Evidence Bill 2025 Part 12 Consequential amendments to other Acts Division 19 Spent Convictions Act 1988 amended s. 481 page 342 (2) This section applies if —1 (a) in accordance with section 53A, a child is2 giving oral evidence in any proceedings under3 this Act; and4 (b) the necessary facilities and equipment for that5 evidence to be given using a video link6 separation procedure are available.7 (3) The child’s evidence must be given using a video link8 separation procedure.9 (4) This section does not apply if the evidence of the child10 is given using a pre-recording procedure.11 12 Division 19 — Spent Convictions Act 1988 amended13 481. Act amended14 This Division amends the Spent Convictions Act 1988.15 482. Section 14 replaced16 Delete section 14 and insert:17 18 14. Division 4 does not apply to proceedings in which19 laws of evidence apply20 (1) Division 4 does not apply —21 (a) to a proceeding in a court or tribunal that22 applies the laws of evidence; or23 (b) to the making of any decision by a court or24 tribunal that applies the laws of evidence.25 (2) Division 4 does not affect the operation of the Evidence26 Act 2025, in particular section 357.27
