#### 52 Circumstances in which occupation certificate not required 52 Circumstances in which occupation certificate not required > > (1) For the purposes of the Act, section 6.9(2)(a)(iii) and (b)(ii), the following circumstances are prescribed— > > > > > (a) the building is a temporary structure, other than a temporary structure that is an entertainment venue, > > > > > (b) the building is a structure resulting from building work to which section 62 applies. > > > (2) A person who is prescribed to be the Crown for the purposes of the Act, Division 4.6 is also prescribed for the purposes of the Act, section 6.9(2)(a)(iv) and (b)(iii), in relation to Crown building work involving the erection of a new building.
