Environmental Protection (Metal Coating) Regulations 2001

The text relies on a small set of recurring legal and technical concepts. Those concepts are defined or operationalised in the regulations and determine how the rules apply.

• Operator and premises. The operator is the person carrying on metal coating, and premises are defined in relation to the operator as the premises at which the operator carries on metal coating (reg 2). This definition makes obligations attach to the person conducting the activity on the location where it is undertaken.

• Metal coating and modalities. Metal coating is defined broadly as methods used to coat metal products, including spray painting, powder coating, and enamelling (reg 2). The regulations therefore cover multiple coating techniques and place specific requirements on spray painting and powder coating activities (regs 4-9).

• Booths and enclosed workspaces. Spray painting booths and powder coating booths are central control points. The terms are defined (reg 2) and the law requires use of such booths for most work: all powder coating must be in a powder coating booth (reg 7), and spray painting must be carried on in a spray painting booth unless the object’s size, shape, position, or location makes that unreasonable (reg 4). Where booths are used, design, construction, installation, maintenance, and operational ventilation and dust management systems must meet specified standards and functional outcomes (regs 6 and 8).

• Ventilation, dust extraction and dust collection systems. The regulations require mechanical ventilation and dust extraction for spray booths (reg 6(b)) and mechanical ventilation and dust collection for powder booths (reg 8(b)). The functional outcomes are restrictive: no visible overspray or powder escapes the booth; all booth air must pass through the extraction/collection system before discharge; and discharged air must not contain any substance that causes pollution (regs 6(b)(i)-(iii); 8(b)(i)-(iii)).

• Visible emissions standard. The regime uses a “visible” emissions benchmark in several places. The requirement that no visible paint overspray escapes from the booth appears in reg 6(b)(i) and similarly for powder in reg 8(b)(i), with an additional general obligation that no visible dust or powder escapes from the premises (reg 9). The choice of a visible threshold sets an observable standard rather than specifying numerical concentration limits for particular substances.

• Containment for chemicals and bunding. For areas where chemicals that can cause pollution are used or kept, the regulations require the area to be within a compound with walls and floor impervious to acid and a bund capacity measured against tank volumes (reg 10(1)(a)-(c)). The compound must prevent stormwater ingress and be designed to avoid overflow or discharge (reg 10(2)(a)-(b)).

• Waste management linkage to Part V licensing. Solid waste must be disposed at landfill or treatment facilities licensed under Part V of the Act (reg 12). Liquid waste must not be discharged to the environment (reg 11).

• Penalties and enforcement modalities. The regulations declare contravention of any regulation to be an offence carrying a fine of $5 000 (reg 13). Separately, reg 14 inserts specific regulation items into Schedule 6 of the Environmental Protection Regulations 1987 with fixed monetary amounts (the inserted table lists amounts 250 and 500 against particular regulations), which operationally appears to create infringement notice instalments for contraventions of listed regulations, though the regulations themselves do not elaborate procedure beyond amendment of Schedule 6 (reg 14).

• Reference to external standards. The regulations incorporate external technical standards by reference: AS/NZS 4114.1 for spray painting booths (reg 6(a)), and AS/NZS 3754 , 1990 for powder coatings by electrostatic spraying (reg 8(a)). Compliance therefore requires meeting both statutory performance requirements and those standards’ provisions.

Taken together, these main concepts form a regime that is both prescriptive in technical inputs (booth design standards and bunding capacity rules) and outcome-oriented in emissions (no visible overspray, dust or powder; no discharge to the environment). The legal duties are attached to the operator and focus on the premises where metal coating is performed.

The primary legal addressees are operators, defined as the person carrying on metal coating (reg 2). That definition attaches duties to the economic actor actively conducting metal coating on particular premises. The regulations apply to metal coating premises described in Schedule 1 Part 2 category 81 of the Environmental Protection Regulations 1987 (reg 3). The text therefore targets a specific statutory category of premises identified in the Environmental Protection Regulations 1987; those premises are within the instrument’s territorial and sectoral scope.

