What it does
This instrument, titled the Export Finance and Insurance Corporation Act 1991 - Declaration of Approved Causes of Loss 2022, is a statutory declaration made by the Export Finance and Insurance Corporation (EFIC) under subsection 21(1) of the Export Finance and Insurance Corporation Act 1991 (the Act). The instrument formally declares a set of named causes of loss to be "approved causes of loss for the purposes of Part 4 of the Act" (s 6). It commences on the day after registration (s 2), and it expressly repeals the prior Declaration of Approved Causes of Loss 2021 dated 13 October 2021 (Schedule 1, item 1).
Mechanically, the instrument does three things contained in its text. First, it records the name of the instrument (s 1). Second, it invokes the enabling power in subsection 21(1) of the Act to make a declaration (s 3). Third, it lists, in s 6, eleven specific categories of loss , labelled (a) through (k) , that EFIC declares to be approved causes of loss for the purposes of Part 4 of the Act. The instrument includes a short definitions clause (s 5) that defines Act, EFIC and a definition of "war-like operation" that expressly includes terrorism, riot, civil commotion, revolution, insurrection, rebellion or any similar uprising.
The core legal effect recorded in the instrument is declaratory: it identifies, for the statutory context of Part 4 of the Act, what kinds of events or government or other acts EFIC regards as approved causes of loss. The instrument does not itself recite any operative rules about claims handling, payments, exclusions, premiums, coverage limits, procedural steps, enforcement powers, or penalties. It is a focused declaration tied to Part 4; beyond that linkage the text contains no new monetary obligations, no specified administrative processes, and no procedural detail. The instrument’s repeal provision (Schedule 1) removes the earlier 2021 declaration and replaces it implicitly with the 2022 list.
