When interpreting the Schedule and its entries, treat headings and notes that form part of the Regulation as legally operative elements of the instrument.

9. Train operational staff and counsel: Ensure court staff, prosecutors, defence counsel and other practitioners involved in cases where witness identity protections may be at stake are aware of the Schedule and its effect. Practical training can avoid mistakes from relying on omitted or misidentified external statutes.

10. Where doubt exists, seek judicial determination: If there is any uncertainty whether a particular external provision counts as a corresponding law under s 42BA(1), the issue may be raised before a court applying Part IIAA. The Regulations will be the definitive starting point for such an argument, but courts may be asked to interpret the application of the declared corresponding law to specific facts.

Following these steps aligns practice with the Regulations’ narrow declaratory function. Because the instrument does not itself impose procedural prescriptions or enforcement mechanisms, compliance is primarily about accurate reference, correct application of the Schedule in the context of Part IIAA, and lifecycle monitoring to avoid a lapse when the instrument sunsets.
