Explosives (Security Sensitive Substances) Regulations 2021

The regulations build on a small set of defined legal concepts. Security sensitive substance is the central concept. Under reg 6(1) a security sensitive substance is any substance declared to be an explosive by proclamation under section 5 of the Act and declared by that proclamation to be a security sensitive substance. The definition is therefore proclamation‑based; the regulations do not themselves list substances. The regulations also create a special interaction with existing hazardous classification rules by allowing the Director to classify a security sensitive substance under the Explosives Regulations 2011 without assigning it to a division of Class 1 Dangerous Goods (reg 6(2)), while clarifying that if the Director instead assigns the substance to one of the Class 1 divisions that assignment removes its status as a security sensitive substance for the purposes of the Act and its regulations (reg 6(3)). This creates a mechanical pathway for reclassification that changes which regulatory regime applies.

Secure is given an operational meaning in reg 3(1): secure means secure from loss, theft, sabotage or unauthorised access. Security risk is defined in reg 3(1) as risk of loss, theft or sabotage or unauthorised access. The regulations explicitly link their conception of security to Commonwealth security law by treating keeping substances secure as including security within the meaning of the Australian Security Intelligence Organisation Act 1979 (reg 3(3)). That link is relevant to personnel vetting and adverse security assessments discussed later.

Several procedural and technical concepts structure compliance. Licence and permit are distinct legal instruments. Licence refers to a licence granted under the Act in relation to a security sensitive substance (reg 3(1)). Permit means a permit granted under these regulations (reg 3(1)). The regulations make many routine dealings permissive only by permit (reg 9). The Director is the decision maker given repeated authority to grant, refuse, renew, vary, impose conditions, suspend and revoke licences, permits and approvals (eg regs 11, 14, 15, 16, 25, 29). The Director may also require a licence holder to return a licence for replacement or alteration where conditions have changed (reg 25(2)).

Security management plan is a formalized compliance document required as a condition of a licence (reg 15). The plan must identify security risks, set out processes to keep substances secure, require constant surveillance where substances are unsecured or transported in unsecured compartments, be fully documented, and be subject to periodic review and approval by the Director (regs 15(1)-(3), (5)-(6)). Compliance plan is a temporary measure permitting licence holders a finite exemption while preparing the security management plan (reg 15(8)-(9)).

Personnel vetting regimes use the concepts of approved security cleared manager and approved security cleared agent (reg 16). Licences and permits must ensure that supervisors, managers and those with direct access are approved security cleared managers or agents, and such people may be required to wear Director‑approved identification (reg 16(1)(a)-(c)). Age thresholds appear in reg 26(1) and (2): licences or permits are not to be granted to natural persons under 18 and security cleared persons must be at least 18 years old.

Records and identity verification are formalised: sale, purchase/acquisition, and use/disposal records must be kept with specific fields enumerated (regs 21-23). Identity verification for recipients requires either a single government‑issued card bearing photo, name, residential address and signature, or two documents meeting specified combinations and cross‑checks; details of documents used must be recorded (reg 21(3)-(5)).

Operational conditions include separation distances for storage of ammonium nitrate varieties (reg 19), a prohibition on household or domestic use or use as fertiliser for recreational grounds for security sensitive ammonium nitrate (reg 7), a 20 kg prescribed quantity for carriage under Part 3 of the Act (reg 4), and a seven clear working days notice period for import/export consignments to/from outside Australia with documentary requirements including statements of composition and certificates of analysis (reg 20).

Administrative discretion, appeals and exemptions are built into the architecture. The Director may issue guidelines about security management plans (reg 15(4)), grant exemptions by Gazette notice (reg 34), and requires police cooperation when necessary (reg 32). Appeals from Director decisions go to the Administrative and Disciplinary Division of the District Court and are generally time‑limited to one month (reg 33).

Penalties and enforceable prohibitions are specified for many contraventions, with maximum monetary penalties and expiation fees set out for a range of offences including unauthorised dealings without a permit (reg 9), supplying to someone lacking a permit (reg 10), failing to lodge annual returns (reg 13), false or misleading statements (reg 31), failure to produce licences or records on inspection (reg 30), contravening licence or permit conditions (reg 24) and breaches of exemption conditions (reg 34). Specific maxima and expiation fees are provided in the relevant regulations.

