sec.25AA Planning chief executive may nominate person to perform functions
This section applies if, in relation to an application for a development approval under the Planning Act — the planning chief executive is the assessment manager or a referral agency for the application; and the planning chief executive has not nominated a person as an enforcement authority for the assessable development the subject of the application under that Act. The planning chief executive may, by written notice given to a person, nominate the person to perform the planning chief executive’s functions as an administering agency under this part for the development approval. s 25AA ins 2019 No. 8 s 42 (sec.25AA-ssec.1) This section applies if, in relation to an application for a development approval under the Planning Act — the planning chief executive is the assessment manager or a referral agency for the application; and the planning chief executive has not nominated a person as an enforcement authority for the assessable development the subject of the application under that Act. (sec.25AA-ssec.2) The planning chief executive may, by written notice given to a person, nominate the person to perform the planning chief executive’s functions as an administering agency under this part for the development approval.
- (a) the planning chief executive is the assessment manager or a referral agency for the application; and
- (b) the planning chief executive has not nominated a person as an enforcement authority for the assessable development the subject of the application under that Act.
