contribution arithmetic (5 percent/20 percent), and routing rules to approved or nominated funds. The Declaration therefore establishes both positive entitlements for members who elect and mandatory operational duties for designated employers when the election is properly made.

The Declaration itself contains no express penalty, sanction or enforcement regime. Its operative clauses impose mandatory duties using “must” and prescribe mandatory timing and form (for example, the designated employer “must” pay 20 percent in specified circumstances, cl 12(2) and cl 13(2)(b)), but the instrument does not set out consequences for non-compliance, nor does it create express enforcement mechanisms or civil or criminal penalties within its text.

Because the Declaration is made under subsections of the Superannuation (Productivity Benefit) Act 1988 (preamble), enforcement and remedial measures for breaches of duties established by the Act are likely governed by the Act and other relevant legislation or administrative processes. However, the text of this Declaration contains no provision that (a) specifies a sanction for failure by a designated employer to make a payment or to perform a deduction, (b) prescribes a remedy for a member if an employer fails to act, or (c) establishes an administrative process for disputes and rectification.

Enforcement implications that do arise from the instrument’s language are procedural and operational rather than punitive: the instrument creates clear expectations and documentary proof points that will be relevant to any enforcement action taken under the Act or other law. For example:

• Notice formalities: A member’s election is effective only if the written signed notice is given to the designated employer within the timeframes in clause 10 (cl 10(1)-(3)). Failure to provide the notice when required eliminates entitlement to employer payments under this Declaration for that payment (cl 9-11).

• Conditional employer obligations: For pre-1 July 1994 payments, the employer’s duty to pay 20 percent is conditional on receiving the member’s 5 percent payment within three months of the member receiving the performance-based pay (cl 12(2)). Where that condition is unmet, the Declaration provides no internal enforcement step but removes the employer’s obligation.

• Mandatory employer actions for post-30 June 1994 payments: The employer’s duty to deduct a 5 percent lump sum and to pay 20 percent to the fund is unqualified in the clause (cl 13(2)). If an employer fails to deduct or remit, the instrument gives no internal remedy; the remedying mechanisms (if any) would be those provided by the Act or other legal processes.

Practically, parties seeking to assess enforcement risk should consult the Act for remedies, sanctions and administrative mechanisms that apply to non-compliance with a declaration made under the Act. The Declaration provides a precise audit trail: written notices, date-stamped receipt by the designated employer, member payments within a three-month window, and employer remittances to approved or nominated funds. Those elements will be essential if enforcement action is pursued under the Act or by related administrative channels, but the Declaration itself does not specify penalties or an enforcement pathway.

The Declaration is an instrument operating within the statutory architecture of the Superannuation (Productivity Benefit) Act 1988 and intersects with the Defence Act 1903 by reference. The text expressly situates itself legally: it is “made under subsections 3F(1) and 4A(1) and (2) of the Superannuation (Productivity Benefit) Act 1988” (preamble). It also ties the defined payment to a decision of the Defence Force Remuneration Tribunal under section 58H of the Defence Act 1903 in its definition of “performance-based pay” (cl 3).

Consequential interactions and dependencies visible from the Declaration include the following:

• Dependent definitions and categories in the Act: The Declaration uses labels that the Act must define and regulate, including “fund employees”, “interim arrangement employees”, “designated employer”, “approved fund” and “nominated fund” (cl 3, cl 5, cl 8, cl 12-13). The Declaration cannot be read in isolation on those points; the legal meaning, eligibility criteria and effects of those labels will be determined by the Act or other superannuation regulations.

• Tribunal determinations under the Defence Act: The definition of performance-based pay is anchored to a Defence Force Remuneration Tribunal decision under s 58H of the Defence Act 1903 (cl 3). That means the availability of the payment type and the identity of payments that qualify are contingent on the Tribunal’s determinations under the Defence Act, situating the Declaration at the intersection of defence remuneration law and superannuation law.

• Temporal cut-offs and retrospective operation: Clause 2 takes the Declaration to have commenced on 3 June 1994 (cl 2), and clause 3’s definition of performance-based pay refers to payments payable on or after 3 June 1994 (cl 3). The Declaration therefore operates with retroactive effect to that date. Interaction with tax law, superannuation law and payroll treatment for payments made around that date will require cross-reference to the Act and to tax law to determine tax deductibility, reporting obligations and other statutory treatments not addressed in the Declaration.

• Fund regulation and approvals: The instrument requires employer payments to be made to an “approved fund specified in the notice” or to the “nominated fund” (cl 8(1), cl 12(2), cl 13(2)(b)). The criteria for a fund being “approved” and the legal status of a “nominated fund” are likely to be statutory or regulatory concepts beyond this Declaration; interactions with superannuation prudential regulation, tax treatment and fund eligibility rules therefore arise.

