Estate Agents (Retirement Villages) Regulations 2016

The regulations rest on a few tightly defined concepts, all of which are set out or cross-referenced in the instrument.

• Owner resident and premises: Both terms are not defined within the text of these Regulations but are adopted by reference from the Retirement Villages Act 1986 (reg 5). Any determination of who qualifies as an owner resident, and what counts as the premises of that person, requires reference to that Act’s definitions.

• Engagement or appointment: This is the contractual relationship between an estate agent and an owner resident under which the agent is authorised to market and sell the premises. The Regulations distinguish engagements or appointments that permit the agent to charge a commission even where the sale cannot be completed because the purchaser does not enter into a separate contract for services with the village manager (reg 6(1)(b)). The instrument targets this particular contractual arrangement.

• Commission liability where the retirement village manager’s contract is required: The Regulations are concerned with engagements which allow the agent to charge commission even if the buyer fails to enter into the separate contract for services with the retirement village manager (reg 6(1)(b)). The phrase appears in both the disclosure duty (reg 6) and in the objective statement (reg 1) and is the factual trigger for the written information requirement.

• Prescribed information: The required content is narrowly expressed. Before obtaining the owner resident’s signature, the estate agent must (a) inform in writing that a commission is payable even if the sale cannot be completed for the reason specified (reg 6(2)(a)), (b) include a reference to the clause of the engagement setting out the commission arrangements (reg 6(2)(b)), and (c) obtain the owner resident’s dated signature on the page on which that information appears (reg 6(2)(c)). The instrument thus prescribes both content and form (page-level signature and dating).

• Advertisement statement: The advertising obligation is a single, exact textual requirement: "Buyer must also enter into separate contract with retirement village." (reg 7(1)). The Regulations additionally specify typographic and legibility parameters: plain text, point type not smaller than the smallest otherwise appearing in the advertisement, and easily legible (reg 7(2)(a)-(b)).

• Penalty units: The monetary exposure for breach is expressed in penalty units (20 units for each relevant contravention). The endnotes explain that penalty units are to be calculated under the Sentencing Act 1991 and the Monetary Units Act 2004, and provide the value for the 2016-17 financial year (endnote 4).

These concepts allocate procedural responsibilities (information, signature, advertising form) to the estate agent, while relying on external Acts for definitional scope and for translating penalty units into dollar amounts. The regulations are tightly circumscribed: they do not, for example, prescribe disclosure to prospective buyers by agents, do not create a duty directly on village managers, and do not alter substantive contractual terms between buyer and manager. They operate as a set of specified pre-signature and advertising controls aimed at clarifying for owner residents the potential for commission liability and for buyers the need to enter a separate contract with the village.

Primary legal subjects and economic actors affected by these Regulations are estate agents who handle sales of premises occupied by owner residents in retirement villages, and owner residents who engage estate agents, with secondary effects on prospective buyers and retirement village managers.

• Estate agents: The Regulations impose affirmative pre-signature duties and advertisement content and formatting obligations on estate agents holding engagements to sell retirement-village premises (reg 6(1); reg 7(1)). The agent must give specified written information, reference contractual clauses, secure a dated signature on the page that contains that information, and ensure advertisements include the exact prescribed sentence in a specified typographic form (reg 6(2); reg 7(1)-(2)). Failure to comply exposes the agent to a penalty of 20 penalty units for each contravention (penalties following regs 6 and 7).

• Owner residents (vendors): The Regulations operate to require estate agents to deliver particular information to owner residents before they sign an engagement (reg 6(2)(a)-(c)). That information concerns an exposure to commission liability where a purchaser fails to contract separately with the village manager (reg 6(1)(b)). The owner resident is therefore the actor the Regulations seek to protect by mandating written notice and a dated signature on that notice. The precise scope of "owner resident" and "premises" is determined by reference to the Retirement Villages Act 1986 (reg 5), so whether a particular vendor is an owner resident for these purposes depends on that Act.

