Environmental Protection (Abattoirs) Regulations 2001

The regulations define several key operational terms that shape compliance obligations.

An abattoir is defined relative to an operator , it means the abattoir to which these regulations apply at which the operator slaughters animals (regulation 2). This person‑specific definition ties the duty to a particular facility; a person who operates multiple abattoirs must comply separately at each. The operator is simply the person who operates the abattoir. That includes both natural persons and corporate entities, and includes the person with day‑to‑day managerial control.

Existing facility means any premises used as an abattoir immediately before the day these regulations came into operation (30 March 2001). This is critical because several provisions (regulation 8 on bleeding area drainage, regulation 13(a) on impermeable containment structures) expressly exempt existing facilities. The transitional provision in regulation 16 also gives existing facilities a twelve‑month grace period on the irrigation management plan obligation. However, the definition does not turn on whether the facility has been upgraded or expanded after commencement; once an existing facility, always an existing facility. That creates a permanent grandfathering advantage for pre‑2001 abattoirs over new entrants.

Treated waste water is water that has been processed through the waste water treatment system. The irrigation management plan requirement (regulation 14) only applies when that water is used for irrigation. The waste water treatment system is the system used for treating waste water from abattoir operations. It is not further defined in technology terms, so it can be any engineered system (ponds, tanks, mechanical treatment) provided it meets the performance standards in Part 5.

A containment structure is any structure in the waste water treatment system in which waste water is contained. For new facilities, such structures must be impermeable (regulation 13(a)). The regulations also require a minimum freeboard of 300 millimetres between the top of the structure and the water surface (regulation 13(b)), and a minimum retention time of 15 days for pond‑based systems (regulation 13(d)).

Save‑all is a tank where greases and oils are collected by settlement or flotation. Bucket trap is a device to collect solids. These are the prescribed devices for treating slaughterhouse floor water (regulation 7(2)), along with screens or other devices.

Treated waste water irrigation management plan means a plan approved under regulation 14. The regulations do not prescribe the content of the plan, leaving that to CEO discretion. This is a notable gap: an operator cannot know in advance what the plan must contain, giving the CEO broad power to impose site‑specific conditions before irrigation may occur.

The primary duty‑bearers are operators of abattoirs with a production or design capacity between 100 tonnes per year and 1,000 tonnes per year. The term "operator" is defined in regulation 2 as a person who operates an abattoir. This includes individual proprietors, partnerships, and corporations. The operator bears almost all of the regulatory duties: dust control (regulation 4(1)), dead animal disposal (regulation 5), lairage drainage (regulation 6), slaughterhouse drainage (regulation 7), waste storage (regulation 9), storm water exclusion (regulation 10), lairage water screening (regulation 11), solid waste disposal (regulation 12), waste water treatment structures (regulation 13), and irrigation plan compliance (regulation 14). The operator is also liable for the penalty under regulation 15.

A second class of duty‑bearer is the owner of an abattoir (other than an existing facility) who is responsible for the drainage of the bleeding area floor (regulation 8). This is an unusual split , the owner must ensure the floor perimeter is constructed so that blood and other liquids are removed by drains or dedicated collection devices. The operator may or may not be the owner, so the regulations impose a separate duty on the owner that cannot be delegated to the operator. This increases complexity for leased or tenanted facilities.

A third class is a person constructing an abattoir (regulation 4(2)). That person must ensure no visible dust escapes during construction. This duty applies regardless of who the eventual operator or owner will be.

The regulations also affect persons who handle dead animals, waste, or treated waste water because the operator’s duties impose contractual obligations on transporters, renderers, and disposal facility operators. The disposal pathways in regulations 5 and 12 require the operator to ensure animals and solid waste are taken to a rendering facility, waste disposal facility, compost facility, or CEO‑approved facility. The operator’s compliance therefore depends on the availability and pricing of those third‑party services.

The Chief Executive Officer of the department administering the Environmental Protection Act is the decision‑maker for approving irrigation management plans (regulation 14) and alternative disposal methods (regulations 5(c) and 12(d)). This creates a gatekeeper role that concentrates discretion in one office, with no appeal mechanism specified in the regulations.

