A person is guilty of a crime and is liable to punishment on indictment under the Criminal Code if the person, in giving any testimony otherwise than on oath or affirmation pursuant to an order under section 5 , makes a statement that –
(a) the person knows to be false in a material particular; or
(b) is false in a material particular and which the person does not believe to be true.
