301Functions and powers of authorised officers

301  Functions and powers of authorised officers  (1) An authorised officer has the functions and powers conferred on an authorised officer by this Act that are specified in the authorised officer’s instrument of authorisation. Note 1: The reference to this Act includes a reference to instruments made under this Act (see the definition of this Act in section 12). See also section 300 which provides for the rules to confer functions or powers on an authorised officer. Note 2: An authorised officer may only perform a function, or exercise a power, if that function or power is specified in the authorised officer’s instrument of authorisation. Secretary may give directions to authorised officer  (2) The Secretary may give a direction to an authorised officer about the performance of the authorised officer’s functions or the exercise of the authorised officer’s powers. Commonwealth authorised officer may give directions to third party authorised officers  (3) A Commonwealth authorised officer may give a direction to a third party authorised officer, or a class of third party authorised officers, about the performance of functions or the exercise of powers by the third party authorised officer or a third party authorised officer included in the class of third party authorised officers. Authorised officer must comply with directions  (4) In performing functions or exercising powers under this Act, an authorised officer must comply with any directions given to the authorised officer under subsection (2) or (3).