• Prospective buyers: Buyers are affected indirectly. Advertisements must include an explicit statement that the buyer must enter into a separate contract with the retirement village (reg 7(1)). This creates a market signal that a sale of the premises commonly involves a second transaction between buyer and village. The Regulations do not require agents to provide further explanations to buyers; they require a specific advertisement label.

• Retirement village managers: The Regulations do not place duties directly on managers, but the disclosure regime imposed on agents recognises the commercial fact that sale completion may be contingent on a buyer entering into a separate contract for services with the manager (reg 6(1)(b), reg 7(1)). Managers are not assigned regulatory obligations or penalties by this instrument.

• Legal and compliance officers in agent firms: Persons responsible for contract drafting, advertising compliance, and recordkeeping within estate agency businesses must update templates, staff training and compliance checks to ensure the prescribed information and advertisement wording and formatting appear and that dated signatures are obtained and retained (reg 6(2)(c); reg 7(2)).

• Regulators and courts: The instrument creates penalty exposure (20 penalty units per contravention). The regulations do not name an enforcing authority. Penalty calculation and procedural aspects are governed by external Acts referenced in the endnotes (Sentencing Act 1991; Monetary Units Act 2004).

Who pays: Financially, the immediate payer of any enforcement penalty is the estate agent found in breach (the penalties are placed after the offending provisions). Who bears economic costs in practice depends on market allocation: compliance costs (paperwork, training, advertisement redesign) fall on agent businesses; potential changes in negotiability of commission terms could affect owner residents’ net sale proceeds or bargaining positions, but the Regulations do not alter contractual entitlements directly.

Who decides: The Regulations place decision points with estate agents (to include the statement, to obtain a dated signature, to print the advertisement statement). Whether and how contraventions are prosecuted, and what evidentiary standards apply, are not set out in the Regulations.

The net effect is a narrow regulation of agent behaviour directed at increasing particular pre-contractual disclosures to owner residents and adding a standard advertisement notice aimed at buyers.

The Regulations impose specific duties on estate agents and create ancillary rights for owner residents and prospective buyers, in the sense of receiving specified information.

Duties imposed on estate agents

• Pre-signature disclosure and signature: If an estate agent agrees to enter into an engagement or appointment with an owner resident to sell the resident’s premises and the engagement permits the agent to charge commission even if the purchaser does not enter into a contract for services with the retirement village manager, the agent must, before obtaining the owner resident’s signature, give written information that (a) the engagement provides for commission to be payable in that circumstance, (b) includes a reference to the clause of the engagement setting out the commission arrangements, and (c) obtain the owner resident’s dated signature on the page where the information is given (reg 6(1)-(2)). The duty is sequential and form-specific: the timing is "before obtaining the signature," the content is prescribed, and the signature must be dated and on the same page as the information (reg 6(2)(c)).

• Advertising label and formatting: An estate agent who holds a written engagement to sell premises in a retirement village must ensure every advertisement for those premises contains the literal sentence "Buyer must also enter into separate contract with retirement village." (reg 7(1)). The agent must ensure the statement is printed or typed in plain text, in point type no smaller than the smallest point type otherwise appearing in the advertisement, and in a form that is easily legible (reg 7(2)(a)-(b)). This creates a duty both of inclusion and of typographic parity within the advertisement.

• Penalty exposure: Each breach of the duties under reg 6 and reg 7 attracts a penalty of 20 penalty units (penalties appended to those regulations). The Regulations do not specify additional remedial rights or civil consequences flowing from non-compliance; they do not, by their terms, create contractual rights or alter the validity of engagements, except insofar as evidence of compliance/non-compliance could be invoked in civil proceedings.

Rights and practical entitlements for owner residents and buyers

• Right to prescribed information: Owner residents have a statutory entitlement to receive the written information specified in reg 6(2)(a)-(b) and to be asked to provide a dated signature on the same page (reg 6(2)(c)). This is a procedural right designed to ensure owner residents are put on notice of the agent’s commission arrangements.

