#### 44 Fulfilment of BASIX commitments 44 Fulfilment of BASIX commitments > > (1) This section applies to an occupation certificate if a relevant BASIX certificate requires a certifier to monitor fulfilment of a commitment listed in the certificate in relation to a building. > > > (2) The certifier must not issue an occupation certificate for the building unless the commitment has been fulfilled. > > > > Maximum penalty (subsection (2))— > > > > > (a) for a corporation—300 penalty units, or > > > > > (b) for an individual—150 penalty units. > > > (3) In determining whether a commitment has been fulfilled, the certifier may rely on the advice of a properly qualified person.