Affected parties include small workshops and large industrial premises alike, insofar as they fit the Schedule 1 Part 2 category reference. The obligations are location‑specific because “premises” is defined relative to the operator’s place of activity (reg 2), and duties such as preventing overspray from escaping “the premises” or, if there are no defined boundaries, onto places to which the public has access, use spatial limits to determine compliance exposure (reg 5).

The requirements create responsibilities for those who design, construct, install and maintain booths and dust/ventilation systems. Although the law names the operator as the person responsible for compliance (reg 2), achieving compliance will typically involve third parties: suppliers and fitters of booths, ventilation, and dust collection systems; builders performing bunding and floor works; contractors for licensed waste treatment or landfill disposal under Part V of the Act (reg 12); and possibly consultants engaged to interpret AS/NZS standards referenced in regs 6(a) and 8(a).

Owners of premises where the operator is not the occupier may be affected insofar as the operator’s duties extend to the premises at which they carry on metal coating and the premises features (building design, compound walls, drainage) may need modifications. The operator/premises nexus in reg 2 means that the person carrying on the activity is the primary duty holder; the text does not explicitly allocate duties to landlords, but they may be involved in practical implementation.

Regulatory enforcement bodies under the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987 are implicated by references to Part V licensing for landfill and waste treatment facilities (reg 12) and by the insertion of items into Schedule 6 of the Environmental Protection Regulations 1987 (reg 14). The regulations do not specify inspection, monitoring, or reporting procedures; they set obligations that inspection and enforcement agencies will enforce under the Act and the Regulations.

Finally, the regulations affect the market for compliant equipment and services. Meeting AS/NZS standards and the bunding and ventilation requirements will create demand for compliant booths, extraction systems, and licensed waste handling services. Operators that cannot reasonably use a spray booth because of object size, shape, position, or location may nevertheless be obliged to ensure no overspray escapes the premises (reg 4 and reg 5), imposing operational constraints on how and where certain coating tasks are done.

The statute places duties on the operator and prescribes certain functional outcomes. It does not create express positive rights for third parties; the obligations are regulatory. The key duties are:

• Use of booths. An operator must carry on all spray painting in a spray painting booth unless such a booth cannot reasonably be used because of the size, shape, position, or location of the object being painted (reg 4). All powder coating must be carried on in a powder coating booth (reg 7). The text therefore creates a presumptive booth obligation for spray painting with a narrow, fact-based exception, and an absolute booth requirement for powder coating.

• Prevention of off‑premises escape. The operator must not carry on spray painting other than in a spray painting booth unless it is carried on in such a manner that no paint overspray escapes from the premises, or if there are no defined premises boundaries, onto any place to which the public has access (reg 5). This imposes an outcome-based duty to prevent escape of overspray beyond the premises.

• Booth performance and standards. If using a spray painting booth, the operator must ensure it is designed, constructed, installed, and maintained in accordance with AS/NZS 4114.1 , Spray painting booths (reg 6(a)); and that it is fitted with an efficient mechanical ventilation and dust extraction system operating so that no visible overspray escapes, all air passes through the system before discharge, and air discharged does not contain any substance that causes pollution (reg 6(b)(i)-(iii)). For powder coating booths, the operator must ensure compliance with AS/NZS 3754 , 1990 and similar ventilation and dust collection performance outcomes (reg 8(a)-(b)(i)-(iii)).

• No visible dust/powder off premises. An operator must ensure that no visible dust or powder escapes from the premises (reg 9). This is a site-wide obligation, not limited to the booth itself.

• Chemical containment. Areas where chemicals that can cause pollution are used or kept must be within a compound with walls and floors impervious to acid, and capable of holding specified volumes relative to tank sizes (110 percent of the largest tank or interconnected system, and not less than 25 percent of total tank volume) (reg 10(1)(a)-(c)). The operator must also ensure stormwater does not enter the treatment-tank area and that the area is designed to prevent overflow or discharge (reg 10(2)(a)-(b)).

• Liquid waste control. An operator must ensure no liquid waste escapes the premises (reg 11(1)), and must not discharge liquid waste into the environment (reg 11(2)). These duties are absolute and framed as prohibitions.