• Right to advertisement disclosure: Prospective buyers are entitled to see the prescribed advertisement statement in plain text and legible form in any advertisement published or caused to be published by an agent holding a written engagement for the premises (reg 7(1)-(2)). The Regulations therefore guarantee a minimal level of market transparency in advertising for retirement-village premises.

Limits and non-alteration of other rights

• Definitions and applicability: The reach of these duties depends on the statutory definition of owner resident and premises in the Retirement Villages Act 1986 (reg 5). Persons who are not owner residents as defined in that Act are outside the instrument’s direct scope.

• No alteration of substantive contracts: The Regulations do not amend or validate clauses in engagements, do not alter the substantive enforceability of contracts between owner residents and agents, nor do they alter contracts between buyers and village managers. The instrument creates disclosure and advertising obligations and a penalty regime for non-compliance but does not by its text change substantive entitlements or duties under other laws.

• No procedural enforcement detail in the Regulations: The text imposes penalties but does not set out enforcement steps, time limits for prosecution, or administrative sanctioning mechanisms. The process by which penalties are pursued is therefore governed by other laws or administrative practice not contained in this instrument.

Operationally, the key duties are narrow, document- and format-specific responsibilities incumbent on estate agents that aim to increase pre-signature disclosure to owner residents and to standardise a minimal advertisement statement for buyers.

The Regulations specify monetary penalties expressed in penalty units for failure to comply with the prescribed duties.

Penalty quantum and calculation

• Each breach of the disclosure duty in reg 6 carries a penalty of 20 penalty units (penalty note attached to reg 6(2)). Each breach of the advertising duties in reg 7(1) and reg 7(2) likewise carries a penalty of 20 penalty units (penalty notes appended to those subregulations).

• The Regulations do not set a dollar amount; the conversion of penalty units into dollars is governed by the Sentencing Act 1991 and the Monetary Units Act 2004, as noted in the endnotes (endnote 4). The endnotes provide the value of a penalty unit for the financial year commencing 1 July 2016 as $155.46. Using that figure, 20 penalty units equated to $3,109.20 for that financial year, with the endnote noting that the amount may be rounded to the nearest dollar. The Regulations indicate that the Treasurer fixes the penalty-unit value for subsequent financial years under the Monetary Units Act 2004 and that the value is published in the Government Gazette and a Victorian newspaper before 1 June in the preceding financial year (endnote 4).

Enforcement mechanism and gaps in the instrument

• The Regulations themselves do not specify which agency is responsible for enforcement, nor do they detail the procedural mechanism for imposing or collecting penalties. The instrument creates the offence and attaches the penalty quantum in penalty units, but the process of investigation, charging, prosecution, administrative enforcement, or appeal must be sought in other legislation or administrative practice.

• There is no express provision in the Regulations for injunctive relief, civil remedies, or private cause of action created by non-compliance. The penalties attached are the only sanctions expressed in the text.

Multiplicity and repetition of offences

• The drafting places a penalty after reg 6(2) and after each subregulation in reg 7. This structure supports a potential multiplicity of penalty exposures: an agent could incur a penalty for failing to give the prescribed information, for failing to reference the clause, and for failing to obtain the dated signature on the same page, depending on enforcement practice. Similarly, the advertising obligations are split between inclusion of the statement and formatting requirements, each carrying 20 penalty units (reg 7(1)-(2)). The instrument does not limit aggregation of penalties, leaving that to prosecutorial discretion or to other procedural law on double-counting of offences.

Administrative and compliance implications

• Firms should assume material financial exposure where obligations are not observed. The regulations, combined with the mechanism for penalty-unit valuation, create a calculable monetary risk for breaches (endnote 4). The Regulations’ focus on pre-signature timing and page-level signature places evidentiary weight on contemporaneous written records, which will be material if penalties are sought.

• Because the Regulations do not identify the enforcement agency, affected parties should look to the Estate Agents Act 1980 and related regulatory frameworks to identify who enforces offences under subordinate legislation of this kind, and to understand time limits and procedural rules relevant to prosecution or administrative action.

