#### 42 Search warrant 42 Search warrant > > (1) In this section— > > > > authorised officer has the same meaning as it has in the [Law Enforcement (Powers and Responsibilities) Act 2002](/view/html/inforce/current/act-2002-103). > > > (2) An inspector may apply to an authorised officer for the issue of a search warrant if the inspector has reasonable grounds for believing that a provision of this Act or the regulations has been or is being contravened in any dwelling. > > > (3) An authorised officer to whom an application is made under subsection (2) may, if satisfied that there are reasonable grounds for doing so, issue a search warrant authorising an inspector named in the warrant, when accompanied by a member of the police force— > > > > > (a) to enter the dwelling, and > > > > > (b) to search the dwelling for evidence of a contravention of this Act or the regulations. > > > (4) Division 4 of Part 5 of the [Law Enforcement (Powers and Responsibilities) Act 2002](/view/html/inforce/current/act-2002-103) applies to a search warrant issued under this section. > > **s 42:** Am 1991 No 92, Sch 2; 2002 No 103, Sch 4.32 \[1\]–\[3\].