• Solid waste disposal. The operator must ensure solid waste is disposed of at a landfill site or waste treatment facility licensed under Part V of the Act (reg 12). This ties solid waste disposal to Part V licensing under the Environmental Protection Act 1986.

• Offences and penalties. Contravention of any regulation is an offence attracting a monetary penalty of $5 000 (reg 13). Reg 14 also amends Schedule 6 of the Environmental Protection Regulations 1987 by inserting a table of specific infringement items with fixed amounts, listing particular regulations and two monetary columns (250 and 500), thereby creating a mechanism for prescribed infringement penalties for violations of listed regulations (reg 14).

Rights are not explicitly granted in the regulations themselves. Rights that may be inferred from the structure are procedural and remedial only insofar as they flow from the Act and the general enforcement framework under the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987, which are referred to but not reproduced. The regulations do not specify inspection rights, appeal processes, or administrative review mechanisms; those are matters for the underlying Act and the Environmental Protection Regulations 1987.

Mechanically, the law shifts compliance responsibility to the operator, requires specific technical standards for booths and containment, establishes absolute prohibitions for certain emissions and discharges, and provides for monetary penalties for contraventions. The duties are both prescriptive on equipment and outcome-based on emissions and containment performance.

The instrument declares that a person who contravenes any of these regulations commits an offence (reg 13). The statutory penalty for such an offence is a monetary fine of $5 000 (reg 13). The text therefore provides a single headline criminal or regulatory offence with a fixed pecuniary maximum.

In addition, reg 14 amends Schedule 6 to the Environmental Protection Regulations 1987 by inserting a table of particular items from the Environmental Protection (Metal Coating) Regulations 2001 with two monetary columns populated by the figures 250 and 500. The inserted entries list a row for each of regulations 4, 5, 6, 7, 8, 9, 10(1), 10(2), 11(1), 11(2), and 12, and show “250” in the first monetary column and “500” in the second monetary column. The regulation text does not itself elaborate the meaning of those two columns. The inserted Schedule 6 table is textually part of the Environmental Protection Regulations 1987 after amendment, and hence provides a statutory basis for fixed infringement amounts associated with particular numbered regulations. The presence of both the $5 000 offence penalty in reg 13 and the Schedule 6 infringement amounts implies a two-tiered enforcement architecture: an offence penalty and specified fixed‑amount contravention notices for listed contraventions as inserted into Schedule 6 by reg 14. The regulations do not set out the procedural mechanics for issuing infringement notices; those procedures are part of the Environmental Protection Regulations 1987 and the enforcement regime under the Environmental Protection Act 1986.

The regulations prescribe no alternative sanctions such as remediation orders, licence suspensions, or more granular penalties. They also do not set out monitoring, sampling, testing, or recordkeeping obligations; enforcement therefore will rest on inspection and enforcement powers provided by the Environmental Protection Act and associated regulations.

Operationally, regulators enforcing these provisions will need to establish whether a contravention has occurred by assessing aspects such as: whether spray painting was carried out in a booth or otherwise in a manner preventing overspray escape (regs 4-6); whether booths meet the referenced AS/NZS standards and whether ventilation and dust extraction or collection systems are “efficient” and operating in the manner required (regs 6(b), 8(b)); whether visible dust, powder, or overspray has escaped a premises (regs 5, 9); and whether liquid and solid wastes have been disposed or contained in compliance with regs 10-12. Determinations of whether emissions cause pollution, and whether discharged air contains any substance that causes pollution (regs 6(b)(iii), 8(b)(iii)), call for technical assessment under the framework of the Environmental Protection Act and are not quantified in these regulations.

The presence of both the general offence penalty and the Schedule 6 infringement amounts provides regulators with options for enforcement. The regulations themselves do not prescribe the criteria for choosing an enforcement pathway; those criteria will be governed by the administering authority’s policies and the broader statutory enforcement regime. The regulations do not create express defences beyond the specific factual exception for spray painting when a booth cannot reasonably be used because of size, shape, position, or location of the object (reg 4).

