23AChief executive officer

23A Chief executive officer (1) The Commission may employ a person as the chief executive officer of the Commission. (2) The chief executive officer is responsible to the Commission for the day-to-day management of the Commission. (3) The chief executive officer is to be employed as an executive under Part 3 of the **Public Administration Act 2004**. (4) If the chief executive officer was, immediately before being appointed, a member of a statutory superannuation scheme within the meaning of the **Superannuation (Public Sector) Act 1992**, the chief executive officer continues to be a member of that superannuation scheme subject to the Act under which the scheme was created. (5) The chief executive officer must not be a Commissioner.