• Payroll and withholding law: The employer deduction requirement for post-30 June 1994 payments (cl 13(2)(a)) interacts with payroll law and any relevant statutory constraints on deductions from employees’ wages. The Declaration imposes a mandatory lump-sum deduction by the employer; whether any employment law constraints (for example, requiring employee consent for deductions) apply is a matter that must be reconciled with the Act and employment law, not with this Declaration alone.

• Administrative and procedural law: The notice requirements and the routing of payments to nominated or specified funds create administrative processes whose compliance implications will intersect with record-keeping, privacy, superannuation reporting and possibly audit obligations under the Act and other legislation.

In sum, the Declaration is a procedural add-on to the Act that prescribes how performance-based pay for a specified class of Defence officers is to be treated for superannuation purposes. It assumes and depends upon external legal definitions and enforcement mechanisms in the Act and engages with Defence remuneration law through the Tribunal reference. For full legal effect, the Declaration must be read together with the relevant provisions of the Superannuation (Productivity Benefit) Act 1988 and any applicable superannuation, payroll and tax statutes and regulations.

The Declaration’s internal text records limited historical data. The instrument is Statutory Rules 1994 No. 3041 and titled Superannuation (Productivity Benefit) (Qualified Employees and Alternative Arrangements) Declaration No. 2 (header). It is dated 24 August 1994 in the signature block (preamble), and clause 2 states that the Declaration is taken to have commenced on 3 June 1994. A short set of notes at the end records that the Declaration is dated 24 August 1994 and that it was notified in the Commonwealth of Australia Gazette on 5 September 1994 (notes).

There are no amendment clauses within the text, no schedules modifying earlier declarations, and no subsequent amending instrument or revocation recorded in the text provided. The instrument itself is a freestanding Declaration; it does not purport to amend prior declarations directly. Because the Declaration is numbered “No. 2” this indicates there was at least one other declaration in the same subject area, but the content of any other instrument and any amendments to it are not included in the text before us.

The precise timeline recorded in the document is therefore:

• 3 June 1994 , the date from which the Declaration is taken to have commenced (cl 2) and the earliest date referenced in the definition of performance-based pay (cl 3).

• 24 August 1994 , date of signature of the Minister for Finance, Kim C. Beazley, and the date the Declaration was made (preamble and signature block).

• 5 September 1994 , the date the Declaration was notified in the Commonwealth of Australia Gazette (notes).

No subsequent amendment history, partial repeal or replacement is recorded in this instrument. Any later amendments, revocations or judicial pronouncements affecting its operation would need to be identified in external sources or later statutory instruments, none of which are contained in this text. For current operative status and any later changes, practitioners must check consolidated statutory records and the Act’s instrument registers.

The Declaration contains no reference to litigation, court decisions, appeals, administrative reviews or disputes arising from its operation. The text is silent on any judicial or tribunal consideration of the instrument. It records only its making, its commencement date and its gazettal notice date (preamble, cl 2, notes).

Given that this instrument is an administrative declaration dealing with superannuation arrangements for a specific class of Defence Force officers, any litigation or administrative challenges that might have arisen would be external to the Declaration and are not recited here. The instrument does not embed a dispute-resolution mechanism or any internal review clause that would generate a documented litigation history within its own text.

Therefore, within the confines of the source provided:

• No cases or proceedings are named in the Declaration.

• No references to judicial interpretation, interlocutory orders or settlements are included.

• There is no recorded litigation history, challenge, or amendment arising from a dispute contained in this document.

Practitioners requiring information on whether this Declaration has been the subject of litigation or judicial interpretation must consult case law databases, tribunal records or consolidated legislative histories outside this instrument. The Declaration itself provides no material on litigation or judicial treatment.

The Declaration creates a number of practical traps and fine points that can produce unintended results if parties do not follow the precise forms, timing, and routing rules in the clauses. Key practical “gotchas” visible in the text include:

1. Timing and scope of elections are narrow and payment-specific (cl 9-10)

• An election applies only to a particular payment: for pre-1 July 1994 service, if the notice is expressed to apply to a payment in relation to service before 1 July 1994, it applies only to that payment; for other cases it applies only to the first payment received after the notice takes effect (cl 9). Practically, a member who intends to capture multiple or subsequent payments must give separate effective notices for each payment unless the wording of the notice is crafted within the narrow constraints permitted by the clause.

