Expungement of Historical Homosexual Offence Records Act 2018

Definitions set the architecture. The Act defines applicant, application, charge, conviction, court, determination, expungable offence, personal information by reference to the Information Act 2002, record, revocation and related terms (s 4). A “record” is broadly defined to include recorded information in any form required to be kept by the Police Force, the Director of Public Prosecutions, courts, and the archives service established under the Information Act 2002 (s 4). That definition identifies who must act when an expungement occurs (see ss 19-23).

Expungable offence is a statutory category, not a free‑standing discretion. Section 7 lists the offences that may be expunged: certain repealed offences (ss 7(a)-(b)), offences prescribed by regulation that involve consensual same‑sex activity (s 7(c)), offences against public decency or morality that could have been used to punish homosexual behaviour (s 7(d)), and inchoate offences (attempt, conspiracy, incitement) related to those offences (s 7(e)). The inclusion of regulation‑made offences (s 7(c)) leaves scope for the Administrator to add specific offences by subordinate instrument.

Eligibility criteria are cumulative and specific (s 8). The CEO may expunge only if: the offence qualifies as an expungable offence (s 8(a)); the person would not have been charged but for suspicion that the conduct was homosexual or connected to homosexual activity (s 8(b)); and, crucially, the conduct would not currently constitute an offence under Territory law at the time of decision (s 8(c). The latter introduces a contemporaneous legality test: conduct that is an offence today is not eligible.

Decision standard and procedure: the CEO must consider applications “as soon as practicable” (s 15(1)) and decide on the balance of probabilities whether the criteria are met (s 17(1)-(2)). The Act requires no oral hearing (s 15(2)). The CEO may request further documentation from applicants (s 11) and may require additional information if an application lacks requisite particulars (s 10). The applicant must provide a consent authorising the CEO to inquire and for disclosure of information to the CEO (s 9(4)(e)). The CEO has powers to inquire and can require information or documents from specified persons and bodies (s 14(2)-(3)). Those persons must take all reasonable steps to comply (s 14(4)).

Legal effects and exclusions: s 20 contains the substantive remedy effects. It operates broadly: treat the person as if the event had not occurred (s 20(1)); exclude references in agreements and instruments (s 20(2)); allow the person to lawfully claim not having been charged or convicted and make evidence of the expunged matter inadmissible (s 20(3)(a)-(b)); remove the matter from criminal history (s 20(3)(c)); remove disclosure obligations and prohibit discrimination based on the expunged matter (s 20(3)(d)-(f)). The section also expressly applies despite other laws to the contrary, naming specific laws (s 20(5)). The Act preserves prior lawful acts done before expungement (s 27) and does not authorise destruction of records (s 19(6)).

Record‑holder duties and CEO directions: upon notification of expungement, record holders must update records to show expungement, include a warning that disclosure is an offence and include any prescribed statements (s 19(1)). They must notify the CEO within 28 days of compliance or explain inability to comply; the CEO can then issue directions (s 19(2)-(4)). If the CEO later revokes an expungement, the holder must “restore” the record to show the charge is no longer expunged and remove the warning and prescribed statements (s 23(1)).

Criminal offences and liability standards: s 25 criminalises unlawful disclosure by persons with access to records, subject to exceptions and with strict liability applying to the access element (s 25(2)). Section 26 criminalises obtaining expunged information dishonestly; absolute liability applies to whether the information is in a record (s 26(2)) and strict liability applies to whether the information is about an expunged charge/conviction (s 26(3)). Part IIAA of the Criminal Code applies to offences under the Act (s 6).

Review and confidentiality: review rights are provided to applicants and the subject of the application by NTCAT (s 30(1)-(2)). Tribunal proceedings are closed and publication of identifying information is prohibited unless the Tribunal authorises it where the benefit outweighs privacy interference (s 30(3)-(4)).

Administrative architecture: the CEO has broad powers “necessary to perform” functions under the Act, may approve forms and delegate (s 29). Regulations are authorised (s 31), including potentially to prescribe offences for s 7(c) and statements required under s 19(1)(c).

Together, these concepts establish an administrative, document‑based expungement regime, defined by statutory eligibility criteria, specific duties for record‑holders and investigatory powers for the CEO, with criminal sanctions to protect the confidentiality of expunged records and review rights through NTCAT.