The regulations operate within the framework of the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987, and explicitly reference those instruments. Reg 3 makes the regulations applicable to the metal coating premises described in Schedule 1 Part 2 category 81 of the Environmental Protection Regulations 1987. Consequently the scope of who falls within these regulations is defined by an external schedule in the Environmental Protection Regulations 1987.

Reg 12 links solid waste disposal obligations to Part V of the Environmental Protection Act 1986 by requiring disposal at a landfill site or waste treatment facility licensed under Part V of the Act. That linkage means operators must use facilities that hold licences issued under Part V processes, so compliance requires engagement with the Part V licensing regime for waste treatment or landfill operations.

Reg 14 amends Schedule 6 of the Environmental Protection Regulations 1987 by inserting specified items and fixed monetary amounts for listed contraventions. Schedule 6 operates within the enforcement architecture of the Environmental Protection Regulations 1987; the inserted items therefore align the new metal coating regulations to the existing infringement notice and fixed‑amount penalty processes under the Environmental Protection Regulations 1987.

The regulations also incorporate external technical standards by reference. Reg 6(a) requires spray painting booths to be designed, constructed, installed, and maintained in accordance with AS/NZS 4114.1 , Spray painting booths. Reg 8(a) requires powder coating booths to be designed, constructed, installed, and maintained in accordance with AS/NZS 3754 , 1990 , Safe application of powder coatings by electrostatic spraying. Those standards are external instruments outside the primary statutory text but become legally binding through incorporation by reference. Compliance therefore requires not only meeting the functional outcomes set out in the regulations but also satisfying the specific technical requirements in the referenced AS/NZS standards.

The regulations refer to “any substance that causes pollution” in relation to discharged air from booths (regs 6(b)(iii) and 8(b)(iii)). Determining whether an air discharge contains any substance that causes pollution will implicate definitions and standards in the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987. The metal coating regulations do not define “pollution” or provide numerical emission thresholds; those determinations are made under the Act and its supporting instruments.

Finally, reg 11(2) provides that an operator must not discharge liquid waste into the environment. How that prohibition interacts with other licences, permissions, or exemptions under the Environmental Protection Act 1986 will depend on the Act’s provisions and any permits or licences issued under it. The metal coating regulations do not create permitting mechanisms; rather they create obligations that likely intersect with the Act’s licensing and enforcement framework.

In sum, the instrument is layered on top of the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987. It creates sector-specific technical and outcome-based requirements, it imports national standards by reference, and it ties waste disposal to Part V licensing. Practical compliance therefore requires operators to navigate the referenced standards and the broader regulatory and licensing system under the principal Act and Regulations.

The regulations as compiled here were made on 30 November 2001 and commenced on 30 November 2001, as shown in the compilation table at the end of the text. The compilation table records the original citation, gazettal date, and commencement date for the Environmental Protection (Metal Coating) Regulations 2001: gazetted 30 Nov 2001 p. 6068-71, commenced 30 Nov 2001.

Regulation 14 effects an amendment to the Environmental Protection Regulations 1987 by inserting the Environmental Protection (Metal Coating) Regulations 2001 into Schedule 6 of the Environmental Protection Regulations 1987 and listing specific regulation items with corresponding monetary amounts (the inserted table listing regs 4, 5, 6, 7, 8, 9, 10(1), 10(2), 11(1), 11(2) and 12 together with amounts 250 and 500). The text of reg 14 in this instrument therefore records a contemporaneous amendment to the Environmental Protection Regulations 1987 made by these regulations.

No further amendment lines are recorded in the compilation table reproduced in this text. The Notes section states that this is a compilation of the Environmental Protection (Metal Coating) Regulations 2001 and includes the amendments made by the other written laws referred to in the following table, but the only entry recorded is the original 2001 regulation. The compilation table contains no subsequent amendment entries in the provided text.

Because this note must rely solely on the supplied text, there is no record here of any amendments later than the initial gazettal and the Schedule 6 insertion effected by reg 14. The regulations therefore, as presented here, reflect their original 2001 form together with the Schedule 6 insertion. Any post‑2001 amendments would need to be checked against later compilations or the official reprint sources outside the content supplied.

