Environmental Protection (Fibre Reinforced Plastics) Regulations 1998

The regulations rest on a small number of core concepts, each defined or operationalised in the text.

• Operator and premises: “operator” means a person carrying on fibre reinforced plastics manufacture and, for duties, “the premises” means the place where that manufacture is carried on (regulation 2(1), 2(2)). Who bears the duties is therefore the person doing the manufacturing at the site.

• Resin and solvent: “resin” is defined as a solid, semi‑solid or liquid organic material used as a base in the manufacture of fibre reinforced plastics (regulation 2(1)); “solvent” is defined by example (acetone, ethyl acetate, ethanol) and by function (“or any other chemical used for dissolving other chemicals in the manufacture of fibre reinforced plastics”) (regulation 2(1)). The functional definition is broad and captures chemicals used as dissolving agents beyond the three named solvents.

• Exposure minimisation and containment: The regulations require airtight storage of resins, solvents and products containing solvents and sealed containers except when filling or emptying (regulation 3(1)). They require limitation of resin exposed to atmosphere to no more than necessary for use (regulation 3(2)), and immediate cleanup of spills with absorbent material stored in airtight containers pending disposal (regulation 3(3)). These provisions operationalise a containment and minimisation approach to fugitive emissions and spill management.

• Low styrene emission resin: The rules constrain resin selection. A “low styrene emission resin” is defined quantitatively as having a maximum emission rate of 20 grams of styrene per square metre of resin per half hour at 23°C, as determined by the Schedule 1 method (regulation 4(2)). Operators must use such resins as the default in manufacturing, unless one of three exceptions applies (regulation 4(1)).

• Measurement method: Schedule 1 sets out a laboratory test procedure intended to provide an indication of styrene loss from a typical single-layer Chopped Strand Mat contact-moulded laminate at controlled conditions (23°C, draught-free room). It prescribes apparatus (balance accuracy, mat type, film, room volume and temperature control), a step-by-step method, replication, and items to be reported (Schedule 1, Method and Items to be reported). The Schedule therefore defines how the emission metric in regulation 4(2) is to be ascertained.

• Waste disposal nexus with Part V licences: Disposal of manufacturing waste is not free-form; the receiving landfill or waste treatment facility must have a licence under Part V of the Environmental Protection Act 1986 (regulation 6). This links day-to-day waste management choices by operators to the broader statutory licensing regime under the principal Act.

These concepts create a compliance architecture that combines equipment and storage standards, product-selection limits tied to a test method, immediate spill controls, dust containment, and specific disposal routes. The Schedule converts a qualitative requirement (use low-emitting resins) into a quantifiable, laboratory-measured benchmark and prescribes how to demonstrate it.

The regulations are written narrowly and identify directly affected persons in their definitions. The primary addressee is the “operator,” defined as a person carrying on fibre reinforced plastics manufacture (regulation 2(1)). That term captures the business or individual performing the manufacturing activity at a site; the duties throughout the instrument are expressed to apply to the operator.

The obligations are site-specific. Where duties refer to “the premises” they mean the premises at which the operator carries on fibre reinforced plastics manufacturing (regulation 2(2)). Therefore the operator at each plant or workshop must apply the storage, spill-response, dust-control and resin-use rules at that physical location.

Secondary or indirectly affected parties include:

• Suppliers of resin and solvents: the rules constrain which resins may be used (regulation 4), and they set the measurement method by which a resin is judged low emitting (Schedule 1). Resin suppliers will, therefore, be functionally implicated in producing or certifying resins that meet the 20 g/m2/half hour benchmark.

• Waste disposal facility occupiers: regulation 6 mandates that waste be disposed of “at an appropriate landfill site or waste treatment facility the occupier of which holds a licence under Part V of the Act in respect of that site or facility.” This places an onus on operators to use only facilities with a Part V licence, and thus links operators to licensed facility operators.

• Personnel responsible for storage, handling, and spill response at the premises: the regulations require immediate mop-up of spills and maintenance of absorbent materials and sealed containers for spent absorbents (regulation 3(3)). These operational duties fall to on-site staff under the operator’s control.