2. Strict notice form and delivery rules (cl 10)

• A notice must be in writing and signed (cl 10(1)) and must be given to the designated employer (cl 10(2)). For pre-1 July 1994 service payments, the notice must be given not later than three months after the member receives the payment (cl 10(2)(a)); for other payments, before the member receives the payment (cl 10(2)(b)). Failure to comply with these formalities defeats the election (cl 10(3), cl 11). Sending a notice to a fund rather than the designated employer, or missing the three-month window for a past payment, cancels the member’s ability to trigger employer payments via this Declaration.

3. Different mechanics for pre- and post-cut-off payments (cl 12-13)

• For pre-1 July 1994 payments, the member must proactively pay 5 percent to the designated employer within three months after receipt to trigger the employer’s 20 percent payment obligation (cl 12(2)). If the member does not make that payment within three months, the employer is not obliged under the Declaration to make the 20 percent payment.

• For payments relating to service after 30 June 1994, the employer has the duty to deduct 5 percent by a lump-sum deduction from the payment and to pay 20 percent to the fund (cl 13(2)(a)-(b)). This difference changes who must act to make the 5 percent contribution: the member for pre-cut-off payments, the employer for later payments.

4. Conditional employer obligation for pre-cut-off payments (cl 12(2))

• The employer’s 20 percent payment is conditional on receipt of the member’s 5 percent payment in the pre-1 July 1994 case (cl 12(2)). This timing condition can be overlooked, leaving members who pay late with no further remedy in the Declaration.

5. Default routing to nominated fund (cl 8, cl 12-13)

• If a member does not specify an approved fund under clause 8, the employer must pay to the nominated fund in relation to the member (cl 12(2)(b), cl 13(2)(b)(ii)). Members who omit to specify a fund may find their employer contributions routed to a nominated fund that they did not intend.

6. Undefined operational terms within the Declaration (cl 3, cl 5, cl 8, cl 12-13)

• Terms such as “approved fund”, “nominated fund”, “designated employer”, “fund employees” and “interim arrangement employees” are used without definition in the Declaration. Their precise legal meaning, eligibility requirements and consequences are external to the instrument. Practitioners must cross-reference the Act or other instruments to avoid misapplication.

7. Retroactivity and date boundaries (cl 2-3, cl 9-13)

• The Declaration is taken to have commenced on 3 June 1994 (cl 2). The definition of performance-based pay references payments payable on or after 3 June 1994 (cl 3), while the operational split uses 1 July 1994/30 June 1994 as the service cut-off (cl 9, cl 12-13). Parties must correctly determine whether a payment relates to service before or after 1 July 1994, a fact-sensitive exercise that may rely on payroll, service records and the Tribunal’s decision.

8. Single-payment application for non-pre-1 July elections (cl 9)

• For elections not expressed to apply to a pre-1 July 1994 payment, the election applies only to the first performance-based pay received after the notice takes effect. Members expecting a recurring treatment for all future payments must actively make further elections.

9. Records and proof required for audit or dispute resolution (cl 10-13)

• Because the Declaration ties employer obligations to documentary events (writing, signature, payment within three months, deductions), absent or ambiguous records will weaken both member claims and employer defences. Employers should maintain date-stamped receipts of notices and payments; members should retain proof of payment and copies of notices.

10. Interplay with payroll deduction law and employment contracts (cl 13(2)(a))

• The mandatory employer deduction for post-30 June 1994 payments (cl 13(2)(a)) may intersect with employment contract provisions or other statutory limits on deductions. The Declaration does not address consent or priority among deductions; affected parties should verify that the deduction mechanism does not conflict with other legal obligations.

These operational pitfalls make strict adherence to the clause language essential. The Declaration’s narrow scope and precise conditions create many edge cases where timing, form and routing errors will determine entitlement or obligation. Parties must map these textual provisions to their payroll, fund nomination and administrative processes to avoid unintended loss of entitlement or unexpected liability.

This section sets out a practical compliance checklist, divided into actions for declared members and for designated employers, aligned strictly with the clauses of the Declaration. The Declaration’s obligations are procedural and financial: compliance requires timely, documented notices and correct payment flows.

For declared members (eligible Defence Force officers)

1. Confirm eligibility

• Verify that you satisfy clause 4: you are an officer of the Defence Force, serving on a continuous full-time basis, and you are entitled to receive performance-based pay in that capacity (cl 4). The Declaration applies only to that class.

2. Decide whether to elect

• If you want your performance-based pay to be taken into account for superannuation under the Act, prepare to make an election in writing (cl 7(1)).

3. Draft and deliver the notice correctly

• Ensure the notice is in writing and signed by you (cl 10(1)).