In summary, the Regulations create criminal/administrative monetary exposure for estate agents’ non-compliance, with the penalty amount derived from statutory penalty-unit mechanisms, but they leave enforcement architecture and procedural detail to other laws and administrative practice.

The Regulations are explicit about their legislative relationships and cross-references, and a reader must consult the referenced statutes to fully determine scope and operation.

Subordinate instrument to the Estate Agents Act 1980

• Source of power: The Regulations are made under section 99 of the Estate Agents Act 1980 (reg 2). That places them as subordinate legislation under that Act. The Regulations do not purport to amend the Estate Agents Act; they operate within powers conferred by it to set conduct requirements for estate agents.

Definitions by reference to the Retirement Villages Act 1986

• Scope reliance: The Regulations adopt the terms "owner resident" and "premises" by reference to the Retirement Villages Act 1986 (reg 5). Consequently, the Regulations’ reach and the identity of persons and premises captured turn on the definitions in that Act. For example, whether a particular vendor qualifies as an owner resident for these Regulations depends on the Retirement Villages Act 1986 definitions. The instrument does not expand or contract those definitions itself.

Penalty units and monetary calculation under other Acts

• Sentencing Act 1991 and Monetary Units Act 2004: The Regulations attach penalties in penalty units but rely on the Sentencing Act 1991 and the Monetary Units Act 2004 to convert those units into dollar values. The endnotes explicitly describe that the value of a penalty unit for the financial year commencing 1 July 2016 is $155.46 and that the Treasurer determines future values under the Monetary Units Act 2004 (endnote 4). These links mean that the dollar exposure under the Regulations will vary over time in line with ministerial determinations laid down in other legislation.

Sunset and subordinate legislation framework

• Subordinate Legislation Act 1994: The endnotes indicate the Regulations will sunset ten years after making, on 12 July 2026, invoking the Subordinate Legislation Act 1994’s mechanism for sunsetting subordinate instruments (endnote 1). Users should note that this is an administrative expiry mechanism that may require legislative action if the policy is to be continued beyond the sunset date.

Revocation of prior subordinate instrument

• The Regulations explicitly revoke the Estate Agents (Retirement Villages) Regulations 2006 (reg 4). Having revoked the prior Regulations, the instrument replaces the earlier subordinate regime in force for the same subject matter. The endnotes cite S.R. No. 100/2006 as the revoked instrument (endnote 1).

No express interplay with consumer law or retirement-village manager duties

• The Regulations are narrowly framed and do not cross-reference consumer-protection statutes or impose obligations on retirement village managers. They do not alter contractual law or the enforceability of contract terms; they impose disclosure and advertising obligations on agents. Any interplay with consumer-law obligations, unconscionability doctrines, or broader statutory protections would need to be assessed against those statutes and common law, which are outside the text of this instrument.

No enforcement agency named in the Regulations

• The text does not designate which regulator enforces contraventions. Enforcement practice is therefore determined by the Estate Agents Act 1980, criminal or administrative prosecution mechanisms applicable to subordinate legislation, and prosecutorial discretion under general law.

In practice, compliance requires reading these Regulations together with the Estate Agents Act 1980 (power and regulatory context), the Retirement Villages Act 1986 (definitions), and the Sentencing Act 1991 and Monetary Units Act 2004 (penalty calculations). The Regulations are a narrowly framed layer of obligations placed on estate agents operating in the retirement-village sales market and operate within a broader legal architecture determined by other statutes.

The instrument contains its own amendment history as follows.

• Original making and commencement: The Regulations were made on 12 July 2016 by the Governor in Council under s 99 of the Estate Agents Act 1980 and came into operation on 31 July 2016 (reg 3; endnote 1).

• Revocation of prior subordinate legislation: The Regulations explicitly revoke the Estate Agents (Retirement Villages) Regulations 2006 (reg 4). The endnotes identify that revoked instrument by its statutory rule number (S.R. No. 100/2006) (endnote 1).