Primary beneficiaries: individuals who were charged with or convicted of an expungable offence, and persons authorised to apply on their behalf, are the direct subjects of the scheme (s 9(1)-(3)). That includes deceased persons where an eligible representative applies (s 9(2)) and persons with impaired decision‑making capacity where specified guardians, attorneys, spouses, relatives or close associates may apply (s 9(3)). The statutory treatment in s 20 applies to the person whose charge or conviction is expunged: legal status, disclosure obligations, admissibility and treatment in appointments, licensing and employment contexts change for that person (s 20(3)(a)-(f)).

Administrative decision‑maker and staff: the CEO and delegated officers implement the scheme. The CEO controls forms, inquiries, directions to record‑holders and the expungement and revocation processes (s 29). The CEO’s exercise of discretion determines who receives relief and what record‑keeping steps are required; delegated staff will carry out inquiries and give notices, relying on powers to request documents (ss 11, 14, 29).

Record holders and public agencies: the Police Force, Director of Public Prosecutions, courts and the Territory archives service (as defined in s 4) have documentary and operational obligations when notified of an expungement: to change records, include a statutory warning, include any prescribed statements and to notify the CEO within 28 days about compliance or inability to comply (ss 4, 19(1)-(4)). Those agencies also are potential sources of information to support the CEO’s inquiries; they must “take all reasonable steps” to comply with notices (s 14(4)). Public sector employees more broadly can be required to provide documents under s 14(2)(e).

Third parties who rely on historical records: employers, licensing bodies, tribunals, courts, insurers and other private bodies that use criminal record checks or references are indirectly affected because s 20 changes the legal relevance of expunged entries. Section 20(3)(f) specifically addresses appointment, employment and licencing consequences. However, s 27 preserves the legality of acts done before expungement , for example, a past dismissal lawfully effected before expungement is not automatically undone by these provisions.

Archives, libraries and researchers: the Act criminalises unauthorised disclosure but contains exceptions for archives and libraries that make information available in forms normally available for public use in accordance with normal procedures (s 25(3)(d)). It also allows disclosure for statistical or research purposes in a form that cannot identify the person (s 25(3)(e)). Those exceptions affect how archives and research bodies handle access requests and anonymisation.

People who provide information to the CEO: persons or bodies providing documents or information in good faith to the CEO under ss 10, 11 or 14 are protected from civil, professional and criminal liability and cannot be held to have breached professional etiquette or standards (s 12(3)). That protection affects police, court registrars, DPP staff and public sector employees who cooperate with the CEO.

Persons with access to records: the Act creates criminal liability for intentional disclosure by persons with access to records where the disclosure results in publication of expunged information and the person is reckless as to that outcome (s 25). Strict liability applies to the element of having access (s 25(2)). This affects employees and contractors of record holders, private screening companies with database access and any third party with authorised access.

Legal representatives and tribunals: applicants and subjects have review rights in the NTCAT (s 30). The closed nature of such hearings (s 30(3)) restricts public scrutiny and affects how legal representatives prepare and handle confidential material in a closed proceeding.

Those who seek compensation: the Act expressly removes any entitlement to compensation for being charged, prosecuted or convicted of an expungable offence or for any losses arising from those historical events, and for having an expunged charge or conviction (s 21). That provision affects any civil claims that might otherwise be advanced against the Territory or third parties for historical harms connected to the offences.

In sum, the scheme reshapes legal status and documentary practice for former defendants (and those acting on their behalf), allocates duties to specified public bodies to alter or restore records, imposes confidentiality duties and criminal sanctions on persons with access to records, offers protection for good‑faith providers of information, and limits compensation routes for historical harms. The CEO sits at the hub of these interactions with delegated staff and the NTCAT overseeing reviewing functions.

Duties of applicants: an applicant must use the approved form and provide specified particulars: full name, date of birth and contact details (including any differences from the time of the charge), applicant identity if acting on another’s behalf, particulars of the charge or conviction (description, date, place and court), transcripts or sentencing remarks if possessed, and a consent authorising the CEO to inquire and receive documents (s 9(4)(a)-(e)). Applicants may also provide any other information they consider relevant (s 9(4)(f)). If an application lacks required information, the CEO may require the missing material within 28 days or longer (s 10(1)). Applicants may respond to a notice of proposed refusal or proposed revocation with further submissions within 28 days (ss 16(2)(c), 22(3)(c)-(4)).