Abattoirs below the 100‑tonne threshold are wholly outside these regulations. Abattoirs above 1,000 tonnes per year are also outside these regulations but will fall under the general EP Act licensing regime, which imposes different (and potentially more onerous) conditions through works approvals and licence conditions. The dividing line at 1,000 tonnes means that a facility that expands production or design capacity above that threshold ceases to be subject to these regulations and must seek EP Act licensing , a regulatory cliff that creates both an incentive to stay under the cap and a compliance risk if capacity creeps up.

The duties under the regulations are almost entirely prohibitory or mandatory, with very few discretionary rights.

Duty to control dust (regulation 4). The operator must carry on operations so that no visible dust escapes from the abattoir. The builder must ensure no visible dust escapes during construction. This is an absolute duty , there is no reasonableness qualification, no best‑endeavours standard, and no exemption for unavoidable dust. A single visible dust emission is a breach, irrespective of frequency or harm.

Duty to dispose of dead animals (regulation 5). Any dead animal that has not been slaughtered on the abattoir must be taken to a rendering facility, waste disposal facility, or disposed of in a manner approved by the CEO, within 24 hours of the operator becoming aware of its death. The clock starts on awareness, not death. The operator must arrange for removal even if the animal dies on a weekend or public holiday. The only exception is if a public body under a written law directs otherwise , for example, if a government veterinarian requires a necropsy or quarantine.

Duty to design drainage to the waste water treatment system (regulation 6). Waste water from lairage pens, raceways, and solid waste storage areas must be drained to the system. The operator cannot discharge this water to the environment or to a separate drain without treatment.

Duty to treat slaughterhouse drainage (regulation 7). The drainage system to the treatment system must not become blocked with solids. Slaughterhouse floor water must pass through a bucket trap, save‑all, screen, or other device to remove solids, greases, and oils before entering the treatment system.

Owner’s duty on bleeding area drainage (regulation 8). For non‑existing facilities, the owner must ensure the perimeter of the bleeding area floor is constructed so that blood and other liquids are removed by drains or dedicated collection devices. This imposes a capital works obligation on the owner.

Duty to store waste properly (regulation 9). Paunch material must be stored in water‑ and vermin‑proof and watertight containers. Dung and manure storage areas must be impervious and have impervious bunds of sufficient height to contain leachate.

Duty to prevent storm water entering the treatment system (regulation 10). Uncontaminated storm water must be kept out of the treatment system. This forces separate storm water drainage.

Duty to screen lairage water (regulation 11). Water from lairage pens must be screened or otherwise treated to remove solids before entering the treatment system.

Duty to dispose of solid waste (regulation 12). Solid waste must go to a rendering facility, compost premises, waste disposal facility, or CEO‑approved facility.

Duty to manage treatment structures (regulation 13). New facilities must have impermeable containment structures. All containment structures must maintain 300 mm freeboard. Anaerobic treatment processes must have a crust or cover. Pond‑based systems must retain waste water for at least 15 days. The system must be managed so that an unreasonable odour does not escape. The odour test is "unreasonable", not "any", which gives some flexibility compared to the absolute dust prohibition.

Right to apply for an irrigation management plan (regulation 14). The operator may submit a plan for CEO approval. Use of treated waste water for irrigation is prohibited unless the plan is approved and complied with. This is a conditional right, not an entitlement.

Right to seek CEO approval for alternative disposal (regulations 5(c) and 12(d)). The operator can apply for approval to dispose of dead animals or solid waste by a method not listed in the regulations.

No appeal or review mechanism is provided in the regulations for a CEO refusal or condition. That would likely fall under the general judicial review provisions of the EP Act or the Administrative Decisions (Judicial Review) Act 1977 (Cth), but it is not specified here.

