#### 162 Application of Part 162 Application of Part > > (1) The provisions of this Part are provisions in force for the purposes of the Act, section 4.67(1). > > > > Note— > > > > The Act, section 4.67(2) provides that the provisions in force for the purposes of the Act, section 4.67(1) are taken to be incorporated in every environmental planning instrument. > > > (2) In this Part— > > > > relevant day means— > > > > > (a) in relation to an existing use referred to in the Act, section 4.65(a)—the day on which an environmental planning instrument having the effect of prohibiting the existing use first comes into force, or > > > > > (b) in relation to an existing use referred to in the Act, section 4.65(b)—the day on which the building, work or land being used for the existing use was first erected, carried out or used.