Practically, reg 14 both establishes the infringement items connected to particular provisions of these regulations and constitutes the only explicit amendment to another instrument recorded within this text. The regulations themselves contain no internal amending provisions beyond that insertion. The compilation notes are limited to the original making and commencement; no later modification history is present in the provided material.

The statutory text supplied contains no references to any litigation, named cases, judicial interpretations, or enforcement decisions construing these regulations. There is no case law cited in the instrument, and the compilation table does not list any judicial determinations. Because this note is grounded solely in the supplied instrument, it records no litigation history.

The absence of litigation references in the text does not mean that none exists; it only means the instrument as provided does not record any cases. Any user who needs to know whether these provisions have been litigated, interpreted by courts or tribunal decisions, or considered in enforcement proceedings should consult external legal databases, the administering authority’s published decisions, or court archives for cases under the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987 that may have engaged these regulations.

In the instrument itself, no decisions, precedents, or interpretive guidance are included. The regulations presuppose enforcement under the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987, so relevant litigation would typically arise under those instruments’ enforcement mechanisms when applied to contraventions of the metal coating regulations. This text contains no litigation record, no listed prosecutions, and no administrative determinations.

Several practical and interpretive traps are visible from the text; they arise from definitional choices, the interaction of prescriptive and outcome-based requirements, and the incorporation of external standards.

• Scope tied to external schedule. The regulations apply to premises described in Schedule 1 Part 2 category 81 of the Environmental Protection Regulations 1987 (reg 3). Users must check that external schedule to confirm whether particular premises are captured. The regulations alone do not list the category’s details; reliance on the category without checking the Environmental Protection Regulations 1987 could lead to mistaken assumptions about applicability.

• Operator definition and premises nexus. “Operator” is defined as the person carrying on metal coating, and “premises” are the premises at which the operator carries on metal coating (reg 2). This construction makes the duty holder the person doing the coating at a location. It does not expressly tackle landlord/tenant or contractor relationships; in mixed-occupancy or contract arrangements the responsible person will be the operator physically carrying on the activity, which may have consequences for contractual risk allocation and compliance planning.

• Booth exception for spray painting. Regulation 4 permits spray painting outside a spray painting booth where a booth cannot reasonably be used because of the size, shape, position, or location of the object. That exception is fact‑intensive and may be a source of dispute. An operator relying on it should be able to justify why a booth could not reasonably be used; otherwise reg 5’s outcome-based prohibition against overspray escaping premises still applies. The dual structure means that even where a booth is not used for practical reasons, the operator must ensure no overspray escapes (reg 5).

• Visible emissions standard. Multiple provisions use “visible” as the compliance benchmark for overspray, dust, and powder (regs 6(b)(i), 8(b)(i), 9). That creates enforceable obligations anchored to human-observable thresholds. However, the regulations also bar discharge of air that contains “any substance that causes pollution” (regs 6(b)(iii), 8(b)(iii)). The two standards are not identical: a discharge could be chemically polluting without being visibly detectable; conversely visible emissions might be deemed non-polluting under some interpretations. Regulators will need to reconcile these coexisting benchmarks in enforcement.

• Bund capacity rules may be multiplicative. Regulation 10(1)(c) requires the compound be “capable of holding , (i) 110% of the volume of the largest metal coating treatment tank or, if tanks are interconnected, 110% of the volume of the tanks in the interconnected system; and (ii) not less than 25% of the total volume of the tanks within the compound.” Both criteria are listed under the same paragraph and therefore both must be satisfied. For some configurations this could require a bund capacity that meets both conditions concurrently; operators must verify both numbers rather than treating one as an alternative.

• “Impervious to acid” specification. Reg 10(1)(a)-(b) requires walls and floors impervious to acid where chemicals that can cause pollution are used or kept. The text does not define “impervious to acid” or prescribe test methods or standards for materials. Operators must therefore determine or document how their materials meet that functional requirement, potentially by reference to engineering practice or material specifications; the standard is functional rather than prescriptive as to materials.

