61A Offence to give false or misleading information or documents
(1) A person must not give to the Commission or an inspector information that the person is required to give to the Commission or the inspector under this Act or relevant legislation that the person knows to be false or misleading in any material particular.
(2) A person must not produce a document to the Commission or an inspector that the person is required to give to the Commission or the inspector under this Act or relevant legislation if—
(a) the person knows the document is false or misleading in a material particular; and
(b) the person does not indicate the respect in which the document is false or misleading.

(3) Subsections (1) and (2) do not apply to an energy licensee who is required to give information or produce a document to the Commission under or for the purposes of the **Electricity Industry Act 2000** or the **Gas Industry Act 2001**.
Section 116AA of the **Electricity Industry Act 2000** and section 229A of the **Gas Industry Act 2001** contain offences relating to energy licensees providing false or misleading information or documents to the Commission.