• Manufacturers using specific processes: the rule on low styrene emission resin contains exemptions for gel coats and closed moulding processes (regulation 4(1)(b)-(c)), and for applications requiring properties not achievable with low styrene emission resin (regulation 4(1)(a)). Operators using closed moulding or gel coat processes, or those with specialised performance needs, are therefore treated differently by the rules.

The enforcement risk is borne by anyone who contravenes the regulations: a contravention is an offence with a monetary penalty (regulation 7). The instrument does not name an enforcing authority or outline inspection powers; the identifying obligations and the criminal sanction are nevertheless directed at operators and their premises (regulation 3-6, 7). The instrument therefore places compliance responsibility squarely on those who carry out fibre reinforced plastics manufacturing at named premises.

The regulations translate into a set of affirmative duties for operators and a restricted set of limited exceptions governing resin selection. Rights are not extensively spelled out; the instrument focuses on duties and an exception framework.

Storage and containment duties

• Store all resins, solvents and products containing solvents kept on the premises in airtight containers (regulation 3(1)(a)).
• Keep those containers sealed except when they are being filled or the contents are being removed (regulation 3(1)(b)). These duties create a continuous obligation to maintain sealed containment except during active handling.

Exposure and operational-minimisation duties

• Do not expose to the atmosphere at any time more resin than is necessary for the purpose for which the resin is being used (regulation 3(2)). This is a performance‑based limit rather than a prescriptive volume limit and requires judgement about what quantity is “necessary”.

Spill-preparedness and waste in transit

• Keep a supply of absorbent material on the premises; use that material to immediately mop up any spillage of resin, solvent or a product containing solvent; and keep any material which has been so used in an airtight container until it is disposed of in accordance with regulation 6 (regulation 3(3)(a)-(c)). The operator must therefore both provide the cleanup capability and ensure used absorbents are themselves contained pending disposal.

Resin selection duty with narrow exceptions

• Do not use resin other than low styrene emission resin in fibre reinforced plastics manufacturing unless: (a) a particular application requires certain physical or chemical properties which cannot be achieved using low styrene emission resin; (b) the resin is a gel coat; or (c) the resin is being used in a closed moulding process (regulation 4(1)(a)-(c)). This turns the standard into a default rule, with three specified derogations.

Definition and test duty

• “Low styrene emission resin” is quantified as having a maximum emission rate of 20 grams of styrene per square metre of resin per half hour at 23°C, as determined using the method set out in Schedule 1 (regulation 4(2)). The Schedule therefore supplies the test procedure that operators or their suppliers will need to apply if they are to demonstrate compliance with the resin-use duty.

Dust containment duty

• Ensure that no visible dust created during fibre reinforced plastics manufacturing escapes from the premises (regulation 5). This is an outcome-oriented obligation requiring control measures sufficient to prevent visible dust egress.

Waste disposal duty

• Dispose of all waste produced during fibre reinforced plastics manufacturing at an appropriate landfill site or waste treatment facility the occupier of which holds a licence under Part V of the Act in respect of that site or facility (regulation 6). This links disposal choices to the licensing status of the receiving facility under Part V of the Environmental Protection Act 1986.

Penalty for contravention

• A person who contravenes these regulations commits an offence subject to a penalty of $5,000 (regulation 7). The regulations do not set out appeal routes, timeframes for compliance notices, or specific inspection powers within this document.

Rights and exceptions

• The instrument grants operators the right to use non-low-styrene resins in three specified circumstances (regulation 4(1)). The text does not create an express administrative approval procedure for those exceptions; operators rely on the factual existence of the condition (e.g. technical necessity or closed moulding) to qualify.

Record and reporting obligations

• The regulations do not expressly impose a record-keeping obligation. Schedule 1 lists items to be reported for the styrene emission test (resin and CSM identification, atmospheric conditions, amount of styrene emitted during 60 minutes), but the Schedule does not itself impose a statutory retention or submission requirement in the core regulatory text. The Schedule therefore provides a measurement template; the regulations establish duties and a penalty for non-compliance.