The regulations affect a defined set of actors in the supply, manufacture, storage, transport and use chain for any substance declared to be both an explosive and a security sensitive substance under the Act and proclamation (reg 6(1)). That includes:

• Licence holders under the Act who store, manufacture or otherwise hold security sensitive substances; reg 8 brings Act licensing into play for security sensitive explosives.
• Persons who import, export, sell, supply, purchase, acquire, use or dispose of security sensitive substances, as those activities require a permit under reg 9 and are subject to restrictions in regs 10 and 24.
• Employers and businesses whose employees or contractors may supervise, manage or have unsupervised access to security sensitive substances, because personnel must be approved as security cleared managers or agents under reg 16 and training and supervision requirements may be imposed under reg 14(2)(e).
• Transport and logistics operators: carriage rules interface with Part 3 of the Act by prescribing 20 kg as the prescribed quantity for carriage (reg 4), and imports/exports require seven working days notice plus documentary compliance (reg 20).
• Manufacturers and their ingredient suppliers: licence conditions relating to manufacture require notification to the Director of the name and address of each person from whom an ingredient is obtained (reg 18).
• Port operators where consignments are landed or leave by sea, who must receive notice of import/export consignments where relevant (reg 20(1)-(2)(a)).
• Directors, inspectors and police: the Director exercises approval, monitoring and enforcement powers (eg regs 11, 14, 15, 16, 25, 29), inspectors may request production of licences and records (reg 30) and the Commissioner of Police must supply information at the Director’s request (reg 32).
• Persons who were permit holders under the former 2006 regulations: their permits are treated as permits under these regulations until expiry, subject to potential differences in conditions where the new regulations prevail (Sch 1 Pt 2 cl 2).
• Individuals applying for approvals (security cleared managers/agents) and close associates of applicants: the Director may request police reports and photographs and may assess character, reputation and relevant offences for suitability (regs 27(2)(c)-(d), 26(5)).

Who pays and bears costs. The immediate economic burdens fall on licence and permit holders and their businesses. Costs include application fees (reg 27(1)(g) and pro rata adjustments for unusual term lengths reg 27(6)), costs of obtaining police reports where requested (reg 27(2)(d) with costs borne by applicant), costs of preparing, documenting and reviewing security management plans and supporting material (reg 15(1)-(3), (6)), expenses for physical security and surveillance where required (reg 15(2)(c)), costs of identity verification systems and five‑year record retention (regs 21-23), and potential operational costs from separation distances and storage constraints for ammonium nitrate varieties (reg 19). Suppliers face an enforcement risk for delivering to recipients without permits (reg 10).

Who decides. The Director is the central decision maker: grant/renewal/refusal of licences and permits (reg 11), approval of security management plans and security cleared personnel (regs 15(5), 16(2)), imposition of licence/permit conditions (reg 14), suspension and revocation (reg 29), and exemptions by Gazette (reg 34). Inspectors exercise on‑site inspection powers (reg 30). The District Court Administrative and Disciplinary Division resolves appeals against Director decisions in specified categories (reg 33).

Who can challenge. Applicants and affected licence/permit holders may appeal the Director’s decisions as specified in reg 33. Appeals are time‑limited and the Director must provide written reasons on request (reg 33(2)-(4)). For many discretionary decisions, the regulations say expressly that they do not fetter absolute Director discretions under the Act (reg 26(6)).

Duties

• Permit requirement for dealings: A person must not import, export, sell, supply, purchase/acquire, use or dispose of a security sensitive substance except as authorised by a permit under these regulations, with a maximum penalty of $5 000 and an expiation fee of $315 (reg 9). This is a primary operational duty that converts common commercial acts into regulated activities.
• Sale restriction: A supplier must not sell or otherwise supply a security sensitive substance to a person who does not hold a permit authorising its purchase or acquisition (reg 10). Maximum penalty and expiation fee are the same as reg 9.
• Licensing obligations: The licensing provisions of the Act apply to explosives that are security sensitive substances (reg 8). Licences are subject to conditions imposed by these regulations and by the Director (reg 14(1)).
• Security management plan: It is a condition of a licence that the holder have a Director‑approved security management plan, ensure activities conform to it, and review it as required (reg 15(1)). The plan must identify and assess security risks and set out documented processes for keeping substances secure (reg 15(2)-(3)). Failure to resubmit the plan if required is an offence (reg 15(7)).
• Security clearances: Licence or permit holders must ensure supervisors/managers are approved security cleared managers and that responsible persons or those with access are approved security cleared managers or agents (reg 16(1)). The Director approves such persons (reg 16(2)).
• Immediate reporting: Theft, loss or apparent unauthorised interference with a security sensitive substance must be reported immediately to a police officer and the Director (reg 17).
• Records retention: Holders of permits authorising sale/supply, purchase/acquisition, or use/disposal must keep records for at least five years with specified content elements (regs 21-23). For sales, identity verification and related documentation must be recorded (reg 21(1)-(6)).
• Import/export notice and documentation: Permits authorising import or export to/from outside Australia must ensure at least seven clear working days notice to the Director and port operator where relevant, accompanied by a manufacturer’s statement of composition and an NATA‑accredited certificate of analysis or equivalent (reg 20(1)-(2)(c)(i)). Import notices must include details of licences/permits under which the substance will be stored, transported or used while in the State (reg 20(2)(c)(ii)).
• Separation distances: Licence conditions specify separation distances for storage of ammonium nitrate blasting intermediate and for storage of 100 tonnes or more of other security sensitive ammonium nitrate, where the default is distances prescribed in the Explosives Regulations 2011 for category ZZ explosives in magazines, unless the Director authorises otherwise (reg 19(1)-(2)).
• Production of documents: Inspectors may require production of licences, permits, approvals and records and failure to comply is an offence (reg 30(1)-(2)).
• Age limits: Licences and permits are not to be granted to natural persons under 18 and security cleared managers/agents must be at least 18 (reg 26(1)-(2)).
• Other conditions of licence/permit: The Director may impose conditions addressing packaging, labelling, storage amounts, plant and premises, training, access controls, record systems and alterations to premises (reg 14(2)(a)-(i), (3)).