CEO duties and powers: the CEO must take reasonable steps to inquire into the application (s 14(1)), may request additional documents and information (s 11(1), s 14(2)), must consider an application “as soon as practicable” (s 15(1)), and must notify applicants and record holders of determinations and provide reasons (s 17(3)-(5)). Before refusing an application the CEO must issue a written notice explaining reasons, provide the documents relied upon and give the applicant 28 days to respond (s 16). The CEO has the power to revoke a determination where it was made because of false or misleading material, but must follow a similar notice and response process before revocation (s 22). The CEO may approve forms and delegate powers (s 29(2)-(3)) and may give directions to record holders who cannot fully comply (s 19(3)).

Record‑holder duties: when notified under s 17(3)(b) that a charge or conviction is expunged, the holder of a record must take “all reasonable steps to change the record” to show the charge or conviction is expunged, include a statutory warning that disclosure is an offence, and include any statement prescribed by regulation (s 19(1)). They must advise the CEO within 28 days of the date of their compliance or explain the extent and reasons they could not comply (s 19(2)). If the CEO receives a report of partial compliance, the CEO may give further directions (s 19(3)); good‑faith efforts are taken as compliance (s 19(4)). If an expungement is revoked, holders must restore records to show the charge is no longer expunged and remove the warning and prescribed statements (s 23(1)) and advise the CEO within 28 days, with similar CEO direction powers (s 23(2)-(4)).

Applicant rights: applicants have the right to be notified of proposed refusals and revocations, to receive reasons and copies of relied‑upon material, and to respond with further material within 28 days (ss 16, 22). If refused, an applicant may reapply only where new and relevant evidence becomes available or there are extenuating circumstances (s 18). Applicants also have the right to review by the Northern Territory Civil and Administrative Tribunal where an application is refused or a determination to expunge is revoked (s 30(1)-(2)). The Act requires that determinations and revocation decisions include written reasons and take effect on the day notice is given to the applicant (ss 17(4)-(5), 22(7)-(8)).

Confidentiality and information duties: the CEO must ensure that information given to an applicant does not include personal information about any other person (s 12(1)). The CEO may require applicants to verify documents or information by statutory declaration (s 12(2)). Persons and bodies providing information or documents in good faith in response to CEO requests under ss 10, 11 or 14 are protected from civil, professional and criminal liability and from professional discipline or standards claims (s 12(3)).

Criminal duties (prohibitions): persons with access to records who intentionally engage in conduct that results in disclosure of expunged information and are reckless as to that result commit an offence (s 25(1)). Those who intentionally obtain information contained in a record about an expunged charge or conviction dishonestly commit an offence (s 26(1)). The access element in s 25 is strict liability (s 25(2)), the presence of information in a record is absolute liability under s 26(2) and the element that the information is about an expunged charge or conviction attracts strict liability under s 26(3). Maximum penalties are 50 penalty units or imprisonment for six months for each offence (ss 25, 26).

Limits and non‑entitlements: persons are not entitled to compensation for having been charged, convicted, punished or for having an expunged charge or conviction or for losses suffered as a result (s 21). Prior lawful acts are explicitly preserved (s 27), and the Act does not authorise destruction of documents even where a charge or conviction is expunged (s 19(6)).

Administrative protections: a person acting in good faith when exercising a power or performing a function under the Act is not civilly or criminally liable for that act or omission (s 28(1)), though this does not affect any liability the Territory would have (s 28(2)). The CEO and delegated officers may act and rely on those protective provisions.

Taken together, the Act allocates procedural duties and documentary obligations to applicants, the CEO and specified record holders, creates criminal prohibitions to protect expunged information, provides review and privacy‑protected proceedings in NTCAT, and sets strict limits on compensation and document destruction. All duties are coupled with operational timeframes (commonly 28 days) and procedural safeguards in ss 10, 16, 19, 22 and 23.

Offences created by the Act are targeted at unauthorised disclosure and dishonest acquisition of expunged information. Section 25 creates the offence of unlawful disclosure: a person who has access to records and intentionally engages in conduct that results in disclosure of information about an expunged charge or conviction and is reckless in relation to that result is liable. The maximum penalty is 50 penalty units or imprisonment for six months (s 25(1)). Strict liability applies to the element that the person has access to records (s 25(2)). The provision contains a set of exceptions where disclosure is lawful: authorised disclosures under the Act, disclosure necessary for performing functions or exercising powers under the Act, disclosure with written consent of the person whose charge or conviction was expunged, information made publicly available by an archive or library in forms normally provided in accordance with normal procedures, and disclosure for statistical or research purposes that cannot identify the person (s 25(3)(a)-(e)). The note to s 25(3) indicates the defendant has an evidential burden in relation to these matters (see section 43BU of the Criminal Code), meaning once evidence suggests an exception, the defendant must raise evidence to point to the exception.