The regulations provide a single specified criminal sanction for non-compliance: a person who contravenes the regulations commits an offence with a penalty of $5,000 (regulation 7). The instrument does not set out graduated penalties for particular breaches, nor does it provide for non-criminal administrative remedies such as infringement notices, enforceable undertakings, or civil penalties within its text. The only expressly stated legal consequence in this instrument is the offence and monetary penalty listed at regulation 7.

Specific enforcement mechanisms, powers of entry, inspection, sampling, or administrative compliance tools are not included in these regulations. The regulations are made under the Environmental Protection Act 1986 (the Act) (title page and preamble), and the disposal requirement in regulation 6 refers to facilities licensed under Part V of the Act. That cross-reference implies that the licensing, monitoring and enforcement apparatus established by the Act and by Part V will be relevant to disposal compliance (regulation 6), but this instrument itself does not describe the mechanics of Part V enforcement or specify which agency will exercise enforcement for contraventions of these regulations. Users of the instrument must therefore read these regulations alongside the Environmental Protection Act 1986 and its enforcement provisions to understand inspection powers, notice powers, and agency responsibilities.

The penalty figure has been amended as noted in the text (regulation 7 amended: Gazette 11 Dec 1998 p. 6613). The regulations do not provide details on aggregation of penalties, corporate liability principles, or whether the penalty amount is per offence, per day, or per premises; the statutory wording simply states “Penalty: $5 000” following “A person who contravenes these regulations commits an offence.” Therefore the immediate, express legal risk is monetary and singular in the instrument. Any enforcement policy, prosecutorial discretion or interaction with licensing under Part V is left to the Act and its administrative framework, which are not reproduced in these regulations.

The regulations are made under the Environmental Protection Act 1986 (title and opening matter) and explicitly link to Part V of that Act in relation to waste disposal. Regulation 6 requires that all waste produced during fibre reinforced plastics manufacturing be disposed of at an “appropriate landfill site or waste treatment facility the occupier of which holds a licence under Part V of the Act in respect of that site or facility.” That reference imports the Part V licensing requirement: the ability of an operator to lawfully dispose of waste depends on the receiving facility’s compliance with Part V licensing. The regulations therefore do not create a separate disposal licensing regime; instead they make lawful disposal contingent on existing Part V licences.

The Schedule’s test procedure is technically self-contained within this instrument but is designed to be read alongside testing and compliance practices under the Environmental Protection Act framework. The definition of “low styrene emission resin” in regulation 4(2) makes compliance a function of satisfying the numerical emission threshold by the Schedule method; any disputes about measurements, sampling or interpretation could therefore implicate evidentiary and enforcement practices under the principal Act and the courts, though the regulations themselves do not provide dispute-resolution or evidentiary rules.

The compilation notes show the regulations were reprinted under the Reprints Act 1984 as at 7 May 2004 and amended by the Environmental Protection (Miscellaneous Amendments) Regulations 1998 (Compilation table). The Reprints Act reprint is a statutory administrative device for producing consolidated versions; it does not change substantive obligations but is relevant to determining the current text and amendment history.

Beyond the explicit Part V cross-reference, no other statutes or regulations are directly referenced in the operative text. The instrument does not specify how it interacts with workplace health and safety laws, planning laws, or local government environmental by-laws. Operators must therefore understand that occupational health and safety obligations, planning approvals, local environmental controls and any other applicable statutory regimes operate in parallel and may impose additional duties not repeated here. The regulations set specific environmental controls concerning resin handling, dust, spill cleanup, resin selection and disposal; enforcement, licences and broader regulatory powers are located in the Environmental Protection Act and other applicable statutes.