• Amendments since making: The Table of Amendments in the instrument reports that there are no amendments to the Estate Agents (Retirement Villages) Regulations 2016 by subsequent statutory rules, subordinate instruments, or Acts as at the version published (section 2 of the Endnotes, "Table of Amendments"). The instrument therefore stands in its original form as at the version date.

• Amendments not in operation: The instrument states there are no amendments not yet in operation at the date of publication (section 3 of the Endnotes).

• Sunset: Administrative expiry: Under the Subordinate Legislation Act 1994 the Regulations will sunset ten years after the day of making, that is on 12 July 2026 (endnote 1). The instrument notes this mechanism explicitly.

• Penalty-unit accounting: The endnotes document that the Regulations provide penalties in penalty units by reference to s 110 of the Sentencing Act 1991, and that penalty-unit monetary value for financial years is to be fixed under the Monetary Units Act 2004 (endnote 4). For the financial year commencing 1 July 2016, the endnotes set out a penalty-unit value ($155.46) and the rounding convention.

No recorded subsequent amendments

• As of the instrument’s version date provided (31 July 2016), there are no recorded amendments to the Regulations. The Table of Amendments section confirms this fact.

Implications of amendment status

• The Regulations are fresh subordinate legislation (2016) that replaced the 2006 Regulations and remained unamended as at the stated version. Their future continuation beyond the sunset date requires action under the Subordinate Legislation Act 1994 or replacement/regulatory redesign. Users should monitor for any later statutory rules or amending instruments that would modify the duties, penalties, or definitions set out here; none are recorded in the published instrument.

The text of the Regulations contains no case citations and records no litigation history. The only judicial or quasi-judicial material present in the instrument is procedural: the Regulations specify penalty units (which in turn are administered under sentencing and monetary-unit legislation) but do not list any decisions, appeals, or case law interpreting these specific regulations.

What the instrument records

• No cases: There are no legal proceedings, test cases, or appeals referenced in the Regulations or the Endnotes. The instrument as published is silent on any litigation.

Practical consequence

• The absence of litigation in the instrument means that, at the time of the published version, there is no statutory guidance from courts interpreting the precise obligations, the meaning of "plain text" or "easily legible," the scope of the signature requirement (for example, whether electronic or scanned signatures suffice), or the limits on aggregation of penalties under these provisions. Any interpretation questions would therefore need to be resolved through conventional sources: (a) the text of these Regulations, (b) the parent Estate Agents Act 1980, (c) general statutory interpretation principles, and (d) any later case law or administrative guidance developed after the date of publication.

• Users seeking clarity on enforcement practice, admissible evidence, or the interplay with contract law in disputes should note that the instrument does not supply adjudicative precedents; they must consult subsequent decisions or administrative guidance not contained in this text.

In short, there is no litigation history recorded in the Regulations; interpretive questions and enforcement practice remain matters to be developed in subsequent adjudications or administrative guidance.

This section flags technical traps and consequential details that arise directly from the Regulations’ text.

1. Page-level dated signature requirement (reg 6(2)(c)): The estate agent must obtain the owner resident’s dated signature "on the page on which the information referred to in paragraphs (a) and (b) is given." This is precise: a signature on a different page may not meet the statutory requirement. Practical consequences include the need to ensure engagement forms or disclosure sheets are arranged so that the required text appears on the same physical or digital page as the signature line and that the signature is dated. The Regulations do not specify whether an electronic signature or an image of a signature suffices; the text requires a "dated signature" on the page, and absent ruling or guidance, parties should capture robust evidence of contemporaneous signature and dating.

2. Narrow textual prescription for advertisement (reg 7(1)): The required sentence must be the exact wording: "Buyer must also enter into separate contract with retirement village.". The provision includes the full stop in the instrument; the text places the sentence in quotation marks as the precise statement agents must include. Agents must avoid paraphrase or alternative formulations; stylistic or marketing edits that change the wording could be non-compliant.