Section 26 criminalises dishonestly obtaining information that is contained in a record and is about an expunged charge or conviction. The maximum penalty again is 50 penalty units or imprisonment for six months (s 26(1)). Absolute liability applies to whether the information is contained in a record (s 26(2)); strict liability applies to whether the information is about an expunged charge or conviction (s 26(3)). Dishonesty is a mental element governed by the Criminal Code (note in s 26(1) referring to s 43AGA of the Criminal Code for the meaning of dishonest conduct). Part IIAA of the Criminal Code applies to offences against this Act (s 6), bringing general principles of criminal responsibility, defences and burden of proof provisions into play.

Enforcement actors and process: criminal enforcement would proceed under the Territory’s prosecutorial systems; the Act applies Part IIAA of the Criminal Code (s 6), implying standard charging, proof and sentencing processes under NT criminal law. The CEO and record holders also have administrative enforcement levers: the CEO may propose refusals, give notices of proposed revocation and ultimately revoke expungements where they were made because of false or misleading material (ss 16, 22). Revocations require notice and an opportunity to respond (s 22), and the CEO’s decision to revoke takes effect when notice is given (s 22(7)).

Record‑holder non‑compliance: record holders must update records and notify the CEO within 28 days of compliance or explain inability to comply (s 19(2)). If the CEO receives an explanation of non‑compliance, they may issue directions on further steps required (s 19(3)). The holder is treated as having complied if it has done all that is reasonably practicable, including following CEO directions (s 19(4)). Similar mechanics apply on revocation (s 23). The Act does not set a distinct administrative penalty for failure to update records, but criminal sanctions for disclosure and administrative directions and public law obligations will be relevant.

Evidence and admissibility: s 20(3)(b) makes evidence of an expunged charge or conviction inadmissible in any proceeding. That is an enforcement mechanism to prevent subsequent use of the historical matter. However, s 27 preserves prior lawful acts done before expungement, meaning enforcement of decisions or acts taken before expungement remains unaffected.

Review: an applicant or the subject may seek review by the Northern Territory Civil and Administrative Tribunal of a decision to refuse or revoke an expungement (s 30(1)-(2)). NTCAT hearings are closed and publication of identifying information is prohibited unless the Tribunal authorises publication where the benefit outweighs privacy interference (s 30(3)-(4)). The closed review process is the administrative review mechanism that functions alongside criminal enforcement.

Protections for providers: persons and bodies giving information or documents in good faith to the CEO in response to requests under ss 10, 11 or 14 do not incur civil, professional or criminal liability and cannot be held to have breached professional standards (s 12(3)). That protects witnesses and officials cooperating in CEO inquiries, supporting enforcement of the scheme through information flows.

Limits on compensation: the Act removes any entitlement to compensation for historical charging, conviction, sentence or as a consequence of expungement (s 21). That is a legislative limit on civil remedies tied to the scheme, relevant to enforcement in civil contexts.

In short, enforcement is both administrative (CEO directions, revocation, record‑holder duties, NTCAT review) and criminal (ss 25-26), with statutory exceptions and liability standards specified. The Act relies on investigative cooperation from public bodies, protective provisions for good‑faith providers and procedural safeguards before refusal or revocation.

The Act expressly interacts with several named legislative regimes and with broader statutory frameworks by reference. It incorporates external definitions and supply chains and asserts primacy in certain areas.

Information Act and archives: “personal information” is defined by reference to s 4A of the Information Act 2002 (s 4). The definition of “record” includes the archives service established under the Information Act 2002 (s 4). The archives service is explicitly a holder of records that must act under the expungement procedures (ss 4, 19). The Act contains special rules recognising archives and libraries: s 25(3)(d) permits disclosure by an archive or library in a form normally available for public use and in accordance with normal procedures, making the public access rules of archival bodies a relevant source of permitted disclosure. The CEO must ensure that information provided to applicants does not include personal information concerning any person other than the subject (s 12(1)), aligning with Privacy and Information Act frameworks.

Criminal Code: Part IIAA of the Criminal Code applies to offences under the Act (s 6). The Act therefore brings principles of criminal responsibility, defences and burden rules from the Criminal Code into play for prosecutions under s 25 and s 26, and the notes in ss 25 and 26 reference particular Criminal Code provisions governing evidential burdens and definitions of dishonest conduct.