Rights

• Application and procedural rights: Applicants may apply for licences, permits and approvals and the Director must follow application and information procedures set out in reg 27. The Director may request additional information but may refuse applications where requests are not complied with (reg 27(2)-(3)).
• Conditional exemptions and temporary relief: The Director may grant an exemption from the security management plan requirement for a period to prepare a security management plan, conditional on having an approved compliance plan and other conditions (reg 15(8)-(9)).
• Renewal discretion and continuity for safety: The Director may renew a licence or permit of the Director’s own initiative without application if it is necessary for protecting persons, property or the environment or keeping a substance secure (reg 12(4)). This permits continuity where public safety considerations justify it.
• Appeal rights: Applicants and licensees may appeal certain Director decisions to the Administrative and Disciplinary Division of the District Court (reg 33(1)). The Director must provide written reasons on request and the appeal period is generally one month from the decision or from receipt of written reasons (reg 33(2)-(4)).
• Notification and consultation before adverse action: Before suspension or revocation the Director must give written notice of proposed action and, unless urgent, allow at least 14 days for submissions (reg 29(5)).

Other notable duties and rights

• False or misleading statements are criminalised (reg 31). Maximum penalty is $5 000.
• Exemptions by Gazette notice are possible but subject to conditions and breach of conditions carries penalty (reg 34).
• The Director may require identification photographs for permits and licences and include them on the instrument (reg 28).
• The Commissioner of Police must provide requested information to the Director for the purposes of determining applications and suspension/revocation decisions (reg 32).

Each duty creates operational consequences: routine commercial purchase requires pre‑qualification of the purchaser; suppliers must perform identity checks and hold written authorisations for third‑party deliveries (reg 21(1)(c), (1)(c)). Many duties are backed by monetary penalties and expiation fees specified in the relevant provisions.

The regulations set out a mix of criminal penalties, expiation fees and administrative enforcement powers. Monetary maximum penalties with specified expiation fees are attached to many of the principal offences.

Prescribed offences and penalties

• Unauthorised dealing without a permit: Reg 9 makes it an offence to import, export, sell, supply, purchase, acquire, use or dispose of a security sensitive substance except as authorised by a permit. Maximum penalty $5 000, expiation fee $315.
• Supply to non‑permit holder: Reg 10 penalises selling or otherwise supplying to a person who lacks a permit. Maximum penalty $5 000, expiation fee $315.
• Annual returns: Failure to lodge annual returns where required (licenses/permits for two years or more) is an offence: maximum penalty $5 000, expiation fee $315 (reg 13).
• Security management plan resubmission: Failure to resubmit a security management plan when required is an offence: maximum penalty $5 000, expiation fee $315 (reg 15(7)).
• Contravention of conditions: A holder who contravenes a condition of licence or permit is guilty of an offence: maximum penalty $5 000, expiation fee $315 (reg 24). This does not apply where the contravention constitutes an offence against the Act (reg 24(2)).
• Production of documents: Failure to produce licences, permits, approvals and records to an inspector is an offence: maximum penalty $5 000, expiation fee $315 (reg 30).
• False or misleading statements: Reg 31 imposes a maximum penalty of $5 000 for making statements that are false or misleading in a material particular in information provided or records kept under the regulations.
• Failure to return licence when suspended/revoked: Failure to return the licence or permit within 14 days of suspension or revocation attracts a maximum penalty of $1 250 and an expiation fee of $160 (reg 29(6) read with reg 25(2) and note of penalty for returning licence under variation regime).
• Variation return requirement: A holder must return a licence or permit to the Director where requested for variation or replacement; failure carries a maximum penalty $1 250, expiation fee $160 (reg 25(2)).
• Exemption condition breach: A person who has been exempted must not contravene conditions of the exemption; maximum penalty $5 000, expiation fee $315 (reg 34(4)).