The instrument provides a short compilation table and notes on its reprint and amendment history. The original Environmental Protection (Fibre Reinforced Plastics) Regulations 1998 were gazetted on 17 March 1998 (p. 1411-13) and commenced on the same date, 17 March 1998 (Compilation table). The regulations were subsequently amended by the Environmental Protection (Miscellaneous Amendments) Regulations 1998, Part 6, which was gazetted on 11 December 1998 (p. 6597-6614) and that amendment came into effect on 8 January 1999 (see regulation 2 of the amending instrument) (Compilation table and consolidated notes). Regulation 7 bears a note that it was amended in the Gazette of 11 December 1998 at p. 6613, which is the same Gazette entry cited in the compilation table (regulation 7 amended: Gazette 11 Dec 1998 p. 6613). The reprint consolidating the regulations as at 7 May 2004 is noted as Reprint 1 (title page and compilation table).

The Notes section also records that the reprint is compiled under the Reprints Act 1984 and includes amendments made by the other written laws listed in the compilation table. The reprint date (7 May 2004) is a snapshot date for the consolidated text in the version provided. The compilation table identifies only the two instruments: the original 1998 regulations and the Miscellaneous Amendments Regulations 1998 Pt. 6, and then Reprint 1 as at 7 May 2004.

The instrument contains an editorial omission note: “[8.] Omitted under the Reprints Act 1984 s. 7(4)(f).” That indicates a regulation 8 had been included in an earlier published version and has been formally omitted in the reprint consolidation, but the operative content and substance of that omitted item are not present in this text.

No later amendments are recorded in the compilation table supplied here beyond those entries. For legislative history beyond these entries, the Environmental Protection Act 1986 and other statutory instruments referenced here would need to be consulted, but those materials are not part of this instrument’s text as provided.

This instrument contains no case law references, no schedules of past prosecutions, and does not list any judicial decisions or administrative determinations applying it. The text itself names no cases and includes no decisions or precedent citations. The Schedule provides a technical testing method and the regulations set offences and duties, but there is no internal litigation history recorded in the document provided.

Because the instrument makes compliance with Part V licences relevant to waste disposal (regulation 6), disputes or prosecutions about disposal practices or licence conditions might in practice engage litigation under the Environmental Protection Act or be dealt with in administrative proceedings. However, this instrument does not record any such proceedings, and it does not provide statutory guidance on prosecutorial discretion, evidentiary standards, or appeal mechanisms specific to these regulations.

Where parties are concerned about enforcement risk or evidentiary proof of compliance , for example, whether a resin meets the “low styrene emission resin” standard , the Schedule provides the detailed laboratory methodology and items to be reported (Schedule 1). Any contested measurement or prosecution based on emission levels would therefore likely turn on whether the Schedule procedure was properly followed, the conditions of the test matched the regulation’s specified temperature and apparatus, and the reported results support the emission figure. The regulations themselves do not specify how courts or tribunals should interpret or weigh Schedule 1 evidence; litigation on those points would be shaped by general evidentiary and statutory interpretation principles rather than by further procedural rules in this instrument.

In summary, the instrument does not supply a litigation record. Any litigation history must be identified from external case law databases or administrative records, which are not part of the text provided.

Several practical and interpretive traps arise directly from the text.

1. Broad definition of “solvent”

• “Solvent” is defined both by specific examples (acetone, ethyl acetate, ethanol) and by function: “or any other chemical used for dissolving other chemicals in the manufacture of fibre reinforced plastics” (regulation 2(1)). That functional limb is open-ended and could capture a wide range of chemicals; operators cannot rely solely on supplier labels that avoid the three named chemicals to fall outside the rule.

2. Subjective standards: “necessary” and “visible dust”

• Regulation 3(2) prohibits exposing to the atmosphere “more resin than is necessary for the purpose for which the resin is being used.” That requires a factual judgment about what is “necessary,” with no quantitative cap supplied in the regulation. Similarly, regulation 5 requires that “no visible dust created during … manufacturing escapes from the premises.” “Visible” is a subjective threshold; what a regulator or inspector considers visible can vary by lighting, distance, and observer. Both obligations therefore admit variable enforcement based on observation and context.

