116 Discretion to decline to provide or continue dispute resolution The Commission may decline to provide or to continue to provide dispute resolution for any of the following reasons— (a) the alleged contravention occurred more than 12 months before the dispute was brought; (b) the matter has been adequately dealt with by a court or tribunal; (c) the matter involves subject matter that would be more appropriately dealt with by a court or tribunal; (d) a person has initiated proceedings in another forum; S. 116(e) amended by No. 26/2011 s. 34(Sch. item 6.12). (e) having regard to all the circumstances, the Commission considers it is not appropriate to provide or to continue to provide dispute resolution.