Regulation 15 states that a person who contravenes any of these regulations commits an offence with a maximum penalty of $5,000. This is a relatively low maximum for an environmental offence , it is fixed dollar amount, not indexed to penalty units. However, regulation 17 adds a layer of complexity by amending Schedule 6 to the Environmental Protection Regulations 1987 to insert the following entries:

| Regulation | Natural person penalty | Body corporate penalty? | | --- | --- | --- | | 4(1) | 250 | 500 | | 4(2) | 250 | 500 | | 5 | 250 | 500 | | 7(1) | 250 | 500 | | 9 | 250 | 500 | | 12 | 250 | 500 | | 13 | 250 | 500 | | 14 | 250 | 500 |

The numbers 250 and 500 likely refer to penalty units under the EP Act. At the time of writing (2001 and 2012), a penalty unit was $50 (WA standard), making the potential penalty $12,500 for a natural person and $25,000 for a body corporate , significantly higher than the $5,000 in regulation 15. How the two penalties interact is not clear from the text. Regulation 17 appears to prescribe a modified penalty for those specific regulations, which would override the general $5,000 penalty under regulation 15 for those offences. The regulations do not state this expressly, which creates interpretive difficulty. A prosecutor might argue for the higher Schedule 6 penalty, while a defendant might argue that regulation 15 caps it at $5,000. This ambiguity is a gotcha.

Enforcement is by the Department of Environment Regulation (or its successor). The $5,000 or unit‑based penalties are criminal, not civil penalties. No infringement notices or on‑the‑spot fines are provided for, so enforcement would require a prosecution in court. That is a less flexible enforcement mechanism than a system of penalty notices.

There are no escalating penalties for repeat offences, no daily continuing penalties, and no powers to issue clean‑up notices or suspension orders within these regulations. The broader EP Act would provide such powers (e.g., environmental protection notices, works orders), but the regulations themselves are silent. The regulations also do not provide for compensation to third parties affected by dust, odour, or water contamination.

The regulations are made under the Environmental Protection Act 1986 (WA) and sit within that Act’s framework. They apply to abattoirs that are not required to hold a works approval or licence under Part V of the EP Act because of their scale. However, the interaction is not explicit: the regulations do not say that compliance with them exempts an operator from the licensing regime. An operator whose activities cause or are likely to cause environmental harm regardless of compliance with the regulations could still be required to obtain a licence under the EP Act. Conversely, an operator who holds a licence under Part V that contains conditions covering the same matters as these regulations might be subject to both regimes, creating double jeopardy.

The regulations also interact with the Environmental Protection Regulations 1987 because regulation 17 inserts penalty provisions into Schedule 6 of those regulations. That schedule lists prescribed offences and modified penalties for a range of industry‑specific regulations. The abattoir regulations are added to that list, meaning that for the eight regulations listed, the penalties are the unit‑based ones (250/500) rather than the $5,000 in regulation 15. This patchwork arrangement means an operator cannot rely solely on these regulations to know their penalty exposure.

Regulation 5 references public bodies and written laws. The operator must comply with the 24‑hour disposal duty unless otherwise directed by a public body under a written law. That might include directions from the Department of Primary Industries and Regional Development regarding animal disease control, or from local government health officers. The operator must know which directions qualify.

There is also interaction with local government health and building regulations. Waste storage (regulation 9) and drainage design (regulations 6-8) may also be subject to local council health and building approvals. The regulations do not confer any exemption from local laws.

Work health and safety laws also intersect: containment structures, dust, odour, and waste handling have WHS implications, but the regulations do not address worker safety directly.

For abattoirs above 1,000 tonnes per year, these regulations cease to apply, and the operator must instead obtain a works approval and licence under Part V of the EP Act, which will impose facility‑specific conditions. The threshold creates a regulatory barrier to entry for facilities near the cap and may encourage operators to artificially limit design capacity or split production across multiple sites.

The regulations were originally gazetted on 30 March 2001 and came into operation on that date. The only substantive amendment shown in the compilation table is the Environmental Protection (Abattoirs) Amendment Regulations 2012, gazetted on 8 May 2012, with the operative provisions commencing on 9 May 2012.