Administrative enforcement and discretionary powers

• Director’s powers: The Director may grant, refuse, impose conditions, suspend, revoke and renew licences and permits (regs 11, 14, 12(4), 29). Suspension may be for a period or conditional, may be prospective and may operate until further order. The Director’s exercise of these powers is subject to procedural requirements to give written reasons and allow submissions unless urgent action is necessary (reg 29(5)).
• Inspectors: Inspectors may require production of licences, permits, approvals and records for inspection (reg 30(1)). Failure to comply is an offence (reg 30(2)). This creates an on‑the‑spot compliance mechanism backed by penal consequences.
• Police information sharing: The Commissioner of Police must provide information to the Director at the Director’s request for determination of applications or for suspension/revocation decisions (reg 32). The Director may require applicants to obtain police reports and pay the costs of obtaining them (reg 27(2)(d)).
• Expiation regime: Several offences include specified expiation fees. That allows certain breaches to be settled administratively rather than by prosecution, subject to the usual expiation processes under South Australian practice.
• Appeal rights: Affected persons have an appeal route to the Administrative and Disciplinary Division of the District Court against specified Director decisions, including refusal to grant, imposition of conditions, suspension and revocation; appeals must be brought within one month of the decision (reg 33). The Director is required to provide written reasons on request (reg 33(3)-(4)).

Enforcement triggers

• Instances that may trigger enforcement action include failure to comply with licence or permit conditions, failure to maintain or produce required records, supplying to recipients without permits, failure to report theft or loss immediately, making false or misleading statements in records or applications and contraventions of specific regulatory prohibitions such as the household use prohibition for security sensitive ammonium nitrate (reg 7).

Interaction of criminal and administrative remedies

• The regulations create parallel pathways: criminal penalties punish breaches and may be prosecuted, while administrative remedies allow the Director to suspend or revoke licences and impose conditions, and expiation fees provide an administrative resolution option in some cases. The Director’s ability to renew licences without application for safety reasons (reg 12(4)) and to require return of licences for variation (reg 25(2)) gives administrative control over the legal instruments that authorise continued activity.

Evidence and procedural supports

• The Director can demand supporting documents during application processes and may refuse applications if requests are not complied with (reg 27(2)-(3)). Approvals may be refused on suitability grounds, including where an adverse security assessment under the ASIO Act applies (reg 26(5)(a)). These provisions enable the Director to ground enforcement decisions on police and security intelligence inputs (reg 32).

In summary, enforcement combines monetary penalties and expiation with administrative controls exercised by the Director and supported by inspection powers and police information sharing. The regime ties continued lawful activity to ongoing compliance with security plans, personnel vetting and documentary controls.

The regulations explicitly interact with several instruments and statutory frameworks. Those interactions shape classification, procedural rights, and the standards that must be met.

Explosives Act 1936 (the Act)

• The regulations are made under the Act and repeatedly incorporate the Act’s licensing apparatus. Reg 8 states that the requirements of the Act in relation to licensing apply to an explosive that is a security sensitive substance. The Director’s powers to vary or revoke conditions are exercised under section 48A of the Act by application of reg 25(1). The regulations do not purport to replace the Act’s substantive licensing structure but layer additional conditions and processes specific to declared security sensitive substances.

Explosives Regulations 2011

• Classification and separation distances are linked to the Explosives Regulations 2011. Reg 6(2) allows the Director to classify a security sensitive substance under the Explosives Regulations 2011 without assigning it to one of the divisions of Class 1 Dangerous Goods. Reg 6(3) establishes that assignment to a Class 1 division under those regulations will cause the substance to be regarded for the Act and regulations as an explosive that is not a security sensitive substance. Separation distances in reg 19 cross‑reference distances prescribed by the Explosives Regulations 2011 for explosives of category ZZ stored in a magazine and Schedule T (reg 19(1)-(2)). This creates a mechanical interface between the two instruments: classification can shift which regime applies and separation distances are borrowed from the other regulations.

Australian Security Intelligence Organisation Act 1979 (ASIO Act)

• The notion of “security” is expressly linked to the ASIO Act. Reg 3(3) states that a reference to keeping security sensitive substances secure includes a reference to keeping the substances secure for the purposes of security within the meaning of the ASIO Act. Reg 26(5)(a) provides that a person who is the subject of an adverse security assessment within the meaning of the ASIO Act will not be regarded as a suitable person to hold a licence or permit or to be approved as security cleared manager or agent. Reg 32 further permits the Commissioner of Police to supply information to the Director on request. These references create a clear conduit for national security assessments and police intelligence to influence licensing and approval decisions.

Corporations Act 2001 (Commonwealth)

• The regulations borrow the Corporations Act’s concept of related bodies corporate indirectly by defining close associates in reg 3(2)(c). That definition feeds into suitability assessments under reg 26(5)(b), which allows the Director to have regard to the character and reputation of the person and the person’s close associates and to take into account relevant offences. Where applicants are bodies corporate the identity and age of each director must be supplied (reg 27(1)(d)), bringing Corporations Act‑style directoral accountability into administrative vetting.

Family Relationships Act 1975 (SA)

• The definition of domestic partner for the purposes of close associates relies on the Family Relationships Act 1975 (reg 3(1)). That inclusion extends the family relationship concept for suitability and close associate checks.

National accreditation standards

• For import/export documentary compliance, reg 20(2)(c)(i) requires a certificate of analysis from a laboratory accredited by the National Association of Testing Authorities Australia (NATA) or an overseas body the Director considers equivalent. That ties scientific verification to recognised accreditation standards rather than leaving accuracy to unilateral statements.