Health Practitioner Regulation National Law (NT) and spent convictions regime: s 20(5) expressly states that the statutory effects of expungement apply despite other laws to the contrary, and it names sections 77(4), 79(3) and 135(3) of the Health Practitioner Regulation National Law (NT) and the Criminal Record (Spent Convictions) Act 1992. That is an explicit cross‑cutting override in respect of those specified provisions, designed to prevent those regimes from requiring disclosure or counting expunged entries. The Act also states it applies despite any other law that allows or requires disclosure of information relating to a charge, conviction, criminal record or criminal history (s 20(5)(c)). Those are broad overrides, subject to the limits in other sections (for example, acts lawfully done before expungement are preserved under s 27).

Tribunal and procedural law: the Northern Territory Civil and Administrative Tribunal Act 2014 procedure is invoked by s 30 and its note. The Tribunal has jurisdiction to review refusals and revocations (s 30(1)), but s 30(3) modifies ordinary public hearing and publication expectations by requiring closed hearings and prohibiting publication of identifying information unless the Tribunal authorises it (s 30(4)). That interacts with the Tribunal’s general procedures and with open‑justice norms.

Guardianship and powers of attorney statutes: the Act allows certain representatives to apply on behalf of persons with impaired decision‑making capacity, listing guardians appointed under the Guardianship of Adults Act 2016, the Public Guardian, attorneys under the Powers of Attorney Act 1980 (Part III), decision‑makers under the Advance Personal Planning Act 2013, spouses, close relatives and close personal associates (s 9(3)). Those references create interaction points with guardianship, enduring power of attorney and advance planning regimes, giving legal actors in those regimes an express statutory role in applying for expungement.

Records and court rules: because “record” includes court records and the DPP’s records (s 4), the Act affects how existing court record‑keeping frameworks and the DPP’s disclosure and file retention practices operate post‑expungement. Section 19(6) explicitly prevents destruction of information or documents, so the Act does not change retention obligations that arise outside it, but it does require annotations, warnings and prescribed statements.

Regulatory scope and delegated legislation: s 7(c) allows offences to be prescribed by regulation as expungable where they involve consensual same‑sex activity, and s 19(1)(c) requires inclusion of any statement or information prescribed by regulation. Section 31 authorises the Administrator to make regulations. Therefore subordinate legislation can alter the list of expungable offences and the content of prescribed statements.

Civil liability and compensation: the Act removes entitlement to compensation for harms arising from historical charges, convictions and expungement (s 21). That interacts with other civil law claims, potentially limiting tort or other remedies for historical harms related to the expunged matters.

Protection and liabilities of public servants: s 12(3) protects persons or bodies acting in good faith in response to CEO requests from civil, professional and criminal liability and professional discipline claims. Section 28 extends protection from civil or criminal liability to persons acting in good faith when exercising powers or performing functions under the Act (subject to preserving any liability the Territory would have) , a classic operational shield that interacts with general public law duties.

In effect, the Act is drafted to operate as a targeted statutory expungement regime that interacts with, and in several respects overrides, other laws that would otherwise require disclosure or count the historical matters. It also integrates with guardianship, powers‑of‑attorney, archives, court and tribunal procedural regimes, and provides for regulatory additions by subordinate legislation.

The Act’s provenance and amendments are set out in the endnotes of the reprint. Assent, commencement and later amendments are recorded there.

• Assent and commencement: Endnote 2 states the Expungement of Historical Homosexual Offence Records Act 2018 (Act No. 8, 2018) received assent on 23 May 2018 and commenced on 14 November 2018 (Gazette G46, 14 November 2018, p 1). Section 2 of the Act provides that commencement is by Gazette notice (s 2).

• Subsequent amendment recorded: the Criminal Code Amendment (Property Offences) Act 2022 (Act No. 24, 2022) is listed in Endnote 2 with assent dated 31 October 2022 and commencement 30 April 2023 (Gazette G8, 13 April 2023, p 1). Endnote 4 specifies that s 26 was amended by No. 24, 2022, s 25. That indicates the offence of dishonestly obtaining information (s 26) was amended by the 2022 Act; the reprint reflects the amended text with the absolute and strict liability elements and new notes referencing the Criminal Code.