The 2012 amendment inserted a new regulation 3, replacing the original application provision. The new regulation 3 applies the regulations to abattoirs with a production or design capacity more than 100 tonnes per year and less than 1,000 tonnes per year. The original regulation 3 is not reproduced in the compilation, but the insertion suggests the capacity range changed. It is plausible that the original range was different (e.g., 50‑500 tonnes), but we cannot confirm without the earlier text. The effect of the amendment was likely to narrow or broaden the scope. Given the purpose of the amendment was to bring more abattoirs under the regulations or to align with updated industry practice, operators who previously fell outside the range may have become subject to new duties overnight.

Regulation 17 (amendment of the Environmental Protection Regulations 1987) was present in the original 2001 regulations and has not been amended since. The penalty units in Schedule 6 have not been updated, but the value of a penalty unit may have changed over time under the parent Act.

No further amendments are recorded. The regulations are now 23 years old and have not been comprehensively reviewed. The technology for waste water treatment, dust control, and odour management has advanced substantially since 2001, but the regulations impose fixed engineering standards (e.g., 15‑day retention, 300 mm freeboard) rather than performance‑based outcomes. That regulatory inertia means operators may be forced to maintain older, more expensive systems even if newer technologies could achieve better environmental outcomes at lower cost.

The source text contains no reference to any court proceedings or litigation. There is no mention of prosecutions, judicial review cases, or appeals involving these regulations. That absence is noteworthy: it may indicate that enforcement has been rare, that the penalties are too low to attract litigation, or that prosecutions are not routinely reported in the legislative compilation. The absence of litigation does not mean the regulations are uncontroversial; it may reflect the low penalty exposure or the practical difficulties of proving visible dust or unreasonable odour.

However, we must not invent cases. The source is silent, so we state that no litigation history is contained in the compiled regulations. A practitioner should not assume no cases exist; a proper legal search would be needed. The compilation table notes that the regulations are a "compilation" but does not include case annotations.

Several provisions contain traps for unwary operators.

Absolute dust prohibition. Regulation 4(1) prohibits "any visible dust" from escaping during operations. This is not qualified by "unreasonable" or "as far as practicable". A single plume of dust from a truck movement, loading, or wind can constitute an offence. There is no de minimis exemption. The operator bears the burden of proof if prosecuted? No, the prosecution must prove the visible dust beyond reasonable doubt. But the absence of a defence of reasonable precautions makes this a strict liability offence (subject to any defence under the EP Act).

Dual penalty structure. As discussed, regulation 15 says $5,000, but regulation 17 adds a table with much higher unit‑based penalties. An operator who assumes $5,000 is the maximum could be shocked by a prosecution that seeks $25,000. The regulations do not harmonise the two penalty provisions.

24‑hour clock for dead animals. Regulation 5 requires disposal within 24 hours of the operator becoming aware. That means the operator must have a 24/7 disposal arrangement. A rendering facility that only operates business hours on weekdays will not suffice if an animal dies on a Friday evening. The operator must have a backup plan, perhaps including a waste disposal facility that accepts carcasses or a CEO‑approved alternative.

Irrigation plan pre‑approval. An operator cannot use treated waste water for irrigation until a plan is submitted and approved. The CEO has no statutory time limit to approve or reject the plan. The operator could be left waiting, unable to irrigate, with tanks filling up. There is no default approval mechanism. This gives the CEO leverage to impose costly conditions.

Existing facility grandfathering is limited. Existing facilities are exempt from regulation 8 (bleeding area floor drainage) and regulation 13(a) (impermeable containment structures) and had a twelve‑month transition for regulation 14. But if an existing facility expands or undergoes major renovation, does it lose its grandfather status? The regulations do not address this. The definition of "existing facility" turns on the status immediately before 30 March 2001, not on continued use. That could be interpreted as permanent, but a regulator might argue that substantial change reclassifies it as a new facility.

Storm water exclusion duty is absolute. Regulation 10 requires the operator to ensure uncontaminated storm water does not enter the waste water treatment system. That forces separate storm water drainage. If the system is designed as a combined system, the operator is in breach every time it rains. Retrofitting can be expensive.