• Stormwater ingress and overflow design obligations. Regulation 10(2) requires that stormwater does not enter the treatment-tank area and that the area be designed so that a liquid cannot overflow or discharge from the area. These obligations implicate site drainage, weatherproofing, and maintenance. Operators on sites with complex hydrology or intermittent works may find compliance requires substantial site works.

• Waste disposal tied to Part V licensing. Solid waste must be disposed of at a landfill or waste treatment facility licensed under Part V of the Act (reg 12). Operators must therefore ensure their waste contractors use licensed facilities; private or ad hoc disposal arrangements that are not licensed are non-compliant even if they are otherwise convenient.

• Dual enforcement figures. The instrument contains a $5 000 penalty for contravention of any regulation (reg 13) and separately inserts fixed amounts (250 and 500) into Schedule 6 of the Environmental Protection Regulations 1987 for specific regulation items via reg 14. Practitioners should note that the existence of both forms of monetary consequence means regulators have options; the practical choice between issuing an infringement notice under Schedule 6 or pursuing an offence under reg 13 will affect procedure, legal rights, and potential penalties.

• Incorporation by reference to AS/NZS standards. Regs 6(a) and 8(a) require booths to comply with specified AS/NZS standards. Practitioners must obtain and apply the current content of those standards noted in the regulations (AS/NZS 4114.1 and AS/NZS 3754 , 1990). The statutes do not reproduce or summarise those standards. Compliance therefore requires translating the standards’ technical provisions into design, installation, and maintenance actions.

• No express monitoring or recordkeeping requirements. The regulations do not specify monitoring frequencies, testing procedures, or records to be kept. That absence means enforcement will depend on inspection evidence, outcomes, and any monitoring obligations under the Act or permits. Operators should not assume that absence of explicit monitoring requirements reduces enforcement risk; inspectors may rely on site inspections and samples to demonstrate non‑compliance with the visible-emissions and pollution provisions.

These points highlight areas where the text’s brevity and its reliance on external standards or external schedules create choices and potential compliance ambiguities. Operators should map their activities against each relevant provision and document the factual basis for any claimed exceptions or compliance measures, given the outcome-based and technical mixture of duties.

Compliance requires translating the regulations’ prescriptive and outcome-based obligations into concrete site, equipment, operational, and administrative actions. Below are actions directed at the duties in the text, together with the specific regulation references.

1. Confirm applicability. Check whether the premises fall within Schedule 1 Part 2 category 81 of the Environmental Protection Regulations 1987, since these regulations apply only to premises described there (reg 3). Confirm who is the operator under reg 2.

2. Spray painting practices.

   • Use a spray painting booth for all spray painting where reasonably practicable. The regulation allows a limited exception when the size, shape, position, or location of the object makes use unreasonable; document why a booth cannot reasonably be used if relying on that exception (reg 4).
   • If not using a booth, ensure spray painting is conducted in such a manner that no paint overspray escapes from the premises; if there are no defined premises boundaries, ensure no paint overspray escapes onto any place to which the public has access (reg 5).

3. Booth design, construction and maintenance.

   • Where a spray booth is used, ensure design, construction, installation, and maintenance comply with AS/NZS 4114.1 , Spray painting booths (reg 6(a)).
   • Where a powder coating booth is used, ensure compliance with AS/NZS 3754 , 1990 , Safe application of powder coatings by electrostatic spraying (reg 8(a)).
   • Ensure booths are fitted with efficient mechanical ventilation and dust extraction (spray booths) or dust collection (powder booths) systems that operate so that no visible overspray or powder escapes, all booth air passes through the systems before discharge, and discharged air does not contain substances that cause pollution (regs 6(b)(i)-(iii); 8(b)(i)-(iii)).
   • Keep maintenance records and service histories for booths and ventilation/dust systems, as practical evidence of compliance; although not mandated by the text, records are useful if enforcement agencies inspect.

4. Powder coating operations.

   • Carry on all powder coating in a powder coating booth (reg 7).
   • Ensure dust collection systems and ducts are correctly sized, installed and maintained to transfer dust to an air cleaning system and prevent visible powder escape (reg 8(b)).