• Interpretation Legislation Amendment Act 2018: Endnote 3 notes that general formal amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22, 2018) to ss 4, 9, 20 and 30. These are described as formal amendments, suggesting non‑substantive drafting or numbering adjustments incorporated into the reprint.

• General amendments list: Endnote 4 contains a “List of amendments” showing that s 26 was amended by Act No. 24, 2022, s 25. The endnotes also include a sequence of placeholders (pt 6 hdg exp No. 8, 2018, s 40; and related items ss 32-39, s 40) that appear to be structural references to a broader legislative schedule or previously intended Part 6 that is now omitted or expired. The list indicates general reprinting adjustments.

• Reprint as at 30 April 2023: The header of the text indicates the Act is presented “as in force at 30 April 2023”. The endnotes’ amendment entries are the source for changes recorded up to that date.

No other substantive textual amendment entries are provided in the reprint’s endnotes beyond the 2022 amendment to s 26 and the formal amendments noted in 2018. The Act’s mechanism allowing regulations (s 31) means the regime can be adjusted by subordinate legislation, for example to prescribe additional expungable offences (s 7(c)) or to prescribe statements to be included in records (s 19(1)(c)); however, the reprint does not include any regulations.

Users should consult the Territory’s reprints and the Gazette for any regulations made under s 31 or any subsequent amending Acts after 30 April 2023. The endnotes provide a partial change log, primarily identifying the 2022 amendment to s 26 and formal 2018 amendments to certain sections.

The text of the Act and its endnotes contain no case law citations or references to judicial decisions construing the Act. The statutory review mechanism is administrative: decisions to refuse to expunge or to revoke an expungement are reviewable by the Northern Territory Civil and Administrative Tribunal under s 30(1). Section 30(3)-(4) imposes confidentiality restrictions on Tribunal hearings and publication, which may limit publicly available administrative decisions.

Because the reprint contains no judicial decisions, and the Act provides for closed NTCAT reviews, there is no litigation history recorded in the source material. The Act does not reference any precedent authorities. Practitioners seeking reported decisions on the Act should search NTCAT records (subject to the closed hearing rule and publication restrictions) and Northern Territory courts for any judicial reviews or appeals arising from Tribunal decisions. The reprint itself does not provide any cases or adjudicated examples.

For now, the source contains no litigation narrative or case law interpreting the substantive tests in s 8, the meaning of “suspected of being, or connected to, homosexual activity” in s 8(b), the application of contemporaneous legality under s 8(c), the scope of the CEO’s discretion, the proper application of strict or absolute liability elements in ss 25-26, or the interplay of s 20’s overrides with other statutory regimes. Those issues are likely to be the subject of case law questions should disputes reach tribunal or court review, but no such material is contained in the provided text.

• CEO notice timing dictates effect: determinations take effect on the day the CEO gives notice to the applicant (s 17(4)). That means any legal benefits of expungement (s 20) do not attach until the CEO’s written notice is received. Delay in notice or in the CEO serving record holders can delay practical effect even if the substantive decision has been made.

• No destruction of underlying records: although records must be annotated as expunged, the Act explicitly does not authorise destruction of any information or document (s 19(6)). Agencies and applicants should not expect documents to be physically destroyed; they will remain in existence, albeit annotated. This has privacy and access implications because the underlying documentary trail persists.

• Exceptions for archives and public sources: s 25(3)(d) creates an exception for archives and libraries to provide information “in a form normally available for public use” under normal procedures. Records placed in public collections or previously released under archival practice may still be accessible, which constrains the practical confidentiality of some historical information.

• Closed tribunal review: NTCAT reviews are closed to the public and publication of identifying information is prohibited (s 30(3)). That limits transparency and the availability of precedents. For practitioners, the closed nature affects evidence strategy and confidentiality protections; for researchers and journalists, it limits access to reasoning.

• Strict/absolute liability elements in criminal provisions: s 25 applies strict liability to the access element (s 25(2)); s 26 applies absolute liability to the element that the information is in a record (s 26(2)) and strict liability to whether it concerns an expunged charge/conviction (s 26(3)). Those standards can produce criminal exposure even where mental culpability is limited, and the Criminal Code’s Part IIAA and other provisions become critical in practice.

• No oral hearings: s 15(2) prohibits oral hearings. The CEO’s process is documentary and written only, with a 28‑day opportunity to respond to proposed refusals/revocations. Applicants and their lawyers must prepare full written submissions and documentary evidence; they cannot rely on an oral hearing to explain nuances.

