What it does
This Act creates a statutory route to the Supreme Court of the Northern Territory for enforcement of environmental requirements that apply to uranium mining operations in the Alligator Rivers Region. It does three mechanical things.
First, it confers jurisdiction on the Northern Territory Supreme Court, at the suit of three specified public bodies, to make orders enforcing any "requirement of or having effect under a prescribed instrument" insofar as that requirement "relates to any matter affecting the environment" in the Alligator Rivers Region (s 4(1)). The three potential plaintiffs are the Director (as defined in the Environment Protection and Biodiversity Conservation Act 1999), the Conservation Commission of the Northern Territory (the Commission), and a Land Council established under the Aboriginal Land Rights (Northern Territory) Act 1976 (s 3, s 4(1)).
Second, the Act defines the scope of what may be enforced. "Prescribed instrument" is a broad cross‑reference to laws and subordinate instruments of either the Commonwealth or the Northern Territory, and expressly includes permits, licences and leases, an authority under s 41 of the Atomic Energy Act 1953, and agreements under Part IV of the Aboriginal Land Rights (Northern Territory) Act 1976 (s 3). "Uranium mining operations" is defined expansively to include prospecting, exploration, milling, refining, handling, transportation, storage, disposal and ancillary constructions such as towns, camps, dams, pipelines and power lines used for those operations (s 3). "Environment" is given a wide formulation that explicitly includes ecosystems, human communities, natural and physical resources, qualities of places and social, economic and cultural aspects (s 3).
Third, the Act sets out the remedial toolbox the Court may use in exercising that jurisdiction. The Court may grant injunctions (including mandatory injunctions), require remedial work, authorise third parties to carry out remedial work and require the principal party to pay or reimburse costs, make interim orders, include provisions necessary to effect the order, make orders notwithstanding other civil or criminal remedies, and suspend, vary or revoke orders (s 5).
