41L Suspension or cancellation of registration (1) If the CEO believes a ground exists to suspend or cancel a CDS supplier's registration, sections 38 to 41 apply in relation to the registration as if a reference to: (a) a CDS approval were a reference to the registration; and (b) the holder of the approval were a reference to the supplier. Registration may also be suspended or cancelled under section 44. (2) Despite subsection (1), the CEO may cancel a CDS supplier's registration on the ground mentioned in section 41K(f) without first giving the supplier a show cause notice. (3) If the CEO cancels a CDS supplier's registration under subsection (2), the following apply: (a) the CEO must give the supplier written notice of the cancellation; Environment Protection (Beverage Containers and Plastic Bags) Act 2011 31 (b) the CEO is not required to give the supplier a review notice for the decision to cancel the registration; (c) the cancellation takes effect on the day the notice mentioned in paragraph (a) is given to the supplier.