• Burden and standard of proof: the CEO decides on the balance of probabilities (s 17(1)-(2)). That is a civil standard; however, applicants must satisfy s 8(b) and (c) , in particular that the person would not have been charged but for suspicion that the conduct was homosexually‑connected and that the conduct is not an offence today. Establishing the historical causal link (would not have been charged but for suspicion) may be factually challenging.

• Revocation risk: the CEO may revoke an expungement if the determination was made because of false or misleading information or documents in the application (s 22(1)). Revocation follows a similar notice/response process and takes effect when notice is given (ss 22(2)-(7)). Applicants should ensure evidence is reliable; an expungement obtained on the basis of later‑discredited information may be reversed.

• No compensation: s 21 expressly precludes any entitlement to compensation for being charged, convicted, punished, having an expunged charge or any consequences flowing from those events. Applicants seeking monetary redress for historical harms will not find a remedy under this Act.

• Preservation of prior lawful acts: s 27 preserves acts lawfully done before expungement. Employers, licensing bodies or courts who made decisions before expungement can point to that legality; expungement does not retroactively undo prior lawful outcomes. For example, a prior dismissal or licence suspension lawfully effected before the expungement remains intact unless separately challenged.

• Ambiguity in “would not have been charged”: s 8(b) requires a counterfactual assessment about whether the person would have been charged but for suspicion of homosexuality. The Act does not define the test’s contours. Proving the causal link may require historical records, police notes and statements, which may be incomplete; the CEO must take “reasonable steps” to inquire (s 14(1)), and persons providing information in good faith are protected (s 12(3)).

• Regulative scope: the power to prescribe offences in s 7(c) and statements in s 19(1)(c) means the statutory list of expungable offences can be expanded by regulation. Practitioners should check the Regulations to see the current operative scope.

• Preservation of documentary trace for investigative or historical purposes: because expunged entries are not destroyed and archives remain potential repositories, research or investigative journalists may be able to find material via public collections or under archival regimes consistent with s 25(3)(d). That limits perfect erasure.

• “Person involved in the conduct” considerations: s 15(3)(a) requires the CEO to consider whether any person involved did or did not consent, and s 15(3)(b) to consider ages of persons involved. These are substantive factors that may defeat eligibility where consent or age issues arise. Collecting evidence on consent and ages may be problematic for historical cases.

• CEO discretion and delegation: s 29 allows the CEO to delegate powers and approve forms. Delegation can speed processing but also create variability in decision‑making. The CEO must provide reasons with determinations (s 17(5)), but the Act leaves a considerable margin for administrative discretion in inquiries and the sufficiency of evidence.

These “gotchas” underline areas where factual complexity, documentary availability, confidentiality, procedural limits and criminal exposure interact. Parties should plan applications with the documentary standards in mind and anticipate the specific statutory constraints.

For applicants (individuals, representatives, guardians, executors):

• Use the approved form: provide full name, date of birth, contact details and any historical differences (s 9(4)(a)). If applying for someone else, state the applicant’s details (s 9(4)(b)).

• Provide charge particulars: include as much information as possible about the charge or conviction , description of the offence, date, place and court (s 9(4)(c)). If available, attach transcripts or sentencing remarks (s 9(4)(d)).

• Consent to inquiries: include the required consent authorising the CEO to inquire into the charge or conviction and to receive disclosed information and documents (s 9(4)(e)). Without consent, the CEO’s ability to obtain records may be constrained.

• Gather corroborating documents: collect documentary support (police reports, court filings, witness statements, contemporaneous correspondence) that assist in satisfying the criteria in s 8, particularly evidence that the charge was connected to suspicion of homosexual activity and that the conduct would not be an offence today.

• Address s 8(c) proactively: demonstrate that the conduct would not constitute an offence at the time of decision (s 8(c)). For example, show that current law permits the conduct in the same factual circumstances.

• Prepare to verify materials: the CEO may require statutory declarations verifying information (s 12(2)). Where possible, obtain statutory declarations from witnesses and include them with the application.

• Respond promptly to requests: if the CEO issues a notice under s 10 or s 11, provide the requested material within 28 days or seek an extension if needed. Failure to comply may lead to the CEO treating the application as withdrawn (s 13(2)).

• Engage with proposed refusals: if the CEO issues a notice of proposed refusal with reasons and relied‑upon documents, respond within 28 days with further submissions and evidence (s 16(2)-(3)). Use this stage to address factual gaps and provide witness statements or documents.

