What it does
This instrument, signed by Malcolm Bligh Turnbull as Minister for the Environment and Water Resources and dated 9 May 2007, performs two discrete legal acts under Commonwealth executive power as described in the instrument text. First, it repeals two previously adopted recovery instruments that were earlier adopted under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) pursuant to subsection 269A(7). The repealed items are: (a) the Thick‑billed Grasswren (Western Subspecies) (Amytornis textilis textilis) Interim Recovery Plan 2000-2002, which the instrument records was adopted under s 269A(7) on 13 October 2003; and (b) the Conservation Research Statement and Species Recovery Plan for Persoonia nutans R. Br. 1996, which the instrument records was adopted under s 269A(7) on 5 October 2001 (instrument, para 1(a)-(b)).
Second, the instrument adopts a set of recovery plans prepared by States or Territories (or agencies of those jurisdictions) and declares those documents to be recovery plans for the Commonwealth listed threatened species specified in the instrument. The adoption is undertaken "under subsection 269A(7) of the Environment Protection and Biodiversity Conservation Act 1999" and covers three New South Wales plans, two Northern Territory plans and two Queensland plans; each adopted plan is identified by title, author and date in the instrument (instrument, para 2 and the three recovery-plan tables).
The instrument records the temporal effect of both operations: the repeal of the two named plans “will take effect on the date of signing of this instrument” and the newly adopted recovery plans “will come into force on the date of signing of this instrument” (instrument, final paragraphs). The instrument is made pursuant to subsection 33(3) of the Acts Interpretation Act 1901 for the repeals and pursuant to subsection 269A(7) of the EPBC Act for the adoptions (instrument, opening lines and para 1).