• Deliver the notice to your designated employer, not to a fund (cl 10(2)). For a payment that relates to service before 1 July 1994, deliver the notice not later than three months after you receive that payment (cl 10(2)(a)); for other payments, deliver the notice before you receive the payment (cl 10(2)(b)). The notice takes effect when given in accordance with those rules (cl 10(3)).

4. Specify a fund if desired

• If you want the employer’s 20 percent contribution paid to a particular approved fund, specify that approved fund in the notice under clause 8 (cl 8(1), cl 12(2)(a), cl 13(2)(b)(i)). If you do not specify an approved fund, the employer will pay into the nominated fund (cl 12(2)(b), cl 13(2)(b)(ii)).

5. Meet the member payment obligation for pre-1 July 1994 payments

• If the election relates to performance-based pay for service before 1 July 1994, pay 5 percent of the total amount of the performance-based pay to the designated employer within three months after you receive the payment (cl 12(2)). Keep receipts and proof of payment.

6. Retain documentation

• Keep copies of the signed notice, confirmation of delivery to the designated employer, proof of any 5 percent payment and any employer responses or fund allocation confirmations.

For designated employers

1. Accept and date notices

• Ensure administrative processes accept written signed notices from declared members and that such notices are date-stamped and recorded on receipt (cl 10(1)-(3)).

2. Validate scope and timing

• For notices that relate to pre-1 July 1994 service payments, check that the notice was received within three months after the member received the payment (cl 10(2)(a)); for others, ensure the notice was received before the member received the payment (cl 10(2)(b)). Confirm that the notice is limited to the payment(s) intended as per clause 9.

3. For pre-1 July 1994 payments, process member payments and employer obligation

• If the member pays 5 percent of the performance-based pay to the designated employer within three months, remit 20 percent of the total amount of the performance-based pay to the fund specified by the member (if any) or to the nominated fund in relation to the member (cl 12(2)(a)-(b)). Keep receipts and evidence of the member payment and employer remittance.

• If the member does not pay the 5 percent within three months, under the Declaration you are not obliged to make the 20 percent payment (cl 12(2)).

4. For post-30 June 1994 payments, effect the lump-sum deduction and employer contribution

• Deduct 5 percent of the total amount of the performance-based pay by a lump-sum deduction from the payment to the member and remit 20 percent of the total amount of the performance-based pay to the specified approved fund or to the nominated fund for the member (cl 13(2)(a)-(b)). Establish payroll processes to effect the lump-sum deduction on the payment date.

5. Fund routing and validation

• On receipt of a clause 8 fund specification, verify that the fund is an “approved fund” under the relevant legislative framework before remitting the 20 percent payment (cl 8(1), cl 12(2)(a), cl 13(2)(b)(i)). If no fund is specified, remit to the nominated fund in relation to the member (cl 12(2)(b), cl 13(2)(b)(ii)). Maintain records of remittance and fund confirmations.

6. Recordkeeping and audit trail

• Maintain contemporaneous records that document notices received, dates, member payments received, deductions made, remittances to funds, and communications with the member and fund administrators. These records will support both internal audits and any external review under the Act.

7. Reconciliation and reporting

• Reconcile payroll and fund remittance records regularly to ensure 5 percent deductions and 20 percent employer remittances align with the total amounts of the relevant performance-based payments. Prepare to supply evidence of compliance if queried under the Act.

Cross-cutting compliance points

• Double-check the classification: Ensure that the person is a “declared member” as per clause 4 and not excluded by virtue of being a “fund employee” or an “interim arrangement employee” (cl 4-5). Those labels are assessed under the Act, so confirm classifications against the Act’s definitions.

• Be precise about the service date cut-off: Determine whether the performance-based pay relates to service before 1 July 1994 or after 30 June 1994 to apply the correct mechanics (cl 9, cl 12-13).

• Communicate early with members: Because some obligations are conditional on member action (cl 12(2)), inform members of the steps and timelines required to effect their elections.

• Get legal cross-references: Because the Declaration uses terms defined in the Act and references the Defence Act’s Tribunal decisions, consult the relevant statutory provisions to resolve definitions and downstream consequences (preamble; cl 3; cl 5).

Compliance under the Declaration is document- and date-driven. Parties should build simple checklists and payroll workflows that mirror the clause logic: written signed notice to designated employer; evaluation of whether the notice relates to pre- or post-cut-off service; member payment within three months for pre‑cutoff payments or employer deduction for post‑cutoff payments; remittance of 20 percent to approved or nominated fund; retention of proof. These steps will align operational practice with the Declaration’s mandatory language.