• Be cautious about representations: false or misleading information can lead to revocation (s 22(1)). Ensure all material is accurate and, where uncertainty exists, frame evidence cautiously and transparently.

• Consider legal representation for complex cases: because the process is documentary and the CEO decides on balance of probabilities without oral hearing (s 15(2), s 17(1)), skilled drafting and assembling of documentary evidence is important.

For record holders (Police Force, DPP, courts, archives service):

• Track notices from the CEO: when given notice under s 17(3)(b) that a charge or conviction is expunged, take all reasonable steps to change records to show expungement, include the statutory warning and any prescribed statements (s 19(1)).

• Document compliance: within 28 days advise the CEO in writing of the date of compliance or provide reasons and extent of inability to comply (s 19(2)). If unable to comply, prepare to receive and implement CEO directions (s 19(3)).

• Keep originals but annotate: do not destroy underlying documents; annotate records as expunged and ensure a clear audit trail that records the change (s 19(6)). Maintain retention consistent with other legislative obligations.

• Protect confidentiality: ensure staff with access to records understand that disclosure of expunged information can be an offence (s 25) and implement access controls, training and logging to mitigate unlawful disclosure risk.

• Cooperate with CEO inquiries: the CEO may issue notices requiring documents or information (s 14). Take “all reasonable steps” to comply (s 14(4)). Good‑faith cooperation is protected from civil, professional and criminal liability (s 12(3)).

• Restore records on revocation: if the CEO revokes an expungement, remove the expungement annotations and warning and advise the CEO within 28 days (s 23(1)-(2)). Follow any CEO directions to the extent reasonably practicable (s 23(3)-(4)).

For the Chief Executive Officer and delegates:

• Use approved forms and delegation appropriately: adopt clear application forms capturing the statutory elements in s 9 and maintain delegation records (s 29).

• Conduct reasonable inquiries: exercise s 14 powers to request documents from the DPP, police, courts, record holders and public sector employees, and ensure requests specify the class or particular items, manner and time for compliance (s 14(3)).

• Protect third‑party personal information: when disclosing documents to applicants, ensure personal information about others is redacted (s 12(1)). If further information is needed, request it in writing and consider statutory declaration verification (s 12(2)).

• Follow procedural fairness in writing: before refusing or revoking, give written notice with reasons and provide copies of material relied upon, and give 28 days for the applicant to respond (ss 16(1)-(3), 22(2)-(4)). Consider and record responses before making a final determination (ss 16(4)-(17(1))).

• Give prompt written determinations with reasons: once decided, provide written notice of determination to the applicant and record holders and include reasons (s 17(3)-(5)). Note the determination takes effect when the applicant is notified (s 17(4)).

• Manage record‑holder compliance: if a record holder reports partial compliance, issue directions as necessary and evaluate whether they have done “all that is reasonably practicable” to comply (s 19(4)).

• Keep confidentiality in Tribunal reviews: when matters proceed to NTCAT, respect the closed hearing rules and the prohibition on publication of identifying information (s 30(3)-(4)).

For employers, licensing bodies and others relying on criminal history:

• Update policies and practice: treat expunged entries as legally not existing under s 20(1)-(3). Reassess decisions where the only reason for refusal or adverse action was an expunged charge or conviction; the person may reapply for licences or approvals without waiting a minimum period (s 20(3)(g)). However, s 27 preserves prior lawful acts, so decisions lawfully made before expungement remain in effect unless otherwise challenged.

For archives and researchers:

• Follow normal procedures for public access: take advantage of the exception in s 25(3)(d) only where disclosures are in forms normally available for public use and in accordance with normal procedures. For research releases, ensure anonymisation to comply with s 25(3)(e).

For lawyers advising clients:

• Assemble documentary evidence demonstrating the factual nexus in s 8(b) and the contemporary legality in s 8(c), prepare statutory declarations as verification where appropriate, respond promptly to CEO notices, and advise on the risk of revocation under s 22.

Across all actors, compliance hinges on meeting procedural timeframes (commonly 28 days in ss 10, 16, 19, 22 and 23), accurate documentation, cooperation with CEO inquiries (s 14), careful handling of personal information (s 12(1)), and systems to prevent unlawful disclosure (s 25). The Act’s protective provisions for good‑faith providers (s 12(3)) and for public servants acting in good faith (s 28(1)) reduce risk for those who comply with requests and directions.