3. Closed moulding and gel coat exceptions are not defined

• Regulation 4(1)(b)-(c) exempts gel coats and closed moulding processes from the low-styrene requirement, but neither “closed moulding process” nor “gel coat” is defined in a technical way beyond regulation 4(2)’s definition of “gel coat” as an outer layer of resin used to improve surface properties. Operators and suppliers will need to interpret whether a process qualifies as “closed moulding” or whether a given resin is a gel coat for the purposes of the exception.

4. Measurement-reporting mismatch in Schedule 1

• Regulation 4(2) sets the low-styrene threshold as “20 grams of styrene per square metre of resin per half hour at 23°C, as determined using the method set out in Schedule 1.” Schedule 1’s “Items to be reported,” item 6, requires reporting “the amount of styrene (g/m2) emitted during 60 minutes.” The regulation references a per-half-hour rate while the Schedule reports per-60-minute emissions. This is a source-text inconsistency which creates uncertainty about whether compliance should be judged by the Schedule’s 60-minute output converted to a half-hour figure, or by another interpretation. The text does not resolve this mismatch.

5. Specific test conditions may not match field conditions

• Schedule 1 specifies a single-layer CSM sample, resin temperature adjusted to 23°C, a draught‑free room of specified volume and temperature control (23°C ± 1°C), and a particular CSM weight (450 g/m2). Real-world laminates, multi-layer constructions, different ambient temperatures, and process variations may produce different emission profiles. Reliance on the Schedule’s laboratory conditions for compliance may therefore produce disputes if field conditions differ. The Schedule is explicit, so adherence to its conditions is necessary to produce the test results it describes.

6. Used absorbent storage and disposal chain

• Regulation 3(3)(c) requires used absorbents to be kept in airtight containers until disposed of in accordance with regulation 6. Regulation 6 requires disposal at a facility with a Part V licence. Practically, operators must ensure interim storage capability, transport arrangements, and a receiving facility with the proper licence; failure at any node can create an offence risk.

7. Enforcement scope not specified

• The instrument creates duties and an offence but does not specify who enforces these regulations, what inspection powers are available, or whether non-criminal enforcement options are available. That places uncertainty on how compliance will be monitored and how breaches will be pursued.

8. Absence of explicit record-keeping requirement

• The Schedule lists items to be reported for the emission test but the regulations do not explicitly require operators to retain test records or to submit them to a regulator. Operators relying on supplier certifications or in-house tests would therefore benefit from retaining documentation even though the instrument does not expressly mandate it.

9. Penalty description is terse

• Regulation 7 states “Penalty: $5 000” but does not specify whether that sum applies per offence, per day, or per person. The practical penalty exposure therefore could be interpreted in different ways; resolving that interpretation would be a function of general statutory interpretation and prosecutorial practice under the enforcing authority.

10. Reprint omissions and historical text changes

• The note “[8.] Omitted under the Reprints Act 1984 s. 7(4)(f).” indicates a prior item was omitted from the reprint. Operators relying on consolidated texts must check whether omitted material was substantive and whether historical regulatory obligations might still have transitional or interpretive relevance.

Each of these points is grounded in the text of the regulations and Schedule 1. Operators and advisers should treat them as concrete areas requiring attention when planning compliance strategies or when considering test data as evidence of conformity.

Compliance requires translating each operative regulation into practical systems, records and supplier engagement. Below are practical steps closely tied to the text.

1. Identify the operator and premises

• Confirm who is the “operator” for each manufacturing site (regulation 2(1)-(2)). Duties are site-specific, so ensure organisational responsibilities are allocated per premises.

2. Storage and containerisation (regulation 3(1))

• Store all resins, solvents and products containing solvents in airtight containers on site and keep containers sealed except during filling or emptying (regulation 3(1)(a)-(b)). Practically, use labelled screw-top drums or sealed cabinets with restricted access. Implement a permit-to-handle system to document times when containers are unsealed.

3. Limit resin exposure (regulation 3(2))

• Implement batching and dispense systems that minimise the quantity of resin exposed at any time. Adopt standard operating procedures that quantify typical “necessary” amounts for common operations so the “necessary” assessment is defensible. Where larger quantities are opened for production, document the technical reason and quantities used.