Police powers and records

• Reg 32 authorises the Director to obtain police reports and for the Commissioner of Police to provide information. Reg 27(2)(d) requires applicants to obtain police reports where asked and to pay their costs. The interaction with criminal records and policing information is therefore direct and procedural.

Appeal routes

• Reg 33 makes clear that appeals against a Director’s decisions lie to the Administrative and Disciplinary Division of the District Court. That establishes the judicial review and merits appeal pathway for specified decisions under the regime. The regulations require the Director to provide written reasons on request and preserve a one month time limit for filing appeals (reg 33(2)-(4)).

Other instruments and future primary legislation

• The regulations expressly revoke the 2006 regime (Sch 1 Pt 1 cl 1) and include transitional arrangements (Sch 1 Pt 2 cl 2) to preserve continuity for permits in force immediately before commencement. The legislative history notes that the 2021 regulations will be revoked by Sch 1 cl 5 of the Explosives Act 2024. That indicates that these regulations are part of a moving regulatory framework and that primary legislation may alter their future operation.

Practical effect of interactions

• Classification under the Explosives Regulations 2011 can remove a substance from the security sensitive category (reg 6(3)), which may reduce the administrative burdens on users if the Director assigns a Class 1 division. Conversely, adverse security assessments under the ASIO Act will lead to refusal or revocation of licences/permits (reg 26(5)(a)). Police reports and intelligence therefore materially affect licensing outcomes alongside safety and environmental considerations. The regulations require documentary alignment with national accreditation (reg 20(2)(c)(i)), and corporate governance and family relationship concepts feed into suitability assessments via the close associate definition and the requirement to disclose director identities (regs 3(2), 27(1)(d)).

Overall, the instrument is tightly designed to operate alongside the Act, the Explosives Regulations 2011, national security legal instruments and police intelligence processes, with specific documentary and accreditation linkages for technical verification.

This instrument is self‑contained in its recitals and Schedule 1. Key historical and transitional events recorded in the instrument are:

• Commencement: The regulations came into operation on 1 September 2021 (reg 2).
• Revocation of previous instrument: The Explosives (Security Sensitive Substances) Regulations 2006 are expressly revoked by Schedule 1 Part 1 clause 1 of the 2021 regulations (Sch 1 Pt 1 cl 1). That means the 2006 regime is replaced by the 2021 regulations on commencement.
• Transitional treatment of existing permits: Schedule 1 Part 2 clause 2 provides that a permit in force immediately before commencement under the 2006 regulations is taken to be a permit issued under the 2021 regulations and will expire on the same date it would have expired under the 2006 regulations (Sch 1 Pt 2 cl 2(1)). Where there is a conflict between the conditions of an existing permit and the conditions imposed by the new regulations, the new conditions prevail (Sch 1 Pt 2 cl 2(2)). That supplies a clear continuity mechanism while enabling the 2021 conditions to override inconsistent prior conditions.
• Legislative history note of future revocation: The legislative history appended to the instrument records that the Explosives (Security Sensitive Substances) Regulations 2021 will be revoked by Schedule 1 clause 5 of the Explosives Act 2024 (Legislative history note). That is a forward reference to primary legislation effecting revocation and indicates this instrument was intended to be transitional toward further statutory consolidation or reform.
• Principal regulations administrative notes: The regulations record their Gazette notice and commencement details as number 55 of 2021, Gazette 20.5.2021 p1405 with commencement 1.9.2021: r 2 (Legislative history).

Amendment mechanisms within the instrument:

• The Director may issue guidelines about security management plans (reg 15(4)) which can alter operational expectations without legislative amendment.
• The Director may exempt classes of persons, substances or activities from the application of the Act or parts of it by Gazette notice (reg 34), and may vary or revoke such exemptions by further Gazette notice (reg 34(1), (3)). That provides an administrative pathway to modify scope and operation of the regime without formal amendment of the regulations themselves.
• The Director’s broad discretions in grant, renewal, variation, suspension and revocation (eg regs 11, 12, 25, 29) mean practical operational rules can change through administrative practice and guidance rather than statutory amendment.

What the instrument does not record

• The text does not contain any amendment entries showing prior amending instruments. The instrument revokes the 2006 regulations and supersedes them. No intermediate amending history or versions are included in the supplied text. No commencement amendments or subsequent variations are recorded in the instrument itself beyond the revocation note pointing to the Explosives Act 2024.

Implications for compliance planning

• Businesses and regulators should note that existing permits were carried over on commencement but are subject to the new conditions where inconsistent (Sch 1 Pt 2 cl 2). They should also be prepared for future legislative change signalled by the legislative history entry referring to the Explosives Act 2024. Administrative change via Director guidelines and Gazetted exemptions is additionally likely, since the Director is empowered to issue guidance and exemptions.