5. Prevent visible emissions from premises.

   • Implement capture, containment, and housekeeping measures to ensure no visible dust or powder escapes the premises (reg 9).
   • Use efficient transfer and cleaning practices to minimise overspray and dust generation.

6. Chemical storage and bunding.

   • Locate any area where chemicals that can cause pollution are used or kept within a compound with walls and floors impervious to acid (reg 10(1)(a)-(b)).
   • Design bunding to be capable of holding both: 110 percent of the volume of the largest metal coating treatment tank (or 110 percent of interconnected tanks where applicable) and not less than 25 percent of the total volume of the tanks within the compound (reg 10(1)(c)(i)-(ii)). Verify both figures and document design calculations.
   • Ensure stormwater is excluded from the treatment tank area and design the area to prevent overflow or discharge (reg 10(2)(a)-(b)). Consider installing sealed drainage and diversion systems and performing periodic inspections, especially during wet seasons.

7. Liquid waste controls.

   • Prevent liquid waste from escaping the premises and do not discharge liquid waste to the environment (regs 11(1)-(2)). Implement containment, collection, and licensed disposal arrangements for liquid wastes produced by metal coating processes.

8. Solid waste disposal.

   • Ensure solid waste from metal coating is disposed at a landfill site or a waste treatment facility licensed under Part V of the Environmental Protection Act 1986 (reg 12). Verify the licence status of disposal sites before sending waste.

9. Vendor and contractor management.

   • Use contractors and suppliers who can provide equipment and services that meet AS/NZS standards and the functional outcomes required by the regulations. Obtain supplier specifications, warranties, and evidence of compliance.
   • When contracting waste carriers, require proof of disposal at a licensed facility under Part V and retain documentation as evidence.

10. Operational checks and training.

• Train personnel in booth operation, ventilation system checks, dust collection maintenance, and housekeeping practices aimed at preventing visible emissions. Although the regulations do not prescribe training, trained staff reduce the risk of non-compliance with the visible emissions and operational requirements.
• Implement routine inspections of booths, filters, ductwork, and collection systems to ensure they are “operating” and “efficient” as required by regs 6(b) and 8(b).

11. Prepare to demonstrate compliance.

• Be ready to show, on inspection, that booths meet AS/NZS requirements and that ventilation and collection systems treat all air before discharge. Maintain evidence such as design specifications, installation certificates, maintenance records, filter replacement logs, and waste transfer documentation.
• For spray painting conducted outside booths on grounds of size or position, document the factual basis for the assertion and the measures taken to prevent overspray escaping the premises (reg 4 and reg 5).

12. Understand enforcement consequences.

• Non-compliance is an offence attracting a $5 000 penalty (reg 13). The insertion into Schedule 6 (reg 14) of fixed amounts (250/500) for listed provisions means regulators may also issue fixed‑amount infringement notices for contraventions of the listed regulations. Have a compliance programme to avoid both pathways.

13. Technical standards procurement.

• Obtain AS/NZS 4114.1 and AS/NZS 3754 , 1990 and implement their relevant provisions in booth design and operation (regs 6(a) and 8(a)). Translate standard requirements into procurement and maintenance specifications.

14. Site-specific risk assessment.

• Conduct a site risk assessment focused on spill containment, stormwater pathways, bund sizing calculations per reg 10(1)(c), and likely emission points. Use the assessment to prioritise capital works and operational controls aimed at meeting the regulations’ visible-emission and pollution-prohibition outcomes.

Implementing these steps will address the express requirements of the regulations. Because the instrument does not prescribe monitoring, testing methods, or recordkeeping formats, practitioners should adopt industry best practice documentation and be prepared to demonstrate compliance to enforcement agencies under the Environmental Protection Act 1986 and the Environmental Protection Regulations 1987. Failure to align equipment and operations with the referenced AS/NZS standards and the functional emission and containment outcomes will expose the operator to enforcement risk, including fixed infringement amounts and the broader $5 000 offence penalty.