3. Typography equality requirement (reg 7(2)(a)): The statement must be in plain text in point type no smaller than the smallest point type otherwise appearing in the advertisement. If an advertisement uses mixed fonts and sizes, the requirement is to match or exceed the smallest point size used elsewhere in the ad. This creates the risk that a long advertisement with very small footnote text or disclaimers (smallest point type) will force the required statement to appear in similarly small type, undermining its legibility requirement in reg 7(2)(b). The interaction of these two subrequirements creates a formatting trade-off agents must manage to be compliant: the statement must not be smaller than the ad’s smallest point type and must also be easily legible.

4. "Plain text" qualification (reg 7(2)(a)): The statement must be in plain text. The instrument does not define "plain text" but, taken literally, suggests the statement must be textual characters rather than an embedded graphic, image, or stylised logo-type rendering. Agents using image-based advertisements or non-text-based layouts should ensure the statement is included as selectable text in the publishing medium.

5. Commission exposure remains contractual (reg 6(1)(b)): The Regulations recognise that an engagement may provide for commission to be payable even where a purchaser fails to enter a required contract for services with the retirement village manager. The Regulations do not change whether such a clause is enforceable; they only require notice and a dated signature on that notice (reg 6(2)). Thus agents or owner residents who assume the Regulations alter contractual enforceability may be mistaken; the Regulations are disclosure and advertising requirements.

6. Multiple penalty exposures (penalties after regs 6 and 7): The draft structure may permit multiple separate penalty counts: failing to give the information, failing to include the clause reference, failing to obtain a dated signature on the page, failing to include the statement in the advertisement, and failing to meet the typography/legibility conditions. Each breach carries 20 penalty units. Enforcement agencies might aggregate or choose selective counts; the Regulations do not constrain aggregation.

7. Definition dependence (reg 5): Whether the duties apply depends on who qualifies as an "owner resident" and what counts as "premises" under the Retirement Villages Act 1986. Agents dealing with persons who occupy retirement-village-style housing but who do not satisfy that Act’s definitions should verify applicability before applying these rules.

8. No enforcement agency named: The Regulations do not name a regulator or enforcement pathway. This lack of procedural detail creates uncertainty about enforcement expectations and the practical process of penalty imposition.

9. Sunset date and continuity (endnote 1): The Regulations will sunset on 12 July 2026 under the Subordinate Legislation Act 1994. If no extension or replacement instrument is made, obligations will lapse automatically on that date. Agents should track whether the instrument is remade, extended, or replaced ahead of that expiry if they rely on its continuing operation as part of compliance programmes.

10. Penalty-unit value changes over time (endnote 4): Dollar exposure will change as the Treasurer fixes the penalty-unit value for each financial year under the Monetary Units Act 2004. The instrument provides the 2016-17 unit value ($155.46) but that figure will not apply indefinitely. Compliance planning should model future variability.

Each of these points follows from the precise language of the Regulations. They create operational implications for drafting, recordkeeping, advertising workflows, and compliance monitoring.

This section sets out a practical, source-grounded compliance checklist and recommended operational controls consistent with the Regulations’ requirements.

1. Identify covered engagements

• Confirm applicability by reference to the Retirement Villages Act 1986 definitions of "owner resident" and "premises" (reg 5). Only engagements with owner residents as so defined, and where the engagement allows commission to be charged even if the purchaser does not enter into a separate contract for services with the manager, trigger the reg 6 obligations (reg 6(1)(a)-(b)).

2. Pre-signature disclosure process (reg 6(2))

• Prepare a one-page disclosure sheet for owner residents that contains the required written information: a clear statement that the engagement or appointment provides for a commission to be payable even if a sale cannot be completed because the purchaser does not enter into a contract for services with the manager (reg 6(2)(a)). Include an express reference to the clause number(s) in the engagement or appointment that set out the commission arrangements (reg 6(2)(b)).

• Ensure the disclosure sheet places the owner resident signature block and date on the same physical or digital page as the prescribed information (reg 6(2)(c)). For electronic forms, ensure the required text and signature field render on the same screen/page and retain metadata showing timestamped signing.