The text of the regulations contains no references to court decisions, judicial interpretations or litigation history. There are no cases named in the instrument. Where dispute resolution and review are contemplated, the instrument expressly identifies the judicial forum and procedural time limits rather than precedents.

Appellate and review pathways provided in the instrument

• Reg 33 establishes the right of appeal to the Administrative and Disciplinary Division of the District Court against certain decisions of the Director: refusal to grant a licence or permit, imposition of particular conditions on a licence or permit, suspension or cancellation of a licence or permit, or the imposition or variation of particular conditions on a licence or permit (reg 33(1)(a)-(b)). Appeals must generally be instituted within one month of the decision (reg 33(2)).
• The Director must, on application by a person seeking to appeal, state reasons in writing for the decision (reg 33(3)). If reasons are not given at the time, an affected person may require the Director to provide reasons in writing and the time for instituting the appeal runs from receipt of those written reasons (reg 33(4)). That provides an administrative precondition that supports effective judicial review.

No reported litigation recorded

• The instrument does not record any litigation under the 2021 regulations nor decisions from the District Court or other judicial bodies interpreting the provisions. There is therefore no litigation history in the instrument to draw on for interpretation of standards like “suitable person”, “security cleared manager”, or the Director’s exercise of discretion.

Practical consequences of the lack of recorded litigation

• Without reported decisions referenced in the instrument, legal interpretation of ambiguous or discretionary terms will depend on administrative practice, Director guidelines (reg 15(4)) and eventual judicial decisions brought under reg 33. Applicants and licence holders should therefore be attentive to Director directions, Gazetted exemptions and any published reasons for decisions, because those documents will shape the practical meaning of the regulations before a body of court decisions emerges.

Evidence channels for Director decisions

• The Director can request police reports and other records to determine applications and suspensions (regs 27(2)(d), 32). In the absence of publicly reported litigation, administrative records and the stated reasons accompanying Director decisions will be the primary sources for understanding how discretion is exercised. Applicants should use the procedural right in reg 33(3) to obtain written reasons where an appeal is contemplated.

In short, the instrument creates a pathway for litigation and judicial oversight but contains no internal litigation history. The effective body of interpretive law will develop over time through Director decisions and any District Court appeals brought under reg 33.

The regulations contain a number of specific provisions where failure to pay attention can produce operational disruption, penalties or unexpected compliance costs. These are concrete traps for the unwary and practical points to flag for counsel, compliance officers and operators.

Permit requirement for many routine acts (reg 9)

• The scope of reg 9 is broad: import, export, sell, supply, purchase, acquire, use or dispose require a permit. Casual sales, temporary acquisition, borrowing or trial use of an item that is a declared security sensitive substance will be regulated. Suppliers must verify purchasers hold permits pursuant to reg 10. The consequence is that standard commercial practices involving off‑the‑shelf sales may be unlawful without a permit.

Supplier liability for recipient’s lack of permit (reg 10)

• A supplier who delivers to a person without a permit risks a $5 000 maximum penalty and $315 expiation fee. Reliance on representations by recipients is not sufficient; reg 21 further requires identity verification and written authorisation where delivery is on behalf of another. Suppliers should obtain and retain copies of permit numbers and identity verification information as specified in reg 21.

Records and identity verification regimes are prescriptive (reg 21)

• Reg 21 prescribes the minimum fields for sale records, mandates identity verification processes and requires retention of records for at least five years. The identity verification rules are specific: either a single government issued card with name, residential address, signature and photograph (and checks for forgery, signature match and photographic likeness), or two or more documents with specified provenance and content (reg 21(3)-(5)). Failure to record the details required in reg 21(5) is an offence risk and undermines defence against supply penalties.

Annual returns and time triggers (reg 13)

• Holders of licences or permits granted or renewed for two years or more must lodge annual returns before a date notified in writing by the Director and face a $5 000 penalty and $315 expiation fee for failure (reg 13). The timing is not calendar fixed; it is on dates notified by the Director. Licence and permit holders must track Director correspondence to avoid missing bespoke deadlines.

Security management plan and documentary requirements (reg 15)

• Security management plans must be approved by the Director, be fully documented and include detailed supporting material. A temporary exemption is possible while preparing the plan, but it is conditional and time limited and may require an approved compliance plan (reg 15(8)-(9)). A failure to meet resubmission deadlines when the Director requires modifications is an offence (reg 15(7)). Drafting a plan without anticipating Director guidance (reg 15(4)) risks repeated resubmissions.

Personnel vetting and adverse security assessments (regs 16, 26)

• Approvals of managers and agents are required and the Director may refuse where a person is the subject of an adverse security assessment under the ASIO Act (reg 26(5)(a)). Close associates are included in suitability considerations (reg 26(5)(b)). Applicants and holders must therefore anticipate background checks and potential disqualifications not only for themselves but for family, partners and corporate associates.

