23 Eligibility for FCFS tariff rate quota entitlement
(1) An exporter is eligible to be allocated FCFS tariff rate quota entitlement for a quota year if: (a) the exporter has applied to the Secretary for an allocation of FCFS tariff rate quota entitlement for the quota year before close of business on 15 February in the quota year; and (b) the application includes an amount that the exporter has requested to be allocated to the exporter as FCFS tariff rate quota entitlement for the quota year; and (c) no tariff rate quota entitlement of the exporter for the quota year has been cancelled under section 27. (2) An application for the allocation of FCFS tariff rate quota entitlement for a quota year must be made in the approved form and given to the Quota Unit.
