58 Manufacturers and distributors must not represent prohibited plastic bags are not prohibited plastic bags A person commits an offence if the person: (a) is a manufacturer or distributor of plastic bags; and Environment Protection (Beverage Containers and Plastic Bags) Act 2011 38 (b) sells, supplies or otherwise provides prohibited plastic bags to another person; and (c) before, or in the course of, selling, supplying or providing the bags, represents to the other person that the bags are not prohibited plastic bags. (a) intentionally sells, supplies or provides the bags; and (b) intentionally represents the bags are not prohibited plastic bags; and (c) is reckless as to whether the bags are prohibited plastic bags.