Director’s broad discretion and non‑fetters (reg 26(6))

• Reg 26(6) states that where the Act gives the Director absolute discretion, the regulation does not fetter that discretion. Where the Act confers absolute discretion, regulation‑level expectations are statements of intention at a point in time rather than binding constraints. Practically, this means the Director’s exercise of power may shift with policy and security considerations and applicants should plan for variable outcomes.

Classification changes can change regime application (reg 6)

• If the Director assigns a substance to a division of Class 1 Dangerous Goods under the Explosives Regulations 2011, the substance ceases to be a security sensitive substance for the purposes of the Act and regulations (reg 6(3)). That can materially change which compliance obligations apply. Parties should seek classification advice before structuring transactions.

Import/export notice, timing and documentary requirements (reg 20)

• Imports and exports to/from outside Australia require at least seven clear working days notice and must be accompanied by a manufacturer’s statement of composition and a NATA‑accredited certificate of analysis or equivalent (reg 20(1)-(2)(c)(i)-(ii)). Failure to provide correct documentation or to meet the 7 working days timeline can delay consignments and expose holders to risk.

Separation distances and storage constraints for ammonium nitrate (reg 19)

• Licence conditions contain specific separation distances for ammonium nitrate blasting intermediate and for bulk storage of other security sensitive ammonium nitrate (100+ tonnes) tied to distances for category ZZ explosives in the Explosives Regulations 2011 (reg 19(1)-(2)). Storage proposals must align with those distances unless the Director authorises otherwise. Developers and operators must account for potentially substantial land use and siting constraints.

Immediate reporting obligations (reg 17)

• Theft, loss or apparent unauthorised interference must be reported immediately to police and the Director. Failure to do so is a condition breach and an offence risk.

Document production and inspection powers (reg 30)

• Inspectors may demand production of licences, permits, approvals and records. Non‑compliance is an offence with a $5 000 maximum penalty. On‑site record systems and staff training about inspector interactions are therefore necessary.

False and misleading statements (reg 31)

• Materially false or misleading statements in applications or records are penalised. The regulations impose a $5 000 maximum penalty which incentivises rigorous systems for accuracy and verification.

Exemption conditions and Gazette notice (reg 34)

• The Director may grant exemptions in the Gazette but such exemptions are conditional and breach carries a $5 000 penalty. Businesses relying on an exemption must track Gazette notices and ensure compliance with any conditions attached.

Cross‑jurisdictional police and security information (regs 27, 32)

• The Director may request police reports and other security information and may require consents for obtaining them; costs are borne by the applicant (reg 27(2)(d)). Applicants should budget for police checks and be prepared to provide consents.

Time limits for appeals and requirement for written reasons (reg 33)

• Appeals must generally be lodged within one month and the Director must provide written reasons on request. Failure to obtain written reasons promptly can shorten effective appeal windows; applicants should rely on reg 33(4) to run appeal time from receipt of written reasons.

Small differences in licence/permit periods affect fees (reg 27(6))

• Application fees are pro rata adjusted where the licence/permit term differs from 36 months. Applicants should verify fee calculations early to budget correctly.

In practice these “gotchas” amount to a package of operational traps: broad permit coverage, prescriptive documentation and identity checks, obligations tied to Director discretions, and immediate reporting and inspection powers. Legal and compliance teams should build these specific requirements into procurement, logistics, HR screening and plant design processes.

Compliance requires an integrated operational, personnel and records approach. Below is a practical, section‑referenced checklist to align business processes with the regulations.

1. Classification check and registration

   • Confirm whether the substance in question is declared a security sensitive substance under proclamation referenced in reg 6(1). If classification is uncertain, request clarification from the Director, noting reg 6(2)-(3) that classification under the Explosives Regulations 2011 can alter the substance’s regulatory status.

2. Licensing and permits

   • Hold or obtain an Act licence where required for holding or manufacturing explosives (reg 8).
   • Identify which activities will require permits under reg 9 (import, export, sale, supply, purchase, acquisition, use, disposal) and apply for appropriate permits via the Director per reg 27(1). Ensure applications specify purposes (reg 27(1)(c)), include identity and age proof (reg 27(1)(d)-(e)), supporting material for management plans if applicable (reg 27(1)(f)), and the prescribed fee (reg 27(1)(g)). Anticipate pro rata fee adjustments for non‑36 month terms (reg 27(6)).

3. Security management plan

   • Prepare a fully documented security management plan as required by reg 15(1)-(2). The plan must assess security risks, document processes to keep substances secure, specify surveillance measures where storage/transport is not physically secured (reg 15(2)(c)), and include supporting material (reg 15(10)). Submit the plan for Director approval (reg 15(5)).
   • If time is needed, apply for a temporary exemption and compliance plan under reg 15(8)-(9) and conform strictly to compliance plan conditions.

