#### 12‑10 Committee review in progress before commencement time
(1) This section applies if:
(a) a committee had been established under subclause 9.1 of Schedule 10 to the old Export Control (Poultry Meat) Orders to review a determination, or a revised determination, of the Secretary of the allocation of inspection services for a registered establishment; and
(b) either:
(i) the committee had not completed the review before the commencement time; or
(ii) the committee had completed the review but no recommendation had been made to the Secretary before the commencement time.
No review before commencement time
(2) If the committee had not completed the review before the commencement time, the committee must after the commencement time complete the review and give a written recommendation to the Secretary on the appropriate allocation of meat inspection services to the establishment as if Part 1 of Schedule 10 to the old Export Control (Poultry Meat) Orders were still in force.
Review but no recommendation before commencement time
(3) If the committee had completed the review but no recommendation had been made to the Secretary before the commencement time, the committee must as soon as practicable give a written recommendation to the Secretary on the appropriate allocation of meat inspection services to the establishment.
(4) A recommendation given to the Secretary under this section is taken to be a recommendation given to the Secretary under subsection 4.26(4) of this instrument.
