sec.110 Stay of operation of decision
If an application is made for internal review of an original decision, the applicant may immediately apply, as provided under the QCAT Act , to QCAT for a stay of the decision. QCAT may stay the decision to secure the effectiveness of the internal review or a later application for external review to QCAT. A stay— may be given on conditions QCAT considers appropriate; and operates for the period fixed by QCAT; and may be revoked or amended by QCAT. The period of a stay must not extend past the time when the chief inspector reviews the original decision and any later period QCAT allows the applicant to enable the applicant to apply for an external review of the internal review decision. An application for internal review of a decision affects the decision, or carrying out of the decision, only if the decision is stayed. s 110 amd 2009 No. 24 s 495 (sec.110-ssec.1) If an application is made for internal review of an original decision, the applicant may immediately apply, as provided under the QCAT Act , to QCAT for a stay of the decision.