4. Personnel vetting and identification

   • Ensure all persons who supervise or manage activities authorised by licences or permits are approved security cleared managers (reg 16(1)(a)).
   • Identify persons who require approval as security cleared agents or managers because they may have access outside direct supervision (reg 16(1)(b)). Apply to the Director for approvals (reg 16(2)). Prepare for age verification (18+), police checks and consent requirements (regs 26(1)-(2), 27(2)(d)).
   • Implement ID card policy consistent with any Director requirements for visible ID while on duty (reg 16(1)(c)).

5. Records and identity verification systems

   • Implement recordkeeping systems to capture the fields required by regs 21-23 for sale/supply, purchase/acquisition, and use/disposal transactions. Ensure retention for at least five years (reg 21(1), 22(1), 23(1)).
   • For sales/supply, implement identity verification protocols matching reg 21(3)-(5). Train staff to examine documents for forgery, signature matching and photographic likeness (reg 21(4)). Capture document identifying numbers, issue dates or issuer details as required (reg 21(5)). Retain written authorisations for third‑party deliveries (reg 21(1)(c), (6)).

6. Import/export compliance

   • For permits authorising import/export to/from outside Australia, plan logistics to provide at least seven clear working days notice to the Director and port operator where relevant (reg 20(1)-(2)(a)). Assemble a manufacturer’s statement of composition and a NATA‑accredited certificate of analysis or approved equivalent (reg 20(2)(c)(i)). For import, prepare details of licences and permits under which storage, transport or use will occur in the State (reg 20(2)(c)(ii)).

7. Storage, separation distances and plant

   • For ammonium nitrate blasting intermediate and other security sensitive ammonium nitrate in bulk, ensure storage locations meet separation distances prescribed by the Explosives Regulations 2011 or obtain written authorisation from the Director to deviate (reg 19(1)-(2)). Account for the definition of ammonium nitrate blasting intermediate (reg 19(3)) when assessing storage strategies.
   • Seek the Director’s approval for any alterations to premises, vehicles or plant as required by licence conditions (reg 14(2)(h)).

8. Reporting, incident and loss protocols

   • Install procedures to report theft, loss or apparent unauthorised interference immediately to a police officer and the Director as required by reg 17. Document the incident and preserve chain of custody and evidence to support police and Director investigations.

9. Annual returns and ongoing compliance

   • If licences or permits have terms of two years or more, establish a calendar and tracking system to lodge annual returns before the date notified by the Director (reg 13). Maintain documents required for potential inspections and returns.

10. Interaction with police and security assessments

• Prepare consent forms and mechanisms for applicants and close associates to provide or obtain police reports when requested (reg 27(2)(d)). Budget for costs of obtaining such police reports which are payable by the applicant (reg 27(2)(d)). Monitor whether any person is subject to an adverse security assessment under the ASIO Act which would render them unsuitable (reg 26(5)(a)).

11. Inspection readiness

• Create an inspection pack with licences, permits, approvals, security management plans, identity records and transaction records available for production to inspectors (reg 30). Train staff about the obligation to comply with inspector requests to avoid the offence in reg 30(2).

12. Managing variation, suspension and revocation risk

• Use reg 25(1) to apply for variations where operations change, and be prepared to return licences or permits when requested for replacement/alteration (reg 25(2)). Note time limits and penalties for failing to return documents (reg 25(2), penalty).
• Keep an auditable compliance trail to support submissions in the 14 day period provided before suspension or revocation unless urgent action is justified (reg 29(5)).

13. Documentation control and accuracy

• Introduce quality assurance processes to prevent false or misleading statements in records or applications (reg 31). Regular internal audits should verify completeness and accuracy of certificate of analysis, composition statements and identity records.

14. Monitor Director guidance and Gazetted exemptions

• Regularly check for Director guidelines on security management plans (reg 15(4)) and for any Gazette exemptions or variations under reg 34. If relying on an exemption, document compliance against the conditions and monitor for variations or revocation.

15. Legal and procedural safeguards

• Where a Director decision is adverse, request written reasons promptly under reg 33(3) and consider appeal to the Administrative and Disciplinary Division of the District Court within one month, noting reg 33(4) extends the time from receipt of written reasons where necessary.

Implementation timeline and budgeting

• Budget for initial application fees and potential police report fees (reg 27(1)(g), 27(2)(d)). Allow time for security management plan drafting, submission and potential resubmissions if the Director requires modifications (reg 15(5)-(6)). For import/export, factor in the seven working day lead time and the time for lab testing and certification (reg 20(1)-(2)(c)(i)).

Checklist for counsel and compliance officers

• Verify substance classification with the Director.
• Confirm licences and permits cover each intended activity.
• Draft and submit a security management plan with supporting material.
• Implement identity verification and five‑year record retention systems.
• Set up personnel vetting and approval pipelines for security cleared managers and agents.
• Prepare incident notification and inspector response protocols.
• Monitor Director guidance, Gazetted exemptions and legislative changes such as the noted revocation by the Explosives Act 2024.

Following these steps aligns operations with the specific, prescriptive duties in the regulations and manages the principal enforcement, timing and documentary risks identified in the instrument.
