#### 16 Non‑compliance with subpoenas If the person named in the subpoena fails to comply with it, the court out of which it was issued may issue a certificate under the seal of the court stating that: (a) leave to serve the subpoena was given by: (i) if the court is a superior court‑a judge of the court; or (ii) if the court is an inferior court‑a judge of the Federal Court of Australia, or a judge of the Supreme Court in the State or Territory in which the application for leave to issue the subpoena was made, as the case requires; and (b) the person named failed to comply with the subpoena.