• Obtain a dated signature from the owner resident on that page before obtaining any other signature to the engagement document (reg 6(2)). Keep contemporaneous evidence (scanned signed page, photocopy, digital signature audit trail).

• Train staff and agents that the pre-signature information must be given and signed before executing the engagement to avoid triggering the penalty in reg 6.

3. Engagement clause cross-referencing

• Maintain a cross-reference map linking engagement clause numbers to the disclosure sheet reference. When engagement clauses change, ensure the disclosure sheet’s clause reference is updated before use (reg 6(2)(b)).

4. Advertising templates and approvals (reg 7)

• Update all advertising templates for print, online, social media and property portals to include the exact sentence: "Buyer must also enter into separate contract with retirement village." (reg 7(1)). Do not paraphrase.

• Ensure the statement is rendered in plain text (avoid embedding as an image) and set in point type no smaller than the smallest point type otherwise appearing in the advertisement. If the advertisement uses multiple sizes, identify the smallest point type in the advertisement and set the statement at that size or larger (reg 7(2)(a)).

• Confirm legibility: the statement must be "in a form that is easily legible" (reg 7(2)(b)). Where the smallest point type in an advertisement would make legibility marginal, consider revising the ad to increase the smallest type size so the required statement is both compliant with the "no smaller than" rule and easily legible.

• Implement final pre-publication checks: a compliance sign-off step should verify the statement appears verbatim, in plain text, at the required point size relative to the rest of the advertisement, and is legible in the publication format.

5. Recordkeeping and evidence

• Retain the dated disclosure page signed by the owner resident in a secure file retrievable for inspection, litigation defence or administrative query. Record the date/time, the identity of the delivering agent, and the version of the engagement referred to (reg 6(2)(c)).

• Archive copies of all advertisements in the precise published form (including HTML source, images and PDFs) with metadata indicating publication date, platform, and versions used. This supports evidentiary needs if compliance is challenged (reg 7).

6. Training and operational controls

• Train all sales staff, advertising designers and compliance personnel on the textual and typographic requirements. Provide examples of acceptable and unacceptable ad layouts to avoid inadvertent non-compliance.

• Implement workflow rules in the marketing/advertising approval system to block publication of retirement-village premises ads unless the compliance checkbox confirming inclusion in the correct form is ticked.

7. Audit and monitoring

• Periodically audit engagements and advertisements for retirement-village premises for compliance with reg 6 and reg 7. Use checklists that confirm clause references in the disclosure sheet match the engagement and that signed disclosure pages are present.

• Monitor penalty-unit value publications (Monetary Units Act 2004/Treasurer determinations) so that exposure calculations used in risk assessments are current (endnote 4).

8. Legal and contractual review

• Ensure legal counsel reviews standard engagement clauses that permit commission to be payable when a sale is incomplete because the purchaser does not enter into the manager’s contract. The Regulations do not alter the enforceability of such clauses; however, disclosure and signature mechanics are required (reg 6(1)(b); reg 6(2)).

9. Digital considerations

• For electronic engagements, ensure the implementation of digital signature technology captures the date on the same electronic "page" as the disclosure and stores an immutable audit trail demonstrating the sequence (disclosure given before engagement signature). Confirm that the digital rendering would be recognised as "plain text" for advertising statements in online ads.

10. Governance and policy refresh

• Note the instrument’s sunset date (12 July 2026) and plan for policy reviews ahead of that date to determine whether templates and compliance processes must be retained, adjusted, or wound up if the Regulations are not continued (endnote 1).

By following these steps, estate agents can align operational practices with the Regulations’ narrow but specific obligations: deliver the prescribed written information and obtain a dated signature on the page containing it before obtaining the engagement signature (reg 6(2)); and include the exact advertisement statement in plain text at no smaller point size than the smallest used in the ad, with legibility (reg 7(1)-(2)). Documentation and audit trails are critical because the Regulations’ compliance proof is documentary and page-specific.
