3A Appearances and entitlements to be present before courts
> > (1) A requirement by or under any other Act that a person appear (or be brought or be present) before a court is taken to be satisfied if the person appears before the court by way of an audio link or audio visual link under this Act.

> > Note.
> >
> > Part 1B of this Act contains provisions with respect to the appearance by audio visual link of accused detainees who are in custody in criminal proceedings.

> > (2) An entitlement of a person under another Act or law for a person to be present in proceedings before a court relating to bail is taken to be satisfied if either of the following are used in relation to the person under this Act—

> > > (a) audio links,
> >
> > > (b) audio visual links.

> > Note—
> >
> > See section 5BB(2A), which provides for the criteria that must be satisfied before a person may be present by audio link in proceedings before a court relating to bail.

> > (3) Any entitlement of a person under section 14 of the [Criminal Appeal Act 1912](/view/html/inforce/current/act-1912-016) to be present in proceedings on the hearing of an appeal is taken to be satisfied if audio visual links are used in relation to the person under this Act.