Odour duty is qualified. Regulation 13(e) requires management "so as to ensure that an unreasonable odour does not escape". This is more flexible than the dust prohibition. However, "unreasonable" is undefined. Neighbour complaints may trigger enforcement, and the test is objective. The operator bears the cost of odour control technology and may still face complaints.

No transitional for 2012 amendment. The 2012 amendment changed the application threshold. Abattoirs that were previously within the old threshold but outside the new one (or vice versa) received no transitional period. If the new threshold brought new abattoirs into the regime, they were immediately subject to all duties.

Compliance requires a systematic approach covering infrastructure, operations, record‑keeping, and prior approvals.

First, confirm whether the regulations apply. The abattoir’s production or design capacity must be more than 100 tonnes per year and less than 1,000 tonnes per year. If capacity is at or below 100 tonnes, the regulations do not apply (though other EP Act provisions may). If capacity is 1,000 tonnes or more, the abattoir is outside these regulations but likely needs a works approval and licence under Part V of the EP Act. The threshold is based on capacity, not actual throughput. If the facility is designed for 900 tonnes per year but only processes 600, it is still subject.

Second, conduct a site audit against each regulation:

• Dust control (reg 4). Implement dust suppression measures such as water sprays, covered stockpiles, sealed roads, and speed limits. Monitor for visible dust. Any complaint could be evidence of an offence.
• Dead animal disposal (reg 5). Contract with a rendering facility or waste disposal facility that provides 24‑hour availability, or obtain a CEO‑approved alternative. Keep a log of animal deaths and disposal times to demonstrate compliance with the 24‑hour window.
• Drainage design (regs 6-8). Ensure lairage pens, raceways, and solid waste storage area drains connect to the waste water treatment system. Install screens, bucket traps, or save‑alls on slaughterhouse floor drains. For new facilities, the owner must construct bleeding area floors with proper drainage.
• Waste storage (reg 9). Use water‑ and vermin‑proof containers for paunch material. Construct dung and manure storage areas with impervious surfaces and bunds capable of containing leachate.
• Storm water separation (reg 10). Ensure roof gutters and yard drains for clean storm water discharge to separate drainage, not into the treatment system.
• Lairage water screening (reg 11). Install screens or treatment devices to remove solids before discharge to the treatment system.
• Solid waste disposal (reg 12). Direct solid waste to a rendering facility, compost premises, waste disposal facility, or CEO‑approved facility. Keep records of disposal receipts.
• Waste water treatment structures (reg 13). New facilities must have impermeable containment structures. Maintain at least 300 mm freeboard. For ponds, retain water for at least 15 days. Anaerobic processes must have a crust or cover. Manage the system to avoid unreasonable odour , this may require aeration, odour control covers, or regular desludging.
• Irrigation management plan (reg 14). If irrigation of treated waste water is intended or practised, submit a plan to the CEO for approval before any irrigation occurs. The plan should detail application rates, monitoring, buffer distances, and soil management. Do not irrigate until approval is obtained.

Third, understand penalty exposure. The primary risk is under Schedule 6 of the Environmental Protection Regulations 1987, which provides for penalties of up to 250 penalty units (natural person) or 500 units (body corporate) for breaches of the listed regulations. The $5,000 in regulation 15 is likely superseded for those specific offences. Ignorance of the higher penalty is not a defence.

Fourth, keep records. Maintain logs of dead animal disposals, waste disposal receipts, irrigation volumes and dates, storm water inspections, dust monitoring, and odour complaints. These records will support a defence of due diligence if an offence is alleged.

Fifth, stay updated. The regulations have not been amended since 2012. But the parent Act or the Environmental Protection Regulations 1987 may change the value of penalty units or introduce new enforcement tools such as infringement notices. Check the current version of the EP Act and the Penalty Units Act 1992 (WA) for unit value.

Finally, consider alternative compliance strategies. If the cost of upgrading infrastructure (e.g., impermeable containment structures, separate storm water drainage) is prohibitive, consider whether the facility can operate under a Part V licence instead. For abattoirs near the 1,000‑tonne cap, it may be more efficient to design for the licensing regime from the outset rather than comply with these prescriptive regulations and then switch.
