17 Who is liable to pay a basic fee

(1) A basic fee that is required to be paid in connection with the performance of a service by this instrument is payable by the person for whom the service is, or is to be, performed. (2) An agent of a person liable to pay a basic fee is jointly and severally liable with that person to pay the fee. (3) If: (a) an agent of a person liable to pay a basic fee pays the fee on behalf of the person; and (b) at the time when the payment is made, the agent has not collected an amount equivalent to the fee from the person; the agent may recover such an amount from the person as a debt due to the agent.