4. Spill response and absorbent handling (regulation 3(3))

• Keep absorbent material on the premises, train staff to mop up spills immediately, and provide airtight containers for used absorbents (regulation 3(3)(a)-(c)). Ensure that used absorbents are labelled and stored pending disposal and that handling reduces secondary emissions.

5. Waste disposal chain (regulation 6)

• Establish formal contracts or arrangements with disposal facilities and confirm that the occupier of the landfill or waste treatment facility holds a licence under Part V of the Environmental Protection Act 1986 in respect of that facility (regulation 6). Maintain documentary proof of the facility’s Part V licence and of waste transfers (transport manifests or receipts), even though these regulations do not expressly impose document-retention periods.

6. Resin selection and testing (regulation 4 and Schedule 1)

• Default to using low styrene emission resin meeting the 20 g/m2/half hour threshold. Where a non‑low-styrene resin is proposed, document which exception applies: technical necessity (4(1)(a)), gel coat (4(1)(b)), or closed moulding process (4(1)(c)). Where relying on the technical necessity exception, retain technical justification demonstrating properties cannot be achieved with low emission resin.
• To demonstrate a resin meets the definition of low styrene emission resin, run the test procedure in Schedule 1 or obtain test data from suppliers produced by the Schedule method. Follow Schedule 1’s apparatus and method carefully: resin at 23°C, a draught‑free room of minimum 50 m3 controlled at 23°C ± 1°C, use emulsion-bound 450 g/m2 chopped strand mat, use the balance accurate to 0.01 g, pour resin at 2.0 times the weight of the CSM, and record weights at the times specified (Schedule 1, Method). The Schedule requires repeating the procedure twice, producing multiple replicates, and reporting atmospheric conditions and the amount of styrene (g/m2) emitted during 60 minutes (Schedule 1, Items to be reported). Note the Schedule/definition mismatch on half-hour versus 60-minute reporting and consider converting the 60-minute measurement into a half‑hour basis consistently or documenting the conversion methodology for future scrutiny.

7. Dust control (regulation 5)

• Implement engineering and housekeeping controls to prevent visible dust from leaving the premises: localised extraction, containment, wet suppression, enclosures and regular cleaning. Train staff on visible-dust thresholds to reduce subjective enforcement risk.

8. Training and operational documentation

• Provide worker training on storage, spill response, sealed handling, and definitions of solvents and resins. Maintain written SOPs describing when containers may be unsealed, spill response timeframes, how used absorbents are sealed, and the criteria for non-low-styrene resin use.

9. Supplier engagement

• Obtain from resin suppliers technical data and, where possible, Schedule 1-compliant emission test reports. Confirm gel coat status or closed moulding suitability where relevant. Ensure supplier documentation identifies the resin and CSM types and the testing conditions (Schedule 1 Items to be reported).

10. Record-keeping and defensibility

• Although the regulations do not explicitly require retention of test reports or handling logs, keep records of: resin selection decisions, any technical justifications for exceptions, Schedule 1 test results (with atmospheric conditions and measured emissions), receipts from licensed waste facilities showing Part V licences, and incident logs for spills and used-absorbent disposal. These records will be relevant if the operator has to demonstrate compliance with the duties or explain reliance on an exception.

11. Audit and review

• Periodically audit storage, spill-response readiness, dust control effectiveness and disposal arrangements to ensure ongoing compliance. Review resin specifications when suppliers change formulation or when ambient process conditions (temperature, ventilation) change.

12. Addressing the Schedule mismatch

• Because regulation 4(2) references a per-half-hour emission rate but Schedule 1 asks for the amount emitted during 60 minutes, document the approach used to reconcile test outputs and the math used to express test results against the regulatory threshold. Where possible, obtain tests providing emissions on a per-30-minute basis or supply the raw time-series data so regulators can see the cumulative loss curve the Schedule requires.

These steps flow directly from the operative text (regulations 2-6 and Schedule 1). They translate the regulatory requirements into procedural, technical and contractual controls that operators can implement to reduce exposure to enforcement risk and to create a defensible compliance posture.
